Pursuant to Decree No. 199/2013/ND-CP on November 26, 2013 of government functions, tasks, powers and organizational structure of the Ministry of agriculture and rural development;
At the suggestion of Director of Department of plant protection;
The Minister of agriculture and rural development issued a category object in the quarantine area; Catalog object in quarantine pest risk analysis must before import into Vietnam.
Article 1. Catalog objects in the quarantine area 1. Plant Trees and parts of trees.
2. products of the tree a) tubers, fruits, seeds, flowers, leaves, stems, shoots, stem, root, bark;
b) of MDF, Bran, dried oil, natural plant fiber, raw form;
c) powder, starch plant origin (except dough, starch);
d) "tobacco, cigarette smoking, fiber yarn, Lao men feed, raw cotton, cotton waste, straw, Twine and aquatic plants;

e) ingredients for animal feed plant origin;

6. The body in an other plant quarantine at high risk of carrying the object to quarantine by the plant protection department determines and reports to the Minister of agriculture and rural development decided.
Article 3. The objects in the quarantine area was free of pest risk analysis objects in quarantine stipulated in article 2 of this circular are free of pest risk analysis in these cases: 1. Seed serves scientific research;
2. useful creatures serve scientific research;
3. in other cases, the Director of plant protection department reports to the Minister of agriculture and rural development decided.
4. The import of the object specified in item 1, 2, 3 this must have a license to import and plant quarantine conducted quarantine regulations.
Article 4. Transitional provisions with respect to the object in quarantine were imported into Vietnam before the day this circular effect that not yet made pest risk analysis, the plant quarantine agency of the exporting country must provide information to the Department of plant protection in accordance to pest risk analysis. Based on the results of the risk analysis pest, plant protection Bureau supplement plant quarantine measures needed to prevent effectively the plant quarantine objects.
Article 5. Terms of implementation 1. This circular has effect as from October 1, 2015.
2. This circular replaces circular No. 39/2012/TT-BNNPTNT on August 13, 2012 of the Minister of agriculture and rural development, issued in an object list quarantine pest risk analysis must before import into Vietnam; Circular 40/2012/TT-BNNPTNT on August 15, 2012 of the Minister of agriculture and rural development issued a category object in the quarantine area of the Socialist Republic of Vietnam.
3. the Chief of the Department, Director of Department of plant protection and other organizations and individuals concerned is responsible for the implementation of this circular.
In the process of implementation of the circular, if there are difficulties and obstacles, agencies, units, organizations and individuals who need timely reflection on the Ministry of agriculture and rural development (plant protection Bureau) to sum up, the Minister reviewed the decision.
