The DECISION to enact the regulation of civil aviation safety _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ the MINISTER of TRANSPORT pursuant to the law of civil aviation Vietnam on June 29, 2006;
Pursuant to Decree No. 51/2008/ND-CP on April 22, 2008 Government's functions, tasks, powers and organizational structure of the Ministry of transportation;
Extra bases estimated at 1, 6 and 8 of the Convention on International Civil Aviation signed at Chicago on 7 December 1944 which Vietnam joined;
Doc 9734-base documentation about safety monitoring, Doc 8335-documentation about the process of examination, approval and supervision of mining organizations International Civil Aviation (ICAO);
According to the proposal of the Director General of transport and Director of Department of Vietnam Airlines, the decision: article 1. Attached to this decision, "the regulation of civil aviation safety".
Article 2. This decision takes effect 15 days from the date The report.

Scope and objects 1. This regulation regulates the standards of eligibility, mining ship, the professional standards of aviation personnel in the field of mining, ship repair, maintenance, medical examiner for aviation personnel.
2. These rules are applicable to organizations and individuals involved in the activity of design, production, testing equipment, aircraft mounted on aircraft, equipment, supplies, consumables to serve repair, maintenance, aircraft maintenance, aircraft, training harness education, training, health assessment for aviation personnel.
3. Scope of each chapter in this regulation are defined respectively in that chapter.
Article 2. Explain technical terms In this regulation, the following terms are understood as follows: 1. 2. "eligible flight instruction" is required maintenance, check or change with respect to aircraft or aircraft equipment required to be done in order to prevent the problem of safe flying menace due to aircraft registration country issued or admit to similar requests by the aviation authorities of countries designed , built.

5. "Chicago Convention" means the Convention on International Civil Aviation signed in Chigago on December 7, 1944.
6. "type certificate" is a certificate in respect of a type of aircraft, including a type design, the operating limitations, the type certificate data sheet, the eligibility criteria and any conditions or restrictions applicable to the type of aircraft.
7. "ICAO" is organized by the international civil aviation was established by the Chicago Convention.
8. "Free" is written by Vietnam Aviation issued allowing long do one or some of the requirements or standards prescribed in this regulation when it deems that the exemption of aviation safety.
9. "exempt" is written by Vietnam aviation enacted allowing a personal, organizational or aircraft are exempt from the application of one or more of the requirements of this regulation when it deems the immunities which can maintain the level of the corresponding safety because of the public interest and ensure safety.
10. "exception" is written by Vietnam Aviation issued to allow a group of people, aircraft or types of exploits are exempt from applying one or more of the requirements of this regulation when it deems the request inappropriate for that group and the exemption applies so consistent with the public interest and ensure safety.
11. "ratification" is the process of evaluation, which allows to make, use or application of technically human, material, equipment, policies or procedures relating to eligibility criteria and exploit aircraft requires the prior approval of the forms issued or issued the license type , certificate, certificates, permits, plan text or other text of the Vietnam aviation.
a) "license" is written by Vietnam aviation level for an individual is performing certain work, specific rights and restrictions with respect to the implementation of that work.
b) "allow" is written by Vietnam Aviation Bureau granted to an individual or organization some certain powers related to the eligibility standards, exploitation of aircraft.
c) "certificate" is written by Vietnam aviation level for an organization to perform certain activities, specific rights and restrictions with respect to the implementation of that operation.
d) "plan" is written by Vietnam aviation level attached to the licence, certificate or similar papers, which indicated the conditions, permissions or restrictions of the licence and the certificate.
12. "match type certificate" is the condition of the aircraft and the equipment fitted on board the flying a perfect fit with the painting, performance and the type certificate data sheet of that aircraft type certificate, including any supplemental type certificates and other changes , improvements were approved by Vietnam aviation applied on Board that aircraft in the extraction process.
13. "eligibility" is the condition of the aircraft meets the requirements for the certificate of eligibility, including: a) match the type certification has been approved by Vietnam aviation or admit to that aircraft type;
b) flying in a State guarantee of safe mining.
14. "eligibility criteria" is the standard due to the Vietnam Aviation issued or acknowledged as the basis for the calculation of engineering and design, including the type of materials used and methods of construction, for each ship class, secure that aircraft class exploitation.
15. "design" is the design of aircraft types, including: a) The drawings and features works by category to determine the configuration and design features of the aircraft to demonstrate product compliance of the product with the standard aircraft eligible to fly is apply;
b) The information on the size, materials and the necessary process used to determine the durability of the structure of the ship products;
c) Guide for maintaining the eligibility of products aircraft aircraft eligibility standards be applied to ship products.
16. "the State ensures the safe extraction" is the status of the aircraft when it meets the following requirements: a) Are consistent with the maintenance maintenance program has been approved by Vietnam aviation including the maintenance work, checks in order to detect and prevent rust (CPCP) and the degradation of the structure systems, and other devices mounted on aircraft;
b) fulfill the eligible flight instruction, instruction and maintenance work, checks required by the Vietnam Aviation issued or acknowledged;
c) fix the failure of the aircraft structure and systems that affect the safe operation of the aircraft in accordance with the maintenance manual has been approved;
d) do the job apply technical notice, improve or change the configured aircraft in accordance with the procedures that have been approved by Vietnam aviation;
DD) The safety equipment fitted on board the flying is in good standing and ready for action consistent with the type of aircraft.
17. "authorization" is written by Vietnam aviation enacted allowing a personally on behalf of the Vietnam civil aviation performed the actions, the task is clearly defined in the text.
Article 3. The responsibility of the Vietnam aviation 1. Vietnam's aviation aviation authorities perform functions safety monitoring, have the following specific responsibilities: a) held the safety management system; test, inspection, monitoring of aviation safety;
b) set or hiring organization, recruiting or hiring technical staff have the appropriate expertise, ability to perform the inspection, assessment and recommendations relating to the licensing, certification, performs the function of monitoring and ensuring the safety of aviation;

c) directly implement the application of the decisions, resolutions, standards, recommended practices, guidelines of international organisations to which Vietnam is a Member;
d) issued the guidance documents, professional requirements, standard base to deploy to apply the provisions of this regulation.
2. Vietnam aviation appointed aviation safety supervisor is authorized to perform the monitoring function, ensuring the safety of aviation. The aviation safety supervisor must be Vietnam aviation safety supervisor card issued to perform their duties. The card safety supervisor must meet the conditions of the qualifications, the experience is as follows: a) monitoring field fly (Flight Inspector): (i) a minimum of 5 years in one of the following work: location management, airplane motor, driver or teacher;
(ii) was the pilot, experienced flight hours accumulated no less than 5000 flying hours at the main steering position;
(iii) with respect to the approval of teachers or the driver (Airman certification tasks), must have driver's license/ATPL CHPL aircraft have appropriate aircraft type are still in force;
(iv) with regard to the work of monitoring (Surveillance tasks), must have a license to drive aircraft ATPL/CHPL force or has not yet too 3 years; with regard to the monitoring of people exploit (Airline surveillance), must have a license to drive a boat bay/ATPL CHPL, style/type (propeller/Jet) aircraft suitable for your type of aircraft/the dig are valid or have expired yet too 3 years;
(v) receive training on safety policies related to inspection, monitoring, adopted in the field of exploitation of aircraft;
(vi) have the knowledge and experience of aviation meteorology;
(vii) likely proficient in English as a rule (the ability to read, understand, speak and listen);
(viii) knowledge of Vietnam civil aviation law, the regulations on flight safety standards for the type of exploitation as Cat II, III & ETOPs, REDUCED VERTICAL SEPARATION MINIMA/MNPS, MMEL, CRM, transport of dangerous goods, investigating the accident, and the regulations/standards/procedures related to exploitation of aircraft;
(ix) have joined the basic training course on monitoring the safety harness aircraft (Flight Operations Safety Oversight policies) were approved.
b) mining monitoring field aircraft (Flight Operation Inspector): (i) a minimum of 5 years working in the field of exploitation of aircraft, have graduated from the course in one of the specialized aircraft-motor (motorized), electrical and electronic equipment (Division) or the exploitation of aircraft or train driver;
(ii) capable of fluent English (the ability to read, understand, speak and listen);
(iii) knowledge of Vietnam civil aviation law, the regulations on flight safety standards for the type of exploitation as Cat II, III & ETOPs, REDUCED VERTICAL SEPARATION MINIMA/MNPS, MMEL, CRM, transport of dangerous goods, investigating the accident, and the regulations/standards/procedures related to exploitation of aircraft;
(iv) receive training on safety policies related to inspection, monitoring, adopted in the field of exploitation of aircraft;
(v) participated in the basic training course on monitoring the safety harness aircraft (Flight Operations Safety Oversight policies);
(vi) to have the ability and experience in building the process check, validating and monitoring for the implementation of the requirements regarding aircraft stubs;
(vii) maintaining the provisions on retraining, update knowledge concerning flight mining sector.
c) safety monitoring field cabin (Cabin Safety Inspector): (i) Have professional certificates about safety or passenger compartment through the training course to train flight attendants ratified;
(ii) have a minimum of 5 years experience working in aviation field related to the duties of flight attendants;
(iii) have the ability to be proficient in English (the ability to read, understand, speak and listen);
(iv) has the basic knowledge about the Vietnam civil aviation laws and regulations/standards/procedures related to cabin safety;
(v) receive training on safety policies related to inspection, monitoring, approval of the safe areas in the cabin;
(vi) have a gift and experience build process checks, monitoring the implementation of the provisions on cabin safety;
(vii) has the ability and experience in the construction of an emergency and safety-risk method in the passenger compartment when there is trouble.
d) monitoring field qualifying standards (Airworthiness Inspector) (i) there by aerospace engineer in one of the specialized aircraft-motor (motorized), electrical and electronic equipment (the subject) and a minimum of 5 years experience working in the field of aeronautical engineering;
(ii) capable of fluent English (the ability to read, understand, speak and listen);
(iii) has the basic knowledge about the Vietnam civil aviation laws and regulations/standards/procedures relating to eligibility criteria;
(iv) receive training on the policy and implementation processes related to inspection, monitoring, adopted in the field of eligibility criteria;
(v) participated in training courses on basic eligibility standards were approved;
(vi) to have the ability and experience in building the process check, validating and monitoring for the implementation of the requirements related to eligibility criteria.
3. The supervisor card safety provisions in paragraph 2 of this Article has the following powers: a) conducted the audit activities, evaluation, testing or monitoring;
b) approach and check any, pungent-ga or anywhere else have aircraft parked or stored, or any organization would do the job, the services related to this regulation;
c) approach and examine any aircraft, aircraft equipment, parts, materials, vehicles, aviation staff or crew members with the purpose of ensuring compliance with this regulation;
d) require any person to give any documents or things would related to the implementation of the provisions of this regulation;
DD) check and copy the licence, certificate, certificates, technical logs, documents or records relating to this regulation;
e) conducted the tests, reviews, test, investigate, verify, test and test flying when necessary to ensure compliance with this regulation.
4. When implementing the powers specified in paragraph 3 of this article, the safety supervisor has the right to request the suspension of flights, suspending the operation of the relevant aviation personnel in order to prevent the possibility of safe flying menace; set the minutes about the incident that occurred at the same time to immediately report to the Vietnam aviation. Safety supervisor must take responsibility for its decisions in accordance with the law.
5. The inspection, testing and monitoring can be done at any time and place would have operations, aircraft maintenance, training and other activities related to the scope of this regulation, in particular as follows: a) any place of public or private where there are parked aircraft to check the aircraft or any material under the provisions of this regulation;
b) any airport with the purpose to check the airport or any airport in any aircraft or on any material under the provisions of this regulation;
c) any aircraft, the cockpit during the flight in order to check the operation of the aircraft, or any equipment of the aircraft and checked the activities of crew members when doing his work.
Article 4. The liability of the Organization, the individual organizations and individuals involved in the design, production, operation, maintenance, testing, exploitation of aircraft, training, coaching, health assessment for aviation personnel have the responsibility to: 1. Compliance with the requirements of this regulation and the specific instructions of the Vietnam aviation related activities.
2. In compliance with the environmental protection requirements under the guidance of the Vietnam aviation.
3. Compliance with the requirements for aviation security.
4. the Establishment and retention of records and documents relevant to its activities under the provisions of this regulation and the specific instructions of the Vietnam aviation.
5. Provide papers, documents, records at the request of the competent person.
6. Exhibiting of certificates are issued to organizations in visible place of the head office; carry permits, certificates are issued to individuals when making the work recorded in the license.
Article 5. Application of preventive measures to ensure the safety of 1. In the event of breach or no longer meet standards, conditions of license, certificate, permit or other documents issued or issued by the Bureau of Vietnam Airlines, Vietnam Airlines Director General can adopt the following measures: a) asked to suspend flights to prevent the menace of flight safety;
b) suspension, suspension term licenses, certificates, allowing text or other text;
c) revoke the licence, certificate, permit or other text;
d) to change the content, scope of activity licences, certificates, allow text or other text;
DD) re-examined to sublicense, license certificate, allowing text or other text.
2. The application of the preventive measures prescribed in paragraph 1 of this article must be established, in which the text stating the nature and extent of the acts dealt with recommendation process, fix or verify for violations, of the measures already applied handle. Director of Department of Vietnam Airlines must take responsibility for its decisions in accordance with the law.
Article 6. Apply the administrative procedure

1. The application or issued, renewed, modified, recognized the validity of the licence, certificate, permit or other text, other documents issued or issued by Vietnam aviation must pay the fees and charges prescribed by the law. Recommended records issued or issued must have a receipt or equivalent papers acknowledged have filed the prescribed fees.
2. The holder of a licence, certificate, permit or other documents issued or issued by Vietnam Aviation may request to change the name on the paper. The suggested name change records including original papers suggested the name was changed and the document proving the change of name.
3. The holder of a licence, certificate, permit or other documents issued under the authority of the Vietnam aviation if changes to the current mailing address, only made his powers in the papers that if reported to the Vietnam aviation writing about your new mailing address within 30 days of change.
4. The licence, certificate, permit or other text, other documents issued or issued by Vietnam aviation can offer to Vietnam aviation copies if documents are lost or broken. 5. license, certificate, permit or other documents issued or issued by Vietnam Aviation may be revoked or suspended if one of the following cases: a) Has forged or deliberately confused in profile grant proposals;
b) Has forged or deliberately confused when recorded in the technical logs, record or report as required by this regulation;
c) papers that were repaired or copy aims to forge.
6. license, certificate, permit or other documents issued or issued by Vietnam aviation will expire if cancelled, suspended or revoked; who granted the kind of paperwork that must return the papers to the Vietnam aviation when requested.
7. Unless Vietnam aviation approved, the permit, certificate, permit or other documents issued or issued by Vietnam aviation was suspended for not applying similar paperwork levels within the time limit is suspended; If that paperwork destroyed, recovery is not applying similar papers issued within 1 year from the date of cancellation, withdrawal.
8. The person to be granted a license, certificate, permit or other documents issued or issued by Vietnam aviation can quit with the intent to delete documents or other papers to be given limited scope or to delete a number of specific features.
Article 7. Authorised person 1. Vietnam aviation can authorize individuals, organized as the representative of Vietnam aviation to reviews, surveys, testing, testing, testing for ship, individuals, organizations to license, certificate, permit or other text.
2. Vietnam aviation made the authorization on the basis of reviews of experience, training and commitment, ensuring that authorized users who are authorized to meet the following conditions: a) have adequate equipment, human resources, it is suitable to work as required;
b) receive training on the processes and procedures of the Vietnam aviation to conduct the required work;
c) Has enough experience in relation to the work as required.
3. Depending on the content and the type is authorized, the authorized persons have the following rights: a) conducted the work at the location are authorized;
b) reception and evaluation of records suggest a license, certificate, permit or other text;
c) conduct reviews, surveys, testing, testing, testing;
d) grant or refuse a licence, certificate, permit or other text;
DD) approved the technical documentation;
e) charge for which the person performing work in accordance with the law.
4. Authorized Persons will be issued a certificate of authorization which stated the purpose, content, duration and type of authorization. Authorization will be valid until the expiry date stated in the authorization text but not more than 24 months from the date of issue, unless terminated sooner. The authorization can be renewed.
5. The authorization expires in the following cases: a) at the request in writing of the authorized person;
b) at the request in writing by the employer in case of need the introduction of the employers for authorization;
c) when the person authorized is no longer working for the employer has introduced with regard to the authorization;
d) when the person authorized to violate the law or do not perform their duties properly authorized;
DD) When the authorized person's help was no longer needed for Vietnam's Aviation Bureau or in the case that Vietnam aviation necessary.
6. the Commissioner shall report periodically or irregularly as required, keeping a copy of all documents to be issued when the execution authorized in an appropriate place according to the rules of the Vietnam aviation.
7. For any reason and at any time, the Vietnam Civil Aviation Administration has the right to unrestricted access work, staff, record, document, the work of the person authorized to examine the performance of authorized tasks. Person authorized to provide promptly to the Vietnam aviation notices periodically or irregularly as required on time, location work was commissioned and created favorable conditions for the inspection of the Vietnam aviation.
Article 8. The exemption, exemption, exception 1. Vietnam Aviation may approve a waiver, exemption or exception with regard to the implementation of the requirements of this regulation. If the applicant is not a citizen or legal resident in Vietnam, must appoint a representative in Vietnam;
b) information related to the proposal, including: quoting the specific requirements that the applicants wish to apply mitigation; technical details the type of extraction is performed with the mitigation; detailed description of the proposed alternative requirements to meet equivalent safety levels; details about the time limit or the expected plan to mitigate; the basis for applying mitigation; how compliance after the end of the time limit for requesting relief; presentation of actual circumstances and reasons for the request for emergency processing;
c) prove the alternative proposal reached safety at least equivalent to the requirements of this regulation, in accordance with the common interest and must contain the following information: (i) a description of the relevant issues and experiences about the accident that the applicant for that involves applying mitigation;
(ii) identify all possible risks if allowed to apply the other proposed projects and measures to be applied to address risks;
(iii) proof that the arguments about public safety and the safety level equivalent is unfounded.
3. After reviewing the adequacy and accuracy of the information in the application, the Vietnam aviation technical assessment on the feasibility of alternative methods. Who was conducting technical reviews to report in writing on the need to alleviate the requirements, the ability to have adequate safety levels, the approved replacement methods match the common interest and make recommendations on the form of decision. Vietnam aviation must be publicly any corresponding decisions are proposed and the dissemination of information for the following objects: a) who have registered in advance with Vietnam aviation due to the benefits related to any of the exemption, exemptions or exceptions can be approved;
b) The person or organization has a license, certificate, specify the same extraction; form of approval or other permission could be affected by that decision.
The person or organization can answer, not opposed or objected to the proposed decision within 30 days to review Vietnam's Aviation Bureau.
4. Individuals or organizations can apply to apply any exemption, exemption or similar would have been adopted or are being considered. The filing is done according to the procedure defined in this article.
5. The approved exemption, exemptions or exceptions will be granted Vietnam aviation decided to apply or change the scope of activities. If the proposal is rejected, the Vietnam aviation must be notified in writing to the applicant.
6. Vietnam aviation will publicly the exemption, exemptions or exceptions had been granted in aviation news announcement of Vietnam. b) individuals or organizations that have a license, certificate, specify the extraction or other form of approval or other similar permit text;

c) new people applying for a license, certificate, specify the extraction or other form of approval or consent related.
Article 9. Recognizing the validity of the papers, documents 1. Vietnam aviation can use permit, certificate, approval, or consent by the ICAO member country to another level or issued as the basis for the licensing, certification, approval, or consent has the same or more restricted permissions with conditions : a) comply with the corresponding provisions of this regulation on the conditions and procedures to recognize valid papers, foreign material;
b) not to use the process in effect to deny their responsibility in ensuring the original documents are used and are issued in compliance with the ICAO standards;
c) conduct tests or additional checks needed on engineering and administration to confirm the capacity of people to be granted and in force the parchment, the document recommended the recognised.
2. The papers, documents are issued to recognize Vietnam Aviation may be amended, suspended, revoked or cancelled according to the conditions and procedures similar to other texts by Vietnam Aviation Bureau granted or issued.
3. Unless otherwise specified, each permit, certificate, approval, specify, or text allowed for by the Vietnam Aviation Bureau granted or issued through the process of recognizing the effect will lapse when the text is used as the basis for granting or issuing lapse , not be circulating, expires or is the ICAO Member States to grant or revoke the suspension, issued.
4. Vietnam aviation must inform the aviation authorities of other ICAO Member States if in the process of certification, testing, monitoring or investigation, the Vietnam Civil Aviation Administration determines that the holder of a certificate, permit, approval, or consent is granted or issued in the process of recognizing the effect : a) does not have the ability or the condition to keep the text;
b) does not match the current ICAO standard or the national regulations applicable to the text;
c) perform the operations below the standards of international safety practices involved.
5. The person is recognized by Vietnam aviation certificate, permit, approval, or allow text responsibly: a) ensure compliance with the provisions of this regulation or the law of the Member State where the ICAO level or issued the original text;
b) observance of the inspection, verification of the Vietnam aviation for the maintenance of the competence and compliance with the standard, the basis of the level or issued documents;
c) to present for the tests or additional checks needed for technical or administrative conducts Vietnam Aviation Bureau to ensure the maintenance of power and effect papers, documents to be recognized.
6. The papers, the document is considered Vietnam's Aviation Bureau acknowledged, recognized in force include: a) the type certificate, supplemental type certificates;
b) certificate of eligibility;
c) health certificate;
d) license, of the aviation staff referred to in chapter IV of this regulation;
DD) certificate of the exploitation of the ship;
e) certificate approved maintenance organisation;
g) training organization certificate is approved;
h) approve, specify or allow for text materials, facilities, equipment, training, equipment and instruments assume approved individually in the technical certification process;
I) authorization for an individual performs some of the functions, duties and on behalf of the safety supervision authorities.
Chapter 2: AIRCRAFT ELIGIBILITY CRITERIA section I. ELIGIBILITY CRITERIA, CONDITIONS, sequence TYPE CERTIFICATION PROCEDURES, FLIGHT QUALIFIED CERTIFICATE article 10. Article 75. Quality assurance system of AMC 1. The basis was the AMC certification must maintain a quality assurance system is approved by Vietnam's Aviation Bureau to ensure that the equipment, staff, health inspection work and profile data to comply with all relevant regulations.
