The DECISION of the MINISTER of AGRICULTURE and RURAL DEVELOPMENT, on the regulation of State management of a steam sterilization operations the object in quarantine the MINISTER of AGRICULTURE and RURAL DEVELOPMENT, pursuant to Decree No. 73/CP dated 16/11/1995 of the Government function duties, powers and organization of the Ministry of agriculture and rural development;

Pursuant to Decree No. 58/CP dated 3/6/2002, the Government passed the Ordinance on plant protection and quarantine;

Proposal of the plant protection Bureau Chief and Director of the science and technology and product quality.

 

Decision: article 1: Date issued under this decision "governance rules about sauna disinfection operation in an unidentified quarantine".

This regulation applies to the organizations and individuals who have a steam sterilization operations on the territory of Vietnam article 2: this decision has the effect after 15 days from the date of signing. Repeal of Decision định189/NN-HERBICIDE/QD on 31/3/1994 of the Minister of agriculture and food industry regulation in State management of activities in an object disinfection plant quarantine and other provisions contrary to this regulation.

Article 3: Plant Protection Bureau Chief, Director of science and technology and product quality, the heads of the relevant agencies, organizations and individuals concerned is responsible for the implementation of this decision.

State management regulations of steam sterilization operations the object in quarantine (issued under decision No 84/2002/QD-BNN, on 24 September 2002 of the Minister of agriculture and rural development) article 1.

Sterilization steam sterilization measures is by steam toxic chemicals to eradicate the pests in an unidentified quarantine stipulated in article 3 of the Charter quarantine issued under Decree No. 58/2002/ND-CP dated 3/6/2002 by the Government.

Article 2. The Mission of the Directorate of plant protection, steam sterilization operations: 1. develop and promulgate the criteria, process of steam sterilization.

2. Check the expertise, skilled on the steam decontamination and the sauna practice certificate for sterilization of individuals with steam sterilization operations on the territory of Vietnam according to the provisions of article 31 of the Charter quarantine issued under Decree No. 58/2002/ND-CP dated 3/6/2002 by the Government.

3. check periodically (once a year) or irregular conditions, steam disinfection practice of the Organization, individuals are prescribed in article 30 of the Charter quarantine issued under Decree No. 58/2002/ND-CP dated 3/6/2002 by the Government.

4. active monitoring steam sterilizers for objects in the quarantine area when infected plant quarantine objects of Vietnam or exotic pests and at the request of the server object.

Article 3. Sterilization monitoring content: 1. Check the practice steam sterilization.

2. check the equipment, steam sterilization practice.

3. Monitoring of chemical drugs used for disinfection of objects in quarantine as required by law.

4. Monitoring of disinfection techniques including drug concentration, volume pills, sterilization time, harmful organisms need to eradicate the correct technical procedure of the Ministry of agriculture and rural development.

5. Monitoring the condition of guaranteed safety for people and the environment in the process of steam sterilization operations.

Article 4.

The organization or individual operating a steam disinfected objects in the quarantine area on the territory of Vietnam must have enough the conditions prescribed in article 30 of Decree No. 58/2002/ND-CP dated 3/6/2002 of Government and article 5 of this regulation.

For organizations that already license the practice of sterilization according to Decision định189/NN-HERBICIDE/QD on 31/3/1994 of the Minister of agriculture and food industry management regulation on sterilization operations the object in quarantine, when the license expires, if continued, steam sterilization operations are implemented in accordance with this regulation.

Article 5. The organization operates a steam sterilization to ensure there is enough of the following specific conditions: 1. direct People Management, Executive (Director-General, Deputy Director General, Director, Deputy Director, technical manager for the enterprise business and public enterprises; Owners of private enterprises) and the person in charge directly when practice must have professional steam sterilized by authorities. (Sample in annex 2)

2. Staff, technical workers, steam sterilization must directly through a training class of steam sterilization and plant protection department or plant quarantine Bureau Department test, confirming vocational qualifications.

3. technical processes, facilities, equipment as defined in decision 70/1998/QD-BNN-S & T on 6/5/1998 of the Ministry of agriculture and rural development and other provisions to ensure service for steam sterilization operations safe for people, pets, about environmental hygiene , about the fire and explosion in accordance with the Ministry of science, technology and environment, the Ministry of public security and the Ministry of health.

4. Location work, chemical warehouses, equipment as prescribed by the competent State bodies.

Article 6. Conditions of certificate of practice steam disinfected in accordance with article 31 of the Charter quarantine issued under Decree No. 58/2002/ND-CP dated 3/6/2002 by the Government.

The conditions stipulated in paragraph 1 of article 31 apply only for the own people directly managing, operating, steam sterilization operations have assumed this position before on 18/6/2002 when the Decree 58/2002/ND-CP of the Government force.

Article 7. Certificate authority practice steam sterilization: 1. plant quarantine Bureau Department certificate of practice, a steam sterilization for individual steam sterilization operations the object in quarantine for preservation in the country.

Article 8. Procedure for grant of a certificate of practice, a steam sterilization: 1. Profile includes: a) the learning outcomes of a steam sterilization operations by the competent authorities. Particularly for those who apply under the provisions of paragraph 1 of article 31 of the Charter quarantine issued under Decree No. 58/2002/ND-CP dated 3/6/2002 of Government must have the verification period of activity in the field of steam sterilization by governing body has confirmed work place.

b) Paper recommended steam sterilization certificates (lục1) c) curriculum vitae of the proposed level (certified by the local authority or governing body) d) health certificate by the medical authority district level or above or equivalent level in accordance with the law.

Article 9. The implementation and certification of the sterilization rule as follows: 1. hold steam sterilizers are qualified to practise under the provisions of article 5 of this regulation have permissions granted, steam sterilization certificates for objects in the quarantine area.

2. The certificate of sterilization and disinfection for objects in quarantine infected objects to quarantine plant quarantine agency are specified (in the plant protection department or the Department) and new monitoring was done.

Article 10.

Prohibited for others to borrow, hire professional or use in other purposes. Organizations, individuals, steam sterilization practice violates the regulations on disinfection shall be handled according to the current regulations on sanctioning administrative violations in the work of protection and quarantine.

Article 11 professional steam sterilization is one of the conditions to the competent State agencies issued a certificate of business registration.

Plant Protection Department, in coordination with the responsible authorities guide test, urging the implementation of this regulation.
