The DECISION regarding authorisation for the Board of management of van Phong economic zone in Khanh Hoa province import and export activities in management and operation of commercial enterprises have invested abroad in the van Phong economic zone and industrial-Khanh Hoa province _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ the SECRETARY of COMMERCE pursuant to Decree No. 29/2004/ND-CP dated 16 January 2004 of the Government function duties, powers and organization of the Ministry of Commerce;
Base industrial regulation, export processing zones, high-tech zones attached to Decree No. 36/CP dated 24 April 1997 from the Government;
Pursuant to decision No. 998/QD-TTg dated 24 July 2006 by the Prime Minister on the establishment management of van Phong economic zone in Khanh Hoa province;
According to the proposal of the people's Committee of Khanh Hoa province in no. 5132/PPC on 1/9/2006, article 1 DECISION: authorization for the Board of management of van Phong economic zone in Khanh Hoa province (hereinafter referred to as the management) management of export-import operations and commercial activities for enterprises foreign investment and the business side on the basis of the contract business investment in the van Phong economic zone and industrial-Khanh Hoa province (hereinafter referred to as the enterprise with foreign capital).
Article 2: management plan review to import and manage the commercial activities of enterprises foreign investment according to the following: 1. Browse the import plan of the enterprise with foreign capital: 1.1-Browse the import plan and confirm the import machinery duty free , equipment, transport, construction materials, spare parts for fixed assets investments including the import by method of hire-purchase financing. The confirm import tax exemptions only made for the project to be granted the investment license before 1/1/2006.
1.2-Browse plans to temporarily import of machinery, equipment, transportation, rent of foreign countries, not yet in technology to cater for the operation of the business.
1.3-Browse the import plan materials, raw materials for manufacturing, business activity of the business.
2. Browse the liquidation of machinery, equipment, vehicles, supplies, raw materials of enterprises have invested abroad in accordance with circular No. 01/2005/TT-BTM on 06/01/2005 of the Ministry of Commerce.
3. Browse the imported product plans to combine with the export products of the enterprise with foreign investment.
Article 3: the sending authority quarterly commercial reports about the implementation of the export and import of the enterprise with foreign investment under the guidance of Ministry of Commerce circular No. 22/2000/TT-BTM on 15/12/2000 of the Ministry of Commerce.
Article 4: the Trade Ministry periodically inspecting the implementation of the provisions of the decision of this authorization in accordance with the law.
Article 5: the decision to this effect after 15 days from the date the report.
