Pursuant to the law on organization of the Government of 25 December 2001;

Basing the Ordinance about the representative body of the Socialist Republic of Vietnam abroad on December 2nd, 1993;

Pursuant to Decree No. 183-CP by the Government on November 18, 1994, detailing the implementation of the Ordinance on the representative body of the Socialist Republic of Vietnam;

Pursuant to Decree No. 15/2008/ND-CP DATED April 2, 2008 of the Government functions, tasks, powers and organizational structure of the Ministry of Foreign Affairs;

Considering the recommendation of the Minister of Foreign Affairs, DECIDES: 1. The position and function 1. Delegation to the Permanent Representative of the Socialist Republic of Vietnam on the side of the United Nations, the World Trade Organization (WTO) and other international organizations at the Jam-ne-Venice, Switzerland (hereinafter referred to as the Mission) is the official representative body of the Socialist Republic of Vietnam relations with the U.N. , WTO and other international organizations at the Jam-ne-Venice, in accordance with the relevant international treaties to which Vietnam participates.

2. the English name of the mission is the Permanent Mission of the Socialist Republic of Viet Nam to the United Nations, the World Trade Organization and other International Organizations at Geneva (referred to as the Vietnam Mission to the UN and the WTO at Geneva).

Article 2. Duties and powers 1. The representative of the Socialist Republic of Vietnam next to the UN, the WTO and other international organizations at the Jam-ne.

2. Protection of the rights and interests of the Socialist Republic of Vietnam to the United Nations, the WTO and other international organizations at the Jam-ne.

3. Promoting cooperation between the Socialist Republic of Vietnam to the United Nations, the WTO and other international organizations at the Jam-ne-Venice, as well as with the Member countries of the international organization; enlist the assistance and technical cooperation of the International Organization for the career development of the country.

4. Perform consular duties to protect the rights and interests of the State, legal entities and citizens of Vietnam in accordance with the provisions of the law of Vietnam and the country.

5. Join the signing, joining international treaties in accordance with the law.

6. Implement state management for the operation of the Socialist Republic of Vietnam next to the UN, the WTO and other international organizations at the Jam-ne.

7. oversee the Organization of administrative reform under the program, planning and guidance of the Government, the Prime Minister and Minister of Foreign Affairs; make the resolution of complaints, accusations, against corruption, against waste, saving practices as prescribed by law.

8. Implementation of the provisions of the State and of the Ministry of Foreign Affairs on the work of the administrative, financial, accounting, clerical, archive, protect State secrets, security authorities and labour discipline.

9. the management, use and protection of property, the facilities of the mission and the use of funds granted by the State budget a saving, efficiency in accordance with the law.

10. Performs other duties and powers as directed, assigned or authorized by the President, Prime Minister, Minister for Foreign Affairs and, in accordance with the law; make the direction of the Minister of industry and trade of the WTO-related tasks.

Article 3. Organizational structure and staffing 1. The room of the United Nations and other international organizations, known as the room of the United Nations, the English name is the UN and International Organizations Affairs Office (referred to as the UN Affairs Office).

Article 4. Leader of delegation 1. Ambassador, head of delegation is the highest representative of the State of Vietnam in the relations with the UN, the WTO and other international organizations at the Jam-ne-Venice, the Mission operates under the heads mode, on the principle of concentration, of democracy.

2. Ambassador, head of delegation is appointed by the President, is head, directed, and comprehensive management for all activities of the mission; be sent and summoned under the provisions of the law. Ambassador, head of delegation is a member of the foreign national Committee of international economic cooperation.

3. The Deputy Head of the delegation by the Minister of Foreign Affairs appointed diplomatic match in accordance with the law and is responsible for helping the Ambassador, head of delegation of professional direction and administration of the subdivisions listed in points 1, 2, 3 of article 3 of this decision and other tasks as assigned by the Ambassador , Head of the delegation. Deputy Head of delegation in charge of WTO Rooms are appointed on the basis of the recommendation of the Minister of industry and trade.

4. Article 5. Duties and powers of the Ambassador, head of delegation of the representative; Deputy Head of delegation representatives and members 1. Ambassador, head of delegation have duties and powers: a) directing and organizing the activities of the representative of the Socialist Republic of Vietnam next to the UN, the WTO and other international organizations at the Jam-ne-Vancouver in accordance with the agreement of the Socialist Republic of Vietnam to the international organization which in the correct way , foreign policy of the State in relation to the relevant international organizations;

d) directing officers, civil servants, officers of the mission implement strictly the way, foreign policy of the State and management of labor discipline of officers, civil servants, officers of the mission aims to create favorable conditions for public servants to fulfill assigned tasks in line with the professional direction of the governing body, a Government negotiator and the authorities;

DD) manage the facilities and the whole of the budget related to maintain the operation of the mission and other budget items under the provisions of the law.

e) timely reporting of the Government, the President, Prime Minister, Minister of Foreign Affairs and the authorities in the country the advocates, formulation of strategic significance to the United Nations, the WTO and other international organizations at the Jam-ne-Venice that affect security, defense, economy , trade and other issues of Vietnam;

2. The Deputy Head of the delegation whose mission and authority: a) made and take responsibility for the task to be the Ambassador, head of the delegation in charge of the assignment;

b) Organization and responsible to the Ambassador, head of delegation on the activities of the unit are allocated and assigned in charge;

c) regular reporting of the Ambassador, head of the delegation on the implementation of the work is assigned in charge;


d) Deputy Head of the delegation in charge of WTO, Rooms at the same time as Deputy Permanent Representative of the Socialist Republic of Vietnam in the WTO is responsible for the direction, organization and the functioning of the operating Room under general direction of Ambassador; have a responsibility to report the Ambassador, head of the delegation on the implementation of the regular work of the room.

3. The members of the delegation have the duties and powers: a) make full and responsible for the mission was the Ambassador, head of delegation of the assignment;

b) actively contribute to strengthening cooperation between the Socialist Republic of Vietnam with the organizations of the United Nations, the WTO and other international organizations at the Jam-ne-Venice;

c) comply with the law of the Socialist Republic of Vietnam, the Charter and the Charter of the United Nations Organization, the WTO and other international organizations at the Jam-ne-Venice; respect for and implementation of the law and international practices, the laws of the country.

Article 6. Reward and discipline 1. The forms, modes of rewards are applied according to the current rules of the State and the Foreign Ministry.

2. The violations of the laws of the Socialist Republic of Vietnam, Switzerland; The Charter and the Charter of the United Nations Organization, the WTO and other international organizations at the Jam-ne-Venice and the provisions of this decision, based on the level of violation, may be processed by the form of disciplinary, administrative sanction or prejudice criminal liability under the law.

3. The Minister of Foreign Affairs, in collaboration with the Minister of industry and trade and the Minister, the heads of the competent authorities in the country to decide the form of discipline for officials and employees working in the mission as proposed by the Ambassador, head of delegation.

4. The Ambassador, head of delegation has the right to decide to take on Member State delegations in the event of breach of the provisions referred to in this Article, causing serious consequences and timely report to the Minister of Foreign Affairs and the heads of the competent bodies in the countries reviewed, resolved. In the event the breach is the Ambassador, head of delegation of the Minister of Foreign Affairs has the right to decide to take on water and this decision must be reported immediately to the President and the Prime Minister.

Article 7. The effect and enforcement responsibilities 1. This decision has effect from 1 June 2009 and repealed the previous provisions contrary to this decision.

2. Ministers, heads of ministerial agencies, heads of government agencies, the Chairman of the provincial people's Committee, the central cities, head of delegation of the Permanent Representative of the Socialist Republic of Vietnam next to the UN, the WTO and other international organizations at the Jam-ne-Venice and the agencies related organizations, is responsible for the implementation of this decision.
