Pursuant to the law on Government Organization, 30 September 1992;

Pursuant to decision No. 67/2000/QD-TTg dated 15 June 2000 of the Prime Minister on the establishment of the National Council on water resources;

Consider the proposal of the President of the National Council on water resources, decision: article 1. Attached to this decision the Organization and regulation of activities of the National Council on water resources.

Article 2. This decision is effective from the date of signing.

Article 3. The Ministers, heads of ministerial agencies, heads of government agencies, the Chairman of people's Committee of the province, central cities, the Chairman and members of the National Council on water resources is responsible for the implementation of this decision.

 

REGULATIONS of the ORGANIZATION and ACTIVITIES of the NATIONAL COUNCIL on WATER RESOURCES (attached to decision No 99/2001/QD-TTg dated 28 June 2001 of the Prime Minister) Chapter 1 the FUNCTIONS, duties and POWERS of the NATIONAL COUNCIL on WATER RESOURCES article 1. The National Council on water resources have the duty to advise the Government in the crucial decisions about water resources in the tasks and powers of the Government: 1. Advice on strategy, the national water resources policy;

2. The review of the large river basin planning;

3. Advise the water transfer between the large river basin;

4. Counsel for the project on the protection, exploitation and use of water resources by the Government decision; Prevention and remedial flood, flooding and the harm caused by water;

5. Advice on the management, protection, exploitation, using the international water resources and solve the dispute arises;

6. dispute settlement consultant on water resources between ministries and between ministries together with the people's Committee of the central cities, and between the provinces and cities under central.

Article 2. Mission bases stipulated in article 1 of this regulation, the National Council on water resources: 1. Actively research, suggestions, comments to advise the Government on the policy and guidelines, the project of large and important issues in the field of water resources;

2. Organize discussions, opinions of experts, the scientists of the national water resource strategy, major projects, important, complex under the control of the Government;

3. Join comments on the report, important, on water resources as proposed by the Ministry, local branches or at the request of the Government.

Article 3. The duties and powers of the Commissioner: 1. duties and powers of the President of the Council:-Leadership Council operate according to function, the tasks defined in article 1 and article 2 of chapter I of this regulation;

-Urge, examine the implementation of the duties of the Commissioner;

-Decided to change the members of the Council after the reunification with the ministries concerned;

-Decide content issues discussed at every session of the Council;

-Convening and chairing the sessions of the Council.

2. duties and powers of the standing Member:-help the President of the Council in the work of the Council;

-Permanent work of the Board and the problem is President of the Board assigned or authorized;

-Convening and chairing the sessions of the Council when he was Chairman of the authorization;

-Led directly to the Office of the National Council on water resources.

3. duties and powers of the Commissioner regularly:-fully participating in the session of the Board and complete the tasks assigned by the Council;

-Have a responsibility to contribute comments on the issues discussed in the session of the Council or by the Council texts sent to; at the same time have the responsibility to respond in writing in the case not expected to be the Board's session;

-Is entitled to refer to and provide the necessary information and to use the means of his unit to perform the task.

4. duties and powers of the Commissioner are not regularly:-participate in the sessions of the Council when invited by the Chairman;

-Have a responsibility to contribute comments on the problems related to the local agency's work at the session of the Council or by the Council texts sent to; at the same time have the responsibility to respond in writing in the case not expected to be the Board's session;

-Is entitled to consult the information needed and to use the means of his unit to perform the task;

-When attending the session of the Council shall be entitled to vote as the Commissioner often.

Chapter 2 PRINCIPLES and WORKING RELATIONSHIPS of the COUNCIL article 4. The working mode of the National Council on water resources was discussed, adding comments and voting at the session of the Council. Chief of the Council as Secretary of the session of the Council.

Article 5. Article 6. Every year the National Council meeting on water resources in 2 States in the second quarter and the fourth quarter. When there is work needed at the request of the Prime Minister, or at the request of at least 1/2 of the regular members of the Council, President of the Council to convene the extraordinary session. The session of the Board must have at least 1/2 of the Council of Commissioners to attend.

Article 7. Depending on the content of the session, the Chairman may invite representatives of local agencies, concerned scientists attended the meeting. If not invited as a member of the Board, often not invited guests do not participate in the voting of the Council issues.

Article 8. In no case held the session, President of the Council may submit documents and comment votes to the Commissioner to obtain comments. Chief of the National Council on water resources is responsible for general comments to the President of the Council and the announcements the results aggregated to all Board members.

Article 9. The National Council on water resources was right to ask the ministries, local report of activities related to water resources to serve the Research Advisory Council.

The Ministry, local branches are responsible for providing the information, the necessary documentation required by the National Council on water resources.

Article 10. Funding of activities of the Council and the Office of the National Council on water resources arranged in genus regularly every year by the Ministry of agriculture and rural development, according to the plan are approved by the authority.

Chapter 3 functions, the MISSION of the OFFICE of the NATIONAL COUNCIL on WATER RESOURCES article 11. The National Council on water resources has helped the Council Office at the Ministry of agriculture and rural development. The Office of the Council has the following principal duties: 1. Preparing the programs and content for the session of the Board and the Chairman of the workshop by the decision;

2. Prepare the content and documents related to the work of the Assembly between sessions and the Organization moved to the Commissioner of this document as well as the agenda before each session at least 14 days for the regular session;

3. General comments participants in writing of the Commissioner is absent during the session to report to the Council and inform the next session conclusion the Commissioner absent;

4. Prepare and send the minutes of the session and the report of the Advisory Council of the up government;

5. Research, prospecting, construction planning advice including advice on international cooperation in the field of water resources and the establishment of the Advisory Group on the issues outlined in article 1 of Chapter 1 of this regulation;

6. Construction of the national water resources records and information necessary to help the work of the Advisory Council. Regular updates of information, metrics related to the duties of the Council;

Article 12. The Organization of the Office of the Council: 1. Management of the water resources agency under the Ministry of agriculture and rural development took office functions the National Council on water resources;

2. Staffing of the Office of the Council is located in the Ministry of agriculture and rural development, and by the Minister of agriculture and rural development regulation;

3. the Director of the Bureau of water management and hydraulic engineering (Ministry of agriculture and rural development) and Chief of the Council. Chief of the Council responsible to the President of the Council and Minister of agriculture and rural development-standing member of the Council on all aspects of the Office's activities;
