CIRCULAR additional amendments to some articles of the circular No. 47/2009/TT-BNNPTNT on 29/6/2011 by Ministry of agriculture and rural development guide and implementation of pilot agricultural insurance in crop, livestock, aquaculture, according to decision No. 315/QD-TTG dated January 3, 2011 by Prime _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ pursuant to Decree No. 01/2008/ND-CP of March 1, 2008 by Itself Government functions, tasks, powers and organizational structure of the Ministry of agriculture and rural development; Decree No. 75/2009/ND-CP on February 10, 2009 by the Government on the amendment of article 3 of the Decree 1/2008/ND-CP;
Pursuant to decision No. 315/QD-TTg dated January 3, 2011 by the Prime Minister on the implementation of the agricultural insurance pilot period 2011-2013;
According to the proposal of the Director General of the economic cooperation and rural development;
The Minister of agriculture and rural development issued a circular amending and supplementing some articles of circular No. 47/2009/TT-BNNPTNT on 29/6/2011 by Ministry of agriculture and rural development guide and implementation of pilot agricultural insurance in crop, livestock, aquaculture, according to decision No. 315/QD-TTg dated January 3, 2011 by Prime (hereinafter referred is the circular No. 47/2011/TT-BNNPTNT), article 1. Amendments and supplements to some articles of the circular No. 47/2009/TT-BNNPTNT as follows: 1. additional point b Paragraph 2 to article 1 as follows: "-made for the insurance of livestock: dairy cows in Vinh Phuc Province;
-Insurance for aquaculture: prawn, shrimp in Tra Vinh province ".
2. Article 3 is amended and supplemented as follows: "article 3. Regulations on the type of disaster, disease hazards and determine the extent of damage to support agricultural insurance pilot 1. The types of natural disasters: hurricanes, flood, floods, droughts, frosts, frost damage, medium bold, saline intrusion, tsunami, thunderstorms, tornadoes.
2. The types of disease: a) for rice plants: dwarf yellow Disease, twisted dwarf leaf, black stripe, the moderates dwarf, silver leaves; pest, deep opaque;
b) for cattle: foot and Mouth Disease, fowl, heat n;
c) against blue ear Disease: pigs, foot and mouth, stamped, Vice, fowl typhoid; cholera;
d) for chicken, duck: bird flu, new cat-xơn (Newcastle), gumboro; cholera (duck);
DD) for fish: liver disease kidney pustules;
e) for prawn: yellow, white spots Disease, the disease necrotic hematopoietic organs and epithelial organs (IHHNV); syndrome of liver necrosis pancreatitis (AHPNS);
g) for shrimp: the disease white spots, yellow disease, the disease necrotic hematopoietic organs and epithelial organs (IHHNV), muscle necrosis disease or illness caused by the virus body chisel (IMNV); Taura syndrome, the syndrome of liver necrosis pancreatitis (AHPNS) ".
3. Authority to publish epidemic disaster: a) the Chairman of the provincial people's Committee decision to publish the kind of disaster, disease according to item 2 article 1 of this circular happened locally in accordance with current legislation;
b) for cases of disease occurs is not yet eligible to publish epidemic according to the rules, then delivered to the people's Committee at district level confirmed the disease on the basis of the test results, the evaluation of the professional bodies such as: plant protection, animal health, Bureau of fisheries or aquaculture Bureau as a basis to resolve the rights of people his pilot agricultural insurance is convenient, fast.
4. Confirm the extent of damage to be covered: on the basis of the results identified the Agency's expertise on natural disasters, epidemics and the scope of influence, insurance and business participants pilot agricultural insurance agreements with each other about the extent of damage and compensation. The case of the two parties do not deal with each other, the communal people's Committee proposal to resolve. The commune people's Committee established the task force (including the Vice Chairman of the people's Committee in charge of township officials, economic statistics, agricultural officer and other components according to the specific conditions of each local) determine the extent of the damage as a base to either side of the agreed compensation. If a party or both parties do not agree to the proposed district people's Committee resolution. 3. Amend article 5 paragraph 1 as follows: "1. The criteria and of local livestock scale: each province chose 11 districts, each district choose from 12 communes; the scale of the whole social insurance. "
4. Add the phrase "or the process of the Department of agriculture and rural development was approved by the province people's Committee" in point b of Paragraph 2, point b paragraph 3, point b paragraph 4 Article 5.
5. Modify Article 6 paragraph 1 point a as follows: "a), geographical scale aquaculture: each province chose 11 districts, each district choose from 12 communes; the scale of the whole social insurance. "
6. Amendments, additional item 2 article 6 as follows: "2. The manufacturing process for aquaculture: applied according to annex V; Annex VI; Appendix VII; Annex VIII; Annex IX attached to circular No. 47/2009/TT-BNNPTNT or processes of the Department of agriculture and rural development was approved by the province people's Committee ".
Article 2.
1. Abolition of the phrase "an area of cultivated lands from the minimum of 5 acres or more" in art. 1 article 4.
2. Annuls Point c Paragraph 2, point c, paragraph 3, point c, paragraph 4 Article 5.
3. Abolition of the phrase "every breeding selection Township" in art. 1 article 6.
4. Repeal of article 6 paragraph 1 point b.
Article 3. Terms of implementation 1. This circular has effect from the day of signing.
2. In the process of implementing if there are problems, the people's Committee and the Organization, individuals involved in agricultural insurance pilot reflects on the Ministry of agriculture and rural development (Department of economic and rural development), the Ministry of finance to study, review and decision.
