Considering the recommendation of the Minister of transport, the DECREE: chapter I GENERAL PROVISIONS article 1. Scope 1. This Decree provisions on violations, the form and the level of sanctions, jurisdiction and procedure for sanctioning of administrative violations in the field of road traffic.

2. Administrative violations in the field of road transport are the acts of individuals, the Organization violates the provisions of the law in the field of road traffic in a manner intentionally or unintentionally not that crime and under the provisions of the law are sanctioned administrative offense , including: a) The violations of traffic rules by road;

b) The violations of the provisions on infrastructure road traffic;

c) The violations of the regulations on the media involved road traffic;

d) The violations of the regulations on drivers means taking road traffic;

DD) The violations of regulations on road transport;

e) The other violations related to road traffic.

Article 2. Application object 1. Personally, the Organization has administrative violations in the field of road traffic on the territory of the Socialist Republic of Vietnam sanctioned under the provisions of this Decree.

2. Minors have administrative violations in the field of road transport, the application of forms of handling as defined in article 7 of the Ordinance on handling administrative violations.

Article 4. The principle of sanctioning administrative violations 1. 2. The sanctioning administrative violations in the field of road traffic by the competent person specified in articles 47, 48, 49 and 50 of this Decree.

3. The extenuating circumstances, aggravation is made according to the provisions of article 8, article 9 of Ordinance on handling administrative violations.

Article 5. Sanctions administrative violations and remedial measures 1. For each administrative violations in the field of road traffic is regulated in this Decree, individuals, organizations suffer a breach in the sanctions: a) caution;

b) fine.

When applying shape, level specific fines for administrative violations is the average of the frame of the fines prescribed for the Act; If the violation has extenuating circumstances, the level of the fine may be reduced to lower than average but not excessive reduction of minimum fine frame; If violations are aggravating the penalty level can rise up high above the average but not exceed the maximum level of fine frame.

2. Depending on the nature and extent of the violation, individual, organization, administrative violations can be applied one or the additional sanctions: a) deprived of the right to use the license, certificate of practice or have no time limit;

3. Article 6. Deprived of the right to use the license, certificate of fostering knowledge about road traffic law have no deadlines or time limits 1. 2. The driver of the means being applied sanctions deprived of the right to use the license, certificate of fostering knowledge about road traffic law have 60 (sixty) days to study and verify the road traffic Law before getting back the license certificate, fostering legal knowledge about road traffic.

4. Article 7. Time sanctioning administrative violations and the deadline are considered not yet sanctioned administrative violations 1. 2.
