The DECISION of the MINISTER of Health On issuing provisions on conditions ensuring food hygiene and safety in the production, trading, use food additives health MINISTER pursuant Article 7 of law protects people's health and hygiene conditions attached Decree No. 24 dated 23/1/1991 of the Council of Ministers (Government);

Pursuant to Decree No. 68/CP dated 11/10/1993 of the Government regulations on functions, tasks, powers and organization of the Ministry of health, at the suggestion of the Director of quality management and food safety – Ministry of health decision: article 1. Attached to this decision regulates the conditions ensuring food hygiene and safety in the production, trading, use of food additives.

Article 2. Director of quality management and food safety and hygiene is responsible for guiding, inspecting the implementation of this decision.

Article 3. This decision takes effect 15 days from the date of signing.

Article 4. The Chief, Chief Inspector, Chief of the Service of the Ministry of health, Director of quality management and food safety, the Director of the Vietnam pharmaceutical Management Bureau, heads of subdivisions, Director of the Health Department of the province or city level, heads of health departments responsible for the implementation of this decision.

 

PRESCRIBED CONDITIONS ENSURE FOOD SAFETY in the PRODUCTION, trading, USE of FOOD ADDITIVES (attached to decision No 1031/2002/QD-BYT on 21/3/2002 of the Ministry of health) chapter I GENERAL PROVISIONS article 1. Scope: this regulation rules on conditions ensuring food safety in the production, trading, use of food additives.

Article 2. Applicable objects: this Regulation applies to the organizations and individuals in the country, the basis of foreign invested production, trading, use of food additives.

Article 3. In this regulation, the terms below are interpreted as follows: 1. food additives are substances that are not considered food or a food ingredient. Food additives have little or no nutritional value, are active on with the purpose to meet the requirements of the technology in the production, processing, handling, packing, shipping, food preservation. Food additives do not include contaminants or substances added to food for the purpose of further increases the nutritional value of food.

2. The basis of the production of food additives is the basis of production, blending, packaging, preservation of food additives.

3. Business establishments, food additives are the basis, wholesale, export, import of food additives.

4. The basis used is the basis of the food additives used in food additives to food processing.

Article 4. The production, trading and use of food additives in food processing to ensure the following principles: 1. According to the provisions of the Ministry of health.

CHAPTER II.

CONDITION ENSURING FOOD HYGIENE and SAFETY in the PRODUCTION, trading, USE FOOD ADDITIVES article 5. Production, trading, use of food additives to make the business registration regulations published standard of quality, hygiene and food safety under the rule of law; ensure correct registered contents published and subjected to inspection, the Inspector of the State administration of quality and food safety.

Article 6. Conditions of business establishments, food additives import/export: 1. The facility must register the business, have clear addresses.

3. The seller must through training of business knowledge, food additives by the competent health authorities organized.

4. Only allowed business, import and export of food additives under the category allows the Ministry of health.

5. food additives must ensure the correct category for food, have made clear, the origin.

6. food additives must have product label by Vietnamese, have recorded on the label directions for use and the prescribed content. The case of the odd tear, repackage, store must comply with regulations on food labels.

7. Conditions of export or import food additive: Must have full documentation, including the original invoice of purchase, import license (for entering), export license (for export); receiving votes published quality standards of food safety and food additive each of State regulators hygiene and food safety.

Article 7. Conditions for production, packaging and food additives.

Tool and equipment containing such as tray, pot containers must be made of materials allowed in food products such as stainless steel, aluminium, epoxy coated material etc.. do not use plastic, plastic-lined regeneration; the measuring instruments have to meet the standard.

Tool and equipment must be cleaned after each ca Palm production.

Only use detergent be used in household appliances and processed foods, may not be used in industrial cleaners.

Packing area, storage space, where the preserved food additives must be kept clean, no insect, rat flea exposure to food additives.

d) requirements for water supply source: operators must ensure proper water according to the regulations of the Ministry of health.

e) hygiene for production workers: Must be health check before employment, are periodic health examinations every year after recruitment and stool examination at least once each year.

Must be learned knowledge about food safety and hygiene to master technological processes and responsibilities.

Not to the clothing and belongings in the production area, packaging.

Keep the toilet clean, washing hands with SOAP before the production, packaging and food additives.

Must wear protective clothing (helmets, masks, ...) and wear gloves when packing food additive.

Do not eat, drink, smoke, breathe in the production area, packaging.

2. Requirements for production materials: a) the raw materials, food additives bought in to blending, packaging must have full, clear about the origin and quality of the additives.

b) Are clearly labeled, with record number of votes enter shipment export sale.

c) Bill of material specify base address.


d) The additive put into processing, to the bottle, packaging, retail shelf must be at least 6 months and limits the use of packaged products must follow the expiry of the original material.

The manufacturing facility address.

Net weight.

Expiry date (or date of production and expiry).

Instructions for use and maintenance.

4. The profile notes, daily tracking must be recorded regularly: full name of the food additive.

Origin.

Process technology.

The production batch, limited use.

Have the purchase invoice stating the client address with the base.

Article 8. Conditions of food processing establishments have used food additive a) not to use the materials is the oxidized products, synthetic sweeteners, preservatives and other additives is not in the list of food additives by the Ministry of health regulations to food processing.

b) only use food additives are packaged, labeled the right content to the provisions in article 7 of this regulation.

c) food additives must ensure the purity of use for food.

e) food additive is used in the right dosage, recipe and instructions for each type of food.

g) packaging products that use food additives on the product label must specify the full name and the type of food additive use.

 

CHAPTER III the RESPONSIBLE PRODUCTION, trading, USE FOOD ADDITIVES article 9. Responsible for manufacturing, packaging, food additives import/export: 1. To register with business management agency 2. To publish quality standards of hygiene and food safety in the health authorities under the provisions of the law.

3. To comply with technological processes, product quality standards evenly and ensure food safety.

Article 10. Responsible business: 1. To register with business management agency 2. Just business, selling food-additive flock has announced the quality standards of food hygiene and safety in healthcare.

Article 11. The responsibility of the client: 1. Only buy food additive has published quality standards in medical Agency.

4. Use the correct food additives dosage instructions.

5. Detect and inform the governing body of the production base of food additives are not properly regulated.

Article 12. Regulations, investigating reports of poisoning food supplements: 1. When discovered or suspected food poisoning (which use additive), where happens to poisoning to immediately report to the nearest health agencies and hold the suspect food additives that cause food poisoning, save the template to the verification investigations.

CHAPTER IV RESPONSIBILITY of PRODUCTION MANAGEMENT, business USE of FOOD ADDITIVES article 13.

1. The Bureau of quality management and food safety the Ministry of health is responsible for: a) directing, guiding and coordinating the departments inspection, monitoring of production and business establishments in order to ensure the production of food additives according to the regulations on the national scope.

b) management, receiving records announced the quality, hygiene and food safety of the manufacturing and processing of food additives, import-export businesses of food additives; management of food additives, imports on the country.

2. The Department of health of the province/city centrally responsible production guidelines, business done right the existing laws and regulations are responsible for management of business establishments, trafficking, use of food additives.

 

Chapter V REWARDED and HANDLE breach of article 14. Rewarding.

Organization, production and business, personal use food additives made good the provisions in this regulation will be rewarded according to the State's General mode.

Article 15. Handle violation.

Organization, production and business, personal use of food additives in violation of the provisions of this regulation, depending on the level will be processed administratively, if damage is compensated according to the provisions of the law.
