ORDINANCE on entry, exit, residence of foreigners in Vietnam in order to contribute to the implementation of the State policy on development of relations of friendship and cooperation with foreign countries and safeguarding the interests of national sovereignty;
Pursuant to the Constitution of the Socialist Republic of Vietnam in 1992;
Based on the resolutions of the National Assembly session, 6 X on the program of building laws and ordinances in 2000;
This Ordinance regulates the entry, exit, residence of foreigners in Vietnam.
Chapter I GENERAL PROVISIONS Article 1 1. The State of the Socialist Republic of Vietnam to create favorable conditions for the entry, exit, transit of foreigners; protection of life, property, rights and legitimate interests of foreigners residing in Vietnam on the basis of the law of Vietnam and the international treaties to which the Socialist Republic of Vietnam signed or joined.
2. Alien entry, exit, transit, residence in Vietnam to comply with the law of Vietnam and respect for the traditions, the customs, the customs of the people of Vietnam. Prohibits using the entry, exit, transit, residence in Vietnam to violate the law.
3. In the case of international treaties to which the Socialist Republic of Vietnam signed or have regulations on the entry, exit, transit, residence of foreigners in Vietnam other than the provisions of this Ordinance, shall apply to the provisions of international treaties.
Article 2 1. The Agency, organization, agency, Vietnam foreign organizations and international organizations located in Vietnam, Vietnam citizens and foreigners legally resident in Vietnam are inviting foreigners in Vietnam.
2. The Agency, organization, personal invite foreigners in Vietnam are responsible to ensure the purpose of the entry of foreigners; financial guarantees and to collaborate with the State authorities to resolve the problems arising with regard to foreigners.
Article 3 Of this directive, the terms below are interpreted as follows: 1. "alien" is a person who has no nationality Vietnam;
2. "resident alien" is alien-residents, business, long live in Vietnam;
3. "foreigners staying" is alien-residents have limited time in Vietnam;
4. "entry" is on the territory of Vietnam through the international border gate of Vietnam;
5. "exit" is out of the territory of Vietnam through the international border gate of Vietnam;
6. "transit" is passing through the area transit in international border gate of Vietnam.
Chapter II ENTRY, exit, TRANSIT Article 4 1. Alien entry, exit must have passports or valuable papers instead of the Passport (hereinafter referred to as passport) and to have a visa by the competent State agencies of Vietnam granted, unless visa-free.
2. Foreigners do Vietnam visa procedures at the Immigration Agency under the Ministry of public security, the Consular Department of the Ministry of Foreign Affairs, diplomatic missions, consular agency of Vietnam abroad.
Visa application are answered within no more than 5 working days from the date of receiving documents.
3. People under the age of 14 has been declared in the application for the visa of escorts, does not have to do private visa procedures.
Article 5 1. Agencies, organizations, individuals invite foreigners in Vietnam posted the text proposed to the Immigration Agency under the Ministry of public security or the Consular Department of the Ministry of Foreign Affairs.
2. the proposed text was answered within a period not exceeding five working days from the date of receiving the text.
Article 6 1. Foreigners who apply for entry visa at Vietnam's international border gate in the following cases: a) on the funeral, relatives visiting relatives are seriously ill;
b) comes from the water do not have diplomatic representations, consular agency of Vietnam;
c) on tourism under the program by the international businesses of Vietnam held;
d) On emergency technical support for the project; emergency seriously ill, who suffer accidents; disaster rescue, disease in Vietnam;
DD) other emergency reasons.
2. Immigration Agency under the Ministry of public security made the grant of the visa provided for in paragraph 1 of this article.
Article 7 1. Vietnam visa (hereafter called the visa) worth of entry, exit through the international border gate of Vietnam.
2. include the following types of visa: a) the visa once valuable, used once within a period not exceeding 12 months;
b) visas several times, using multiple times within a period not exceeding 12 months.
3. The visa was not renewed.
The visa was granted to foreigners who may be cancelled if in one of the cases provided for in article 8 and article 9 of this Ordinance.
Article 8 1. The competent State agencies of Vietnam has not entry for foreigners, if in one of the following cases: a) are not eligible as defined in paragraph 1 of article 4 of this Ordinance;
b) forged papers, deliberately false declaration upon entry, please;
c) for reasons of disease prevention;
d) serious breach of the law of Vietnam in the previous entry;
DD) for reasons of national security, other special reason according to the decision of the Minister of public safety. 2. The Minister of public safety review, the decision for foreigners in the case prescribed in clause 1 of this entry.
Article 9 1. Foreigners may be postponed if the exit in one of the following cases: a) are under criminal liability or prejudice is a defendant in the civil dispute, the economy, labor;
b) Are obliged to enforce the criminal judgment;
c) Are obliged to enforce civil judgments, economy, labour;
d) Are obliged to accept the decision sanctioning administrative violations, tax obligations and other financial obligations.
2. The cases stipulated in points c and d paragraph 1 of this article, if there is a guarantee by the money, property or other measures to ensure the implementation of obligations under the rules of the law of Vietnam, is the exit.
3. the investigating agency, Procurator, Court, court enforcement agencies from the central cities, or more competent to decide to postpone the exit in cases stipulated in points a, b and c of paragraph 1 of this article.
The Agency has the authority to postpone the exit clearance decision to postpone the exit when no longer required postponed exit. 4. The Minister of public security decided to postpone the exit for foreigners in cases specified in point d of paragraph 1 of this article as suggested by Ministers, heads of ministerial agencies, heads of government agencies, the Chairman of the provincial people's Committee, the central cities.
5. The decision to postpone the exit, people suggest postponed exit contrary to the provisions of this Ordinance, if the physical damage caused to the person being postponed, then exit right to compensation under the provisions of the law.
Article 10 Who are visa-free transit; If the combined demand on sightseeing, travel Vietnam, then be Immigration Agency under the Ministry of public security to resolve according to the regulations issued by the Ministry of public security.
Chapter III RESIDENCE Article 11 1. Foreigners must register the purpose of entry, time limit and residential address in Vietnam and must function properly registered purpose.
2. Foreigners who are not domiciled in the area banned foreigners reside.
Article 12

The foreigner was walking freely on the territory of Vietnam consistent with the purpose of entry was registered, except in zone to foreigners go back; If want to zone, must be allowed by the competent State agencies of Vietnam area manager.
Article 13 1. Foreigners are staying in Vietnam in one of the following cases are reviewed, settle for permanent residence: a) is the struggle for freedom and national independence, as a Socialist, because democracy and peace, or for the cause of science that were persecuted;
b) Have contribution for building and protecting the country Vietnam;
c) is the spouse, child, father, mother of citizens resident in Vietnam Vietnam.
2. Foreigners resident, please check in at the Immigration Agency under the Ministry of public security. Article 14 1. Resident aliens are the Immigration Agency has the authority under the Ministry of public security issued permanent Cards. Resident cardholders be visa-free entry, when exiting.
2. resident alien must show an and resident card with the Immigration Agency under the Ministry of public security authority periodically 3 years; If permanent change of address or other registered content must check in at the card.
3. resident alien must declare staying with the Immigration Agency has the authority under the Ministry of public security if the night out registered permanent address.
4. resident card withdrawal or cancellation of the card when the person being granted settlement in another country or deported.
Article 15 1. Foreigners are staying in Vietnam is suitable for the purpose, duration and registered address.
2. Certification of sojourn was the Immigration Agency has the authority under the Ministry of public security issued to foreigners at the gate of Vietnam. The time limit for staying consistent with the time limit granted values of the visa.
Certificate of staying level may have been destroyed or severely shorten the time limit in the case of people granted Vietnam law violations or not staying consistent with the stated purpose of registration.
Foreigners staying must declare staying with the Immigration Agency has the authority under the Ministry of public security; If requested, Supplement, modify, extend or convert the purpose of staying signed to do the procedure at the Immigration Agency under the Ministry of public security. 3. Foreigners staying from 1 year upwards are the Immigration Agency has the authority under the Ministry of public security issued card. Card term from 1 year to 3 years. The card is visa-free exit and entry within the value of the card.
4. Foreigners are entitled to preferential rights, diplomatic immunity, consular procedures level, supplemented, modified, extended stay, temporary resident Card issued in the Foreign Ministry.
5. The review level, Supplement, modify the visa; card level, extend a temporary stay is made within a period not exceeding five working days from the date of receiving documents.
Chapter IV EXPULSION Article 16 1. Foreigners were expelled from Vietnam in the following cases: a) to the competent courts of Vietnam sanctions expulsion;
b) Was the Minister of public security decision to expel.
2. The expulsion of aliens are entitled to the privileges, immunities, foreign consulates are resolved by diplomacy.
Article 17 1. The Immigration Agency under the Ministry of public security is responsible for enforcement of the judgment and the decision to expel.
2. The judgment and the decision to expel should be the Immigration Agency under the Ministry of public security delivered to the deportees at the latest 24 hours before the execution.
3. In the case of deportees involuntarily Executive judgment or decision on deportation, the Immigration Agency under the Ministry of public security to apply coercive measures to expel.
Chapter V the STATE MANAGEMENT on ENTRY, exit, RESIDENCE of FOREIGNERS in VIETNAM Article 18 content of State management in the field of the entry, exit, residence of foreigners in Vietnam including: 1. The promulgation of the legal text;
2. Signing, joining international treaties;
3. Perform the operations management of entry, exit, transit, residence;
4. State statistics;
5. International cooperation;
6. Monitoring, inspection, test, handle breaking the law.
Article 19 1. The unified Government to manage state on the entry, exit, residence of foreigners in Vietnam.
The Ministry of public security is responsible for presiding over the Government implement state management on entry, exit, residence of foreigners in Vietnam.
2. The Government issued regulation coordination between ministries, ministerial agencies, government agencies; regulations of the people's Committee of responsibility levels in the management of the State on the entry, exit, residence of foreigners in Vietnam.
Article 20 diplomatic missions, Consulate of Vietnam in foreign grant, modify, Supplement, cancel the visas abroad.
Article 21 ministries, ministerial agencies, government agencies, provincial people's Committee, the central cities in the scope of the task, their powers are responsible for implementing State management on entry, exit, residence of foreigners in Vietnam.
Chapter VI HANDLING of breach of article 22 1. The person who violates the provisions of this Ordinance, then depending on the nature and extent of the violation which dealt with administratively or prejudice criminal liability; If the damage is compensated according to the provisions of the law.
2. The person who would take advantage of the Office, the powers in violation of the provisions of this Ordinance, then depending on the nature and extent of the violation being disciplined or suffer prejudice criminal liability; If the damage is compensated according to the provisions of the law.
Article 23 The appeal the administrative decision, denouncing violations of the law in the field of the entry, exit, residence of foreigners in Vietnam are made according to the provisions of the law on complaints and denunciation.
Chapter VII ENFORCEMENT PROVISIONS article 24 of this Ordinance also apply to the Vietnam bring foreign passport for entry, exit, transit, residence in Vietnam.
Article 25 of this Ordinance with effect from 1 August 2000.
This Ordinance replaced the Ordinance on entry, exit, residence, travel of foreigners in Vietnam on 21 February 1992.
The previous provisions contrary to this Ordinance are repealed.
