Considering the recommendation of the Minister of labor, invalids and Social Affairs, the Minister of finance, DECIDES: 1. In 2009, enterprises having difficulties due to the economic downturn does not yet have the ability to pay wages, social insurance and pension money lose jobs or retrenchment under the provisions for workers to lose jobs, the State loans to pay, specifically the following : 1. The object of the loan: businesses having difficulty due to the economic slowdown that is reducing the number of existing workers from 30% or from 100 workers or more (not counting workers have a time limit of less than 3 months) and after you have used the resources of the enterprises that still do not yet have the ability to pay wages social insurance, pension and job loss or retrenchment for labor has fallen.

2. Loan duration: a maximum of 12 months.

3. loan Rate: maximum loan rate by number of funds for payment of arrears of salary, social insurance premiums and subsidies job loss or retrenchment pay for workers who lost jobs.

4. Interest rate: 0% (not percent).

5. Lending institutions: Vietnam Development Bank.

Article 2. For workers who lost jobs at businesses that business owners fled in 2009: the provincial people's Committee, the central cities of local budget effects pay for workers in the list of business account pay wages that the business owed workers. Sources from the local budget in advance to be repaid from revenues when done handling the assets of the business in accordance with the law. Article 3. Article 4. The responsibilities of the Agency 1. Enterprise: a) plans the labor arrangements, borrowing needs and making loans under the rules;

c) report Department of labor-invalids and social projects on the implementation of the labor arrangements, payment of wages, social insurance premiums and subsidies job loss or retrenchment for workers under the provisions of the Ministry of labor, invalids and Social Affairs.

2. The Ministry of labour invalids and social: a) presiding, in cooperation with the Ministry of finance and the relevant agency Guide and check the implementation of this decision;

3. Ministry of planning and investment to host, in cooperation with the Ministry of Finance: a capital source for additional Funds) on employment in the national target programme on employment;

b) arranged funds clearing bank for social policy to lend an apprenticeship, go work abroad as stipulated in paragraph 2, paragraph 3 of article 3 of this decision.

4. The Ministry of finance, in cooperation with the Ministry of planning and investment funds layout make up interest rates to Vietnam Development Bank loans to businesses paying salaries, social insurance premiums and retrenchment or job loss allowance as defined in article 1 of this decision and instruct the , the central city in the making.

5. Vietnam Development Bank responsible for mobilizing and organizing the implementation of loans as defined in article 1 of this decision.

6. The social policy Bank responsible for mobilizing and organizing the implementation of loans as defined in article 3 of this decision.

Article 5. Enforcement provisions: 1. The decision to this effect from the date of enforcement.

2.
