On strengthening the National Committee for AIDS,
and prevention and drug addiction, prostitution

PRIME MINISTER Pursuant to the Law on Government Organization December 25, 2001;
Pursuant to the Anti-Narcotics December 22, 2000;
Proposal of the Minister of the Interior and the Minister-Chairman of the Government Office,
DECISION:
Article 1. Position and function
National Committee for prevention AIDS and prevention and control of drug addiction and prostitution (hereinafter referred to as the National Committee) be strengthened on the basis of the National Committee for AIDS, and prevention and drug addiction, prostitution was established under Decision No. 61/2000 / QD-TTg of June 5, 2000 by the Prime Minister.
National Committee is a joint organization, mandated to assist the Prime Minister to direct and coordinate the prevention and control of AIDS and the prevention and control of drug addiction and prostitution.
Article 2. Duties and powers of the National Commission
1. Help the Prime Minister to direct the construction of strategies, policies, programs and plans for AIDS, and prevention and drug addiction and prostitution.
2. Help the Prime Minister to direct and implement, supervise, inspect and evaluate the activities of the ministries, branches and localities of the prevention and control of AIDS and prevention and drug addiction and prostitution. 3
. Prime Minister help organize and direct the activities of coordination between ministries, branches, localities and mass organizations; integrating and coordinating the programs and plans of work and resources for AIDS, and prevention and drug addiction and prostitution as required and common goals.
4. Directing the ministries, branches and central associations, the People's Committees of provinces and cities directly under the central government implement the assigned tasks and report the situation, task performance results for AIDS, and prevention, against drug addiction and prostitution.
5. Assisting the Prime Minister to direct the activities of international cooperation in the field of AIDS and the prevention and control of drug addiction and prostitution.
6. Synthesis and periodically report to the Prime Minister on the implementation of the prevention and control of AIDS and the prevention and control of drug addiction and prostitution.
Article 3. Members of the National Committee

Article 4. The organization and operation of the National Committee
1. The National Committee members work on a part-time basis. The heads of the agencies defined in Article 3 of this Decision nominate representatives to participate in the National Committee members, the Prime Minister's decision.
2. The text by the Chairman of the National Committee used the seal signed by the Prime Minister. 3
. Funding for the operation of the National Committee for the State budget and allocated in the annual budget estimates of the Government Office.
4. Chairman of the National Commission issued working regulations of the National Commission, the operating mechanism, mode of information, reports; the relationship between the National Committee for the Steering Committee of the ministries, branches and localities to ensure close coordination and unified direction from the central to local levels.
Article 5. The apparatus assisting the National Committee
1. Government Office assists the Chairman of the National Committee of the construction program, the work plan of the National Commission; regulation and inspection coordination and urge the implementation of the tasks of the ministries, branches and localities; synthesis, reported joint activities in the areas of AIDS and the prevention and control of drug addiction and prostitution; perform some other duties by the Chairman of the National Committee delivered.
2. Literacy Department Government Office is a unit directly perform the tasks mentioned in paragraph 1 of this article, which has a division in charge of civil servants by a departmental officials direct. Staffing division responsible by Chairman of the National Committee decided to follow the proposal of the Minister-Chairman of the Government Office.

Article 6. Specific responsibilities of the agency is member of the National Committee for AIDS, and prevention and control of drug addiction and prostitution
1. Ministry of Public Security:
As the standing body on anti-drug addiction; preside and coordinate with ministries, branches and localities in formulating and implementing strategies, policies, programs and plans to prevent and combat drug crime and drug crime control over the nationwide; coordinate with the Ministry of Defence, Ministry of Finance and related agencies struggle detection, investigation, treatment and prosecution of individuals who commit violations of the law on the prevention of drug abuse and prostitution; the granting and revocation of licenses and transit through Vietnam's territory of narcotics, pre-substances, addictive drugs and psychotropic medicines; grant and withdraw permits for import, export of narcotics use in the prevention of and fight against drug-related crime. Perform statistical assessment of the situation on the prevention of drug; management information on drug crime. 2. Ministry of Labour - Invalids and Social Affairs:
As the standing body on the prevention of prostitution; preside and coordinate with ministries and agencies develop and direct the implementation of guidelines, policies, programs and plans for prevention and control of prostitution on a national scale; chaired the steering organization and management of treatment, rehabilitation, education, vocational training, job creation, community reintegration for drug addicts and sex workers in health establishments and in public Dong.

. MOH:
As the standing body on AIDS; preside and coordinate with ministries and agencies to build and coordinate implementation of strategies, mechanisms, policies, programs and plans on HIV / AIDS on a national scale; statistics and assess the situation of HIV / AIDS at the local and nationwide; organizing medical examination and treatment for people living with HIV / AIDS, medical, social healing for drug addicts and sex workers infected with HIV / AIDS in the health facilities, medical facilities and at public; studies of drugs and treatment regimens of drug addiction; manage the production, sale and use of narcotic drugs, psychotropic drugs used for medical purposes and drug detoxification support.
4. DOD:
Steering Command of Border Guard, Coast Guard Department of the chair or coordinate with the Ministry of Public Security, Ministry of Finance, Ministry of Agriculture and Rural Development, Committee for Ethnic Minorities , General Administration of Customs and the ministries, branches and localities involved in: drug crime prevention, control and prevent the transport of illegal narcotics across the border and at sea; participated in the elimination of crops containing narcotic substances; rehabilitation organization for people in border areas, islands and sea; taking control and prevent the trafficking of women and children across the border.
5. Ministry of Public Security, Ministry of Defense, Ministry of Labour - Invalids and Social Affairs, the Ministry of Health of the Ministry used to assist the Minister, Deputy Chairman of the National Committee in implementing its obligations in the field of work assigned.
6. Government offices:
a) To assist the Chairman of the National Committee to guide, direct, inspect and urge the integration and coordination of programs, planning and use of resources for prevention AIDS and prevention and control of drug addiction and prostitution as required and common goals; assist the Chairman of the National Committee held operational coordination between ministries, branches and mass organizations; synthetic joint activities on the prevention and control of AIDS and the prevention and drug addiction, prostitution, to report to the Prime Minister;
B) submit to the Government, the Prime Minister of the legal documents, mechanisms and policies on AIDS and prevention of drug addiction and prostitution at the request of the ministries related.
7. Ministry of Finance:
a) To draw up the state budget estimates according to the estimates and ensure adequate and timely funding from work annually to AIDS and prevention and drug addiction prostitution; chaired inspect and supervise the use and settlement of funds under the current regulations;
B) direct the General Department of Customs in the chair and coordinate with the Ministry of Defense, Ministry of Public Security to control and prevent the transport of narcotics, addictive drugs illegally into Vietnam and from Vietnam abroad.
8. The Ministry of Planning and Investment:
a) coordinate with the Ministry of Finance and other ministries and agencies to build the annual budget estimates for the prevention and control of AIDS and the prevention and control of drug addiction, trade sex the competent authorities in accordance with the regulations;
B) Chair and coordinate with ministries and branches to actively mobilize other resources for this work served; construction management mechanism, used to ensure that resources are used effectively.
9. Judicial:

Coordinate with related ministries, research institutions, recommended improving the system of legal documents on the prevention of AIDS and the prevention and control of drug addiction and prostitution; organizational communication, dissemination, legal education on the prevention of AIDS and the prevention and control of drug addiction and prostitution.
10. Ministry of Culture - Information:
chair and coordinate with the concerned agencies in directing the implementation of information and communication on the prevention of AIDS and prevention and drug addiction and prostitution.
11. Ministry of Education and Training:
chair and coordinate with the concerned agencies in directing and organizing the work of education on the prevention of AIDS and the prevention and control of drug addiction and prostitution in establishments education.
12. Ministry of Agriculture and Rural Development:
chair and coordinate with the Ministry of Defense, Committee for Ethnic Minorities and local directing the propaganda campaign for the elimination of plants containing narcotic drugs and switch alternative plant structure tree containing narcotics.
13. Ministry of Industry:
chair and coordinate with relevant ministries and agencies to promulgate and implement regulations on management of precursors, drugs and psychotropic substances in the field of industrial production; granting and revoking permits for export and import of precursors used in the industrial manufacturing sector.
14. Commission Ethnicity:
coordinate with the Ministry of Agriculture and Rural Development, the Ministry of Defense to direct conversion alternative production plants containing narcotics; coordinate with the Ministry of Public Security, Ministry of Labour - Invalids and Social Affairs, the Ministry of Defense direct the work of AIDS and prevention and drug addiction, prostitution in mountainous and ethnic minority areas.
15. Vietnam Fatherland Front:
Chaired mobilizing the social strata in the country to implement the prevention and control of AIDS and the prevention and control of drug addiction, prostitution, associated with the mobilization of the entire people unite to build cultural life in residential areas.
16. Vietnam General Confederation of Labour, Women's Union, Vietnam, Ho Chi Minh Communist Youth Union, the Vietnam Farmers' Association and the political organization - society, based on their functions and tasks of deployment prevention and control of AIDS and the prevention and control of drug addiction and prostitution for union members, membership; coordinate with ministries, branches and localities to mobilize the strength of the entire population to participate in the prevention and control of AIDS and the prevention and control of drug addiction and prostitution.
Article 7. To organize and direct the work of AIDS and the prevention and control of drug addiction and prostitution in the ministries, central agencies and localities
1. The ministries and central agencies:
Based on the characteristics and specific requirements of each sector, the agencies to establish the Steering Committee for AIDS, and prevention and drug addiction, prostitution, helping Prime Minister and branches in directing, implementing and coordinating the work of AIDS and prevention and drug addiction, prostitution of the ministries themselves.
A Steering Committee led by ministries as its head. Where not established, the Steering Committee of the Heads of agencies shall assign a leader in charge of layout and full-time or part-time civil servants to assist the leadership track, aggregation.
Heads of ministries decided to set up a steering committee, defining the functions, duties, composition and operation regulation issued by the Steering Committee for AIDS, and prevention and drug addiction prostitution.
2. In the provinces and cities directly under the Central Government:
a) Establishment of the Steering Committee for AIDS, and prevention and drug addiction and prostitution in the provinces and cities directly under the Central Government (hereinafter the provincial people's Committee) to assist the Chairman of the provincial people's Committee to direct, deploy and integrate the prevention and control of AIDS and the prevention and control of drug addiction and prostitution in the province and by the Chairman Chairman or Vice Chairman of the provincial people's Committee as its head;
Steering Committee and the members of the Steering Committee by the Chairman of the provincial People's Committee decision.
B) Establish specialized departments located at the Office of the Provincial People's Committee to assist the Steering Committee to coordinate, integrate, test and supervise the activities on the prevention of AIDS and prevention currency drug and prostitution (on the payroll of the Office of the people's Committee) and assigned a Deputy Office of the provincial people's Committee in charge of this department;
C) Based on the functions, duties, composition and operation regulation of the National Committee, Chairman of the provincial People's Committee regulating the functions, tasks, structure and issuing Member operation Regulation of the provincial Steering Committee and guide subordinates building operation regulation of the Steering Committee consistent, uniform, compact and efficient operation. 3
. In the districts, towns and provincial cities (hereinafter referred to as district level):
a) Establishment of the Steering Committee for AIDS, and prevention and control of drug addiction and prostitution by district a leader of the district people's Committee as its head. Steering Committee and members of the Steering Committee by the Chairman of the district People's Committee decision;

B) Bureau of the district People's Committee shall assist the Steering Committee. Depending on the nature, characteristics and specific requirements of each locality can be held responsible part or full layout servants in the Office of the People's Councils and People's Committees at district level to monitor, aggregate General and assigned a Deputy Office directly responsible for this task;
C) Based on the functions, duties, composition and operation regulation of the Provincial Steering Committee and the guidance of the provincial People's Committee, Chairman of the district People's Committee regulating functions, duties, membership structure and issued the Regulations of the Steering Committee of the same level.
4. In communes, wards and townships (hereinafter referred to as the commune level):
a) Based on the characteristics and requirements of the prevention and control of AIDS and the prevention and control of drug addiction and prostitution of each local presidents commune people's Committee decided to establish the Steering Committee for AIDS, and prevention and control of drug addiction and prostitution;
B) If not established the Steering Committee, a leadership assignment commune-level People's Committees to monitor, the general direction of this work. By staff to assist the Office of the People's Councils and People's Committees of communes undertake.
5. Funding Activities:
The operational cost of the Steering Committee for AIDS, and prevention and drug addiction and prostitution in the ministries, branches and localities in the state budget due to security under the current regulations of the Law on state Budget.
Article 8. Effect
This decision takes effect after 15 days from the date of its publication; replacing Decision No 61/2000 / QD-TTg of June 5, 2000 of the Prime Minister on the establishment of the National Committee for AIDS, and prevention and control of drug addiction and prostitution. Article 9. Responsibilities

implementation Ministers, heads of ministerial-level agencies, heads of government agencies, Chairman of People's Committees of provinces and cities directly under the Central Government and members the National Committee is responsible for the implementation of this Decision. /.
