Decree on the duties, powers and organization of the Government's border Committee the GOVERNMENT pursuant to the law on Government Organization, 30 September 1992;
To strengthen the management of the State border, the national territory, defend the sovereignty, rights and interests of the Socialist Republic of Vietnam on land, at sea, on air, the Islands and the continental shelf of Vietnam;
According to the proposal of the head of the Government's border Committee and Minister, head of the Organizing Committee of government officials;
 
DECREE: article 1. The Government's border Committee is the body in the Government, has the function of State management and in directing the work of the border, the national territory, determines the rights and sovereignty of Socialist Republic Vietnam on land, at sea, on air, the Islands and the continental shelf of Vietnam.
Article 2. The Government's border Committee has the following powers and duties: 1. To help the Government identify national boundaries, the seas and Vietnam continental shelf, determined the scope of sovereignty and the rights of Vietnam for the Islands, the waters, the seabed and airspace;
2. Research, advocates proposed signing, ratification of international treaties relevant to the issue of borders, the territory, the issue of managing the waters, airspace, continental shelf of Vietnam;
3. Chaired the drafting of planning national boundaries, defined the boundaries of exclusive economic zone and the continental shelf of Vietnam with the neighbouring countries concerned;
4. Guidance, direction and implementation of gender and the gender of demarcation on the basis of the Treaty planned national border signed between the Socialist Republic of Vietnam with the neighboring countries, chairing the drafting and submission to the Government regulation on the border with the neighbouring countries and the Organization of the Guide and make the border statute signed with the water;
5. the host Government and the drafting of policies and regulations on border management, the national territory, continental shelf waters and airspace to Vietnam Governments review and promulgation; self issued or relevant disciplines jointly issued within the scope of his authority the documents guiding the implementation of the provisions of the Government related to the management of the border, the national territory, the waters, the seabed and airspace Vietnam; monitor, check the implementation of the text;
6. check, track, general situation of dispute in land border areas, on the continental shelf, the sea, the Islands and the Sun to the Vietnam government projects to solve;
7. The Government of the processor or the processor instructions by the jurisdiction issues arise in the operations of local departments relating to sovereignty, the right of sovereignty and national interests on the Mainland, the Islands, on the waters, the continental shelf, as well as in the Sun of the Socialist Republic of Vietnam;
8. Cooperation with international organizations, within and outside the countries in the area of research, exchange of information, learning experiences, enhance the professional level of service for the management of the national territory, continental shelf waters, Islands and the Sun as well as the settlement of the disputes on the border , the territory, waters and continental shelf;
9. Ask the local industries and periodic reports, or each event on the State border management, the territory, the Islands, the sea, the continental shelf and the sky, at the same time providing the necessary documents of local and industry concerning the events that occurred at the border , the Islands, the waters, the continental shelf and over Vietnam to General Government reports or resolved under the authorization of the Prime Minister;
10. Fostering professional officials responsible for the management of the border, the national territory of professional expertise; organizational management, variable, the base material was delivered;
11. the Government's border Committee is the standing agency of the U.S. continental shelf research Vietnam by decision No. 205-CT on 28-5-1984, and is the permanent agency and the maid of the Steering Committee on issues relating to Sea and Changsha by decision No. 252-dated 671992.
Article 3. Organization of the Government's border Committee include: Service Central Vietnam border.
The western border (the border Vietnam Laos Cambodia Vietnam,).
Service (in charge of the issue of the sea, Islands, the continental shelf and the Sun).

The mission, the staffing of the unit by the Board due to the head of the Government's border Committee provisions 4. The Government's border Committee led by Chief Curator; help the prefect had the Deputy head. Head of Department is responsible to the Prime Minister about the whole of the work to be delivered, the Deputy Head of the Committee responsible to the Chief of mission is assigned. Head of Department, the Deputy head, the Deputy Head of the Board is appointed by the Prime Minister and dismissed.
Article 5. The establishment of the organization about the borders in some provinces and cities have coastal borders and by the head of the Government's border Committee, Minister, head of the Organizing Committee suggested Government officials and Prime Minister decide.

Article 6. This Decree replaces Decree No. 188-6-10-1975 and in force from the date of promulgation. The previous provisions contrary to this Decree are bãu.
Head of the Government's border Committee, Ministers, heads of ministerial agencies, government agencies, the Chairman of the people's committees of provinces and cities under central authority responsible for the implementation of this Decree.
