CIRCULAR guide management, use the certificate export of specimens in the Memorial annex Convention on international trade in the animals, endangered wild plants _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ pursuant to Decree No. 86/2003/ND-CP on 18/7/2003 of government functions, tasks, powers and organizational structure of the Ministry of agriculture and rural development;
Pursuant to Decree No. 82/2006/ND-CP on 10/8/2006 on the management of Government's export activities, import, re-export, enter from the sea, transit, breeding, rearing and artificial cultivation of animals, endangered wild plants, precious, rare;
The Ministry of agriculture and rural development guides implementation of the management and use of certificates for export of specimens in souvenirs Appendix Convention on international trade in the animals, endangered wild plants (hereinafter abbreviated as CITES certificates).
Section I: GENERAL PROVISIONS 1. Scope of this circular, management guidance use the CITES certificate stipulated in Decree No. 82/2006/ND-CP on 10/8/2006 on the management of Government's export activities, import, re-export, enter from the sea, transit, breeding, rearing and artificial cultivation of animals endangered wildlife, plants, precious, rare.
2. Objects of State bodies, institutions, households and individuals in the country; Vietnam who settled in foreign countries, organizations, foreign individuals have activities related to exports out of the territory of the Socialist Republic of Vietnam Memorial specimens are manipulated from the species of wild plants, the provisions in the Appendix of the Convention on international trade in the animals , endangered wild plants (hereinafter abbreviated as CITES).
Section II: printing, publishing, management, USE the CITES CERTIFICATE 1. Print, released a CITES certificate) CITES certificate by the governing body of the Convention on international trade in endangered species of wild flora endangered, Vietnam printing and issuing general unity in the country. FPD, provinces and cities under central management, reception, allocated to organizations and individuals are eligible to use the provisions of article 2, item.
b) Certificate Template CITES certificate-size: length 21 cm, width 16 cm.-CITES certificate is printed in English and Vietnamese on carbon paper, contact Customer Affairs root are white, the yellow store.
-CITES certificate has the serial number in the top right corner by the governing body of the Convention on international trade in endangered species of wild flora endangered, Vietnam.
-Form CITES certificate according to the appendix to this circular.
2. organizations and individuals are granted and the use of certificate CITES a) breeding Farm, farm growth, artificial cultivation base animals, wild plants are State bodies have issued the certificate of registration of farm, farming establishments as defined in article 21 of Decree 82/2006/ND-CP b) business model mementos are State agencies licensing authority of business registration; have the contract products or the supply of raw materials from animals, wild plants with the farming, artificial cultivation base animals, wild plants according to the current rules of the State.
3. Management and use of certificates CITES a) governing body of the Convention on international trade in endangered species of wild flora endangered, Vietnam is responsible for:-printing, consider issuing CITES certificates according to the suggestion of FPD provinces and cities under central;
-Check the CITES certificate management for FPD, provinces and cities under central; the Organization, individuals are issued and used.
b) FPD the province, central cities are responsible for:-register CITES certificate needs of individual organizations on the management with CITES management authorities in Vietnam in December of every year; established as the number, serial number CITES certificate is received; ensure timely CITES certification, meet the demand for organizations and individuals, specified in point 2, the entry; pay the cost of printing, CITES certificates issued with the authority to manage the Convention on international trade in endangered species of wild flora endangered, Vietnam;
-Management, check and guide the use of CITES certificates of organizations and individuals, in accordance with the provisions of the law;
-Periodic reports annually to the governing body of the Convention on international trade in endangered species of wild flora endangered, Vietnam on the State management, use and on the CITES certification in January next year;
-Responsibility before the law about the management, allocate on CITES certificates.
c) Organization, the individual is granted and the use of CITES certificate are responsible to:-register with FPD in on demand using the CITES certificate in the next plan year, in December and the payment of the cost of buying the CITES certificates with FPD;
-Registration sample code, icons, labeling of specimens is souvenirs produced; established as the number, serial number CITES certificate is granted and the payment of the cost of buying the CITES certificates with FPD;
-Periodic reports 6 months about the use of CITES certificate at the latest on the 15th of July each year; annual report at the latest on January 15 every year for FPD. Content of the report to reflect specifically on the number of CITES certificate is granted, the number of the certificate was used, the number and value of specimens has been CITES certificate;
-Write the full content of the CITES certificate to the client in accordance with the provisions of this circular and responsible before the law and the governing body of the Convention on international trade in endangered species of wild flora endangered, Vietnam about using and CITES certificate.
4. Use a CITES certificate) CITES certificate is delivered for the Vietnam settled abroad and foreigners (hereinafter the appeal) have active export of specimens of species of wild fauna specified in the appendices of CITES and eligible for export under the Decree No. 82/2006/ND-CP use;
b) CITES certificate is only used in the case of export of specimens complete souvenirs; not to be used for the sample is animal, plant life;
c) a client certificate CITES only a maximum of 4 (four) specimens of each kind;
d) broken certificate can not be used, then the slash and full. The certificate is lost or when it detects a fake certificate papers, organizations, individuals must report immediately to the police and the FPD.
5. Write the certificate-Written clearly, not erased, only written a blue or black ink, not abbreviated. The original link to the customer, white kept a yellow color. CITES certificates at the content delivered to the customer and the store must be the same.
-Code Camp: specify the code camp is the competent State bodies.
-The name and address of the Distributor Base: stating the name and address details of organization, the distribution of individual specimens.
-The number of the certificate: by the Organization, individuals using the CITES certificate in consecutive natural numbers from number 1.
-Customer name: specify the full name of the client.
-Citizenship: specify the nationality of the customer.
-Passport number: full record both the letter and the passport number.
-Scientific name Column: write the full name of the sample.
-Sample description Column: specify the type of the sample (bags, wallets, belts, etc.).

-Column source and Annex: specify the specimen in the annex of the Convention on international trade of endangered species, the endangered wild plants, the provisions of decision No 54/2006/QD-BNN on 05 July 2006 of the Minister of agriculture on the publication of the list of animal species wild plants, the provisions in the Appendix of the Convention on international trade of endangered species, the endangered wild plants.
-The column number: specify the number and the unit (what, ...).
-Signature and name of the camp: sign and specify the full name of the level.
-Date: indicate the date CITES certificate.
Section III: IMPLEMENTATION of this circular have the effect after 15 days from the date The report.
Ministries, ministerial agencies, government agencies, people's committees of provinces and cities under central, Director of the Department of agriculture and rural development, the Director of the FPD, the heads of the agencies of the Ministry of agriculture and rural development is responsible for implementation of this circular.
