The DECISION of the GOVERNOR of the STATE BANK Of issuing regulations officers, public officials, State Bank officials-*-GOVERNOR STATE BANK-pursuant to the law the State Bank of Vietnam no. 01/1997/QH10 on 12/12/1997;
-Based Ordinance, no. 01/1998/PL-UBTVQH10 on February 26, 1998;
-The labor code base on 23/6/1994;
-Pursuant to Decree No. 15/CP dated 2/3/1993 of the Government regulating the duties, powers and responsibilities of the State management, ministerial bodies;
-At the suggestion of the Director of personnel and training, Decisions 1. Attached to this decision "legal officers, public officials, State Bank officials".
Article 2. This decision takes effect 15 days from the date of signing and replace the following decisions:-decision No. 59/QD-NH9 on 19/3/1997 of the Governor of the State Bank issued regulations on run servants seconded to work in the unit in the State banking system.
-Decision No. 276/QD-NH9 on 14/8/1997 of the Governor of the State Bank issued rules for public officials, State Bank officials are trained.
-Decision No. 362/QD-NH9 on 31/12/1996 of the Governor of the State Bank issued the authorization rules manage servants, Bank officials.
-Decision No. 363/QD-NH9 on 31/12/1996 of the Governor of the State Bank on the issuance of regulations on the management and training of public servants in the State banking system.
Article 3. Office Manager, Director of personnel and training, the heads of the units of the State Bank, Director of the State Bank branch, central cities, Chairman of the Board, General Director of the State-owned commercial bank, Gold Corporation Vietnam , Director of the plant, the companies State Bank is responsible for the implementation of this decision.
 

 



STATE BANK GOVERNOR Le Duc Thuy (signed) BYLAW OFFICERS, PUBLIC OFFICIALS, STATE BANK OFFICER (attached to decision No 61/2000/QD-NHNN9 on Feb. 23, 2000 by Governor State Bank) chapter I GENERAL PROVISIONS section 1 article 1 objects. The object of this regulation is to apply public bank officials, who are recruited, appointed or hold a regular public service, public servants are classified A, B, C, D according to the level of training, specialization, one administrative, careers in payroll and paid from salary Fund of the State Bank.
Article 2. Some objects are applied each section of these rules are: 1-the people who work at the Bank under labor contracts regimen (the officer).
2-employees working in the banking business.
Article 3. The State Bank of servants are classified as follows: 1-classification by level of training: a) the servant class A is the servant of qualified professional training from undergraduate upwards fits the job duties;
b) category B officer is the servant of qualified professional training in College, professional school fits the job duties;
c) C is the type the servant of servants of professional training at the primary level;
d) type D are servants of servants of professional training in the ranks below the elementary level.
2-classified according to the location of the work include: a) servant leadership (management and Administration): enjoy leadership allowance;
b) professional officer.
Section 2 obligations, the right kind of officials and public servants of State Bank article 4. Officers, State Bank has the following obligations: 1-loyal to the State of the Socialist Republic of Vietnam; protect the safety, honour and national interests;

8-learning often raise the level; initiative, creativity, coordination in order to complete the task, the service delivered;

10-responsible before the law on the enforcement of duties, public service; public servants serving leaders are responsible for implementing the tasks of the public service, public servants jurisdiction under the provisions of the law;

Article 5. Officers, State Bank has the following benefits: 1-off every year according to the provisions of article 74, article 75, paragraph 2, paragraph 3 and article 76 Article 77, vacation holidays according to the provisions of article 73 and the private according to the provisions of article 78 of the Labour Code;
2-In case the reason was non-paid vacation after the consent of the head of the Agency, organization, use of public officers;

8-be taking comments, monitoring, test the operation of the Agency in accordance with the Government on the implementation of democracy in the activities of the Agency.
9-complaint, accusations, claims about the work of the Agency, organization or individual that is against the law for her to the Agency, the competent organization in accordance with the law;
10-Be the law and people protection when duty, public service;

Chapter II EMPLOYMENT article 7. Article 9. Organization of the examination.

Article 11.

Article 12. Article 21.

Article 31.

Article 35. Article 111.

Article 113. When the Disciplinary Council meeting must have the face of litigants. The case of the absence of the litigants must have good reason. If litigants absent twice when was summoned, the disciplinary board was still meeting to review and recommendation forms of discipline.
Time to process disciplined offense for a maximum of 3 months from the date of detection. Case the violation has the complexity takes time to investigate, verify, then may be extended but time limits do not exceed 6 months.
Article 114.
1-public servants be disciplined by reprimand, warning, then raising the wage level and appointed to the higher position to follow rules: limited revision lifting more 1 year; not appointed higher within at least 1 years since has decided to discipline.
2-since the disciplinary decision, after 12 months if the servant not re-offending and no offense to the level to the disciplinary bodies, competent unit decides to terminate effective discipline.
3-the layout position, folded back the salary scales (for those cases, lower turnover, lower ranks) by the review unit, decide or recommend competent to consider, decide each case specifically.
Article 115. The case of public officials disciplinary acts of corruption, the disciplined are made according to the provisions of the Ordinance against corruption and the other provisions of the law.
Article 116. Article 117.
1-public servants was enforced discipline, if it deems adequate shall not have the right to complain about the decision to discipline themselves to the Agency, the competent organizations under the provisions of the law on complaints and denunciation.
2-servant to compensate damage, if found themselves not yet satisfactorily then has the right to complain about compensation decisions for themselves to the Agency, the competent organization as determined by the law on complaints and denunciation.
3-the unit receives complaints of public servants must have the responsibility to consider and to answer litigants in the time limit prescribed by the law.
4-serving servants from Service captains and equivalent back down, was fired after complaining that still was fired then has the right to sue in administrative cases in administrative court under the provisions of the law.
Article 118. The records, documents relating to the disciplined and the decision to enforce the discipline must be stored in the profile of public servants.
Chapter VIII TERMS OF IMPLEMENTATION of Article 119. Director of personnel and training is responsible for guiding and organizing the implementation of this regulation.
Article 120.
1-the heads of the units belonging to State Bank is responsible for implementation of this regulation.
2-Chairman of the Board, General Director of the State-owned commercial banks, the total gold silver company, gem Vietnam, Director of the factory, the company organized the implementation of the relevant provisions with respect to the unit specified in this regulation.
Article 121. Unit and individual public servants, officers do not perform or improper implementation of the provisions of this Regulation shall subject the nature and degree of the violation will be disciplined or arrested save for criminal liability in accordance with the law, if the cause of damage to material compensation.
