The decision on issuing the provisions on quality management of construction works _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ CONSTRUCTION MINISTER pursuant to Decree No. 36/2003/ND-CP dated 4 April 2003 of the Government functions, tasks, powers and organizational structure of the Ministry of construction;
Pursuant to Decree No. 51/1999/ND-CP dated 8 July 1999 the Government issued regulations on investment and build the evil Decree 12 v/2000/ND-CP dated 5 May 2000, Decree No. 7/2003/ND-CP dated 30 January 2003 by the Government on amendments and supplements to some articles of the regulation on investment management and building attached to the Decree No. 51/1999/ND-CP dated 8 July 1999 from the Government;
At the suggestion of Director of Department of the State inspection of the quality of construction works, the Director of the legislation;
Article 1 DECISION. Attached to this decision regulates the quality management alternative constructions quality management regulations of construction works attached to decision No 17/2000/QD-BXD dated 2 August 2000 of the Minister of construction.
Article 2. This decision was implemented uniformly throughout the country and have effect after 15 days from the date The report.
Article 3. Ministers (signed) Nguyen Hong Quan QUALITY MANAGEMENT REGULATIONS of CONSTRUCTION WORKS (attached to decision No 18/2003/QĐ-BXD dated 27 June 2003 the Minister of construction) Chapter 1: GENERAL PROVISIONS article 1. The object and scope of this regulations prescribe the content of quality management of institutions, individual investment advisory activities and building, construction business, project management, construction, owner and Manager of State bodies involved in the survey design, construction, testing, delivery, warranty, maintenance, construction works in new construction projects (including ancillary works, works, works serve kicked), restoration, renovation, irrespective of form of ownership, capital.
Article 2. Article 3. Decentralized management on the quality of construction works 1-Ministry of construction: the unification of State management of the quality of construction works within the country, is responsible for: a) issued legal documents about the quality management of survey, design, construction , testing, delivery, warranty, maintenance, construction and installation works; the agreement to have sets of specialized construction, specialized technical manager issued the regulations on quality management of specialized construction and specialized quality management techniques in the process.

c) periodically check or irregular management of construction quality of owner, organization design and implementation consultancy business for the construction works of the project group a. direct quality control organization works in both countries when needed.
d) implementation and responsible for the assessment of the quality of construction works according to the hierarchy of the Government;
e) synthesis report the Prime Minister six months, 1 year on the quality of construction works as specified.
Department of State inspection of quality of construction, survey, design and construction of relevant units of the Ministry of construction to help Minister to build on responsibilities.
2-provincial people's Committee: a) the provincial people's Committee of the unified state management on the quality of construction works at the local responsibility:-Guide and check the implementation of legal documents on management of construction quality at the local level.
-Check periodically or irregularly in quality management of construction of owner, design consultants and construction business for public works projects in the Group B, C by local management. Direct quality control organization works locally as needed.
-Handle the infringing on the quality of construction works and construction issues locally according to the hierarchy in article 25 of this regulation.
-General and periodic construction Ministry report in six months on the State of the quality of the local construction management (reporting form as Appendix 27 of this Regulation).
-Decentralized governance for quality of construction works for the project by the people's committees at district level, the investment decision.
Construction Department is the agency that helps provincial people's Committee on responsibilities.

b) instructions, check the implementation of the quality management regulations for the construction works by the specialized management on nationwide.
c) appraising, approving engineering designs and the total construction work by specialist assigned by the Government; instructions, check the work appraisal, design, engineering, and total construction specialization according to the regulations on investment and construction management for the professional work by the management;
d) periodically check or irregular quality management by the owner, design consultants and construction business for the professional work by the management. When necessary, direct the Organization to check the quality of the construction work in The disciplines of management. Petitions handled in violation of the quality of construction works. Article 4. Responsible for the quality of the work of the investor, the investment consultant organization and building, construction business 1-for the owner: a) is responsible for the whole of the quality of the construction works of the project due to her management.
b) made under the provisions of article 14, paragraph 1 to article 46 of the regulation on investment management and building attached to Decree No. 51/1999/ND-CP on 08/7/1999, and the related content in this regulation.

d) to hire consultancy organization overseeing construction when the owner is not eligible under the regulation.

Chapter 2: QUALITY MANAGEMENT of CONSTRUCTION SURVEY and DESIGN of CONSTRUCTION WORKS article 5. Building survey 1-the works must be done building survey at the venue construction.

Article 6. Construction design 1-The construction works must be designed with the prescribed drawings.

8-advisory organization established technical design or construction engineering design must make the author supervision during construction according to article 17 of this regulation.
9-design consultancy specialized construction works outside of work to implement the provisions of the above paragraphs of this Article, have to comply with regulations on product content design of the specialized construction work.
10-organization design consultants are not subcontract the entire contract or the main part of the content of the contract for a different design consulting organization.
Article 7. Product test survey construction, design 1-The trials of products building survey (survey results report construction), product design (design records) on the basis of the following documents: a) the contract bidding and delivery building survey, design.
b) task of building survey, design.

Article 8. 7-The written approval of the State administration authority on environmental safety, fire prevention, safety, safety, safety dikes, traffic safety and the relevant requirements.
Article 10. Technical design or construction engineering design 1-contents technical design or construction engineering design: a) the condition of capacity building activities of the advisory organization, individual design.

Article 11. Competent appraisal of engineering design 1-works in the important national project, the project group A: a) for works of the project using the State budget:-Ministry of construction engineering design works in national important projects due to the prime investment decisions; the work of the project group A led by Ministers, ministerial heads, government agencies, the Chairman of the provincial people's Committee and the corporate investment decisions.

Article 12. The authority to approve the design, engineering or construction engineering design 1-for construction works (regardless of form of ownership, capital) who has the authority to approve investment decisions or be allowed to authorize subordinates to approve the technical design but must be responsible before the law about the authority. 2-for the construction of the project due to a people's Committee at district level, the town decided to invest according to the hierarchy of the provincial people's Committee: Chairman of the people's Committee of the district level approval of technical design.
3-content of the decision approving the technical design or construction engineering design is regulated under article 38 clause 2 of the regulation on investment management and building attached to Decree No. 51/1999/ND-CP on 08/7/1999 of the Government. 5-authority approving engineering design must take responsibility before the law about the content approval prescribed in article 38 of regulation on investment management and building attached to Decree No. 51/1999/ND-CP on 08/7/1999 of the Government.
Article 13. The authority approved the construction drawing design 1-for three-step design works, construction drawing design must be approved. The approval authority shall be as follows:

a) for works in the investment project and construction of the capital budget, capital credit by the State guarantee, credit capital investment and development of the State, the base level of technical complexity of projects and level of competence, the expertise of the owner who has the authority to approve the technical design was authorized for investor approval of construction drawing design projects consistent with the technical design has been approved.
b) for the use of other sources of capital, the investor is responsible for approval of construction drawing design.
c) The construction drawing design must have the seal of approval by the owner according to the model in annex 25 of this regulation.
2-case when set construction drawing design projects have changed compared to the technical design has been approved, the owner must have the authority to review approved.
3-in the course of construction, the owner is allowed only after the design change was authorized allowing investment decisions. Chapter 3: QUALITY MANAGEMENT in CONSTRUCTION article 14. Supervision work in the construction process owner (project management, or consulting organization supervision was the owner hired), organization design and construction business to be eligible under the regulations and must have the departments ensure sustained monitoring activities in a systematic way the entire exam process the construction from the construction to completion and delivery of the entire works under this regulation.
Article 15. 3. When making EPC contract, the owner is responsible for: a) to perform the work specified in clause 1.2 of this except for the trials of job.
