The decision on issuing regulations of the Organization and activities of the Center for continuing education _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ the MINISTER of EDUCATION and TRAINING bases of Decree No. 15/CP on 02/3/1993 of the Government about the tasks, powers and responsibilities of the State management of ministries, ministerial agencies;
Pursuant to Decree No. 29/CP 30/3/1994 of the Government of the tasks, powers and organization of the Ministry of education and training;
Pursuant to Decree No. 43/2000/ND-CP dated 30/8/2000 the Government detailing and guiding the implementation of some articles of the law on education;
At the suggestion of the Director of continuing education, the decision: article 1. Attached to this decision the Organization and regulation of activity of the Center for continuing education.
Article 2. This decision takes effect 15 days from the date of signing. This decision replaces decision No 2578/QD on 07/11/1992 the Minister of education and training on the regulation of organization and activity of the continuing education center and decision No. 1660/GD-Tel on 20/5/1997 of the Minister of education and training on the promulgation of the regulations on the Organization and activities of the Center for continuing education the district.
Article 3. Chairman of the provincial people's Committee, the central cities, Chief of the Ministry, Director of continuing education, the heads of the relevant units in the Government Ministry of education and training, the Director of the Department of education and training is responsible for the implementation of this decision.

The location of the Center for continuing education.
 Continuing education center is the main institution rules in the national education system. Continuing education centre has legal personality, a seal and have your own account.
Article 2. Duties and powers of the Center for continuing education.
 The Agency has the authority to establish the Center for continuing education based on the training needs and conditions specific to the provisions for the implementation of part or all of the following powers and duties: 1. Implementation of the educational program: a) literacy programs and continuing education after the literate;
 b) supplementary program of elementary, secondary, supplementary additional high schools;
 c) foreign language training programs, fostering information technology applications;

 2. The investigation of local learning needs, determine the content of learning required, propose the Organization of appropriate learning with each type of object;
 3. support to the professional high school, College, University organizations make no formal training programme locally according to the rules in article 41 and 42 of the law on education;
 4. The organization of separate classes under the program prescribed in paragraph 1 of this Article for the subjects entitled to preferential primary, disabled people and the audience enjoy other social policy according to local training plan;
 5. Organization of the teaching and practice of professional engineering, production labor activities and other activities in service learning;
 6. management of teachers, staff and students;
 7. Management, land use, infrastructure, equipment and financing in accordance with the law;
 8. The study, casting lessons with regard to the activities of the Centre for continuing education, contributing to the development of non-formal education.
Article 3. The system of continuing education center.
 1. continuing education center in the central cities, (hereinafter referred to as the continuing education center). This Center does not perform the tasks specified in point a of paragraph 1 article 2 of this regulation.
 2. continuing education center in the County, district, town, city in the province (hereinafter referred to as the regular District Education Center). This Center does not support missions of universities, colleges, as specified in paragraph 3 of article 2 of this regulation.
 3. The Center for continuing education in political organization, social-political organizations, economic organization, the people's armed forces (hereinafter referred to as the Center for continuing education in the Organization). This Center accomplish tasks such as regular District Education Center.
 4. foreign languages and information technology center. This Center is only performing the duties specified in point c of paragraph 1 article 2 and paragraph 3 article 2 of this Regulation (for foreign languages, Informatics).
Article 4. The name of the continuing education center.
 1. The name of the continuing education center is specified as follows: a continuing education centre) + name;
 b) language centre, + unique name.
 2. The name of the Center was inscribed on the decision establishing the Centre, the seal, the sea and the center of the transaction documents.
Article 5. Decentralized management.
 1. the continuing education center, Center for continuing education, continuing education center in the institutions, language centre, University of local news by Department of education and training manager, direct steering.
 2. foreign language Center, information technology in the University because the school management as stipulated in the Charter.
Article 6. Rules and continuing education center.
 Based on this regulation, the continuing education center built his Center's rules.
Chapter 2: ORGANIZATION and MANAGEMENT of article 7. Conditions established continuing education center.

 3. regular District Education Center, Center for continuing education in the institutions by the President of the provincial people's Committee decided to set up at the suggestion of the Director of the Department of education and training.
 4. Language Centre, University of local news by the Director of the Department of education and training establishment.
 5. foreign languages and Informatics Centre of the University by the Rector of the University decision-making established.
Article 8. Records and procedures established the Center for continuing education.
 1. Application consists of: a) the application for the establishment of the Center;
 b) feasible scheme specified in point b of paragraph 1, article 7 of this regulation;
 c) resume of the Director of the Center scheduled.
 2. The authority receiving and evaluation records are defined as follows: a) the Department of education and training receive the record established the Center for continuing education, coordinated with relevant agencies to organize the evaluation and the Chairman of the provincial people's Committee.
 b) Director of the Department of education and training decisions established foreign language centre, University of local news after writing to allow provincial people's Committee.
 c) Rector of the University decided to establish the Centre of foreign languages, Informatics in his field after the text of the Department of education and training.

Article 9. Merger, Division, separation, suspension, dissolution of continuing education center.
 1. Authority decided to establish continuing education centre as defined in article 7 of this regulation have the authority to decide on merger, Division, separation, suspension, dissolution of continuing education center.
 2. The procedure of the merger, Division, separation, suspension, dissolution of regular education center follow the Government's rules.
Article 10. Class organization.
 1. Students studying at the Centre in the form of periodic focus, just recently (in the Organization) are organized by classes. Each classroom has a teacher, have the class Secretary, a grade or two Deputy elected by the collective class.
 2. registered students study at the Centre in the form of distance learning, self-study guides are organized according to the regulations of the Ministry of education and training.

Article 12. Director.

 3. The authorized establishment of the Centre for continuing education-appointed Director of the Center for continuing education. The Director's term of Office is 5 years.
 4. the Director of the Center for continuing education has the following powers and duties: a) planning and implementation plans to fulfill the Mission of the Center;
 b) facilities management and the property of the Centre;
 c) teacher and staff management;
 d) proposed the appointment of Deputy Director; appointed Chief, founded the professional service and the Advisory Council of the Centre;
 DD) receive and manage students in school, for studies for the students under the provisions of paragraph 1 of article 2 of this regulation;
 e) financial management, decided to collect more details and distribution of the fruits of labor, engineering practice, services (if any);
 g) conventions are Signed, the certificate and the certificate of proficiency in technical and career for students studying in the center according to the current regulations;

Article 13. Deputy Director.

Article 14. The Board of education.
 1. The Board of education was held to advise the Director in the performance of the duties and powers of the Centre by the Director of the establishment at the beginning of the school year and as President.
 2. Components of the Board of education are: the Deputy Director of the Organization, representing the Communist Party of Vietnam, the Communist Youth League, trade unions, professional growth, some experienced teachers.

Article 15. The other Council.
 Pursuant to the request of the Administration, the Director of the Centre may be established in other Councils. The functions, duties, powers, composition, mode of working and operating time of the Assembly by the Director decision.

Article 17. Asset management, finance.
 1. The management of the property of the Center for continuing education must follow strictly the regulations of the State. All members of the Centre are responsible for preserving, protecting the assets of the Centre.
 2. The management of currency, from the financial resources of the Centre for continuing education are subject to the regulations of the State; the full observance of the accounting regime, statistics and periodic reports according to the regulations.
Chapter 3: EDUCATIONAL ACTIVITIES, Article 18. Forms of learning.
 The study included: learning to focus periodically, just recently (in the Organization); thematic learning, distance learning, self-study guides.
Article 19. Education programs, teaching plans.

 To perform the duties specified in paragraph 3 of article 2 of this regulation, the Centre for continuing education the responsibility to abide by the following rules: 1. The investigation of local needs, building plans to open the class President of the provincial people's Committee.

 -Shared reward, discipline;

Article 23. Testing, reviews, classified study results.
 1. Inspect, evaluate, categorize conduct and results for students according to the regulations of the Minister of education and training for each level and type of training.

Students in regular education centre according to the different learning, has completed the program of each school level: primary supplementary; Supplement supplement, junior high school, are eligible under the rules of the Ministry of education and training, are to attend the graduation examination of the corresponding level and if there are enough graduation requirements are granted with the diploma level. Chapter 4: teacher article 24. Teacher continuing education center.
 Teacher's continuing education center is the person in charge of education, taught in the Centre, including the Director, the Deputy Directors, teachers teach subjects according to the educational program to get diplomas and certificates of the national education system.
Article 25. The Mission of the teacher.
 The teacher has the following duties: 1.  4. Preserving the quality, reputation, honor of the teachers; previous exemplary students, respecting the personality of the students, treat with students, protect the rights, legitimate interests of students; solidarity, helping colleagues;
 5. Perform other duties specified by law.
Article 26. Rights of teachers.
 Teacher continuing education center has the following rights: 1. Be the Center to perform the task;
 2. Enjoy all benefits of spiritual and physical care, health protection under the policy regime for teachers;
 3. Be direct or through your organization join the central management;
 4. Enjoy the raw salary and allowances as specified when was to raise the level of professional service;
 5. Is scientific research, production labor participation, technology transfer services in educational institutions and other research establishments if ensure completion of tasks in the Center;

Chapter 5: students article 31. Students in regular education center.
 Students in regular education center include those with needs and those with academic obligations, eligible to participate in one of the Center's programs.
Article 32. The Mission of the student trainee to have the following duties: 1. Respect the teacher, teachers, managers, staff of the Centre; implementing rules of the Center and the provisions of this regulation;
 2. Fully implementing the learning requirements, practices labor due to the proposed Centre;
 3. Preserve and protect the assets of the Centre;
 4. Contribute to building, protecting and promoting the traditions of the Center;
 5. Pay your school fees in full and on time (for students in an have to pay your school fees).
Article 33. Rights of students.

Article 36. Rewards and discipline.

 1. Students have achievement in learning and work are the Centre and the level of management education rewards according to the following form: a) awarded the title of advanced practitioners, students each school year.
 b) Awarded the certificate of merit, if successful in the examinations at;
 c) other forms of reward.
 2. The student violated the defects in the process of learning and work out, depending on the nature and extent of that infringement be disciplined according to the following form: a) rebuke.
 b) warning recorded transcripts, informed the agency that sent students and families.
 c) terminated.
Chapter 6: FACILITIES and Equipment 37. The base material.

Article 40. Educational equipment-library 1. Continuing education center must have the minimum teaching device according to the requirements of the education program.

Chapter 7: the RELATIONSHIP BETWEEN REGULAR EDUCATION and SOCIETY Article 41. The responsibility of continuing education center.

Article 42. The relationship between the social Center.
 The Center in cooperation with the Agency in order to: 1. Consistency of the views, content, educational method by method not to the authorities, the social and political organization supported, enabling the Center to perform well in his mission.
 2. Mobilization of the organizations and individuals build regular learning movement and healthy education environment, the Help Center for continuing education improve the facilities, the equipment and the technical means, contribute to improving the quality of education, the Center's training.
