The implementation of Decree No. 41/CP dated 6 July 1995 from the Government detailing and guiding the implementation of some articles of the labor code of labor discipline and responsibility for long-range missions the material has been modified in addition to Decree No. 33/2003/ND-CP dated April 2, 2003 of the Government (hereafter referred to collectively as Decree No. 41/CP) , after the opinion of the Vietnam General Confederation of labor and the ministries concerned, the Ministry of labor, invalids and Social Affairs passed as follows: i. the OBJECT and SCOPE of the object and scope of application as defined in article 1 of Decree No. 41/CP are the employers and employees working under labor contract mode in the enterprise, agency, organisation of the following: 1. establishment of the enterprise, operating under the State enterprise law, business law, law on foreign investment in Vietnam;

2. The business of political organization, social-political organizations;

3. The administrative agency, employing business are not public officials, State officials;

4. economic institutions in the people's army, the people's public security the employer not the officers, non-commissioned officers, soldiers;

5. Cooperative established and operated under the law on cooperative use of labour;

6. The basis of education, health, culture, sports, non established under Decree No. 73/1999/ND-CP dated 19 August 1999 from the Government on the policy to encourage socialization with respect to activities in the areas of education, health, culture and sports;

7. Agencies, organizations, foreign or international personal plays on the territory of Vietnam have the employers was the Vietnam unless the international treaties to which the Socialist Republic of Vietnam signed or otherwise;

8. enterprises, agencies, organizations and individuals, Vietnam using foreign workers unless the international treaties to which the Socialist Republic of Vietnam signed or otherwise.

Businesses, agencies, organizations or individuals mentioned on here are referred to as unit.

 

II. CONSTRUCTION PROCESS and REGISTRATION of LABOR REGULATIONS of the construction unit, registered labor regulations as specified in article 4, article 5 of Decree No. 41/CP is done according to the following sequence: 1. The base characteristics of production-business unit, construction labor regulations in accordance with the labor law and other related laws and express the full content is primarily the provisions of article 4 of Decree No. 41/CP;

III. FORM PROCESSING In VIOLATION Of LABOR DISCIPLINE 1. IV. PROCESSING Of VIOLATION Of LABOR DISCIPLINE 1.
