Pursuant to the Constitution of the Socialist Republic of Vietnam in 1992 was revised, some additional articles by resolution No. 51/2001/QH10;

Congress enacted the law on people with disabilities.

Chapter I GENERAL PROVISIONS article 1. Scope this law regulates the rights and obligations of disabled people; the responsibility of the State, the family and society for people with disabilities.

Article 2. Explanation of terms In this law, the terms below are interpreted as follows: 1. The disabled is the defective one or more body parts or impaired function is expressed makes disabled employees, student activities, academic trouble.

5. special education is the method of education dedicated to disabled people in institutions.

6. integrate sales education is the educational method combines the integration of education and specialized education for disabled people in institutions.

7. Independent living is the disabled person be autonomy to decide the issues relevant to the lives of themselves.

8. the approach is the disabled person to use are public works, transport, information technology, cultural services, sport, travel and other services tailored to community.

Article 3. The form and extent of disability 1. The form of disability include: a) motor disabilities; b) disability hearing, said; c disabled see;)

d) nervous, mental disability;

intellectual disability);

e) other defects.

2. Disabled Persons are divided according to the degree of disability: a) the disabled person who is heavy due to special disability leads to can't do serve the needs of personal daily activities;

c) disabled people disabled people is not light in cases specified in point a and point b of this paragraph.

3. Government regulations details on the form and extent of disability specified in this article.

Article 4. The rights and obligations of persons with disabilities 1. People with disabilities are guaranteed to perform the following rights: a) equal participation in social activities;

b) independent living, community integration;

c) are exempt or reduce a number of contributions for social activities;

d) Are health care, rehabilitation, cultural studies, education, employment, legal assistance, access to public works, transport, information technology, cultural services, sport, travel and other services in accordance with the form and the degree of disability;

DD) other rights prescribed by law.

2. Disabled people perform the obligations of citizens under the law.

Article 5. The State's policy on disability 1. Every year, the State budget arrangement to implement the policy on disability.

Article 6. Socialization activities help people with disabilities 1. The State encourages the Organization, personal investment, funding, financial assistance, technical to perform orthopaedic operations, rehabilitation, health care, education, vocational training, job creation, provide other services help people with disabilities.

Article 8. The responsibilities of the family 1. The family are responsible for education, creating conditions for family members to raise awareness of disability issues; implement preventive measures, reduce birth defects, defects caused by injury, illness and other risk leading to disability.

Article 9. Disabled people's organizations, organizations for disabled people 1. Organizations of disabled people is the social organizations are established and operate in accordance with the law to represent the rights, legitimate interests of members are disabled, involved construction, monitoring the implementation of the policy, laws for the disabled.

Article 10. Funds help disabled people 1. Disabled persons assistance Foundation is the charitable social fund aimed at mobilizing resources to help the disabled.

b) support from the State budget;

c) other legal revenues.

3. disabled people Assistance Fund was established and operates under the provisions of the law.

Article 11. On the disabled Vietnam on April 18 On disabled people every year is Vietnam.

Article 12. International cooperation on disability 1. International cooperation on disability is made on the basis of respect for independence, sovereignty, territorial integrity, equality, in accordance with the law of Vietnam and international law.

b) join the international organization; signing, joining and implementing international treaties, international agreements related to the disabled;

Article 13. Information, communication, education 1. Information, communication, education about disability issues in order to prevent, minimize disability; raising awareness, changing attitudes and behavior about disability issues; combating stigma, discrimination of people with disabilities.

2. Content of information, communication, education about disability issues including: a) the rights, obligations of disabled people;

b) way, advocates, policy of the party, the State's law on disability;

c) responsibilities of agencies, organizations, individuals, families for disabled people;

d) disabled causes and preventative measures, minimize disability;

VND) Against stigma, discrimination of people with disabilities.

Article 14. The prohibited acts 1. Stigma, discrimination, disabled people.

2. Invasion of the body, dignity, honor, property, rights, legitimate interests of disabled people.

3. Entice, lure or force the disabled people make violations of the law, moral society.

4. Taking advantage of the disabled, disabled people's organizations, organizations for the disabled, pictures, personal information, the status of persons with disabilities to benefit the axis or violations of the law.

Chapter II DISABLED CONFIRMATION article 15. The responsibility to determine the level of disability 1. Determining the degree of disability caused by the Council determines the level of disability is made.

Article 17. Method of determining the degree of disability 1. 5. Minister of labour, invalids and Social Affairs detailing the sequence of procedures, records, determine the level of disability as defined in this Article.

Article 19. Disability certification 1. Disabled certificate has the following basic content: a) the full name, date of birth, sex of the disabled;

b) residence address of the disabled;

c) disabilities;

d) the degree of disability.

Chapter III HEALTH CARE article 21. Primary health care in place of residence 1. Article 22. The doctor, cure 1. The State guarantees disabled people to be patient, healing and the use of appropriate health services.

2. Disabled Persons are entitled to medical insurance policy under the provisions of the law on health insurance.

3. The family of disabled people have a responsibility to create conditions conducive to the disabled are the doctor, healing.

4. Disability is mental disease person is in a State of depression, agitation, had the idea of suicide behavior, or endanger others supported living expenses, travel expenses and costs of treatment during compulsory treatment in medical establishments, healing.

5. Encourages organizations and individuals to support the medical examination and treatment for the disabled.

Article 23. The responsibility of the base doctor, cure 1. Implementation of the measures examined, the cure is suitable for disabled people.

2. Priority consultation and treatment for people with disabilities is especially heavy and severe disability, disabled children, disabled, elderly disabled women get pregnant under the provisions of the law on the examination and treatment.

3. Advise preventive measures and early detection of disabilities; define birth defects for children newborn to promptly take measures of treatment and rehabilitation, orthopaedic fit.

4. Make renovating, upgrading the facilities to serve patients, cure is not yet guaranteed access for the disabled.

Article 24. Orthopedic facility, rehabilitation 1. Orthopedic facility, rehabilitation is the basis of provided services, rehabilitation for the disabled.

2. orthopedic facility rehabilitation, including: a) the Institute of orthopedics, rehabilitation;

b) Orthopaedic Centre, rehabilitation;

c) hospital nursing, rehabilitation;

d) Faculty of rehabilitation medical facility;

DD) the Rehabilitation Division of the basis of social protection;

e) base.

3. The establishment and operation of the facility, rehabilitation is made according to the provisions of the law.

4. the State guarantees the construction of technical infrastructure for orthopaedic base, public rehabilitation.

Article 25. Rehabilitation based on the community 1. Rehabilitation based on the community's measures taken in the community in order to transfer the knowledge of disability issues, recovery skills and positive attitudes to disabled people, their families and the community to create equality of opportunity and community inclusion for people with disabilities.

2. The disabled are facilitating, support rehabilitation based on the community.

3. The family of disabled people have a responsibility to create favorable conditions for disabled people rehabilitation based on the community.

4. Basis adjustment, rehabilitation is responsible for taking active professional guide rehabilitation based on the community.

5. the people's committees of all levels have the responsibility to build and organize the implementation of the programme of rehabilitation based on the community; create conditions for agencies, organizations and individuals organized or participated in rehabilitation activities based on community.

Article 26. Scientific research, training of professionals, technicians, production equipment for disabled people 1. State funding support under the project for the Agency, scientific research organizations of the disabled, training specialist, orthopedic technician, rehabilitation.

2. Establishments manufacturing orthopedic instruments, facilities, rehabilitation equipment, assisted living, studying and working for the disabled be loans with interest rates incentives, tax reduction, exempt under the provisions of the law.

3. Orthopedic instruments, facilities, rehabilitation equipment, assisted living, studying and working for the disabled from the program, non-refundable aid projects or by the organisations, foreign individuals donate, support tax reduction, exempt under the provisions of tax legislation.

Chapter IV EDUCATION article 27. Education for persons with disabilities 1. The State creates conditions for people with disabilities is consistent with learning needs and capabilities of people with disabilities.

2. The disabled are higher than the age of the age prescribed for general education; priority in enrollment; exemption, reduction of some subjects or educational activities and content that the ability of the individual cannot meet; be waived, reduced fees, training fees, other contributions; are scholarship, media support, school supplies.


3. Disabled Persons are provided the means of learning support material, exclusively in cases required; disabled people listen, said to be by sign language; the disabled look was studied by national standard Braille.

4. The Minister of education and training is coordinated with the Ministry of labor, invalids and Social Affairs, the Minister of finance detailing the item 2 of this Article.

Article 28. The method of educating persons with disabilities 1. The method of educating the disabled including education educational inclusion, integration and sale of specialized education.

2. inclusive education is primarily a method of education for disabled people.

3. Disabled Persons, the father, mother or guardian disability chooses education consistent with the development of the individual disabled person. The State encourages the disabled to participate in learning educational method by integration.

Article 29. Teachers, educational administrators and education support staff 1. Teachers, educational managers join disability education, educational support staff trained disabled person, fostering updates on professional expertise and skills to meet the educational needs of people with disabilities.

2. Teachers, educational managers join disability education, educational support staff disabled people enjoy the extra mode level and policy incentives under the Government's regulations.

Article 30. The responsibility of educational institutions 1. Ensure proper teaching and learning conditions for disabled people, are not denied receiving the disabled entrance in contravention of the law.

2. Make improvements, upgrade teaching and learning facilities are not yet guaranteed access for the disabled.

Article 31. The Centre supports development of education integration 1. The Centre supports development of education inclusion is the base content provider program, equipment, teaching and learning materials, consulting services, educational support, appropriate institutions with the characteristics and circumstances of disabled people.

2. Development Assistance Center integration education has the following task: a) the detection of defects to the choice of suitable educational methods;

b) make early intervention measures to disabled people in the community to choose appropriate educational methods;

c) psychological counseling, health, education, careers to choose appropriate educational methods;

d) supports disabled people in the family, in institutions and the community;

DD) provides program content, equipment, teaching and learning materials special match each shape, the level of disability.

3. The establishment and operation of the Center for educational development support integration to ensure the following conditions: a) Has the facilities, equipment and media support services to suit the characteristics of the disabled;

b) has a team of officers, teachers, education support staff have qualifications in accordance with the method of education of disabled people;

c) with content, fostering education programs and documents consulted in accordance with the method of education of the disabled.

4. The Chairman of the provincial people's Committee, the city of centrally established or allowing established the Center for educational development support inclusion.

5. The Minister of education and training, in collaboration with the Minister of labor, invalids and Social Affairs detailing the conditions of establishment and operation of the Center for educational development support inclusion defined in paragraph 3 of this article.

Chapter V VOCATIONAL and EMPLOYMENT Article 32. Vocational training for disabled people 1. The State guarantees disabled people to be consulted free trade, choice and vocational skills, abilities equally as others.

2. vocational establishments are responsible for issuing certificates, vocational training recognized as disabled people learn most of the training program and qualified under the provisions of the heads of State for vocational management.

3. Vocational training institutions for the disabled must ensure conditions of vocational training for the disabled and enjoy preferential policies according to the provisions of the law.

4. The disabled apprenticeship, vocational teachers for the disabled enjoy mode, the policy prescribed by the law.

Article 33. Jobs for disabled people 1. The State creates conditions for the disabled labour rehabilitation, a free job advice, get a job and work with appropriate health and characteristics of disabled persons.

2. Organs, organizations, enterprises, individuals refused to recruit disabled people are eligible for recruitment into work or employment standards set out the rules of law intended to limit the opportunities of the disabled.

3. Organs, organizations, enterprises, individual employers are disabled depending on the specific conditions of work arrangement layout, ensuring conditions and appropriate working environment for people with disabilities.

4. Organs, organizations, enterprises, individual employers are disabled to fully implementing the provisions of the labour legislation to workers are disabled.

5. employment organization responsible for vocational counselling, advice and employment for disabled people.

6. People with disabilities create employment or household job creation for the disabled are loans with preferential interest rates to produce business, instructions on production, technology transfer, support the consumption of products as specified by the Government.

Article 34. Production facilities, business use many workers are disabled facilities, business use from 30% of the total number of workers up as disabled people supported improving conditions, appropriate working environment for people with disabilities; corporate income tax exemption; get the loan with preferential interest rates according to the project for the development of business; are priorities for land rental, ground, and water, reduce land rents, premises, water production, according to the national business workers are disabled, disabled level of workers and enterprise scale.

Article 35. Policy disabled people into work 1. Encourage State agencies, organizations and businesses getting disabled people into work. The business employs many workers are disabled to enjoy preferential policies according to the provisions of article 34 of this law.

2. Government Regulation details the policy encourages agencies, organizations and businesses getting disabled people into the work prescribed in clause 1 of this article.

Chapter VI culture, fitness, sports, RECREATION and TRAVEL Article 36. Cultural activities, fitness, sports, recreation and tourism for disabled people 1. The State supports cultural activities, fitness, sports, recreation and travel consistent with characteristics of the disabled; create conditions for disabled people are enjoying the culture, fitness, sports, recreation and tourism.

Article 37. Organizing cultural activities, fitness, sports, recreation and travel of persons with disabilities 1. Cultural activities, fitness, sports, recreation and travel of disabled people are mainstreamed into the cultural life of the community, held diverse types, to meet the needs of cultural enjoyment, fitness, sports, recreation and travel of persons with disabilities.

2. The Congress of the national disability sports, sports competitions, cultural contest of disabled people held matching characteristics, the needs of disabled people and the socio-economic conditions.

Article 38. The responsibility of culture, fitness, sports, recreation and travel 1. Investment in infrastructure, means of assistance and create favorable conditions for the disabled to participate in cultural activities, exercise, sports, entertainment and travel; deployed manpower, vehicles, tools to support disabled people when organizing cultural activities, fitness, sports, recreation and tourism.

Chapter VII, PUBLIC WORKS, transportation, INFORMATION TECHNOLOGY and COMMUNICATION Article 39. Condominium and public works 1. Approval of the design, construction, testing new construction, renovation and upgrade of condominium, Office and technical infrastructure works, social infrastructure works must comply with the system of the national technical regulation on building to ensure disabled access.

2. Condominiums, office buildings and public infrastructure, social infrastructure works was built before this law is in effect that has not guaranteed the access for the disabled to be renovated, upgraded to ensure access under the roadmap prescribed in article 40 of this law.

Article 40. Highway improvements, public works 1. Until January 1, 2020, the following public works to ensure access for people with disabilities:


a) Headquarters work of State bodies;

b) station, bus station, the pier;

c) consultation basis;

d) educational establishments, vocational training;

DD) culture, fitness, sports.

2. Until January 1, 2025, all condominiums, office buildings, public infrastructure, social infrastructure works in the cases specified in paragraph 1 of this article to ensure access for people with disabilities.

3. The Government detailing the implementation of the roadmap for each type of improvement the work prescribed in clause 1 and clause 2 of this Thing.

Article 41. Join the transportation of persons with disabilities 1. The personal transportation of the disabled when in traffic to ensure national technical regulation and conformity with the health conditions of the disabled. Personal transportation requires the control permits disabled people are educated and licensed driver for the media.

2. Disabled people when in traffic by means of public transport are using means of support or assistance respectively; allowed to bring and free when carrying vehicles, support equipment fit.

3. Disabled people especially heavy and severe disability are exempt, discount tickets, reviews of service when in traffic by a number of public transportation under the provisions of the Government.

4. Disabled Persons are priority tickets, help, convenient seating arrangement when using public transport.

Article 42. Public transport 1. Public transport should have priority seats for disabled people; have the tool supports up, down or convenient assistance consistent with characteristics of disabled persons.

2. public transport for disabled people access use must meet national technical regulation on traffic approaching by competent State bodies.

3. participating units of public transport must invest and means of ensuring the technical regulation on traffic approaching on the transport routes according to the rate specified by the Government in each period.

4. public transport meet national technical regulation on traffic approaching the tax reduction, exempt under the provisions of tax legislation when produced, imported.

43 things. Information technology and communication 1. The State encourages the agencies, organizations, businesses and individuals active in the field of information technology application and development of information technology for disabled people.

2. the mass information bodies have the responsibility to reflect the material and spiritual life of the disabled.

Vietnam television station is responsible for implementation of the program had broadcast Vietnamese subtitles and sign language for the disabled as defined by the Minister of information and communications.

3. the State has a policy of tax reduction, exemption, loans with preferential interest rates and other support for research activities, manufacturing, production and supply of services, means of support for disabled people access to information and communication technologies; support for the collection, compilation and publication of materials in Braille for disabled people look, read document for disabled people to hear, speak and intellectual disability.

Chapter VIII SOCIAL PROTECTION Article 44. Social support, support monthly care 1. The object of monthly social benefits include: a) the disabled especially heavy, except where the provisions of article 45 of this law;

b) disabled people.

2. The object is supported funding the monthly care include: a) family of disabled people is especially heavy, are directly nurture, care for that person;

b) the recipients nurture, care for the disabled is especially severe;

c) Disabled Persons specified in clause 1 of this article who are pregnant or raising children under 36 months of age.

3. The provisions in paragraph 1 of this article are children, elderly people enjoy a higher allowance for others of the same level of disability.

Chapter IX LIABILITY of STATE BODIES on the WORK of the DISABLED Article 49. The State administration on work disability 1. The unified government administration on work disabled people.

g) build and execute the program to raise awareness about disabled people and disabled people;

h) examination, inspection of the implementation of the law on disability;

I) make international cooperation on disability;

l) perform statistical, survey, construction and management of databases and information, periodically published reports about disabled people;

m) planning and management of the base system, rehabilitation and disability care facilities under the jurisdiction.

2. The Ministry of health is responsible for the following: a) the implementation of the governance of the health care of people with disabilities;

b) chaired and coordinated with the Ministry of labor, invalids and Social Affairs detailing the activities of rehabilitation of people with disabilities; rehabilitation training; the programme for prevention of disabilities; guide the implementation of rehabilitation based on the community for people with disabilities.

3. The Ministry of education and training has the following responsibilities: a) implement state management for education for the disabled;

b) specified national standard about sign language and Braille for disabled people;

c) perform the planning system of the specialized institutions for the disabled and the System Center support inclusive education development;

d) teacher training, educational support staff, curriculum, materials, curriculum and textbooks for learners to apply are disabled; the direction of research, manufacturing and supplying teaching equipment suit every shape and degree of disability;

DD) chaired and coordinated with the Ministry of labor, invalids and Social Affairs, the Ministry of Health implemented a program of special education for disabled children.

4. The Ministry of culture, sports and tourism is responsible for implementing State management on work culture, sport, recreation and tourism for disabled people; direction, guidance and implementation of activities enhancing spiritual cultural life for disabled people.


5. The Ministry of construction is responsible for chairing and coordinating with ministries, ministerial agencies concerned issued, guidance and implementation of the national technical regulation on residential housing construction, Office construction, technical infrastructure, social infrastructure works secured access for disabled people.

6. The Department of transportation is responsible for chairing and coordinating with ministries, ministerial agencies concerned issued, guidance and implementation of the national technical regulation on transportation infrastructure, support tools and policy priority to disabled people participate in public transport.

7. The Ministry of information and communications is responsible for issuing, guidance and implementation of the national technical regulation on access to information for people with disabilities; steer, guide our bodies perform advocacy, policy, common law for disabled people.

8. The Ministry of science and technology chaired and coordinated with the ministries, ministerial agencies concerned issued, guidance and implementation regulations encourage the research, manufacture and application of products to support disabled people to use.

Chapter X TERMS Enacted 51. Applicable law 1.
