LAW on ORGANIZATION of PEOPLE'S COUNCILS and PEOPLE'S COMMITTEES pursuant to the Constitution of the Socialist Republic of Vietnam in 1992 was amended and supplemented by resolution No. 51/2001/QH10 on 25 December 2001 of the Xth Congress, session 10;
This law regulates the Organization and operation of people's councils and people's committees.
Chapter I GENERAL PROVISIONS article 1 the people's Council is the organ of State power in the local, which represents the will, aspirations and the mastery of the people, by the people elected local, responsible to local and State agencies.
The people's Council to decide the important measures and guidelines to promote the potential of the local, local development and construction of social-economic, strengthened defense, security, constantly improve the material and spiritual life of the local people, rounding up local's obligation for the country.

The people's Committee is responsible for observance of the Constitution, the law, the text of the State bodies and the resolution of the Assembly of the people of the same level to ensure implementation, measures for socio-economic development, strengthen national defense, security and other policies implemented on the area.
The people's Committee to implement state management functionality locally, helping to ensure the consistent management of the State administrative apparatus from central to the base.
Article 3 the people's Council and people's Committee organizes and operates according to the principle of democratic concentration.

Article 4 1. The people's Council and people's Committee was held in the following divisions: a) The directly governed City (provincial level);
b) District, district, town, city in the province (district level);
c) communes, wards and towns (known collectively as the social level).

Article 8 the performance of the people's Assembly is guaranteed by the efficiency of the people's Council session, the performance of the people's Council, the people's Committee, the people's Council and Committee of Council of people's deputies.

6. Decides to assess the management, development and use of local human resources;
7. Decide to practice saving measures, waste prevention, fight against corruption, the fight against smuggling and trade fraud.
Article 12 in the areas of education, health, social, cultural, information, sport, provincial councils perform these tasks, the following powers:

1. Decisions undertakings, measures of education, career development and training; planning decision, plans to develop the network of preschool education, general education, vocational education; ensure the facilities and conditions for educational activities, local training;
2. Decisions undertakings, measures to develop cultural, career information, sport; safeguards, promote the value of local heritage; measures to ensure the facilities and conditions for cultural activities, information, local sports according to the rule of law;
3. Decisions undertakings, measures to develop human resources, employers, jobs and improve working conditions, living of workers, labor protection; perform residential distribution and improve local people's lives;
4. Decide on measures of education, protection, youth care, youth and children; building the civilized lifestyle, culture and family; the traditional ethical education, preserving the customs of the peoples; measures to prevent the spread of culture products, depraved, superstitious, except rice, and the prevention of social evils, the unhealthy expression in local social life;
5. The decision of the planning, network development plan examination and treatment; measures to protect people's health, protection and care of the elderly, the disabled, orphans are not helpless; protection, care of mothers, children; implementation of population policy and family planning; disease prevention and local health development;
6. The decision to implement the policy measures, the preferential regime for the wounded, the sick, the family of martyrs, the people and the families with water; a policy of social insurance, social relief and poverty, and poverty reduction.
Article 13 in the fields of science, technology, natural resources and environment, provincial councils perform these tasks, the following powers: 1. Decisions undertakings, measures to encourage research, promote technical innovations, the application of scientific and technological progress to develop production business and life of the local people;
2. Decide the measures of management and use of land, mountains, rivers, water resources, soil resources, resources in local waters in accordance with the law;
3. Decide on measures to protect the environment; Prevention and remedy the consequences of natural disasters, hurricanes, environmental degradation, environmental pollution, the local environment issues as prescribed by law;
4. The decision of the measures implementing the provisions of the law of standards and product quality; prevent the production and circulation of counterfeit goods, the poor quality locally, protect the interests of consumers.
Article 14 in the fields of Defense, security, safety, social order, people's Council to implement these tasks, the following powers: 1. To decide measures to perform tasks associated with security, Defense economics, economics with defense, security and made the task of building the reserve mobilization in local;
2. Decide on measures to ensure security and order, social security, the prevention, fight crime and other violations of the law in other provinces.
Article 15 In the implementation of the policy of ethnic and religious policy, the people's Council has the following powers, duties: 1. To decide measures to implement national policies to improve the material and spiritual life, raising the population of fellow of the minorities, ensuring equal rights between peoples , enhance citizen solidarity and mutual help, solidarity between the local peoples;

Article 16 in the field of law enforcement, provincial councils perform these tasks, the following powers: 1. to decide on measures to ensure the enforcement of the Constitution, the law, the text of the State bodies and their local resolution;
2. The decision of the measures of protection to life, freedom, honor, dignity, rights and legitimate interests of other citizens;
3. Decide on measures to protect the property, interests of the State; property protection of organs, organizations and individuals in the locality;
4. Decide on measures to ensure the settlement of complaints, accusations of citizens in accordance with the law.
Article 17 in the area of the local government building and managing the administrative boundary, the people's Council, the implementation of these tasks, the following powers: 1. Election, resignation and recall the Chairman, Vice Chairman, Commissioners, Council President, Vice-President and other members of the people's Committee , Head and other members of the Board of the people's Council, the people's assessors of the people's courts of the same level; recall of Deputies and councils accept the peoples Council deputies resign delegates duty prescribed by law;
2. Vote of confidence for people held by the people's Council election;
3. Approve the structure of the specialized agencies in the provincial people's committees, district level; establishment, merger, dissolution of some specialized agencies in the people's committees of the same level under the guidance of the Government;
4. The decision of the local career payroll matching development requirements and the ability of local budgets; through the total payrolls of local administration before the competent decision;

7. Removal of part or the entire decision, the directive against the law of the people's committees at the same levels, resolutions against the law of the people's Councils at district level;
8. The dissolution of the people's Councils at district level in the case of the people's Council which do serious damage to the interests of the people, the Committee on the National Assembly to ratify before implementation;
9. Approve resolutions of the people's Councils at district level about the dissolution of the people's Council levels.
Article 18 city councils centrally performed those duties and powers prescribed in articles 11, 12, 13, 14, 15, 16 and 17 of this Act and perform these tasks, the following powers: 1. to decide on measures to promote the role of social-economic center of the municipality in relation with the local Department regional and country, according to the hierarchy of the Government;

Section 2 the DUTIES and powers of the PEOPLE'S COUNCILS at DISTRICT LEVEL in the economic area article 19, district councils perform these tasks, the following powers:

Article 20 in the areas of education, health, culture, information, sport, and social life, the district councils perform these tasks, the following powers: 1. To decide the measures and conditions necessary to build and develop the network of preschool education, general education on the area under overall planning;
2. Decide the measures ensuring the facilities, to develop cultural, career information, local sports;
3. Decide on measures for preserving, restoration, preservation and promotion of the value of works of art, culture, historical monuments-sightseeings and culture according to the hierarchy;
4. Decide on measures for prevention of social evils in the locality;
5. decision on protective measures, wellness, prevention of disease; care of the elderly, the disabled, orphans are not helpless; protection, care of mothers, children; implementation of population policy and family planning;
6. decision on measures to implement preferential policies for the wounded, the sick, the family of martyrs, the people and the families with water; measures to implement the policy of protection of labour, social insurance, social relief, poverty, and poverty reduction.
Article 21 in the fields of science, technology, natural resources and environment, the district councils perform these tasks, the following powers: 1. Article 22 in the field of Defense, security, safety, social order, district councils perform these tasks, the following powers: 1. To decide measures to carry out the task of building the people's armed forces and civil defence; ensure the implementation of the regime of military service, building the reserve mobilization, Logistics mission, military rearguard policy and policy towards the people's armed forces in the locality; measures associated with security, Defense economics, economics with defense, security;
2. The decision of the measures taken the task of maintaining security, order, social security; measures to fight the prevention, fight crime and other violations of the law in the other provinces.
Article 23 In the implementation of the policy of ethnic and religious policy, the District Councils have the task, the following powers: 1. To decide the tasks performed, the economic-development project of the society for the ethnic minorities, remote areas and difficult areas;
2. Decide on measures to ensure the implementation of ethnic policies, religious policy under the provisions of the law.
Article 24 in the area of law enforcement, district councils perform these tasks, the following powers: 1. to decide on measures to ensure the enforcement of the Constitution, the law, the text of the State bodies and their local resolution;
2. The decision of the measures of protection to life, freedom, honor, dignity, rights and legitimate interests of other citizens;
3. Decide on measures to protect the property, interests of the State; protection of the assets of the Agency, organization, local individual;
4. Decide on measures to ensure the settlement of complaints, accusations of citizens in accordance with the law.
Article 25 in the field to build the local government and the management of administrative boundaries, the district councils perform these tasks, the following powers: 1. Election, resignation and recall the Chairman, Vice Chairman, Commissioners, Council President, Vice-President and other members of the people's Committee , Head and other members of the Board of the people's Council, the people's assessors of the people's courts of the same level; recall of Deputies and councils accept the peoples Council deputies resign delegates duty prescribed by law;

Article 26 district councils perform those duties and powers specified in articles 19, 20, 21, 22, 23, 24 and 25 of this Act and perform these tasks, the following powers: 1. to decide on measures to ensure the uniform implementation of the plan for socio-economic development and urban planning of the city;
2. Decide the measures ensuring public order, traffic; fire, explosion prevention and protection of the environment, the urban landscape;
3. measures decided municipalities population management and the Organization of local people's life.
Article 27 the town councils, the city in the implementation of the duties and powers provided for in articles 19, 20, 21, 22, 23, 24 and 25 of this Act and perform these tasks, the following powers: 1. Through overall planning on building and development of the town in the cities, on the basis of overall planning of the province to the people's Committee of the supervisor;
2. Decide the plan of building the technical infrastructure of the municipality of the town, a city in the province;
3. Decide on measures to ensure public order, traffic, fire, explosion prevention and protection of the environment, the urban landscape of the towns and cities in the province;
4. decision management populations municipality and the Organization of local people's life.
Article 28 of the District Councils in Islands perform those duties and powers specified in articles 19, 20, 21, 22, 23, 24 and 25 of this Act and perform these tasks, the following powers:

1. Decide on measures to build, manage, protect the island, the waters in accordance with the law;
2. Decide on the measures to manage the population and the Organization of local people's life;
3. Perform the duties, other rights prescribed by law.
Section 3 DUTIES and powers of the PEOPLE'S COUNCIL of SOCIAL economy in the field of 29 Articles, Town Council, the implementation of these tasks, the following powers: 1. to decide on measures to implement the economic development plan-annual society; employer plan annual public interest; measures to make agricultural extension programs, forestry, fisheries, promotion of industry and economic structure transformation, crops, livestock according to overall planning;
2. The decision of State budget revenue estimates; estimated local budget expenditure, revenue and budget estimation allocation levels; approval of local budget settlement; the advocates, measures to implement the local budget and the adjusted estimation of local budgets in accordance with the law; monitoring of the implementation of the budget was the people's Council decision;

4. Decide on the measures of construction and development of cooperatives, economic cooperation, local households;

6. The decision of the measures taken to build, repair of roads, bridges, drains in the town and the other infrastructure in localities;

Article 30 in the areas of education, health, and social life, culture, sports, information, resources, environment protection, communal councils, the implementation of these tasks, the following powers: 1. to decide on measures to ensure the necessary conditions for the children in the elementary school right age the complete program, universal primary education; the Organization of kindergartens; implementation of additional cultural and literacy for people in this age;
2. Decide on measures of education, youth, youth care, Pediatric; building the civilized lifestyle, family, culture, traditional moral education; preserving the customs of the peoples; prevent spreading product culture, depraved, superstitious, except rice, prevention of social evils in the locality;
3. Decide on measures to develop cultural activities, art, physical education; the guide organizes traditional festivals, the protection and promotion of the value of historical-cultural and local attractions as prescribed by law;
4. The decision of building, remodeling, works in local cultural management;
5. Decides to ensure measures to preserve sanitation, waste disposal, disease prevention, environmental protection measures within the scope of management; the measure made medical facility programs, population policy and family planning;
6. The decision to implement the policy measures, the regime for the wounded, the sick, the family of martyrs, the people and the family with the water, the relief society and people's stadium to help families in difficulty, the elderly, the disabled, orphans are not helpless; implementation measures poverty, and poverty reduction.
Article 31 in the fields of Defense, security, safety, social order, social people's Council, the implementation of these tasks, the following powers: 1. to decide on measures to ensure the implementation of the regime of military service; building the army, defense and civil defense; the task of logistics in place; a policy of military policy and the rearguard for the people in the armed forces;

2. The decision of the measures of protection to life, freedom, honor, dignity, rights and legitimate interests of other citizens;
3. Decide on measures to protect the property, interests of the State; protection of the assets of the Agency, organization, local individual;
4. Decide on measures to ensure the settlement of complaints, accusations of citizens in accordance with the law.
Article 34 In the construction of local government councils, town, commune and perform these tasks, the following powers: 1. Election, resignation and recall the Chairman, Vice Chairman of the people's Council, the President, Vice-President and other members of the people's committees at the same level; recall of Deputies and councils accept the peoples Council deputies resign delegates duty prescribed by law;
2. Vote of confidence for people held by the people's Council election;

3. decision management populations and the Organization of local people's life.
Section 4 REPRESENTATION Article 36 COUNCILS the people's Council of delegates who represent the will, aspirations of local people, exemplary Executive policy, the laws of the State; advocacy, lobbying, policy people and participate in the management of the State.
Article 37 of the peoples Council deputies each tags start from the first session of the Assembly of the people that come to the session of the people's Council the following key.

Article 38

Deputies to the people's Council has a duty to attend the session, the session of the people's Council, join the discussion and vote on the issue in the tasks and powers of the people's Council.

Article 39 deputies to the people's Council to close contact with voters in the Unit elected, subject to the supervision of the voters, have the responsibility to collect and reflect the honest opinions, aspirations, recommendations of the voter; protect the legitimate rights and interests of the voters; exposure mode and done at least once a year to report on the operation of his constituency and that of the Council, answered the request and recommendations of the voters.
After each session the people's Council, deputies to the people's councils are responsible for reporting to the voters of the outcome of the session, and the common interpretation of the resolutions of the Council, and with the people implementing the resolutions.
Article 40 the Council of people's Deputies received requests, recommendations of the electorate must have a responsibility to answer to voters.
Upon receiving complaints, denunciations of the people, the people's Council is responsible for the research, promptly moved to who has the authority to resolve, track, urging the settlement; at the same time notify the complainant, the report said.
Within the time limit prescribed by law, the person who has the authority to consider, resolve and notified in writing to the Council the people knew the results.
Article 41 delegates to the people's Council has the right to questions people's Council Chairman, President and other members of the people's Committee, the Chief Justice's courts, the people's Procuratorate chiefs and heads of specialized agencies in the people's committees at the same level. The person to be questioned must answer about the problems that the people's Council.
During the Council meeting, the people's Council sent questions to the people standing at the same level. The person being questioned must answer before the Council at that session. In case of need to investigate, verify, then the Council can decide to reply at the following meeting of the Council or for the written reply sent to delegates were questioned and the people's Council.
In the time between the two people's Assembly session, questions in the Council of representatives are sent to the people's Council the same level to turn to the person to be questioned and decided the time limit to answer questions.
Article 42 delegates to the people's Council has the right to request state authorities, organizations, social organizations, people's armed units to promptly terminate the unlawful employment, the State's policy in the Agency, organization, or unit of officers, civil servants, personnel agencies , organization, unit.
When Deputies asked councils to meet the person in charge of the State bodies, organizations, social organizations, people's armed units, that person is responsible.
Deputies to the people's Council has the right to make recommendations to State authorities about the enforcement of the law, the policy of the State and about the problems in the common interest. Authorities have a responsibility to answer the recommendations of participants.
Deputies to the people's Council has the right to suggest the people's Council vote of confidence for people held by elected councils.
Article 43 the people's Committee, the organs, organizations, units and officials and public servants in the locality, in the scope of the mission, his powers have a responsibility to provide documentation, information, ensure the place of contact voters and create favorable conditions for the activities of the Council of people's deputies.
Vietnam Fatherland Front Committee and the Member organizations of the delegates to the people's Council contact voters, collect opinions, aspirations and recommendations of the people with the people's Council.
Article 44 during the Council session, without the consent of the Chairman, the meeting was not to arrest people's Council. If criminal handed or in case of an emergency where people's Assembly deputies detained, the Agency ordered detention must immediately report to the session chair.
Between the two sessions of the Council, if the State Agency has the authority to order detention deputies to the people's Council, they must inform the President of the people's Councils at the same level.
Article 45 delegates to the people's Council can vacate on duty deputies because of health reasons or because of other reasons. The acceptance of the people's Assembly deputies resign on duty deputies due to people's Councils at the same level of review and decision.
Article 46 Council of people's deputies would no longer worthy of the trust of the people, then custom level mistake that gets people's Council or voters recall. The people's Council and people's Committee decision making Council or voters to recall deputies of people's Council at the suggestion of the Vietnam Fatherland Front Committee of the same level.
