The DECISION to enact the regulation of civil aviation safety _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ the MINISTER of TRANSPORT pursuant to the law of civil aviation Vietnam on June 29, 2006;
Pursuant to Decree No. 51/2008/ND-CP on April 22, 2008 Government's functions, tasks, powers and organizational structure of the Ministry of transportation;
Extra bases estimated at 1, 6 and 8 of the Convention on International Civil Aviation signed at Chicago on 7 December 1944 which Vietnam joined;

According to the proposal of the Director General of transport and Director of Department of Vietnam Airlines, the decision: article 1. Attached to this decision, "the regulation of civil aviation safety".
Article 2. This decision takes effect 15 days from the date The report.

Scope and objects 1. This regulation regulates the standards of eligibility, mining ship, the professional standards of aviation personnel in the field of mining, ship repair, maintenance, medical examiner for aviation personnel.
2. These rules are applicable to organizations and individuals involved in the activity of design, production, testing equipment, aircraft mounted on aircraft, equipment, supplies, consumables to serve repair, maintenance, aircraft maintenance, aircraft, training harness education, training, health assessment for aviation personnel.
3. Scope of each chapter in this regulation are defined respectively in that chapter.

2. 7. "ICAO" is organized by the international civil aviation was established by the Chicago Convention.

11. "ratification" is the process of evaluation, which allows to make, use or application of technically human, material, equipment, policies or procedures relating to eligibility criteria and exploit aircraft requires the prior approval of the forms issued or issued the license type , certificate, certificates, permits, plan text or other text of the Vietnam aviation.

12. 14. "eligibility criteria" is the standard due to the Vietnam Aviation issued or acknowledged as the basis for the calculation of engineering and design, including the type of materials used and methods of construction, for each ship class, secure that aircraft class exploitation.

16. "the State ensures the safe extraction" is the status of the aircraft when it meets the following requirements: a) Are consistent with the maintenance maintenance program has been approved by Vietnam aviation including the maintenance work, checks in order to detect and prevent rust (CPCP) and the degradation of the structure systems, and other devices mounted on aircraft;

Article 3. The responsibility of the Vietnam aviation 1. Vietnam's aviation aviation authorities perform functions safety monitoring, have the following specific responsibilities: a) held the safety management system; test, inspection, monitoring of aviation safety;
b) set or hiring organization, recruiting or hiring technical staff have the appropriate expertise, ability to perform the inspection, assessment and recommendations relating to the licensing, certification, performs the function of monitoring and ensuring the safety of aviation;

c) directly implement the application of the decisions, resolutions, standards, recommended practices, guidelines of international organisations to which Vietnam is a Member;
d) issued the guidance documents, professional requirements, standard base to deploy to apply the provisions of this regulation.
2. Vietnam aviation appointed aviation safety supervisor is authorized to perform the monitoring function, ensuring the safety of aviation. The aviation safety supervisor must be Vietnam aviation safety supervisor card issued to perform their duties. The card safety supervisor must meet the conditions of the qualifications, the experience is as follows: a) monitoring field fly (Flight Inspector): (i) a minimum of 5 years in one of the following work: location management, airplane motor, driver or teacher;
(ii) was the pilot, experienced flight hours accumulated no less than 5000 flying hours at the main steering position;
(iii) with respect to the approval of teachers or the driver (Airman certification tasks), must have driver's license/ATPL CHPL aircraft have appropriate aircraft type are still in force;
(iv) with regard to the work of monitoring (Surveillance tasks), must have a license to drive aircraft ATPL/CHPL force or has not yet too 3 years; with regard to the monitoring of people exploit (Airline surveillance), must have a license to drive a boat bay/ATPL CHPL, style/type (propeller/Jet) aircraft suitable for your type of aircraft/the dig are valid or have expired yet too 3 years;
(v) receive training on safety policies related to inspection, monitoring, adopted in the field of exploitation of aircraft;
(vi) have the knowledge and experience of aviation meteorology;
(vii) likely proficient in English as a rule (the ability to read, understand, speak and listen);
(viii) knowledge of Vietnam civil aviation law, the regulations on flight safety standards for the type of exploitation as Cat II, III & ETOPs, REDUCED VERTICAL SEPARATION MINIMA/MNPS, MMEL, CRM, transport of dangerous goods, investigating the accident, and the regulations/standards/procedures related to exploitation of aircraft;
(ix) have joined the basic training course on monitoring the safety harness aircraft (Flight Operations Safety Oversight policies) were approved.
b) mining monitoring field aircraft (Flight Operation Inspector): (i) a minimum of 5 years working in the field of exploitation of aircraft, have graduated from the course in one of the specialized aircraft-motor (motorized), electrical and electronic equipment (Division) or the exploitation of aircraft or train driver;
(ii) capable of fluent English (the ability to read, understand, speak and listen);
(iii) knowledge of Vietnam civil aviation law, the regulations on flight safety standards for the type of exploitation as Cat II, III & ETOPs, REDUCED VERTICAL SEPARATION MINIMA/MNPS, MMEL, CRM, transport of dangerous goods, investigating the accident, and the regulations/standards/procedures related to exploitation of aircraft;
(iv) receive training on safety policies related to inspection, monitoring, adopted in the field of exploitation of aircraft;
(v) participated in the basic training course on monitoring the safety harness aircraft (Flight Operations Safety Oversight policies);
(vi) to have the ability and experience in building the process check, validating and monitoring for the implementation of the requirements regarding aircraft stubs;
(vii) maintaining the provisions on retraining, update knowledge concerning flight mining sector.
c) safety monitoring field cabin (Cabin Safety Inspector): (i) Have professional certificates about safety or passenger compartment through the training course to train flight attendants ratified;
(ii) have a minimum of 5 years experience working in aviation field related to the duties of flight attendants;
(iii) have the ability to be proficient in English (the ability to read, understand, speak and listen);
(iv) has the basic knowledge about the Vietnam civil aviation laws and regulations/standards/procedures related to cabin safety;
(v) receive training on safety policies related to inspection, monitoring, approval of the safe areas in the cabin;
(vi) have a gift and experience build process checks, monitoring the implementation of the provisions on cabin safety;
(vii) has the ability and experience in the construction of an emergency and safety-risk method in the passenger compartment when there is trouble.
d) monitoring field qualifying standards (Airworthiness Inspector) (i) there by aerospace engineer in one of the specialized aircraft-motor (motorized), electrical and electronic equipment (the subject) and a minimum of 5 years experience working in the field of aeronautical engineering;
(ii) capable of fluent English (the ability to read, understand, speak and listen);
(iii) has the basic knowledge about the Vietnam civil aviation laws and regulations/standards/procedures relating to eligibility criteria;
(iv) receive training on the policy and implementation processes related to inspection, monitoring, adopted in the field of eligibility criteria;
(v) participated in training courses on basic eligibility standards were approved;
(vi) to have the ability and experience in building the process check, validating and monitoring for the implementation of the requirements related to eligibility criteria.
3. The supervisor card safety provisions in paragraph 2 of this Article has the following powers: a) conducted the audit activities, evaluation, testing or monitoring;

c) approach and examine any aircraft, aircraft equipment, parts, materials, vehicles, aviation staff or crew members with the purpose of ensuring compliance with this regulation;
d) require any person to give any documents or things would related to the implementation of the provisions of this regulation;
DD) check and copy the licence, certificate, certificates, technical logs, documents or records relating to this regulation;
e) conducted the tests, reviews, test, investigate, verify, test and test flying when necessary to ensure compliance with this regulation.
4. When implementing the powers specified in paragraph 3 of this article, the safety supervisor has the right to request the suspension of flights, suspending the operation of the relevant aviation personnel in order to prevent the possibility of safe flying menace; set the minutes about the incident that occurred at the same time to immediately report to the Vietnam aviation. 5. The inspection, testing and monitoring can be done at any time and place would have operations, aircraft maintenance, training and other activities related to the scope of this regulation, in particular as follows: a) any place of public or private where there are parked aircraft to check the aircraft or any material under the provisions of this regulation;
b) any airport with the purpose to check the airport or any airport in any aircraft or on any material under the provisions of this regulation;
c) any aircraft, the cockpit during the flight in order to check the operation of the aircraft, or any equipment of the aircraft and checked the activities of crew members when doing his work.
Article 4. The liability of the Organization, the individual organizations and individuals involved in the design, production, operation, maintenance, testing, exploitation of aircraft, training, coaching, health assessment for aviation personnel have the responsibility to: 1. Compliance with the requirements of this regulation and the specific instructions of the Vietnam aviation related activities.
2. In compliance with the environmental protection requirements under the guidance of the Vietnam aviation.
3. Compliance with the requirements for aviation security.
4. the Establishment and retention of records and documents relevant to its activities under the provisions of this regulation and the specific instructions of the Vietnam aviation.
5. Provide papers, documents, records at the request of the competent person.
6. Exhibiting of certificates are issued to organizations in visible place of the head office; carry permits, certificates are issued to individuals when making the work recorded in the license.
Article 5. Application of preventive measures to ensure the safety of 1. In the event of breach or no longer meet standards, conditions of license, certificate, permit or other documents issued or issued by the Bureau of Vietnam Airlines, Vietnam Airlines Director General can adopt the following measures: a) asked to suspend flights to prevent the menace of flight safety;
b) suspension, suspension term licenses, certificates, allowing text or other text;
c) revoke the licence, certificate, permit or other text;

2. Article 6. Apply the administrative procedure

1. 7. Article 7. Authorised person 1. Vietnam aviation can authorize individuals, organized as the representative of Vietnam aviation to reviews, surveys, testing, testing, testing for ship, individuals, organizations to license, certificate, permit or other text.
2. Vietnam aviation made the authorization on the basis of reviews of experience, training and commitment, ensuring that authorized users who are authorized to meet the following conditions: a) have adequate equipment, human resources, it is suitable to work as required;

c) Has enough experience in relation to the work as required.

d) grant or refuse a licence, certificate, permit or other text;

5. The authorization expires in the following cases: a) at the request in writing of the authorized person;

d) when the person authorized to violate the law or do not perform their duties properly authorized;
DD) When the authorized person's help was no longer needed for Vietnam's Aviation Bureau or in the case that Vietnam aviation necessary.
6. the Commissioner shall report periodically or irregularly as required, keeping a copy of all documents to be issued when the execution authorized in an appropriate place according to the rules of the Vietnam aviation.
7. For any reason and at any time, the Vietnam Civil Aviation Administration has the right to unrestricted access work, staff, record, document, the work of the person authorized to examine the performance of authorized tasks. c) prove the alternative proposal reached safety at least equivalent to the requirements of this regulation, in accordance with the common interest and must contain the following information: (i) a description of the relevant issues and experiences about the accident that the applicant for that involves applying mitigation;
(ii) identify all possible risks if allowed to apply the other proposed projects and measures to be applied to address risks;
(iii) proof that the arguments about public safety and the safety level equivalent is unfounded.
3. After reviewing the adequacy and accuracy of the information in the application, the Vietnam aviation technical assessment on the feasibility of alternative methods. Article 9. Recognizing the validity of the papers, documents 1. 3. 4. 5. The person is recognized by Vietnam aviation certificate, permit, approval, or allow text responsibly: a) ensure compliance with the provisions of this regulation or the law of the Member State where the ICAO level or issued the original text;
b) observance of the inspection, verification of the Vietnam aviation for the maintenance of the competence and compliance with the standard, the basis of the level or issued documents;

b) certificate of eligibility;
c) health certificate;
d) license, of the aviation staff referred to in chapter IV of this regulation;
DD) certificate of the exploitation of the ship;
e) certificate approved maintenance organisation;
g) training organization certificate is approved;
h) approve, specify or allow for text materials, facilities, equipment, training, equipment and instruments assume approved individually in the technical certification process;

Article 73. Asked about the medical staff of the facility are AMC certification basis was AMC certification when meeting the following conditions of medical staff: 1. The medical staff are employed must have sufficient levels of expertise needed to conduct the test health assessment, and be approved by Vietnam aviation;

Article 74. Asked about the machinery and equipment of the base are AMC certification basis was AMC certification when meet the following conditions on machinery and equipment: 1. Premises, equipment, clinic to ensure suitable may conduct inspection , health inspection;
2. Have a separate headquarters and equipment records have tags to ensure safety for health records;

3. Always available entire operating equipment and the necessary test equipment as defined in the medical Manual of civil aviation of ICAO to implement each stage needed in inspection, health examiners;
4. Measurement equipment, determine the size of their software and must be calibrated according to the regulations.
Article 75. Quality assurance system of AMC 1. The basis was the AMC certification must maintain a quality assurance system is approved by Vietnam's Aviation Bureau to ensure that the equipment, staff, health inspection work and profile data to comply with all relevant regulations.
