A decision on plans to implement resolution No. 07/NQ-TW of the politics of international economic integration and action program of the Government of Vietnam trade agreement implementation-Usa _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ the MINISTER OF JUSTICE pursuant resolution No. 07/NQ-TW on November 27, 2001 of the Politburo about the international economic integration and decision No. 37/2002/QD-TTg dated 14/3/2002 of the Prime made resolution No. 07/NQ-TW on 27/11/2001;

Pursuant resolution No. 48/2001/QH10 on 28.11.2001 of the National Assembly on the ratification of the agreement between Vietnam and the SOCIALIST United States of commercial relations and decision No. 35/2002/QD-TTg dated 12/3/2002 by the Prime Minister on the Government's action program to make Vietnam trade agreement-United States;

Pursuant to Decree No. 38/CP of the Government on the 04.6.1993 function, the tasks, powers and organization of the Ministry of Justice;

Proposal of the Director General, international cooperation Department, Ministry of Justice.

Decision: article 1.-attached to the decision of the Ministry of Justice plans to implement resolution No. 07/NQ-TW on November 27, 2001 of the political integration of the international economy and the Government's action programme attached to decision No. 35/2002/QD-TTg dated 12/3/2002 of the Prime made Vietnam trade agreement-United States.

Article 2.-this decision with effect from the date of signing.

Article 3.-the Director of personnel and training, Director of international cooperation, Director of the civil law-economics, Director of the criminal law – administration, Rector of Hanoi University of law, Director of Field training for judicial positions and heads of the relevant units responsible for the implementation of this decision.

 

 PLANS to implement resolution No. 07/NQ-TW of the politics of international economic integration and action program of the Government that made Vietnam trade agreement-United States 1. The PURPOSE of the REQUEST, the action plan of the Ministry of Justice made resolution No. 07/NQ-TW of the politics of international economic integration and action program of the Government that made Vietnam trade agreement-United States (hereinafter referred to as the plan) should meet the following requirements and purposes : 1.1 this plan as the basis for other units in the justice sector, the judicial officer, officers from the central to local organization holds meaning, purpose, requirements of resolution No. 07/NQ-TW on international economic integration and the Government's action program to implement the agreement aimed to capture the advantages and difficulties from which strove to promote internal forces, patriotic traditions, ethnic cultural identity, make use of the advantages and the opportunity, overcome the difficulties and challenges in the process of implementing the agreement, serves the goals of economic and social development, industrialization and modernization of the country, maintaining sovereignty and independent SOCIALIST orientation.

1.2 Based on this plan, each unit in the judicial sector to urgently build specific plans of his unit, actively develop your activity to give the recommendations to modify, complement the legal text in the operating range of the unit yourself keep up the roadmap of international economic integration and the implementation of the Treaty in order to improve the legal system in Vietnam, in response to the country's development in the new period.

1.3 this plan also aims to create new impetus to the strengthening of the Organization, the system of judicial bodies, the organizational and Legal Affairs at the Ministry, industry, business, supplementary law agencies, training institutions, fostering judicial officials sources ..., contribute to the effective implementation of the tasks related to the judiciary in implementing resolution No. 07/ NQ-TW on November 27, 2001 of the Politburo about the international economic integration, resolution No. 48/2001/QH10 ratification of a trade agreement between Vietnam and the SOCIALIST REPUBLIC of the United States signed on 13/7/2000, decision No. 35/2002/QD-TTg on the action program of the Government that made Vietnam trade agreement-United States and decision No. 37/2002/QD-TTg on the main actions of the program Government implement resolution No. 07/NQ-TW says above.

2.2. Reviewing legal documents.

2.3. planning of building laws and ordinances

2.4. The formulation of laws strengthening the formulation of laws, amendments, supplements, issued the new legal text in the authority issued by the Ministry of Justice; improving the quality of feedback and evaluation of the draft legal text by other ministries prepared taking into account the agenda of international economic integration and the implementation of Vietnam's international commitments;

2.4.2-finalizing the draft decree amending and supplementing a number of articles of Decree 92/CP on the activities of foreign lawyers in Vietnam.

Need to get expert opinions on the compatibility of the draft decree with Vietnam's commitments on legal services. This work should be completed in the second quarter of 2002.

2.4.3-organization is set to discuss, research improve the provisions of the civil code, especially the "intellectual property rights and transfer of technology" to meet the requirement of commitment in Vietnam-Vietnam trade agreement.

2.4.4-build book "legal Handbook" on Vietnam's international commitments related to the international economic integration to use in performance appraisal, suggestions to build legal documents related to international economic integration.

2.5. The research work Delivered in legal Science Research Institute, in collaboration with the international cooperation Department conducted activities: collection of documents, lectures, articles, legal documents about the law of international trade, u.s. trade laws are directly related to the process of international economic integration and enforcement of the agreement , international treaties are the Treaty references to ensure the implementation of the agreement; the Organization of the thematic session laws, provides legal information, including the planned construction of the scientific research about the content of the agreement and the legal problems of serving the enforcement of the agreement.

This work needs to be done in 2002 and continue to be developed in the next year. In 2002 have reported initial situation overview the research work in this section.

2.6 training work-Put the content of resolution No. 07/NQ-TW about the international economic integration, content agreements and Vietnam's international commitments in the field of international economic integration into the law curriculum, study materials of training classes, fostering the law.
