Pursuant to the law of civil aviation Vietnam on June 29, 2006;

Considering the recommendation of the Minister of transport, the DECREE: chapter I GENERAL PROVISIONS article 1. Scope and objects 1. This decree regulating the implementation, ensure the flight muscle of Vietnam and special flights of foreign aircraft in the Vietnam Sun; the responsibilities of the bodies in the work unit, ensure the flight muscle.

2. The object of this Decree apply include the Organization, individuals related to the organizations make sure the flight muscle of Vietnam and special flights of foreign aircraft in the Vietnam Sun.

Article 2. Explanation of terms In this Decree, the terms below are interpreted as follows: 1. The flight muscle is the flight used completely separately or combined trade and transport are the competent State Agency confirmed or reported under the provisions of this Decree.

2. The flight muscle of Vietnam is the flight muscle by Vietnam Airlines or by units of the Ministry of defence made in, outside of Vietnam.

5. The Ministry of Foreign Affairs in coordination with the bodies concerned regulations of ritual farewell flight muscle of Vietnam and foreign countries.

6. The Ministry of finance instructed the estimating, billing, settlement the State budget for ensuring the protection, special flights of Vietnam.

Article 6. c) domestic flight muscle due to Department of Defense: Joint Chiefs of staff, operations, the Consular Bureau, Bureau of State reception, The Commander of the police, Defence Forces-the air force and the army unit concerned;

d) special international flights due to Ministry of defence: the reception Bureau, Bureau of State-Ministry of Foreign Affairs, a guard commander, operations, airspace, air force-Vietnam Aviation-Ministry of transport, the Corporation ensure Vietnam flight operations.

3. The time limit for notification delivery flight muscle of Vietnam as follows: a) for flights using separate aircraft: minimum 5 days before the date planned for domestic flights; a minimum of 10 days before the date envisaged for the international airport;

b) for combined flights of commercial shipping: minimum 24 hours before scheduled take off for domestic flights; a minimum of 5 days before the date of implementation for international flights;

c) for professional military muscle: the Defense Department is ready to respond as required.

4. the competent authority informed the flight muscle of Vietnam is responsible for timely notification to the agencies, relevant units of the content changes related to professional duties.

5. The agency or receive flight notification unit specialized in Vietnam's basic responsibility to implement, record and archive full of details about the implementation of prescribed duties.

Article 9. The competent authority informed the flight muscle of foreign countries 1. The bodies referred to in article 7 of this Decree.

2. Operations-Department of Defense.

3. the Consular Bureau, Ministry of Foreign Affairs.

4. Vietnam Aviation-Ministry of transport.

Article 10. Delivery notice dedicated flight of foreign body 1. Notice of special flights abroad are made in writing or permitted to fly with the content referred to in paragraph 1 of article 8 of this Decree.

2. Written notice of special flights abroad are sent to the agencies, the following units: a) for flight fly away, fly to Vietnam: the reception Bureau, Bureau of State-Ministry of Foreign Affairs, a guard commander, Vietnam, aviation operations, Defence Forces-the air force, and the Corporation for operational flying Vietnam;

b) for transit flights flight Vietnam: Vietnam aviation, operations, Defence Forces-the air force, and the Corporation for operational flying Vietnam.

3. Notice of the flight muscle of Foreign Affairs received a minimum of seven (7) days prior to the scheduled flight, except in special cases.

Chapter III LIABILITY of the AGENCY, the UNIT and the ORGANIZATION CONCERNED article 11. The responsibilities of the agencies and units of the Ministry of transportation 1. Vietnam's Aviation Bureau is responsible for: a) Is receiving clues, mission deployment ensures the flight muscle of Vietnam by Vietnam Airlines made, special flights;

b) monitor compliance with technical standards, ensuring security, safety for the professional flight of Vietnam by Vietnam Airlines;

Article 12. The responsibilities of the agencies and units of the Department of Defense operations, Defence Forces-the air force made the management, in collaboration with the business provides air traffic services for aircraft operating the flight muscle in the Notification Manager by Vietnam; coordinate with related agencies to deploy special flight service go to the airport by the Department of Defense management; direct implementation, professional flight management by Vietnam's Defense Ministry made.


Article 13. The responsibilities of the agencies and units of the Ministry of Foreign Affairs 1. The Bureau is responsible for coordinating with airlines of Vietnam or the unit of the Department of Defense assigned specialized flight muscles of Vietnam made the excuse of foreign aircraft through diplomatic lines for special flights; permission for the flight muscle of the foreign jurisdiction.

2. State reception Bureau is responsible for ensuring the implementation of ritual farewell flight muscle of Vietnam at airports, airports; ensuring the coordination of ritual farewell flight muscle of Vietnam at international airports, the airport of Vietnam; implementing the ritual farewell flight muscle of foreign airports, Vietnam airport.

Article 14. Article 15. The responsibility of the Party Central Office, Office of the President, Office of the National Assembly, the Office of the Government 1. 3. In the case of receiving written notice of the special flight to Vietnam later than the time specified in article 8 paragraph 3 of this Decree, Vietnam Airlines must report immediately to the authorities, the relevant unit about the difficulties and obstacles to coordination and timely processing.

Article 18. The responsibility of the provincial people's Committee, the city in Central 1. In collaboration with the Ministry of public security and other agencies, relevant units oversee the Organization ensuring security, safety, order, ceremonial welcome for Vietnam's special flight and the flight of foreign professionals in aviation, ports and airport in addition to the airport.

2. In coordination with the Foreign Ministry to deploy ritual farewell flight muscle of Vietnam and the ritual farewell flight muscle of foreign airports, local airport.

Chapter IV the TERMS OF IMPLEMENTATION of article 19. Terms of implementation 1. The Decree has effect after 45 days from the date of signing. The previous provisions contrary to this Decree are repealed.

2. Office of the Communist Party, Chairman of the Office of the President, the President of the Office of the National Assembly, Ministers, heads of ministerial agencies, heads of government agencies, the Chairman of people's Committee of the province or city level, heads of agencies, units, the organization concerned is responsible for the implementation of this Decree.
