The PRIME MINISTER'S DECISION on the establishment of the Government negotiator on the economics-international trade PRIME Base article 20 Government Organization Law on September 30, 1992;
Pursuant to decision No. 31/1998/QD-TTg dated October 2, 1998 of the Prime Minister on the establishment of the National Committee of international economic cooperation;
According to the proposal of the Chairman of the National Committee of the international and economic cooperation Minister, head of the Organization-Government officials, decision: article 1. Establishment of government negotiations on international trade-economic (Government negotiator) to prepare and make the negotiations of Vietnam joining and operating in a World Trade Organization (WTO); conducted the negotiations with the U.S. Government about trade agreements.
Article 2. Government negotiator whose mission: 1. To do General clue, drafted the strategies and methods of negotiations WTO and Vietnam trade agreement negotiations-the United States, the National Committee of the international economic cooperation look for comments to the report by the Prime Minister for approval before proceeding with formal talks and to serve as a basis for the construction scheme of negotiations of the ministries.
2. Make the negotiations at various levels, different ranges within the framework of the WTO and organization of negotiations of a trade agreement with the United States, on the basis of ensuring compliance with the strategy and methodology of negotiations has been the Prime Minister for approval.
3. In coordination with the ministries concerned to coordinate the specialized activities to meet the requirements of the work, as well as talks to implement the results of negotiations after the prime consideration, decision.
4. Perform other duties as assigned by the Prime Minister.
Article 3.
1. composition of Government delegation include: head of the delegation, Deputy Head of the delegation and some of the members.
Head of the delegation is Undersecretary of Commerce-Secretary General of National Committee for international economic cooperation, the Government appointed by the Prime Minister.
The Deputy Head of the delegation is representative of the ministries are directly related to the field, content negotiation, by the Chairman of the National Committee of the international economic cooperation appointed, dismissed on the basis of the proposal of the Secretary-General of the Committee.
2. The members of the Government delegation composed of representatives of the Ministry of supply: trade, Foreign Affairs, finance, planning and investment, science, technology and the environment, industry, agriculture and rural development, justice, culture and information, the Office of the Government, the State Bank of Vietnam , The General Department of customs and tourism.
Member of the Government delegation led by the ministries said on nomination to undertake professional work in government negotiations and must be approved by Committee Chairman.
3. The ministries concerned have elected officials have the capacity to do the clue and is representing the ministries involved Government negotiator.
Article 4. Delegation Chief Government negotiator on the economics-international commerce has the following powers and duties: 1. Subject to the direction of the Prime Minister, President and Vice Chairman of the National Committee of international economic cooperation in the preparation and conduct of negotiations.
2. The activities of the Government negotiator in the synthesis and drafting strategies, negotiating projects; preparing and conducting negotiations at various levels, different ranges within the framework of the WTO and organization of the Vietnam trade agreement--the United States, on the basis of the strategies and methods of negotiations has been the Prime Minister for approval.
3. Pursuant to operative tasks and content specific negotiations in each period, the head of the Government negotiating delegation has the right to propose the ministries involved replacement of the representative bodies that join the Government negotiator.
4. the apparatus used by the Office of the National Committee of international economic cooperation in order to assist the work of the negotiating Group.
Article 5. The funding activities of the Government negotiator is in funding the general operation of the National Committee of international economic cooperation.
Article 6. This decision takes effect 15 days from the date of signing and replaces decision No 264/TTg dated 7 May 1997 by the Prime Minister on the establishment of the Government negotiator to join the World Trade Organization (WTO).
Article 7. Chairman of the National Committee on international economic cooperation, the Ministers, heads of ministerial agencies, heads of government agencies, the Chairman of the provincial people's Committee, the central cities, Union Chief Government negotiator on the economics-international trade is responsible for the implementation of this decision.
