Article 2. The object to apply this law applies to organizations, individual household energy use in Vietnam.

Article 3. Explanation of terms In this law, the terms below are interpreted as follows: 1. Energy, including fuel, electric power, thermal energy obtained directly or through processing from sources of non-renewable energy resources and renewable.

2. non-renewable energy resources including coal, coal gas, oil, natural gas, iron ore, uranium and other energy resources that do not have the ability to regenerate.

3. renewable energy resources including wind power, water power, solar lighting, geothermal, biomass and other energy resources capable of reproducing.

5. Use the energy saving and efficiency is the application of management measures and techniques aimed at reducing losses, reducing the energy consumption of vehicles, equipment and still ensure the needs, goals set out for the production process and life.

6. Energy audit is measuring activity, analysis, calculations, evaluation to determine energy consumption, energy saving potential and proposed solution using the energy saving and efficiency for facility energy use.

7. the energy Label is the label provides information about the type of energy use, energy consumption, energy efficiency and other information to help consumers identify and choose vehicles, energy saving devices.

8. energy labeling is the paste, add, in, carving up the energy label products, packaging.

9. Energy efficiency is just the number that indicates the ability of the media, device shifting energy use into useful energy.

10. the minimum energy performance Level is the lowest energy performance levels by the competent State agency rules for the media, the device uses the energy that below that level, the device will be subject to a special management.

11. energy-saving products is the means, the device has a high energy efficiency, good insulation materials consistent with the standards, technical regulation by the competent State Agency regulations.

Article 4. The principle of using the energy saving and efficiency 1. Consistent with the strategy, the overall planning of energy policy, energy security and environmental protection.

Article 5. The State's policy on the use of energy saving and efficiency 1. Implementing measures using the energy saving and efficiency to serve socio-economic development is one of the top priorities.

2. Financial assistance, energy prices and other necessary preferential policies to promote the use of energy savings and efficiency.

3. increase investment, applying diverse forms of mobilization of resources to promote scientific research, development and application of advanced technologies to use energy saving and efficiency; renewable energy development potential match, Vietnam's conditions contribute to ensuring energy security, environmental protection.

5. Encourage the development of consulting services; sensible investment for the propaganda, education, support organizations, households, individuals using the energy saving and efficiency.

Article 6. Strategy, planning, energy use program 1. Strategy, planning, energy use program must meet the following requirements: a) stable energy supply, safety; fair use, saving energy resources;

b) forecasts of supply, demand of energy consistent with the strategy, planning, planning of socio-economic development; harmony, balance between the planned coal industry, oil and gas, electrical power and other energy planning;

c) promote the use of energy savings and efficiency, prioritizing development of clean energy technologies, raise the proportion of renewable energy use;

Article 7. Statistics on the use of the energy industry coordinated with State Administration about the Government statistics issued statistical norms on the use of energy in the system of national statistics targets according to the provisions of this law and the law on statistics.

Article 8. The prohibited acts 1. Ruin of national energy resources.

2. Forgery, cheating in order to enjoy the preferential policy of the State in the use of energy savings and efficiency.

3. Advantage of the prerogatives and powers in the management of energy use and efficiency savings for the purpose of service.

4. Knowingly provides information not honest about the energy efficiency of vehicles and equipment in the energy labeling operations, testing, advertising and other activities damaging to the interests of the State, the legitimate rights and interests of organizations, households and individuals.

5. The manufacture, import, circulation, media equipment for use in the energy category vehicles, the equipment must be removed by the competent State bodies.

Chapter II USE of ENERGY SAVINGS and EFFICIENCY in INDUSTRIAL PRODUCTION article 9. Responsible use of energy saving and efficiency of industrial production 1. Industrial production including manufacturing, processing, processing of goods; manufacturing and repair of vehicles and equipment; mining facility; production facilities, provide energy.

d) made the process operators, maintenance mode, maintenance vehicles, equipment in the production line to combat the loss of energy;

DD) phasing out the vehicles, the device has technology backward, consume more energy in accordance with the Prime Minister.

3. Ministry of industry and trade, in collaboration with ministries, ministerial agencies concerned issued technical standards and norms applied energy use in each of the industrial production sector.

Article 10. Measures for saving energy use and efficiency in manufacturing, processing, processing of goods basis for production, processing, processing of goods based on the standards, technical standards and norms on the use of energy to choose, apply technology and management measures the following : 1. investing in the modernisation of production lines, processing, processing of goods; replace the device backward technology, low energy efficiency to save energy and protect the environment;

6. Apply heat-electricity cogeneration technology for processing facilities, machining, manufacturing our goods have the potential of developing electric load and heat.

Article 11. Measures for saving energy use and efficiency in manufacturing, repair facilities, manufacturing equipment, repair equipment, means the base standards, technical standards and norms on the use of energy to choose, apply technology and management measures the following to: 1. develop and implement plans to replace obsolete technological equipment; investment in installation of new generation machines there are modern technologies, high automation;

2. Apply furnace technology measures, training materials, creating embryos, forging, stamping, machining, turning, milling products proven in the fact that saving and high efficient about energy use;

3. Installation of the inverter, the device speed adjustment motor power capacity needs for the crane, lifting and transport equipment in the factory; production line layout is reasonable in order to save energy.

Article 12. Measures for saving energy use and efficiency in the mining facility


Mining base to base standards, technical standards and norms on the use of energy to choose, apply technology and management measures the following: 1. Apply reasonable procedures to reduce fuel consumption, electricity, water supply for vehicles, mining equipment;

2. Choose appropriate equipment, means the condition of mine opened to raise the productivity of extraction, and energy savings;

3. Application of energy saving technology in ready, shipping, processing, minerals;

4. Design, installation of reasonable ventilation system in the mine shaft ensuring the use of energy savings and efficiency.

Article 13. Measures for saving energy use and efficiency in production facilities, power supply 1. c) facility must comply with the method of mobilization of units of national power; construction and implementation of automatic power reduction plan;

d) hydroelectric plants are in full compliance with operating procedures exploiting the reservoir or reservoirs, ensure the required generator, to join the mission to regulate water supply for production and life;

Article 14. Chapter III USE of ENERGY SAVINGS and EFFICIENCY in BUILDING LIGHTING, article 15. Measures for saving energy use and efficiency in building activity 1. Article 16. Responsible for managing the State on use of energy savings and efficiency in building activity 1. The Ministry of construction, Ministry of industry and trade, in collaboration with ministries, ministerial agencies concerned issued norms about energy use, technical standards of design, construction, building materials in order to use the energy saving and efficiency.

3. State administration of the building are responsible for checking, timely processing of violation of regulations on the use of energy efficiency and savings for buildings under construction, renovation; do not grant the building permit for the construction works does not comply with the norms on the use of energy, to use the technical regulation of energy savings and efficiency.

Article 17. Responsible use of energy savings and efficiency in public lighting owner, head of facilities management of public lighting systems are responsible to perform the following requirements: 1. Ensure public lighting systems are designed according to standards, technical standards for each of the works and the area lighting; priority use of high performance lighting equipment, lighting equipment, use of renewable energy sources, to take advantage of natural lighting sources;

2. When the repair, replacement, installation of new lighting equipment is used defined lighting is energy efficient products;

3. Operate the public lighting system is suitable according to time of day, seasonal, Department, region.

Article 18. Responsible for managing the State on use of energy savings and efficiency in public lighting 1. The Ministry of construction issued technical standards, regulation of public illumination warrant requires the use of energy savings and efficiency.

2. The Ministry of science and technology announced the national standards on energy efficiency in public lighting.

3. provincial people's Committee has the responsibility to adopt measures to manage synchronous, tightly controlled the implementation regulation on energy saving in lighting; The people's Committee of the district, County, town, city in the province, the people's committees of communes, wards and towns make public lighting management under decentralized authority.

Chapter IV USE of ENERGY SAVINGS and EFFICIENCY in the TRANSPORT of article 19. Measures for saving energy use and efficiency in the operation of transport 1. Encourage organizations and individuals to participate in consulting, design, development of public transport; the production, use, transport, energy saving; exploitation and application of LPG, natural gas, electricity, fuel mix, alternative biofuel petrol.

b) building and applying regulations on maintenance and repair of transportation vehicles in the scope of management to reduce fuel consumption;

3. The owner, the contractor when building, renovating the transportation responsibility: a) made the solution of using the energy saving and the effectiveness of the approved projects;

b) apply measures to use the energy saving and efficiency in construction.

Article 20. The liability of the Organization, individual manufacturing, importing equipment, means of transport 1. Organization, production equipment, individual means of transportation is responsible for: a) in compliance with technical standards, the energy consumption by the competent State agencies issued in production equipment, means of transport;

b) applies innovative technologies; strengthening research, fabrication equipment, vehicles save fuel, use clean fuels, renewable energy and other alternative fuels.

2. organizations and individuals importing equipment, means of transport are responsible for compliance with the regulations regarding energy consumption by competent State bodies.

Article 21. Responsible for managing the State on use of energy savings and efficiency in the operation of transport 1. The Department of transportation is responsible for: a) apply measures to use the energy saving and efficiency in the planning of the transportation system by road, rail, waterway, airway;

b) presiding, in cooperation with ministries, ministerial agencies concerned construction and issued under the authority of technical standards, the energy consumption for transport means;

c) directing, guiding the implementation of removal of vehicles too indefinite, not reaching minimum energy performance levels;

d) transport business guide rationalise transport activities aims to improve the efficiency of energy use means of transport;

DD) investment planning, exploitation of the public transportation system, enhancing the use of rail transport network, combined transport waterways;

Chapter V USE the ENERGY SAVING and EFFICIENCY in AGRICULTURAL PRODUCTION Article 22. Measures for saving energy use and efficiency in agricultural production 1. The planning, the Organization of agricultural production must ensure the request using the energy saving and efficiency.

c) remove route vehicles, equipment, agricultural machinery, fisheries catch backward technology, low-power performance as specified by the competent State agencies;

d) made propaganda activities, dissemination of knowledge, the use of energy savings and efficiency.

Article 23. Measures for saving energy use and irrigation efficiency 1. The organization planning the rational irrigation system, optimizing the system of reservoirs, canals, take advantage of the natural flow.

2. Operate, reasonable capacity pump pump station in the nest levels, drainage of irrigation systems.

Article 24. Reduce the power loss and the use of renewable energy in the rural, agricultural production 1. Investment, improving rural power grids suitable standards, technical standards are intended to ensure your safety, reduce power losses.

2. Encourage the production, using energy sources in place by water power, wind power, solar light, gas, a by-product of agricultural and other renewable energy sources.

Article 25. Responsible for managing the State on use of energy savings and efficiency in agricultural production 1. Chapter VI USE the ENERGY SAVING and EFFICIENCY in the OPERATION of SERVICES and HOUSEHOLD Article 26. 2. Use insulation materials, appliances are energy efficient products; increasing use of media, the device uses renewable energy;

3. Limit the use of large capacity electric devices, consume a lot of electricity in peak hours;

4. Build habits, lifestyle to save energy in lighting devices and appliances.

Article 28. Responsible for managing the State on use of energy savings and efficiency in the operation of the service, household 1. Ministries, ministerial-level agencies in the scope of the mission, his powers have a responsibility to guide the implementation of the provisions of this law on the use of energy saving and efficiency in the operation of the service, household.

2. the people's committees of all levels within the mission, his powers have a responsibility to implement the following provisions: a) propaganda, advocacy services, households make use of measures of energy saving and efficiency;

b) manage the implementation of the regulations on the use of energy saving and efficiency of base local service activities;

c) mobilization of households made models of household use energy saving and efficiency; in response to the activities on the use of energy saving.

Chapter VII USE the ENERGY SAVING and EFFICIENCY in INVESTMENT PROJECTS, agencies, UNITS USE STATE BUDGET Article 29. Use the energy saving and efficiency in the investment projects from which the home State new project investment, improvements in infrastructure, construction works have used state capital to implement the provisions of this law suit each sector of activity and the other provisions of the relevant legislation on the use of energy savings and efficiency in all the stages of the project.

Article 30. Measures for saving energy use and efficiency in Agency, unit using State budget 1. Every year, the Ministers, heads of ministerial agencies, Chairman of the provincial people's Committee has the responsibility to steer the Agency units use State budget directly under the building and implementation of the plan to use the energy saving and efficiency, including the goals, measures, norms on the use of energy for Office subordinate constructions, and report the situation of energy consumption; build and implement energy saving regulation internally, ensuring the operation of the media, the device uses the energy consistent with the standards, technical standards.

2. register with energy plans to use state management bodies of local power; popular plans, measures and regulations made plans to use energy to all public servants.

DD) apply energy management model under the guidance of the competent State agencies;

e) make rules about the use of energy saving and efficiency in new construction, renovation, expansion of facilities.

2. Ministry of industry and trade, in collaboration with ministries, ministerial-level agencies, provincial people's Committee guide base using key energy construction and made plans to use the energy saving and efficiency every year and five years; periodic reporting form regulations every year and five years.

Article 34. Energy audit for the facility energy use key 1. The basis of key energy use to make energy audit mode by using the order form or audit organizations hire energy audit done.

2. The organisation must have sufficient energy audits to the following conditions: a) is the legal entity established in accordance with the law;

b) has a team of energy auditors are certified energy auditors;

c) have the means, technical equipment used for the energy audit.

3. The facility energy use key order energy audit mode when the conditions specified in point b and point c of paragraph 2 of this Article.


4. Industry specific regulations about the order of procedures performed energy audit; the content, training, authority, recognition, recovery of energy auditors certification.

Article 35. Conditions, the Mission of the energy management at the facility energy use key 1. Energy Manager at the facility energy use key must have the following conditions: a) has a college diploma in engineering or energy related to the basis of key energy use in industrial production, building construction , the operation of the service; have a diploma from a technical level upwards to the base of the key energy use in agriculture, transportation;

b) energy management certificate by the competent authority.

b) network organizations manage energy usage, applied energy management model;

c) implement measures to use the energy saving and efficiency according to the objectives and the plan has been approved;

d) test, reviews the implementation of the measures to use the energy saving and efficiency;

DD) to track energy consumption needs of the equipment and the entire production lines; the volatility of energy consumption needs related to the installation of new, renovate, repair of equipment energy use; perform periodic reporting under the regulations;

e) organization information, advocacy, training, training in the use of energy.

3. Industry regulated content, training, authority, recognized energy management certificate.

Article 36. State management responsibility for the facility energy use key 1. The State Agency has the authority on energy management is responsible for: a) check regularly the situation of facility energy use energy use; reception, storage and organization to report energy use and efficiency savings annually, and five years of the base under the provisions;

b) periodic reports based on the energy use of facility energy use key provisions of article 33 of this law, requests, instructions adjust the annual plan, five-year plan on the use of energy savings and efficiency, energy usage limit to suit production planning , the unit's business.

2. The facility energy use key does not implement the provisions of articles 33, 34 and 35 of this law and the provisions of the relevant legislation on the use of energy saving and efficiency shall be dealt with according to the provisions of the law.

Chapter IX MEDIA MANAGEMENT, equipment USE ENERGY Article 37. Measures to manage the use of energy saving and efficiency for vehicles, equipment for the State to apply measures to manage energy use and savings following efficiency for the media, device: 1. develop and publish standards of energy efficiency, minimum energy performance levels of the media equipment energy use;

2. Labelling of energy for vehicles, equipment for energy use;

3. Public information on the use of energy means, equipment;

4. Remove the media, equipment under minimum energy performance levels;

5. Handle the violations stipulated in this article.

Article 38. The construction, announced energy efficiency standards, minimum energy performance levels 1. b) conform with the requirements of socio-economic development, scientific and technological level of the country, to meet the requirements of regional and international integration;

c) encourage investment in research, production, offering the market a product of high energy efficiency, saving energy.

2. The Ministry of science and technology announced the five-year energy efficiency standards, minimum energy performance levels.

Article 39. Labelling of energy 1. The media, the media list in the device, the device is labelled energy must be labeled before bringing out the market.

2. Production, import business means, the device performs the energy labeling for the media, after the device was authorized agency certificate labeled energy.

3. the energy label certificate is granted after the media, the device has been tested in accordance with standard in-room energy performance test.

4. Ministry of industry and commerce is responsible for: a) building, the Prime Minister issued the list of media, the device is labelled energy and routes taken;

b) specified the contents, specifications energy label;

c the test room regulations) are eligible to be granted the certificate of the test match with energy efficiency standards;

d) regulatory sequence, the certification procedures for energy labelling for vehicles and equipment;
