The DECISION of the MINISTER of AGRICULTURE and RURAL DEVELOPMENT, functions, tasks, powers and organization of the plant protection Department of the MINISTER of AGRICULTURE and RURAL DEVELOPMENT Ordinance base protection and quarantine in 2001;
Pursuant to Decree No. 86/2003/ND-CP dated 18 July 2003 of the Government mandate the functions, duties, powers and organizational structure of the Ministry of agriculture and rural development;
The base article 19 of Decree 87/2002/ND-CP dated 11 November 2002 from the Government mandate the functions, duties, powers and organizational structure of ministries, ministerial agencies;
Proposal of the Director of the Organization Department, DECIDES: 1. The position and function of plant protection Bureau is the Agency directly under the Ministry of agriculture and rural development, implement state management functions and specialist inspection and plant quarantine protection, plant protection drugs within the country.
Plant Protection Department has legal personality, has its own stamp, there is funding activities, open an account according to the provisions of the law.
The headquarters of the plant protection Department in Hanoi.
Article 2. Duties and powers plant protection Bureau was assigned Minister made these tasks, the following specific rights: 1. The Minister for law projects, project Ordinance, the draft text of the legal regulations in the scope of management of the Department. 2. The Minister of planning, strategy, policy, and the annual five-year plan, program, project, scheme in the scope of management of the Department as assigned by the Minister.

4. On the Management specialization: a) on the protection of plant:-governance work of the investigation, detection, prediction, and the direction taken in the room except for the main pests of plant resources primarily;

b) About quarantine:-managing and directing the work of domestic quarantine;

-Management of disinfection operations as provided by the State and the international treaties to which that Vietnam signed or joined.
c) On plant protection drugs:-manage the registration of plant protection drugs;
-Management of the assay the new plant protection drugs;
-The Minister announced plant protection drugs categories are allowed to use plant protection drugs, limiting the use of the plant protection and drug use in Vietnam; allocation targets imports of plant protection drugs restricted use;
-The Minister for permission to import plant protection drugs limit the use of the plant protection drugs, not yet in the list are allowed to use;
-Manage and organize the implementation of quality control of raw materials and finished products plant protection drugs prescribed by law;
-Manage the use of the plant protection drugs prescribed by law;
-Manage and organize drug residue control for plant protection in agriculture, forest products and agricultural environment after use of the plant protection drugs;
-Unify managed the destruction of drugs, drug packaging plant protection under the provisions of the law;
-Management of the national reserve of plant protection drugs as required.

6. Manage a number of business units, public service Department of plant protection, quarantine, plant protection drugs according to assigned by the Minister.
10. active participation in the management of the Association, non-governmental organizations in the scope of management of the Department as assigned by the Minister.
11. specialized inspections; check, complaints, accusations; against corruption, negative; handle the breach of plant protection, quarantine and plant protection drugs according to the authority.
12. Build and implement administrative reform programs of the Department according to the aim and content of the program of the Ministry of administrative reform.
13. About organization management, officer: a) On the work of the Organization:-planning of network protection, quarantine within the country;
-Managing and directing the organization system building of protection and quarantine the country as stipulated by law and the hierarchy of the Ministry;
-Identity management, badges, insignia, badges, tags, tag inspection quarantine mode and allocated for use with specialized inspection officials and quarantine officials.
b) on the work of officers:-participation in training, fostering professional service for civil servants, employees and the public to join forces to protect plants and plant quarantine;
-Implementation of salary mode and the mode of remuneration policies, reward, or discipline for public servants, officers in the scope of management of the Bureau 14. Management of the collection, use the fees and charges prescribed by law; financial management, property and other resources are allocated; implementation of the budget is allocated according to the rules.

Article 3. Organization 1. Local leaders: leadership the Bureau Chief and has Deputy by the Minister of agriculture and rural development appointed under regulations.

Article 4. Enforceable decisions in effect after fifteen days from the date the Government Gazette; replace decision No 882/NN-TCCB dated 24 June 1996 of the Minister of agriculture and rural development, functions, tasks, powers and organization of the plant protection Department and the Ministry's previous rules contrary to this decision.
Article 5. Responsibility Director of Department of plant protection, the Office, the Director, the Bureau Chief, Chief Inspector, President of the people's committees of provinces and cities under central, Director of the Department of agriculture and rural development and the heads of the agencies, the relevant units of the Ministry is responsible for the implementation of this decision.
