The DECREE regulating the fire and forest fire _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ the GOVERNMENT pursuant to the law on organization of the Government of 25 December 2001;
Pursuant to the law on fire prevention and 29 June 2001;
Pursuant to the law to protect and develop forests on December 3, 2004;
Considering the recommendation of the Minister of public security, the Minister of agriculture and rural development, the DECREE: chapter I GENERAL PROVISIONS article 1. Scope of this Decree, regulations on fire, forest fire, armed forces organization means, funding, investment, policy regime for operating room fires and forest fire; the responsibility of the Government, agencies, institutions, households and individuals active in fire and forest fire.
Article 2. The object of applying bodies, institutions, households and individuals work, live on the territory of the Socialist Republic of Vietnam to comply with the provisions of this Decree; in the case of international treaties to which Vietnam is a member have other regulations shall apply under the provisions of international treaties.
For the plant, industrial, warehouse, House and other facilities built in the forest, forest, in addition to follow this decree must now implement the provisions of Decree No. 35/2003/ND-CP dated April 4, 2003 detailing the Government's implementation of some articles of the law on fire and fire (here referred to as Decree No. 35/2003/ND-CP) and the other provisions of the State on fire and fire.
Article 3. Article 5. Article 14. Investment funds for the Fire Department and fire in forest planting projects 1. b) funding for the project, the design, the construction, the jurors, trials of fire and fire;
c) funding for the work of the fire mission execution and forest fire until the end of the project.

Article 16. Check the safety of fire and forest fire 1. 3. Article 17. Temporarily suspended the activities when violating regulations on fire and forest fire 1. The Agency's activities, organization, facilities, motor transport, households and individuals in the forest, the forest is temporarily suspended in the following cases: a) The works are not allowed to use or cause fire sources, sources which directly risk incurred a forest fire;
b) activities generate hazardous fires in the Woods, the forest such as leakage of petroleum, natural gas or other dangerous substances about fires and other activities that use fire, heat sources, using the instruments, means to arise in case sparks appear hazardous fire;
c) activities are permitted to use fire in the forest, the forest but appears the elements and uncontrolled conditions can result in the risk of forest fires;
d) has dealt with the administration of the fire and forest fire but still no fix, fix.
2. When the risk of forest fires are specified in point a, b, c paragraph 1 excluded or in breach of fire and forest fire are specified in point d of paragraph 1 are remedied, the repair shall be recovered back.
The case of expiry of temporary suspension of works out that the risk incurred a forest fire has not yet been excluded or administrative violations of fire and forest fire not yet fix, fix, extend the temporary suspension of operations.
3. The temporary suspension of the operation of the agencies, organizations, foundations, motor transport, households and individuals stipulated in paragraph 1 of this article is limited only in the smallest scope as defined in clause 2 article 20 of Decree 35/2003/ND-CP. 4. The time limit for temporary suspension of operations, extension of temporary suspension of activity and the recovery operation for the cases specified in paragraph 1 of this article is made according to the provisions in clause 3 and clause 5 article 20 of Decree No. 35/2003/ND-CP.
5. The authority to temporarily suspend operations, extend the temporary suspension of operations and recovery operations for the cases specified in paragraph 1 of this article are those that have been prescribed in clause 6 article 20 of Decree No. 35/2003/ND-CP.
In addition to the above authorities, the following people in the State administration of forestry has the authority to temporarily suspend operations, extend the temporary suspension of operations and recovery operations for the cases specified in paragraph 1 of this article and in the following range: a) the Minister of agriculture and rural development or the person authorized is entitled to decide suspension from work on nationwide;

c) when Rangers discovered cases are at risk of directly causing forest fires is entitled to temporarily suspend operations, and must promptly report to direct superior authority.
6. The Ministry of agriculture and rural development, in coordination with the Ministry of public security manual procedures to temporarily suspend operations, extension of temporary suspension of activity and active recovery back to the case prescribed in clause 1 of this article and issued the form "decided to temporarily suspend operations" , "The decision to extend the suspension of operation", "active recovery decisions back".
7. The persons specified in clause 5 of this when a decision to temporarily suspend operations, decided to extend the suspension of operation, decided to recover active again, and sent to the people's Committee and the fire police agencies and fire.
Article 18. Suspended the activities when not ensure safety of fire and forest fire 1. Chapter III article 19 FOREST FIRE. Article 22. The mobilization forces, means and assets to forest fire 1. The authority to mobilize forces, means and assets to forest fire are made according to the provisions of article 25 of Decree No. 35/2003/ND-CP DATED. 2. The mobilization of priority vehicles, and vehicles of the army, of international organizations, institutions and individuals in Vietnam to join the forest fire is made according to the provisions of article 24 of Decree No. 35/2003/ND-CP.
Article 23. The Commander who commanded the forest fire forest fire is made according to the provisions of paragraph 1 and point d, e clause 2 Article 37 fire Laws and fire.

Chapter IV ORGANIZATION and ARMED FORCES MEANS FIRE and FOREST FIRE article 25. Organization, fire force management and forest fire 1. Article 26. Training, professional training, fire prevention and fire forces and forest fire training contents, expert training, fire prevention and fire forces and forest fires made in accordance with paragraph 1 Article 34 of Decree No. 35/2003/ND-CP. Article 27. Equipped vehicles fire and forest fire 1. b) equipped with the means of fire and forest fire;
c) training, fostering knowledge-enhanced fire and forest fire;
d) application of scientific and technological advances into the operating room fires and forest fires.
2. the State encourages the study of production, Assembly, export, import the media fire and forest fire.
3. the authorities, institutions and individuals to produce, assemble and fire extinguishing means of forest in the country, export, import the media fire and forest fire to enjoy preferential policies on taxation under the provisions of the State.
