Pursuant to Decree No. 187/2007/ND-CP on December 25, 2007 of the Government functions, tasks, powers and organizational structure of the Ministry of information and communications, regulations: chapter I article 1. 3. fixed radio station is a radio station in the fixed service.

Fixed services as radio information services between fixed points predetermined.

4. Mobile Radio is a radio station in the mobile business, use the at motion or paused in the non-points.

Mobile business is the radio information service between mobile stations and ground stations, or between mobile stations.

Ground station is a radio station in mobile services but do not use while in motion.

5. train Station is a mobile radio frequency usage in the maritime mobile services put on ships, boats and other floating facilities.

The maritime mobile service is a mobile business between Taiwan ship with coast or between the ship together or between the information on the ship; the rescue station and the radio station Radio phase emergency position indicator also in this profession.

11. radio information network is the internal network information including mobile radio stations due to the Organization, individuals set up at the location whose address and scope determined that that network owners are entitled to use to serve internal communications are not intended to benefit directly from the operation of the network.

12. foreign missions including diplomatic missions, consular agencies, representative offices of international organizations in Vietnam are entitled to preferential rules, diplomatic immunity.

Article 3. Licensing Agency using radio frequency RF power supply Bureau, renewals, modifications, additional content license to use radio frequency and revoked the license of use of radio frequencies.

Article 5. To renew the licence of use radio frequencies 1. Before the expiry of at least 30 days for the license to use frequency and radio equipment, 60 days for the license to use the frequency band, 90 days for the license to use the frequencies and satellite orbits, the Organization, the individual must send the proposal to renew the licence of use frequency power to be extended in accordance with the regulations. The licence was renewed for only the duration of use, the other parameters of the license does not change.

Article 6. Modify, supplement the content license to use radio frequency When the license validity, organization or individual wishing to modify, complement some of the content in the licenses (except for the duration of use) it must make records suggest amendments, supplements the content license.

Article 7. Stop using frequency, radio equipment 1. Within the validity of the licence, if the Organization, individuals no longer need to use the frequencies, the radio equipment shall notify in writing to the Department radio frequency.

Article 8. Declare and cancel request, renew, modify, supplement the license content using radio frequencies 1. Article 9. Receiving records and licensed by electronic means the reception profile and the granting, renewal, modification, additional content license to use radio frequencies by electronic means comply with provisions of the law on electronic transactions and must meet regulations regarding profile procedures of this circular.

Article 10. The filing fee, the fee to use radio frequency and receive individual organizations license only receive the license when sufficient level fees, renewals, amendments, supplements the corresponding license content and sufficient use of radio frequencies under the rules.

Chapter II PROCEDURES for GRANTING, RENEWAL, AMENDMENT, addition, WITHDRAWAL of LICENSES to USE RADIO FREQUENCY ITEM 1. Granted, RENEWED, modified, ADDITIONAL CONTENT LICENSE to USE FREQUENCY and RADIO EQUIPMENT article 11. Records request, renew, modify, supplement the content license to use frequency and radio equipment for amateur radio stations 1. Article 17. Records request, renew, modify, supplement the content license to use frequency and radio equipment for satellite earth stations (except in the case specified in article 18 of this circular and satellite earth stations in the GMDSS system placed on the ship) 1. b) copy of certificate of relevant telecommunications network under the rules (applicable to satellite earth stations in the telecommunications network has been licensed); or certified copies or certified under the provisions of the contract of use of satellite information services (for satellite earth stations operated independently of the Organization, enterprise use of satellite information services the telecommunications business has been the Ministry of information and Media Licensing); or a copy of the license to provide services of transmission of broadcasting satellite television broadcasting regulations (applicable to the press agency, service provider business transmission broadcast television broadcasting); or a copy of the decision to establish or business registration certificate or certificate of investment (applicable to the Organization, enterprise business at sea, multinational companies, government agencies, software development and high-tech zones when using regional or international satellites); or certified copies of the text by the competent authorities granted under the rules (applicable to organizations, enterprises are allowed to participate in the activity of aviation safety, maritime safety as stipulated by the world's Aviation Organization-ICAO, World Maritime Organization-IMO when using regional or international satellites).

Article 18. Records request, renew, modify, supplement the content license to use frequency and radio equipment for the radio station for the Agency's overseas representatives, senior foreign delegation was entitled to preferential rules, diplomatic immunity, foreign correspondents go under served Group 1. The licensing of use frequency and radio equipment for satellite earth stations of foreign representative offices, senior foreign delegation to visit Vietnam to enjoy preferential regulations, diplomatic immunity and foreign reporters going by catering to the delegation performed as specified in circular No. 01/2006/TTLT-BBCVT-BCA-BNG on 03/03/2006 guidelines the granting allow use of satellite information stations (known as satellite earth stations in this circular) for representative offices abroad, foreign delegations, foreign reporters follow serve foreign delegation.

b) license renewal records including:-affidavit to suggest licensing the use frequency and radio devices according to the corresponding template specified in Appendix 2 of this circular;


-Copy license to set up relevant telecommunications network as a rule (if permission is granted before the change).

c) profile modification, additional content including: license-license proposal affidavit of use frequency and radio devices according to the corresponding template specified in Appendix 2 of this circular;

-The documents explaining the need to modify the content, additional (when requested).

3. for radio stations (excluding satellite earth stations) of senior foreign delegation was entitled to preferential rules, diplomatic immunity, foreign reporters away as a group) serving the new level records include:-affidavit to suggest licensing the use frequency and radio equipment under model 1 k Appendix 2 of this circular;

-The text recommended by the governing body to welcome the delegation.

Article 19. Article 21. Article 22. Records request, renew, modify, supplement the content license to use frequency and radio equipment for fixed stations, banks (not in touch with satellites), individual equipment and the absence of provisions in articles 11, 12, 13, 14, 15, 16, 17, 18, 19 , 20 and article 21 of this circular 1. b) copy of certificate of relevant telecommunications network under the provisions;

c) copies are certified pursuant to certificates or passports for longer time limits for individual licensing proposal.

Article 23. Time resolved to license use frequency and radio equipment 1. For recommended records licensed for amateur radio stations, tv stations, radio stations the train put on fishing means, radio frequency Bureau to resolve, renewed modified, additional content licenses within 10 working days from the date of receipt of a valid application.

For the record suggest for the remaining case, the Bureau of radio frequency-level resolution, renew, modify, supplement the license content within 20 working days from the date of receipt of a valid application.

2. Special cases, when records suggest granting, modifying, supplementing the content license to use the radio frequencies of the same organization, individuals sent within 20 working days has a number of radio frequencies need to be determined to exceed the 100 frequencies shall within 5 working days from the date of receipt of a valid application Frequency, the power of written notice due and expected resolution time (maximum 6 months) for the Organization, the individual licensing proposal.

3. If the records are incomplete, not yet valid, then within 5 working days of receipt of the record, the Bureau of radio frequencies is responsible for announcements, instructions in writing to the individual organization to supplement, complete the profile.

4. in case of refusal to license, Bureau of radio frequency notice in writing stating the reasons for refusal, individuals within the time limit specified in paragraph 1, 2 of this Thing.

5. for the case to change the frequencies do not handle harmful interference, resolve licensing period not exceeding 10 working days from the date of conclusion about the handling of harmful interference.

Article 24. The agency receiving records and license delivery organization, personal license to use the suggested frequency and radio equipment to apply for and receive a license in one of the following: 1. The Bureau of radio frequencies;

2. The radio frequency Center of the Bureau of radio frequencies;

3. other coordination bodies by radio frequency authorization.

Section 2. Granted, RENEWED, modified, ADDITIONAL CONTENT LICENSE to USE the BANDS article 25. Records request, renew, modify, supplement the content license to use the frequency band 1. New level records include: a) for the Organization, Enterprise won in the auction or acceptance of examination frequency use rights power then not filing the proposal to license use frequency and licensed use after the band has been licensed telecommunications related.

b) for organizations, businesses are licensed under the direct license forms, records, including:-A testimony to suggest to license use of the frequency band under model 2 annex 2 of this circular;

-A copy of the relevant telecommunication licences under the regulations.

2. license renewal records include: a) affidavit of proposed license to use the frequency band under model 2 annex 2 of this circular;

b) a copy of the relevant telecommunication licences under the regulations (if the telecommunication license granted before the change).

3. the modified profile, additional content license are: a) affidavit of proposed license to use the frequency band under model 2 annex 2 of this circular;

b) documents explain the content to modify, complement (when requested).

Article 26. Time resolved to license use of the bands 1. Radio frequency Bureau to resolve, renewed, modified, additional content use license as follows: band a) for auction, rights to use radio frequencies: new level within a period not exceeding 20 working days from the date of winning business in the auction or acceptance of examination was licensed for telecommunications; renew, amend, supplement the license content within a period not exceeding 60 days from the date of receipt of a valid application.

This rule does not apply when the rules of the auction, the examination regulations.

b) for direct licensing: renew, extend, modify, supplement the license content within a period not exceeding 60 days from the date of receipt of a valid application.

2. If the records are incomplete, not yet valid, then within 5 working days from the date of receiving the application, the Bureau of radio frequencies is responsible for announcements, instructions in writing to the individual organization to supplement, complete the profile.

3. in case of refusal to license, Bureau of radio frequency notice in writing stating the reasons for refusal, individuals within the time limit specified in paragraph 1 of this article.

Article 27. The agency receiving records and delivery frequency license agency receipt and delivery of the license to use the frequency band: Intergalactic radio frequency.

Category 3. Granted, RENEWED, MODIFIED, ADDITIONAL CONTENT LICENSE to USE FREQUENCIES and SATELLITE ORBITS in Article 28. Records request, renew, modify, supplement the content license to use frequencies and satellite orbits 1. New level records include: a) affidavit of proposed license to use frequencies and satellite orbits form 3 Appendix 2 of this circular;

b) copy of certificate of relevant telecommunications network under the rules.

b) copy of certificate of relevant telecommunications network as a rule (if permission is granted before the change).

3. the modified profile, additional content license includes:


a) affidavit as defined in art. 1 of this article;

b) documents explain the content to modify, complement (when requested).

Article 29. Time resolved licensing 1. Radio frequency Department of evaluation and resolved to grant, renew, modify, supplement the license content within a period not exceeding 45 days from the date of receipt of a valid application;

2. If the records are incomplete, not yet valid, then within 5 working days from the date of receiving the application, the Bureau of radio frequencies is responsible for announcements, instructions in writing to the individual organization to supplement, complete the profile.

3. in case of refusal to license, Bureau of radio frequency notice in writing stating the reasons for refusal, individuals within the time limit specified in paragraph 1 of this article.

Article 30. The agency receiving records and license delivery agency receiving records and license delivery frequencies and satellite orbits: the Bureau of radio frequency.

ITEM 4. REVOKE the LICENSE to USE the RADIO FREQUENCIES article 31. Revoke the license to use the radio frequencies 1. Revocation of licenses to use radio frequencies for organisations, individuals violating the law about radio frequency as specified in paragraph 1 to article 23 of the law on radio frequencies shall be as follows: a) for specified at points a and b paragraph 1 Article 23 of the law on radio frequency , revocation of licenses to use radio frequency based on the decision of the Court or the competent State bodies.

b) with respect to the cases stipulated in points c, d and e of paragraph 1 to article 23 of the law on radio frequencies, the revocation of the license of use radio frequency based on the conclusions of the inspection or test results with radio frequency or the decision of the Court.

c) for cases specified in point 1 article 23 of the law on deposit VND radio frequency power, revocation of licenses to use radio frequencies was made if after 60 days from the date the Agency has the authority to send notices of fees or on other financial obligations prescribed that the Organization individuals not filed enough frequency fees or do not make the financial obligations.

2. organizations and individuals to stop using frequency and radio equipment by the decision to revoke the license of use of the radio frequency RF power Bureau.

3. List of organizations and individuals who have a license to use the radio frequencies withdrawn and recovered due to be posted publicly on the electronic information page of the Bureau of radio frequency.

Chapter III, lend LEASE with RADIO EQUIPMENT Article 32. Regulations on rent, lend radio equipment 1.
