The DECREE stipulates the functions, duties, powers and organizational structure of the Ministry of health _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ the GOVERNMENT pursuant to the law on organization of the Government of 25 December 2001;

Article 2. Duties and powers of the Ministry of health are responsible for implementation of the duties and powers stipulated in Decree No. 86/2002/ND-CP dated 5 November 2002 of the Government functions, tasks, powers and organizational structure of ministries, ministerial agencies and those duties, the following specific powers : 1. The Government of the Prime Minister, the project of law, ordinances and draft legal text about the care and protection of people's health;
2. The Government of the Prime Minister, strategy, planning, long term plan, annual and five years in the field of health care and protect people's health and the important project of Ministry of health;
3. Issued under the authority of decisions, directives, circulars in the scope of the governance;
4. Steer, guide, check and responsible implementation of these legal texts, strategy, planning, planning and the national curriculum after being approved and other legal documents in the scope of management of the Ministry; advocacy, dissemination, legal education and information in the areas of health care and protect the health of the people;
5. Guide the ministries, ministerial agencies, government agencies and people's committees of provinces and cities under central on the implementation of the policy and guidelines, the provisions of the law related to health care activities and protect people's health.
6. About preventive medicine: a) The Prime Minister approves planning, technical divide the system of preventive medicine and quarantine system of border health;
b) regulated industry standards of technical expertise in the areas of: infectious diseases, non-infectious diseases, HIV/AIDS; injury, health school, labor health and occupational disease; community nutrition; about safe drinking water sanitation, running water; about vaccines and medical products; on the types of chemicals, antibacterial preparations, insects in the medical field; about wellness and health education on media; on the conditions of production, the vaccines business of medical products. DD) hosted, in cooperation with the ministries to the emergency, prevention and treatment of disaster victims in the disaster;
e) in coordination with the Finance Ministry and the Prime Minister decided to catalogue and organize the national reserve made national reserve of drugs, vaccines, biological and medical equipment;
f) Permanent Work in the field of HIV/AIDS of the National Commission for HIV/AIDS, prevention of vices drugs, prostitution.
7. About examination and treatment, rehabilitation: a) The Prime Minister of planning, consultation network technical divide, cure, rehabilitation, assessment (medical examiners, legal, mental health);

f) prescribing conditions, standard of practice examination and treatment. Unified management of the granting and revocation of the certificate of practice examination and treatment, qualified certificate of practice for examination and treatment privately, sell, set up, foreign investment under the provisions of the law;
In collaboration with the Ministry of culture and information in the regulation of advertising, information visit, healing, rehabilitation, medicine, food and medical equipment to affect human health;
g) specified categories: drugs, surgery, procedure, examination of subclinical paid for the compulsory health insurance, medical insurance for the poor and people with water when treatment.
Hosted, in cooperation with the Ministry of finance and the closing level frame regulations affecting the voluntary medical insurance.
8. About traditional medicine: a) prescribing measures to consolidate the network of medical services by traditional medicine, combining traditional medicine with modern medicine in the prevention, treatment, rehabilitation, training, scientific research and production of traditional medicine;
b) regulations the regulations of technical expertise, health by traditional medicine;
c) prescribing conditions, standard practice in traditional medicine. c) directing, instructing and examining the management of cosmetics that affect human health;
d) building national mail Pharmacy and Pharmacopoeia;
DD) in collaboration with the Ministry of culture and information in the prescribed information, advertising, about the drugs, vaccines, biological medical products and cosmetics directly affect human health;

e) uniformly manage the grant and revocation of the certificate of practice of private medicine, qualifying certificate for the practice facility of production, circulation, distribution of the drug.
10. food safety: a) issued under the authority of the standards of food safety and hygiene, the technical processes, ensure food safety and hygiene;
b the unified management of the grant) and revoked the certificate of standard food safety and hygiene;
c) is responsible for the direction, instruction, examining the implementation of the rules on food safety.
11. On equipment and medical works: a) the category rules, technical standards on equipment for the medical facility, the medical school, pharmacy and medical equipment;

c) appraisal under the authority of the project to build the medical work;
d) investment project decisions under the authority of the management;

12. On training medical personnel: a) directed the compilation of programs, curriculum and training medical personnel including content, professional instruction, technical colleges, high schools and local health content management program under the Ministry of education and training;

13. The organization and steer the implementation plan of scientific research, scientific research, application of technology in the fields of medicine, pharmacy and medical equipment;
14. Implementation of the international cooperation in the field of health care and protect people's health according to the provisions of the law;
15. The evaluation and checking the implementation of investment projects in the field of the management of the Ministry in accordance with the law;

Article 4.
