The DECREE stipulates the functions, duties, powers and organizational structure of the Ministry of culture-information _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ the GOVERNMENT pursuant to the law on organization of the Government of 25 December 2001;
Pursuant resolution No. 2/2002/QH11 on 05 August 2002 of the National Assembly of the Socialist Republic of Vietnam, the POKER session key for the regulations and ministerial agencies of Government;

According to the recommendation of the Minister of culture and information and the Minister of the Interior, the DECREE: article 1. The position and function of the Ministry of culture-information is the Government agency which performs management functions of State for culture, information includes: cultural heritage, performing arts, cinema, art, exhibition, photography, journalism, publishing, copyrights for works of literature-arts , library, mass culture, advertising, stock information; governance of public services and make the owner representatives the State's stake in State enterprises in the fields of culture, information under the provisions of the law.
Article 2. Duties and powers of the Ministry of culture and information, is responsible for implementation of the tasks and powers under the provisions of Decree No. 86/2002/ND-CP dated 5 November 2002 of the Government functions, tasks, powers and organizational structure of ministries, ministerial-level agencies and the mission , the following specific rights: 1. The Government of the Prime Minister, the project of law, ordinances and draft legal text of the State management sector of the Department;
2. The Government, the Prime strategy, development planning, long term plan, annual and 5 year in the field of governance;
3. Promulgation of decisions, directives, circulars in the scope of the governance;
4. Steer, guide, test and is responsible for implementing the legal text, strategy, planning, plan, after being approved and other legal documents in the scope of management of the Ministry; advocacy, dissemination, legal education and information about the State management sector of the Department.
5. On the cultural heritage: a) The Prime Minister decided: planning network of museums; Organization and implementation guidelines after approval;

6. About the performing arts: a) The Prime planning units of the State on the performing arts; Organization and implementation guidelines after approval;

8. About fine art, photography, exhibition: a) issued regulations in art, photography, exhibitions;

9. About the press: a) The Prime press network planning in the country, the Office of the resident representative in the foreign press agencies of Vietnam;

10. About publishing: a) The Prime Minister plans to publish, print, book release; Organization and implementation guidelines after approval;
b) regulates the conditions of establishment and the business of publishing, printing, release the book prescribed by law;

d) licensed to publish publications is not intended for trading organizations and Vietnam and foreign organizations based in Vietnam under the rule of law; manage the publication and dissemination of the work to a foreign jurisdiction;

e) legal publications management and appraisal publications when necessary;

g) decided to suspend, revoke, confiscate, all circulation and destroy the publication violates the law;
h) appointed by the agreement, dismissal of the Director, Deputy Director, Editor, Deputy Editor and Publisher.
11. On copyright for literary, artistic works: Government Regulation) your preferred mode of royalties to the author, the owners of literary, art and instructions made after approval;

c) implementation of measures to protect the legal rights of the State, organizations, individuals in the field of copyright for literary, art;

DD) guide the copyright protection for literary, artistic works for the local branches, businesses, social organizations and citizens.

Article 4. Effective enforcement of this Decree has effect after 15 days from the date of public notice, replacing Decree No. 81/CP dated 8 November 1993 from the Government about the functions, duties, powers and organization of the Ministry of culture-information and regulations previously contrary to this Decree.
Article 5. Responsible for enforcement of the Minister of culture and information, the Ministers, heads of ministerial agencies, heads of government agencies and the President of the people's committees of provinces and cities under central authority responsible for the implementation of this Decree.
