The CIRCULAR regulates the order of quarantine procedures, seafood, seafood products _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ pursuant to Decree 1/2008/ND-CP dated 03/01/2008 of the Government functions, tasks, powers and organizational structure of the Ministry of agriculture and rural development; Decree No. 75/2009/ND-CP on 10/9/2009 of the Government on the amendments to article 3 of the Decree No. 01/2008/ND-CP dated 03/01/2008 of the Government functions, tasks, powers and organizational structure of the Ministry of agriculture and rural development;

The Ministry of agriculture and rural development regulation sequence, the quarantine procedures of fisheries, aquatic products as follows: chapter I GENERAL PROVISIONS article 1. Scope and objects 1. This circular regulates the order and quarantine procedures for fishery products, the fishery products when domestic, export, import, re-export, import export temp re enter, move the gate, transiting the territory of Vietnam.
2. This circular apply to organizations and individuals, Vietnam; organizations, foreign individuals have manufacturing operations, business and transport of fishery products, the fishery products on the territory of Vietnam. 
Article 2. Explanation of terms some of the wording in this circular are interpreted as follows: 1. Fisheries: are animals or all stages of the life cycle of life in the country include the species of fish, crustaceans, molluscs, prickly skin, sponge, sinus colon, amphibians, worms, reptiles and mammals live under water, including the eggs look like , sperm, embryos and larvae.
2. Aquatic products like: Is the type of fishery products used to produce the same, do the same for commercial farming or farmed landscape including the eggs, sperm, embryos and larvae.
3. commercial fisheries: aquatic species Are used to make food, raw materials for food processing, animal feed, feed for aquaculture or use with other purposes.
4. fishery products: includes aquatic products was dead in the form of whole fish, other products derived from aquaculture.
5. Raw materials for food processing: Is the type of seafood, seafood products are used as raw materials for food processing before consumption.
6. Quarantine: Is the Fed kept completely isolated from aquatic products for direct or indirect contact with other aquatic products in a certain period of time to check out the room.
7. Where livestock quarantine: quarantine areas include; hot temporary custody of business establishments; hot, Central pond cultivation base of animal breeds, production, business like aquatic products used to feed the quarantine.
8. Owner: is the owner of fisheries and aquaculture products, or the Manager, agent, escorts who transport, health care, preserving fisheries and aquaculture products represented the owner.
Article 3. Aquatic quarantine guidelines, fishery products 1. Fisheries and aquaculture products, when shipped, the circulation in the country must be quarantined 1 time at the place of departure in the following cases: a) aquatic breeds;
b) commercial fisheries, aquatic products taken out of the region has published translator for that species of competent bodies;
c) aquatic product used as a raw material for the processing of animal feed, food for aquatic products.
2. Fishery products, the fishery products for export must be quarantined in the following cases: a) international treaties, bilateral, multilateral agreements that Vietnam has signed or participated in should quarantine regulations;
b) at the request of the owner or the importer;
3. Fishery products, the fishery products import, re-export, import export temp re enter, move the gate, transiting the territory of Vietnam must be registered with the Department of veterinary quarantine. quarantine registration must be done before the owners signed a contract with the exporter.
4. Fishery products to be imported breed livestock quarantine in place ensure the required veterinary sanitation, veterinary agencies have the authority to approve and monitor during quarantine.
5. the quarantine time to quarantine aquatic products, aquatic products, depending on the disease, each kind of seafood but not more than 10 days. If the above mentioned time limit, animal quarantine agency must inform the shippers knew the reason.
6. The case of sampling the seafood, seafood products to disease testing, checking the sanitary veterinary norm, according to the guidelines in annex 1 attached herewith;
The case of fisheries and aquaculture products imported from these countries have mutual recognition agreements with Vietnam is not insulated and the test sample (except in the case of detection of fisheries there are manifestations of the disease), the sanitary and veterinary norms recognized each other.
Article 4. Sample quarantine profile fisheries, aquatic products samples of quarantine profiles fisheries, aquaculture products as defined in Appendix 2 attached to this circular contains: 1. quarantine Declaration Paper fisheries, aquatic products transported in water (sample 1);
2. The paper the quarantine report fisheries and aquatic products export and import (form 2);
3. the quarantine certificate (form 3): used for aquatic products, aquatic products export, import, re-export, import the temporary transfer, in transit the territory of Vietnam Customs cargo service at the gate (attached to circular No. 17/2003/TTLT/BTC-BNN & RURAL DEVELOPMENT-BTS on 14/3/2003 between the Ministry of finance and the Ministry of agriculture and rural development-Ministry of fisheries);
4. a quarantine certificate of fisheries, aquatic products shipped out of the country a) Form 4a: use case in animal quarantine authority does not perform the authorized quarantine and quarantine certification of animals, animal products transported in water;
b) form 4b: use case in animal quarantine agencies perform the authorized quarantine and quarantine certification of animals, animal products transported within the country under decision No. 126/2008/QD-BNN on December 30, 2008 by the Minister of agriculture and rural development (hereinafter the decision No. 126) on the amendments additional, decision No. 86/2005/QD-BNN on 26/12/2005 of the Minister of agriculture and rural development (hereinafter the decision No. 86);
5. a quarantine certificate of fisheries, aquatic product export (form 5): used for the case of fisheries, fisheries products are not used as food; make gifts, the notebook, the diplomatic bag export to countries that do not have an agreement with the competent authorities of Vietnam about a quarantine certificate sample seafood, seafood products;
The case of fisheries, fishery products for export to countries that have agreements with the competent authorities of Vietnam about a quarantine certificate form of fisheries, aquatic products importing country or own request quarantine certificate template to use quarantine certificate templates.

b) quarantine certificate of fisheries, aquatic products to temporarily enter the re-export, transfer, transit the territory of Vietnam: 2 a Original (01 a save at animal quarantine authorities entry gate, 7 a gives shippers); 2 a Copy of the level for the shippers (01 a save at animal quarantine authority export gate, 1 submission to quarantine animals enter the gate when the quarantine procedures for the next batch).
4. animal quarantine agencies have the authority to be responsible for printing, use of quarantine profiles sample seafood, seafood products in accordance with the current rules.
5. Prohibit the printing, distribution and use of records contrary to the provisions of this circular.
Article 6. The time limit for the value in use of the quarantine certificate for fishery products, the fishery products 1. The time limit for the value in use of the quarantine certificate for fishery products, aquatic products, domestic shipping is calculated according to the time of transport from the place of departure to the final destination.
2. The time limit value use the quarantine certificate of fisheries, aquatic products export and import value of use not to exceed 60 days.

3. The time limit for the value in use of the quarantine certificate for fishery products, the fishery products to temporarily enter the re-export, transfer, transit the territory of Vietnam is calculated according to the maximum time allowed for stay on the territory of Vietnam.
Article 7. Authority to quarantine and quarantine certification of fisheries, fisheries products 1. Authority to quarantine and quarantine certification of fisheries, aquatic products transported in water.
a district level veterinary Stations) make quarantine and quarantine certification of fisheries and aquaculture products, when shipped within the province;
b) provincial animal health Bureau perform quarantine and quarantine certification of fisheries and aquaculture products, when shipped outside the province;

b) fisheries, aquatic product import, re-export, import export temp re enter, move the gate, bonded, to transit the territory of Vietnam.
3. quality control agency in the Department of management of the quality of agricultural production and fisheries implemented quarantine and quarantine certificates for fishery products, the fishery products exported for use as food.
Article 8. Veterinary hygiene requirements for the place of quarantine of fisheries 1. Where livestock quarantine: a) location where the quarantine must facilitate the localization, press room when the disease has occurred;
b) Aquarium, the pond is suitable for the clinical examination, sampling tests;
c) Have the banks, wall cover to prevent the direct or indirect contact with the external fisheries; minimize the impact of environmental conditions to the same aquatic breeding time in quarantine;
d) pond, Aquarium is handled the leak proof, spill-resistant water;      
DD) convenient for disinfection, hygiene and sanitation must be detoxification, detoxification disinfection before and after each batch of livestock quarantine;
2. Water used in farming quarantine period: a) Has adequate water use veterinary hygiene standards;
b) Have separate plumbing system; do not use water feed from the tank, the other pond.
3. feed use in livestock quarantine period: a) Has enough food to ensure animal health and hygiene conditions, the quality and fit for each species;
b) Have separate food preservation repositories.
4. Get enough aquatic veterinary medicines, chemicals, biological products used during livestock quarantine.
5. Equipment and tools: a) the equipment, farming tools to ensure animal health and hygiene requirements;
b) Is sanitation, reduction of disinfectant before and after each use;
c) do not use generic tools, equipment during quarantine.
6. Have the system record books with information on disease situation, using food, veterinary drugs, chemicals, biological products in farming quarantine time.
7. Take measures sewage waste, ensure hygiene standards before release.
Chapter II procedure of the QUARANTINE ORDER seafood, SEAFOOD PRODUCTS category 1 fisheries, QUARANTINE AQUATIC PRODUCTS SHIPPED in the COUNTRY article 9. A quarantine report fisheries and aquatic products transported in water 1. Shippers must declare a quarantine with veterinary Stations when shipped within the Department or Bureau of animal health when shipped out of the province. Quarantine Declaration time shall be as follows: a) for aquatic breeds must declare at least 3 days prior to shipment;
b) for commercial fisheries, fishery products must declare at least 2 days prior to shipment.
2. the quarantine report records include: a) quarantine Declaration Paper fisheries, aquatic products transported in water (sample 1);
b) a copy of the certificate, secure base disease emergence of aquatic products (if any);
c) examination results slip copy seafood (if available);
d) license of the Rangers for fisheries, aquatic products in the species list animals endangered wild plants, and rare under the provisions of the law of Vietnam or the provisions in the Appendix of CITES.
3. Confirm the quarantine Declaration: a) right after getting the records prescribed in paragraph 2 of this article, the Agency of animal quarantine check declarations and related documents; If the profile is not valid, then the full owners manual complete records as prescribed;
b) during 7 working days from receipt of valid records, based in epidemic situation where, animal quarantine authorities confirmed a quarantine Declaration, notice of the place, the time conducting quarantine and prepare the conditions to check out the room.
Article 10. Quarantine for aquatic products like 1. The room is done right in the temporary custody of the tank base business; hot, Central pond cultivation base of animal breeds, production, business like fisheries.
2. check, monitoring during quarantine.
During 1 work day, since fisheries are concentrated in places where regulation, the Agency must conduct animal quarantine check out room.
a) check the number, type, size, fishery products follow a quarantine Declaration records;
b) examined clinical symptoms during the quarantine, if infectious disease aquatic facilities, quarantine agency sample pathogens (focused on the suspected individuals infected) according to the category of objects of animal quarantine, animal products and aquatic products attached to decision No 110/2008/QD-BNN on 12/11/2008 of the Ministry of agriculture and rural development (after This is called the quarantine objects directory).
c) sample test, the test of diseases in aquatic diseases category must publish room for the case: aquatic products used to produce the same; aquatic products of unknown origin in the base business like fisheries.
Within 7 working days, animal quarantine agency must send samples to the laboratory to check the target disease.
d) with regard to fishery products originating from the region, secure base disease do not have to do tests for the disease has been recognized disease safety.
3. in less than 10 working days from receipt of samples, laboratory test results must be reported to animal quarantine authorities.
Test case results in doubt, animal quarantine agency must inform the shippers know to sample check. In less than 2 working days, the lab must announce test results for animal quarantine authorities.
4. During 1 working days from receiving the full test results, if enough aquatic veterinary hygiene standards, animal quarantine agencies performed: a) check veterinary hygiene conditions for transport and widgets;
b) quarantine certification (form 4a or 4b) for aquatic products breeding veterinary sanitation standard within 12 hours before shipping.
Quarantine records for shippers include: quarantine certificate (given to shippers), the quarantine certificate of fisheries, aquatic products shipped out of the country, a copy of the reply slip test results (if any); a copy of the certificate, secure base disease emergence of aquatic products (if any) and other relevant documents.
c) perform or supervise the disinfection, hygiene and detoxification for transport and supplies attached for at least 6 hours before unloading the goods for carriage;
d) animal quarantine staff perform clinical examination of fisheries before unloading the goods; check, monitoring the process of unloading of seafood onto the means of transport;
owners Guide) sanitation, reduction of disinfectant where quarantine, where unloading of aquatic products.
5. for the same seafood are caught wild.
a) shippers must declare quarantine as stipulated in point a, paragraph 2 article 9 of this circular with veterinary Stations (the case to feed locally) or animal health (when shipped out of the province).
b) cases to local farming, animal quarantine agencies to perform quarantine under the provisions of point b, c paragraph 2 of this Article. After the implementation of the quarantine, if qualified aquatic animal health hygiene, quarantine agency animal quarantine certification allows put to use.
c) where shipped out of the province, animal quarantine agencies to perform quarantine under the provisions of point b, c paragraph 2, clause 3, 4 this.   
6. The case of fisheries does not ensure the required veterinary hygiene, animal quarantine agencies not quarantine certificates and conduct processing according to the regulations.

Article 12. Quarantine for aquatic products

1. The room was done right at the base, the preservation of the home.
2. check, monitoring during quarantine.
During 1 work day, since fisheries products are the focus at the prescribed place, the Agency must conduct animal quarantine check out room.
a) check the amount of aquatic products, according to the record of the report server.
b) examined the implementation of the rules on the processing of aquatic products before putting out the announcement.
c) check the status of preservation, packaging products and sensory test for aquatic products.
3. During 1 working days from receiving the full test results, if the fishery products eligible for veterinary hygiene, animal quarantine agencies performed: a) made under the provisions of point a, c paragraph 4 Article 10 of this circular;
b) quarantine certification (form 4a or 4b) for aquatic products breeding veterinary sanitation standard within 12 hours before shipping.
Quarantine records for shippers include: quarantine certificate (given to shippers), the quarantine certificate of fisheries, aquatic products transported in water and other related papers (if available).
c) check, monitoring the process of unloading of aquatic products up transport; seal the means of transport; perform or supervise the disinfection, hygiene and detoxification centres, and unloading of cargo.
4. The case of fisheries products does not ensure the required veterinary hygiene, animal quarantine agencies not quarantine certificates and conduct processing according to the regulations.
Article 13. Aquatic quarantine in local varieties of receiving 1. Animal quarantine agencies locally where receiving the shipment just made the same aquatic quarantine in place come in the following cases: a) the shipment without quarantine certificates or certificate invalid quarantine;
b) animal quarantine authorities detected the μtorrent or more fisheries when the animal quarantine agencies;
c) animal quarantine authorities detected or suspected infected seafood.
2. for shipments to quarantine, animal quarantine agencies conduct established thereon, require shippers make quarantines the shipment and sample the disease in quarantine objects list.
a) case of satisfactory test results, the quarantine authority allows the shipment are put to use.
b) where examination results do not meet the requirements, animal quarantine agencies conducted measures handled according to regulations.
QUARANTINE item 2 fisheries, AQUATIC PRODUCT EXPORT article 14. A quarantine report fisheries and aquatic products export 1. Shippers must declare the records with the quarantine authorities before shipment for at least 10 days (for aquaculture) or 5 days (for aquatic products) as defined as follows: a) for fisheries, aquatic product exports are not used for food: at animal quarantine agency in the Department of animal health;
b) for fisheries, seafood export products used as food: declared in quality control agency in the Department of management of the quality of agricultural products and fishery products.
2. Profile declarations include: a) quarantine Declaration Certificate (form 2);
b) other related documents prescribed in points b, c, d paragraph 2 article 9 of this circular;
c) copies the license of the aquaculture authority for the species named in the list of species of aquatic products export conditions or directory of fisheries export bans;
d) copies the license of the Agency CITES Vietnam for fisheries and aquaculture products in the species list animals endangered wildlife, plants, precious, rare under the provisions of the law of Vietnam or the provisions in the Appendix of CITES.
DD) A requirement that the target of the Agency's quarantine authority importer (if applicable);
e) Model certificates of quarantine at the request of the importing country authorities (if applicable);
3. Confirm the quarantine declaration made under the provisions of paragraph 3 of article 9 of this circular.
Article 15. Aquatic quarantine, export aquatic products 1. Seafood export quarantine done as specified in paragraph 1, points a, b, item 2, paragraph 3, point a, c, d, e clause 4 Article 10; clause 1, article 11 2 of this circular.
2. Check out the aquatic product export translation made under the provisions of paragraph 1, 2, point a, paragraph 3 c of article 12 of this circular.
3. Sampling check the norms required by the importing country.
4. During 1 working days from receiving the full test results, if fisheries, aquatic products eligible for veterinary hygiene, quarantine agency animal quarantine certification of fisheries, aquatic products (sample 5 sample quarantine certificate or conformity with the requirements of the importing country).
5. in case the owner or importer is not required to export quarantine: shippers must accomplish domestic transport quarantine under the provisions of Articles 10, 11, 12 for fisheries and aquaculture products specified in paragraph 1 of article 3 of this circular.
6. At the gate: a) shippers must quarantine Declaration (form 3) with animal quarantine authorities at the gate;
b) animal quarantine agencies perform quarantine records, the number, type, size seafood, seafood product volume under quarantine certificates; the health status of aquaculture, veterinary hygiene situation for fisheries products;
If a valid quarantine records; healthy seafood; aquatic products ensure the required veterinary hygiene, packing, preserving as a rule, animal quarantine agencies gate complete quarantine procedures for customs clearance procedures gate. Only change the quarantine certificate by the animal quarantine authority in animal health released if shippers or importing States have required;
c) cases detected infected seafood, infectious disease facilities; fishery products does not warrant veterinary sanitation, animal quarantine authorities quarantined shipment gate and notified to the certification authority control room performing the disposal according to the regulations;
d) performing or overseeing sanitation, reduction of disinfectant for the place of unloading, transport, waste, fillers and relevant instruments after shipping.
Category 3 AQUATIC QUARANTINE AQUATIC PRODUCT IMPORTS, article 16. Register a quarantine Declaration, fisheries, fishery products imported 1. Shippers wishing to import fishery products, the fishery products must register with the import quarantine and veterinary Bureau.
2. Registration documents include: a) quarantine application imported aquatic products, aquatic products (shippers can plan the plan to import the goods in time 3 months from the date of the registration application to import quarantine);
b) notarized business registration certificate (for business); Businesses only have to file the certificate of business registration the first time or after the change, additional lines of business;
c) Sample quarantine certificate or certificate of export quality (as required);
d) licence by the authority competent for the aquaculture species are in the catalog import is conditional or not named in the list of imports;
DD) license of the Agency CITES Vietnam for fisheries and aquaculture products in the species list animals endangered wildlife, plants, precious, rare under the provisions of the law of Vietnam or the provisions in the Appendix of CITES.
e) veterinary hygiene certificates where livestock quarantine for aquaculture products (if any);
f) HACCP certificate or equivalent of processing facilities in the country exporting aquatic products import used as food or raw material for food processing;
g) other documents relating to imports (at the request of the Department of animal health for each specific object).
3. within 5 working days from the receipt of a valid profile, disease situation bases of aquatic products for export and domestic, animal health has a responsibility to answer for shippers and guidance the Agency has the authority to check vet where hygiene and quarantine (for aquaculture); quarantine authorities quarantine animals and aquatic products, aquatic products import.
4. After the Bureau of veterinary medicine approved, shippers must declare to the animal quarantine authorities are animal health designate prior to the gate at least 8 days for fisheries, 4 days for aquatic products to perform the translation.
Profile import quarantine Declaration include: a) the quarantine certificate (form 3); in case of need, animal quarantine authorities can request shippers to declare a quarantine declaration form more aquatic products, aquatic products export and import (form 2);
b the text of answer) Department of animal health on the quarantine of imported aquatic products, fisheries products;
c) copies the quarantine certificate of fisheries, fisheries products of the exporter (if available);
During 1 work day, since getting a valid profile, animal quarantine agencies notify the owners location, quarantine time.
Article 17. Aquatic quarantine, aquatic products at the gate to enter the animal quarantine agencies performed: 1. The check quarantine import profile: a) the quarantine of imported records as defined in points a, b, d, paragraph 4 Article 16 of this circular;
b) quarantine certificate or certificate of export quality (original) content consistent with the details of the shipment (of type, number, mass, size, packaging).
2. Check the import goods; compare with quarantine certificate or certificate of export quality about the type, size, quantity, weight, condition, packaging of goods.
3. check condition of veterinary sanitation, reduction of disinfectant means of transport; perform or supervise waste shippers, fillers incurred during shipping.
4. If imports to ensure the requirements of veterinary hygiene, quarantine certificates and other related documents are valid, then the animal quarantine authority made gate:

a) granting the transport of fishery products, the fishery products import, about where quarantine (Form 6) allow shippers take goods on where quarantine (for the case of quarantine) or where the facility receiving the shipment to perform quarantine, quality control and food safety;
b) quarantine certification of fisheries, aquatic product import (form 7) for shipments not quarantine, not sample and test veterinary sanitation;
Paper transport seafood, seafood products imported on where quarantine (Form 6) or a quarantine certificate of fisheries, aquatic product import (form 7) is the basis for the customs clearance procedures gate.
5. Guide the owners the necessary requirements in the shipping process from the gate to the place of quarantine.
6. With regard to fisheries, aquatic product import does not make customs procedures at the entry gate that transferred customs procedures at the gate or other customs points, animal quarantine agencies NET: gate a) as specified in item 1, 2, and 3 of this article;
b) unloading process monitoring of fisheries, fisheries products onto the means of transport;

Article 19. Quarantine of imported seafood products to use with other purposes 1. AQUATIC QUARANTINE section 4, INTERIM FISHERIES PRODUCTS IMPORT EXPORT TEMPORARY EXPORT, RE-RE-ENTER, MOVE the GATE, TRANSITING the TERRITORY of VIETNAM article 21.
