Decisions about quality control, technical safety and environmental protection for motor vehicles imported into Vietnam to the MINISTER of TRANSPORT pursuant to article 48, article 50 of the law on road traffic on June 29, 2001;
Pursuant to Decree No. 34/2003/ND-CP dated 4 April 2003 of the Government functions, tasks, powers and organizational structure of the Ministry of transportation;
Pursuant to article 23 paragraph 1 d, paragraph 1 article 25 and article 27 of Decree No. 179/2004/ND-CP on October 21, 2004 of the Government to manage state on the quality of products, goods;.
At the suggestion of the Director of the Vietnam register, Director of science and technology, Director of legislation, decision: article 1. Attached to this decision the provisions on quality control, technical safety and environmental protection for motor vehicles imported into Vietnam.
Article 2. This decision has the effect after 15 days from the date The quote and replace decision No 1944/1999/QĐ-BGTVT dated 7 August 1999 of the Minister of transport issued the regulations on quality control, technical safety the motor road vehicles imported into Vietnam.
Article 3. Director in collaboration with the Vietnam register Service Guide Science and technology organization, and examined the implementation of this decision.
Article 4. Office Manager, Director of science and technology, Director of Legal Affairs, Director of transportation, Director of Department of roads in Vietnam, Director of the Vietnam register, Director of Department of transportation/traffic public works of the province of the central cities, and heads of agencies, relevant units responsible for the implementation of this decision.
 
 
REGULATIONS on QUALITY CONTROL, TECHNICAL SAFETY and ENVIRONMENTAL PROTECTION for MOTOR VEHICLES IMPORTED into VIETNAM (attached to decision No. 35/2005/QĐ-BGTVT dated 21 July 2005 of the Minister of transport) chapter I GENERAL PROVISIONS article 1. The object and scope of application 1. This text of regulations on quality control, technical safety and environmental protection for other types of vehicles because of the organizations and individuals in the country and abroad (hereinafter referred to as the organization or individual) motor vehicle imported into Vietnam.
2. This Regulation shall not apply to: a) motorcycles imported machines;
b) motor vehicles imported to use on defense purposes, security of the Ministry of defence.
Article 2. Explanation of terms In this regulation the terms below are interpreted as follows: 1. The motor vehicle is the type of motor vehicles operating on roads defined in the latest version of the ISO standard ISO and 6211 7271.
2. Batch import vehicles are imported vehicles are declared in the same declaration of imported goods 1.
3. Motor vehicles of the same type as the motor vehicles of the same owner, same marks, industrial design, and other specifications and has the same origin.
Article 3. Motor vehicles imported into Vietnam are subject to the current rules on the types and technical standards for motor vehicles.
Article 4. Vietnam register (hereinafter the quality control agency) organized and conducted the inspection on quality, technical safety and environmental protection (hereafter called check) vehicles imported within the country.
Chapter II PROVISIONS on the INSPECTION of IMPORTED VEHICLES article 5. Registration records check 1. Check registration records for each batch of imported vehicles was established 1 Kit includes the following documents: a) A sign indicates the test frame, engine number and year of manufacture of the vehicle.
b) import copies.
c) technical document is the document introducing the technical features (copy) and/or a registered motor vehicle specifications import (original) of the Organization, the individual import which may present the following basic content:-size parameters;
-The parameters on the weight: the weight of itself; the payload; entire weight; the weight distribution on the axles (applicable only to vehicles having a gross weight of 15 tonnes or more);
-The basic specifications of the engine;
-The number of passengers, including the driver;
-Tire Size;
-Introduction to the main system as: transmission system; brake system; the steering system; the suspension; lighting system and signals; special structure on the vehicle (if any).
Particularly for vehicles not yet through the use of outside technical documents mentioned above, organizations and individuals to import additional copies of test coupons issued by the manufacturer for each vehicle that shows the number of the frame, engine number (if applicable) or original certificate of quality (C/Q) manufacturer for imported vehicles.
2. Free technical documents referred to in point c of article 5 paragraph 1, for the import of motor vehicles of the same type with the type of vehicles that have been tested and certified quality, technical safety and environmental protection of motor vehicle importers (hereafter referred to as the certificate).
Article 6. Check for vehicles not yet through the use of 1. Check free Long quality check for vehicles not yet through use, produced before the time of the import of no more than 3 years, comply with the requirements referred to in article 3, are valid records according to the provisions of article 5 and satisfy one of the following conditions: a) the motor vehicle has been checked by the agreement or the agreement of mutual acknowledgment of standard and the fit that Vietnam join signed;
b) vehicles have a certificate of compliance with the regulations ECE, EEC, EC European technical safety and environment protection for motor vehicles by the competent foreign authority;
c) motor vehicles of the same type with different agencies and check quality control certification.
2. check motor vehicles not yet through the use, importation does not comply with the requirements in paragraph 1 article 6 shall conduct the following checks: a) check 1 samples of each type of vehicle type with regard to:-import motor vehicles do not have sufficient technical documentation referred to in point c of article 5 paragraph 1 or ,-imported vehicles were examined at the place of export is required.
b) check each of the for:-vehicles not yet through the use be produced before the time of importation on 3 years or,-where quality inspection agencies have proving basis differences between specifications technical document with the imported motor vehicles.
c) content check: just check under the category of general inspection, check engine, check the brake system, check out the suspension, check the steering system, check the electrical equipment, signal lights prescribed in article 7.
Article 7. Check for used motor vehicles imported, used, have valid records be checked once the following regulations: 1. General test a) frame of the engine right with a sign test;
b) the motor vehicle is in the normal operating status, ensuring full use, functionality, appearance and texture match technical documents registered in the quality control agency (except in the case of vehicles without cargo tanks);
c) motor vehicles must adhere to the size specified by the Ministry of transportation;
d) motor vehicles must have the weight and the distribution of weight on the axle to obey regulations of the Ministry of transportation. For the cargo vehicle with the weight distribution on the axles, larger payload of passengers, vehicle imports are determined according to the results of calculating the axial load allowed as specified;

Motor vehicle imported cases have change some specifications than the base car, the entire weight of your vehicle is not greater than the weight of the vehicle the basis stated in the technical documentation.
2. check the hull, cockpit, crates a) Not cracked, no distortion, no perforation tearing;
b) Painted the hull (excluding crates), cockpit not long foot, peeling each large plate;
c) up and down the door closed, gently open, not open by itself when the car runs;
d) windshield and window glass is glass, the right type of vehicles which, in accordance with the rules of safe for the person sitting in the car; no cracking, scratching into streaks;
e) mirror is full, true type, positioned for sure;
f) chassis no warping, fracture, not a rust;
g) Seats the driver and passenger seats have the correct layout with technical documentation, docking and certainly has the size to comply with current standards.
3. check the motor a) true type or type of equivalent capacity. The entire volume for 1 ton of cars must reach from 7.35 kW;
b) no fuel leakage phenomenon, lubricating oil and cooling water;
c) engine must work when booting with Air launch consecutive power no more than 3 times, each time not more than 5 seconds;
d) engine is stable activity in the rotation mode does not load; No strange knock;
e) pressure lubrication, cooling water temperature when the engine works stable must be in the limits allowed under the technical documents of that type;
f) limit allowed of engine emissions do not exceed the level of current rules for the motor vehicle;
g) noise level does not exceed the level of current rules for the motor vehicle.
4. Check the transmission system and the system of moving a) Speed and the angle sum of active bridge wheel does not exceed 150;
b) not have strange knock in the gearbox, the gearbox, the main transmission structure ... when operating;
c) clutch control gently, completely closed, the definitive cut. Freestyle cruise, cruise work of clutch pedal is located within the limits allowed under the technical documents of that media type. Hydraulic clutch no oil leakage phenomenon;
d) gearbox, gearbox: out of easily, not stuck, don't jump up and not leak oil;
e) cardan axles no distortion, no cracks;

5. check brake system a) are full of parts, the details according to the technical documentation of the type of vehicles;
b) gas pipelines, not cracked, worn, not defeated, no leaks;
c) for brakes, oil, after no more than 2 times the brakes the brakes must be applied. From the time the brakes are applied while the effect not less than 1.5 seconds;
d) for pneumatic braking system: after 10 minutes the engine working at no load, the pressure in the compressed air to reach the levels prescribed by the technical documents of that type of car. When the pedal off the brakes, the pressure in the journey the average compressed air not less than 5 kg/cm2. After turning off the engine for 30 minutes, the amount of pressure reduction of compressed air in the jar is not greater than 0.5 kG/cm2.
6. check the steering system a) are full of the clusters, the details according to the technical documentation of the types of vehicle and normal functioning, stable;

7. check the suspension a) resilient parts: spring, torsion, oven, ... to the right category, quantity, no fracture, buckets of deviation. Not worn into the back ledges between the leaf spring. Ensure the correct clearance with documentation of the vehicle type;
b elastic parts) for compressed gases: no leaks, ensure balanced hull according to the direction;
c) The hydraulic absorbers operate normally, no oil leaks.
8. Check the electrical equipment, lights and signals a) is full of electrical equipment with the right technical documents of that type of vehicle and the assurance function;
b) electric Horn, lights, signal lights, gotten rain ensures the technical safety standards under current rules for motor vehicles are in circulation.
9. Check the specialized structure for specialized vehicles, the specialized structure is complete, make sure the functions match the technical documents of that type of car.
Article 8. Processing test results 1. For the motor vehicles comply with the requirements referred to in paragraph 1 article 6 shall be granted exemption from notification quality control, technical safety and environmental protection for imported motor vehicles (hereinafter the exemption notification check) according to the template outlined in annex 1 attached to this regulation.
2. for motor vehicles has a satisfactory test results, the Agency examined the quality certification according to the template outlined in Appendix 2 attached to this regulation.
3. for motor vehicles through unsatisfactory examination, the quality control agency announced did not meet the quality, safety and environmental protection engineering vehicle import form referred to in annex 3 to this regulation attached and send it to the Organization, the individual import to take measures to handle.
4. The certificate or notice long check for motor vehicles imported to be used to solve the safety inspection procedures and techniques to solve the other related procedures as required by the competent authority (for example, motor vehicle registration the import procedure, resolve).
For those vehicles has been issued a certificate or notification of long check but is damaged does not guarantee the quality in the process of unloading, transport, storage, the certificate or notice long check has granted to vehicles which will not be valid.
5. Processing for other cases a) for technical documentation referred to in point c of article 5 paragraph 1 have yet to demonstrate the full range of on-demand content, the basic specifications of the vehicle is determined on the basis of the actual test.
b) for vehicles used in the size and/or weight greater than current rules shall be tested to import but in the certificate indicates the quality is when in traffic must be allowed by the competent authority on the management of road.

c) for motor vehicles change from abroad on a number of technical parameters and structural comparison with base organizations, personal imports must present the technical documentation for the car has changed. After checking, if vehicles ensuring the requirements of quality, safety technique for vehicle imports, the quality control agency certification for that car and clearly in the certificate of the vehicle has been changed from overseas.
d) for vehicles have frame and/or engine number was opaque this page then the quality inspection agencies inspect only if the opaque this page is due to technical fault of the manufacturer and the opaque this page must be manufacturers of confirmation. Case of doubt about the number and/or the frame of the car's engine, the quality control agency will referendum in specialized examiners.
e) for imported motor vehicles were damaged during shipping from the port of shipment to Vietnam then was allowed to perfect in some situations:-hull, cockpit, cargo containers have scratches or paint the box to the local culture but poker not be termites, perforation;
-Windshield, glass windows were cracked;
-Lighting systems, signal: cracked, shattered; The control relays are missing; Colors of lights are not consistent with the current rules;
-Mirror cracked, shattered;
-Wiper rain damage or unusual activities;
-The battery does not work.
Chapter III IMPLEMENTATION article 9. The Organization, individuals are responsible for import: 1. Responsible for the truthfulness and accuracy of the records document has provided quality control agency;
2. the present status quo of motor vehicle Agency to check the quality of the execution of the test;
3. Make decision on disposal of the Ministry of transport if there is violation of rules of the State inspection of the quality of motor vehicle imports.
Article 10. Quality inspection agencies have the responsibility: 1. implementation of this regulation at the same time have the responsibility to guide the Organization, individuals importing in ensuring quality requirements, technical safety and environment protection for motor vehicles;
2. Uniform issuing, management certificate and notice of exemption from inspection;
3. Perform the test, the testing of motor vehicles according to the required content when there are doubts about the mismatch of the specifications of the vehicle;
4. Construction, issued guidelines and quality control procedures, technical safety and environmental protection for motor vehicles imported into Vietnam;
5. Collecting the revenues related to testing, certification, inspection exemption notice under current rules;
6. test records of motor vehicles within 3 years;
7. General results check the quality of imported motor vehicles to the Department of transport report in January and July each year.
