CIRCULAR active rules on bank card _ _ _ _ _ _ _ _ _ _ _ _ _ _ pursuant to the law the State Bank of Vietnam the number 46/2010/QH12 16 June 2010;
Pursuant to the law on credit institutions the number 47/2010/QH12 16 June 2010;
Pursuant to Decree No. 101/2012/ND-CP on 22/11/2012 of the Government on non-cash payments;
Pursuant to Decree No. 154/2013/ND-CP on 11/11/2013 of government functions, tasks, powers and structure of the State Bank of Vietnam;
At the suggestion of Director payments;
The Governor of the State Bank of Vietnam issued a circular regulating the bank card operations.
 
Chapter I GENERAL PROVISIONS article 1. Scope this circular regulates bank card operations (hereinafter referred to as card) include: the operation, use, release, payment switches, electronic clearing and settlement of transactions.
Article 2. Application object 1. The card issuer.
2. payment card organization.
3. switching the card organization.
4. the celebrated electronic card transaction clearing.
5. The unit accepts the card.
6. The card holder.
7. Organizations and individuals related to the activity card.
Article 3. Explanation of terms In this circular, the terms below are interpreted as follows: 1. Bank cards as means of payment by the issuers of the card issued to perform card transactions according to the terms and conditions to be agreed by the parties.
Cards in this circular does not include the cards due to the supply organization, the service released only for use in the payment of goods and services of the organization.
2. Debit Card (debit card) is the card allows cardholders make transactions within the card and overdraft limit amount (if any) on the payment account of the cardholder opened at card issuing organization.
3. Credit Card (credit card) cards allow cardholders make transactions within card credit limit granted as agreed with the issuers of the card.
4. Prepaid Card (prepaid card) cards allow cardholders make transactions within the card money value loaded on the card corresponding to the amount paid in advance for the issuers of the card.
Prepaid cards include: prepaid cards (have the cardholder identification information) and anonymous prepaid card (without the cardholder identification information).

19. the international card organisation (abbreviated as TCTQT) is the organization established in foreign countries according to the provisions of the law of foreign countries, there is agreement with the TCPHT, TCTTT and other stakeholders to cooperate and release of payment card issuer by card code TCTQT level in accordance with the provisions of the law of Vietnam and international commitments.
20. automatic transaction Machine (Automated Teller Machine-ATM abbreviation) is the device that the server can use to perform transactions such as: send, insert, withdraw cash, transfer, bill payment of goods, services, information, change the BATTERIES, consult the information card or other transactions.
21. The device accepted the card at point of sale including Point of Sale (POS), Mobile Point of Sale (mPOS) and the other card acceptance device type is the type of card reader devices, terminals are installed and used in the ĐVCNT for which the cardholder may use the card to pay for goods , room service. Article 4. The currency used in the transaction the card 1. On the territory of Vietnam: a) cash transaction by the card must be made in Vietnam;
b) for the other card transactions: (i) the trading currency is Dong Vietnam. Cases are used to trading foreign exchange according to the legal provisions on the management of the foreign exchange trading in currencies is Vietnam or the Vietnam Dong and foreign currencies;
(ii) the currency of payment is Vietnam. The ĐVCNT just get paid in Vietnam from TCTTT;

2. In addition to the territory of Vietnam: When the card transaction outside of Vietnam, the cardholder must make payment for the TCPHT in Vietnam according to the exchange rate by the parties to the agreement consistent with the provisions of the State Bank.
 
Article 5. Charge card services

         1. TCPHT Only be charge cardholders. The card services fee schedule of the TCPHT must conform with the provisions of the law, to be listed and must provide the card holder before use and when there is a change. The form of notice and provide information about fees for the card holder must be specified in the contract and use of the card. Article 8. The prohibited acts 1. Make, use, transfer and circulation of fake cards.

3. ĐVCNT currency surcharges or price discrimination when the cardholder payment of goods and services by the card.
4. Theft, collusion to steal card information; disclosure and provision of information card, the cardholder and the card transaction not correct provisions of the law.
5. Intrusion or attempted unauthorized intrusions, destroying the program or the database system's release, payment cards, switch cards, electronic card transaction clearing.
6. Use the card to make the transaction for the purpose of money laundering, terrorist financing, fraud, fraud and violations of other laws.
 
Chapter II article 9 CARD. Issuers of the card 1. Commercial banks, cooperative bank, foreign bank branch, released the card when the card services supply operations are recorded in the license or additional licenses, amendments (if any) by the State Bank.

Article 10. Card issuing procedure 1. TCPHT to the internal regulations of the applicable card in your system. After the release of physical, non-card TCPHT to build a document describing the process for open/stop using the card, the card transaction process, risk management process (including the steps: identification, measurement, control and handling of risks), the scope of use of the card and the control measures of the use of the card in the right range.
2. Before issuing a new card or change the template tag was released, TCPHT must register with the State Bank of card templates. Records and registration card template made according to the provisions of article 11 of this circular. After the Bank confirmed the registration template tag, TCPHT released the registered card types.
3. When issuing debit cards, TCPHT the main cardholder to request to have your payment account open at TCPHT.
4. The agreement on the issuance and use of tags must be established as a contract issue and use of cards match the provisions of this circular and the other provisions of the relevant laws. The content of the contract as defined in article 13 of this circular.
5. Before signing the release and use of the card to the customer, the card holder requests TCPHT provide complete information, the necessary paperwork in order to get to know the client as specified by law.
6. TCPHT in Vietnam must use BIN due to State Bank level, except in the case prescribed in clause 7 of this.
7. TCPHT in Vietnam have agreed to release the card carries the brand of TCTQT used by TCTQT BIN level.
8. TCPHT not be agreement with the other institutions aimed at restricting or preventing the release of the cards.
9. When the stop release more cards were released, TCPHT must inform in writing to state banks to track, manage.
Article 11. Records, registration card template 1. Set TCPHT 1 set of sample registration card records submitted directly or sent by post to the State Bank include: a) template tag registration certificate according to the appendix attached to this circular;
b) template tag in kind (for the physical card) or template tag expected when printed out (for the non-physical cards);
c) copies the text deals with the TCTQT card in the case released the card BIN due to TCTQT;
d) text copies of the agreement signed with the Organization of card switching, electronic clearing organization of card transactions, collaborative or link release card (if available).

Article 12. The information on the card 1. The information on the card must include the following elements: a) TCPHT Name (short name or commercial TCPHT's logo) on the front of the card;

c) names or trade marks of the card (if available);
d Card Number);
DD) validity period (or the time of start of effect) of the card;

Article 13. Contract release and use the cards 1. Contract release and use the card must include the following minimum content: a) contract number;
b) time (day, month, year) set up the contract;
c the cardholder name, TCPHT); the personal name card holder authorized to use the card for the Organization the Organization's card;
d) The content of the rights and obligations of the parties;

e) the provision of information TCPHT for the card holder on the account balance, transaction history and other necessary information;

g) limits and change limits use of the card, including the overdraft limit (for debit card) and the credit limit, the time limit for granting credit, repayment period, the level of minimum repayments, interest rate, repayment method (for credit card and debit card overdraft is). Agreement on the provision of credit to the cardholder may be stated in the contract and use of the card or in a separate agreement in writing;

I) The case of refused payment card;
k) The case of a temporary lock, capturing cards or cancel the effect of the card during use;
l) cases of refund amount on a card not yet used up;
m) implementing measures to ensure the security, privacy in the use of the card and the card loss case or disclose your card information;
n) investigation, complaint handling, dispute in the process of using the card.
2. for anonymous prepaid card, TCPHT to have the regulations and the terms of the release and use of anonymous prepaid card and must publicly for the customer. TCPHT must have a written agreement with the Party proposed the release of anonymous prepaid card, which consist of: minimum content of information suggested party issued the card, the card number, the card limit, the more load money on the card, using the card range, duration of effect (or the time of start of effect) of the card.
Article 14. Card limit 1. TCPHT agreement with the cardholder regarding payment limits, transfer limit, limits cash (including cash withdrawal limit in foreign countries) and the other limits in the use of the card to the cardholder in accordance with the law on Foreign Exchange Management and the other provisions of the law.
2. for anonymous prepaid card, TCPHT specifies the limits and balance recharge limit on the card, make sure the balance on an anonymous prepaid card at all times not too 05 (five) million Vietnam.
Article 15. Credit card level 1. The granting of credit through credit cards must ensure the following requirements: a) made under the contract to release and use of the card and the text of the agreement on the granting of credit between the card holder with TCPHT (if available);
b) TCPHT must have internal rules on granting a credit card credit line with legal provisions regarding safety in the operation of the credit level, including specific provisions on the subject, limits, conditions, duration of credit granted, the duration of repayment, interest rate applied, process evaluation and the decision to grant credit cards according to the principle of a clear delineation of responsibilities the Middle stitch evaluation and the decision to grant credit;
c) TCPHT review and decide the level of credit through credit cards for the card holder meets the following conditions: (i) the cardholder subject to the provisions of art. 1 and item 2 article 16 of this circular and not subject to credit are not specified in article 126 of the credit institutions Act and the instructions of the Bank;
(ii) the card holder using the correct loan purpose and have the ability to guarantee financial debt;
d) TCPHT review and ask the cardholder to apply measures to ensure implementation of the repayment obligation in accordance with the law.
2. Lending under the overdraft limit for debit card TCPHT must comply with the applicable provisions of the law and of State Bank loans.
3. The granting of credit through credit cards, loans under the overdraft limit for debit card TCPHT must comply with regulations on limiting the granted credit, limited credit supply in article 127, article 128 of the credit institutions Act and the instructions of the State Bank.
 
Chapter III article 16 CARD. The object was to use the cards 1. For the main cardholder is personal: a) People from 18 and older have the capacity for civil acts in full under the provisions of the law are using debit cards, credit cards, prepaid cards;
b) People from enough 15 years to eighteen years are not lost or limited capacity for civil acts, there are private assets to ensure service in the use of the card is to use the debit card overdraft not, prepaid cards.
2. With regard to the primary cardholder's organization: the Organization was established, legitimate activities according to the provisions of the law of Vietnam, including: legal, private companies are using the cards. The card holder is held is authorized in writing to the individual using the card of the organization or allow individuals to use the extra card as prescribed in this circular.
3. for extra card holder: card holder accessories are used by specific cards of main card holder, but only to the extent specified below: a) People from 18 and older have the capacity for civil acts in full under the provisions of the law are using debit cards, credit cards , prepaid cards;
b) People from enough 15 years to eighteen years are not lost or limited capacity for civil acts are represented according to the laws of that person agree in writing on the use of the card is using debit cards, credit cards, prepaid cards;
c) Who from the age of 6 to 15 year old enough yet not lost or limited capacity for civil acts are represented according to the laws of that person agree in writing on the use of the card is to use the debit card overdraft not, prepaid cards.
Article 17. The principle of using the card 1. The card holder must provide accurate, complete the necessary information required by TCPHT when signing the release and use of the card and is responsible for the truthfulness of the information provided.
2. When using a credit card, debit card, the card holder overdraft are to use the money for your purposes and payment in full, in time for the TCPHT the funds borrowed and interest arising from the use of the card under a contract signed with TCPHT.
3. scope of use of the card: a) debit cards, prepaid card identifiers are used to perform card transactions under the agreement between the card holder with TCPHT;
b) credit cards used to pay for goods and services; loaded, cash under an agreement between the card holder with TCPHT;
c) anonymous prepaid card can be used only to pay for goods and services and not the cash;
d) extra Card issued to the cardholder under the age of 15 are not cash and can only be used to pay for your purposes determined by agreement in writing between the TCPHT and the main cardholder.
Article 18. Ensure safety in the use of the card 1. TCPHT: a) responsible in the management of risk when issuing the cards have to register with the State Bank;
b) dissemination, guidance for customers on the service card, using the card manipulation process, the risks may be encountered when using the card and how to handle the incident;
c) implement measures to ensure safety, the prevention of risks for the card transactions according to the principles of risk management in electronic banking activities; information security related to card operations; ensure the system infrastructure, technical service operations management, payment card operated smoothly and safely;
d) set, maintaining constant hot line 24/7 to receive promptly the information reflected by the card holder;
DD) in collaboration with the TCTTT, organize, tag switching, electronic clearing organization of card transactions made the necessary measures to ensure safety in the card operations; implement risk management for other stakeholders according to the principles of risk management in electronic banking activities;

e) provided the information the card contains signs of cheating, forgery for investigating authorities about the crime of card; checking, reviewing or coordinating with relevant authorities updated the list of cards need to deny payment or fake signs for TCTTT and ĐVCNT; in collaboration with the relevant authorities and stakeholders in the prevention of offences related to the activity card and inquiry, handled when criminal detection using tags as specified by law;
g) consider, examine, close monitoring to make sure the payment, transfer money by card abroad for your purposes, use the card limit and in accordance with the provisions of the law on Foreign Exchange Management.
2. The cardholder and the cardholder's personal organization authorized to use the card of the organization is to preserve the security of the card, PIN, the cardholder verification code, card information, transaction information, not to reveal the information cards; inform and collaborate with TCPHT to process in the event of the loss of cards or require investigation, complaints.
3. TCTTT must coordinate with the TCPHT, organize, tag switching, organizing electronic card transaction clearing, ĐVCNT, the relevant authorities and other stakeholders in the prevention of offences related to the activity card.
4. ĐVCNT must implement in full the measures, technical processes and cardholder information security, fraud detection, forged in the payment card is TCTTT instructions and must take responsibility for the damage if not done right ĐVCNT the provisions of TCTTT.
5. When participating in agreements with other institutions about issuing, payment card, TCPHT, TCTTT are the agreement on the parties involved are responsible for compliance with the provisions of the law on the protection of personal data, personal privacy, document security, information cards, card transactions and cardholder's account.
Article 19. Handle in case of losing the card or the card information 1. The loss of the card or the information card, the cardholder must immediately notify TCPHT.
2. Upon receipt of the notification of the card holder, TCPHT are made right the lock and in coordination with the parties concerned to implement measures for other necessary services in order to prevent the damage that can occur, and report back to the card holder. Deadline TCPHT completion of the processing of the notice received from the cardholder not exceeding 5 working days for the card to be issued by the State Bank BIN or 10 working days for the card by TCTQT BIN level since the date of the notification of the card holder.

Article 20. Investigation, handling of complaints in the process of using the card 1. When there are errors or erroneous suspicions about trading cards, the card holder has the right to request the investigation TCPHT.
2. TCPHT specifying the deadline the cardholder must submit a request for investigation for TCPHT not be less than 60 days from the date the request transaction incurred investigation.
3. TCPHT has the responsibility to resolve the investigation request of the card holder and card holder for the reply within the time limit agreed by the parties concerned, in accordance with the provisions of the law. The case related to the TCTTT, the TCPHT must immediately notify TCTTT and TCTTT, in coordination with the relevant parties to resolve. TCTTT is responsible for answering the request investigation of the card holder within a maximum of 5 working days for ATM transactions in Vietnam of the card due to TCPHT in Vietnam released and 10 working days for transactions via POS/mPOS in the tag's Vietnam by TCTTT release; or by agreement between the parties with respect to the remaining transactions from the date the request was received from TCPHT.

Chapter IV PAYMENT CARD TRANSACTION SETTLEMENT, article 21. Card payment organizations 1. Commercial banks, cooperative banks, foreign bank branches are active when the card payment service provision card to be recorded in the licence or additional licenses, amendments (if any) by the State Bank.

Article 22. Payment cards organization 1. b) where TCTTT is not TCPHT, then the processing of the transactions made on the basis of the agreement between the Organization and the TCTTT card TCPHT, TCTQT, switch and other stakeholders on the process and procedure of payment card.
3. The responsibility of the TCTTT for ĐVCNT: a) construction, conduct negotiations and signing of the contract payment card with ĐVCNT;
b) organized the equipment installation at the point of sale card acceptance, set the line connections and other technical conditions of service for payment card;
c) instructions ĐVCNT using the device to accept a card at the point of sale, payment card procedures, measures to detect fraud, forgery and require the cardholder information security in payment card;
d) to receive and handle the investigation request, complaint of ĐVCNT;
DD) monitoring of ĐVCNT in implementing the content of the contract payment card signed and the maintenance of conditions of payment cards; cases detected ĐVCNT currency surcharge of the card holder, the TCTTT must implement measures to handle and reflection for the competent State bodies.
4. TCTTT is the theme name (short name or logo) of the organization that is the TCTTT tag switching on ATM of TCTTT and on the ĐVCNT of TCTTT at POS.

Article 23. The unit accepts the card 1. ĐVCNT must return or through TCTTT to refund to the cardholder amount the price difference, the surcharge has currency rules.
2. ĐVCNT must comply with the contract signed with TCTTT.
3. ĐVCNT has the right to request the TCTTT investigation, complaints against the erroneous transaction or suspected errors and claim under the provisions of the law.
Article 24. Held the tag switching, electronic card transaction clearing 1. The switches, electronic card transaction clearing between TCPHT, TCTTT for card transactions has BIN State Bank level made through organized card switches, electronic clearing organization of card transactions be licensed State Bank.

3. The electronic clearing of transactions the card BIN due to TCTQT provided under the agreement between the TCPHT, the TCTTT and the parties concerned.
4. switching the card organization, organized electronic card transaction clearing agreement with the participating member organizations about standards, business processes, rules and other regulations on activity card switches, electronic card transaction clearing in accordance with the law.
5. hold the card switches, electronic clearing organization of card transactions made a connection direct systems with TCPHT, TCTTT and TCTQT under the agreement between the parties, to ensure the safe supply of continuous switching services, and other services for its member organizations and TCTQT join the connection.
Article 25. The international card organization 1. TCTQT signed an agreement with the Organization of card switching State Bank licensed to perform prescribed in clause 2 article 24 of this circular.
2. TCTQT not given the restrictions for the TCPHT, TCTTT purpose: a) unfair treatment on the brand is printed on cards of affiliated organizations, collaboration released the card;
b) restrict the right to choice of card switching the ĐVCNT through the regulations on fees or other obligations.
Article 26. The resulting settlement clearing The card transaction settlement of financial obligations arising from the clearing of transactions between the card TCPHT, TCTTT must be done in an organization are permitted by the State Bank.
Article 27. Refuses to pay the card 1. TCPHT, TCTTT, ĐVCNT have to deny the payment card in the following cases: a) using the card to make card transactions prohibited under the provisions of article 8 of this circular;
b) cards were reported lost card holder;
c) expired Card use;
d) the card is locked.
2. TCPHT, TCTTT, ĐVCNT are denied payment card under the agreement in the following cases: a) to the payment account balance, credit line or overdraft limit remains (if any) is not enough to pay payments;
b) cardholders to violate the provisions of the TCPHT in the agreement between the card holder with TCPHT according to which the card declined payment.
3. TCPHT is responsible for notification by text message or data about the cases specified in paragraph 1, paragraph 2 this TCTTT; TCTTT responsibility report for ĐVCNT.
4. The notification of the card being refused payment in effect since the time of the parties related to the payment card transactions receive notice in writing or by message data. After the parties have received notice that the card payment and still to happen the cases taken advantage card then the determination of responsibility by the parties to the agreement.
 
Chapter V reports, PROVIDE INFORMATION and HANDLE breach of article 28. The report 1. TCPHT, TCTTT, switch, card organizations organize electronic card transaction clearing make periodic reports under the reporting statistics and regulation of the State Bank.
2. When internal procedures regarding the issuance, payment card, TCPHT, TCTTT must send the State Bank for tracking and monitoring.
3. A minimum of 15 days before applying the card services fee schedule (issued new or adjusted, supplements), TCPHT must send the card services fee schedule of his organization for the State Bank to track and monitor.
4. TCPHT, TCTTT, switch, card organizations organize electronic card transaction clearing is responsible for reporting the State Bank in the following cases: a) according to the specific requirements of the State Bank to serve state management objectives;
b) When there are unusual happenings that arise in operating the card can do to affect the situation of operation of TCPHT, TCTTT.
Article 29. Provision of information 1. TCPHT, TCTTT, ĐVCNT, switch, card organizations organize electronic card transaction clearing, TCTQT is responsible for the security of information card, the card holder, the card transaction and only provide information as requested by the cardholder, of competent State agencies or as specified by law.
2. TCPHT, TCTTT agreements with each other regarding the sharing of information related to the activity card as specified by law.
3. TCTQT is responsible for providing the information regarding the transaction card has BIN so TCTQT upon request of the State Bank to perform state management functionality.
Article 30. Handle violation of individual organization violates the provisions of this circular, then depending on the nature and extent of the violation will be dealt administrative violations, serious cases being prejudice criminal responsibility, if the damage to compensation under the provisions of the law.
 
Chapter VI article 31 ENFORCEMENT TERMS. The responsibilities of the units belonging to State Bank 1. Service payment a) track, general implementation and advised the Governor of the State Bank to handle the obstacles in the process of implementing this circular;
b) handles registration card form; receive and track the stop notice release more cards issued by the TCPHT.
2. Inspection bodies, the banking supervision; State Bank branch in the central cities, made the inspection, testing, monitoring compliance with the provisions of this circular, dealing with cases of violation under the jurisdiction and announcing results for the Service payment, the relevant units.
Article 32. Effect 1. This circular has effect from the date of 15/8/2016, unless otherwise stipulated in paragraph 2 of this Article.
2. Item 2 article 24 this circular effect since 01/01/2013.
3. From the date of this circular effect, the following provisions most effective: a) decision No. 20/2007/QD-NHNN dated Jan. 15/5/2007 of the Governor of the State Bank issued the regulation issue, payment, use and provide services in support of bank card operations;
b) decision No. 32/2007/QD-NHNN dated Jan. 9/7/2007 of the Governor of the State Bank of balance limit for anonymous prepaid card;
c) article 3 Circular No. 23/2011/TT-NHNN dated Jan. 31/8/2011 of the Governor of the State Bank on the enforcement options to simplify administrative procedures and payment activity sectors other sectors according to the Government's resolution on the simplification of administrative procedures in the scope of the management functions of the State Bank of Vietnam.
Article 33. Organizing Office, Director of the payment, the heads of the relevant units in the State Bank of Vietnam, the Director of State Bank branch in the province, central cities, Chairman of the Board, the President of the Council members, the Director-General (Executive Director) credit institutions , foreign bank branch, organization, organize, tag switching electronic card transaction clearing, organizations and other individuals concerned is responsible for implementation of this circular.
