The CIRCULAR issued Charter elementary school _ _ _ _ _ _ _ _ _ _ _ _ _ _ pursuant to the law on education, June 14, 2005; Law on amendments and supplements to some articles of the law on education, November 25, 2009;
Pursuant to Decree No. 178/2007/ND-CP dated 3 December 2007 of the Government functions, tasks, powers and organizational structure of ministries, ministerial agencies;
Pursuant to Decree No. 32/2008/ND-CP dated 19 March 2008 of the Government functions, tasks, powers and organizational structure of the Ministry of education and training;
Pursuant to Decree No. 75/2006/ND-CP dated 10 August 2006 from the Government detailing and guiding the implementation of some articles of the law on education;
Pursuant to Decree No. 115/2010/ND-CP on December 24, 2010 the Government's governance responsibilities in education;
At the suggestion of the Director of primary education, the Minister of education and training decision: article 1. Attached to this circular Charter elementary school.
Article 2. This circular has effect from the date of Feb. 15, 2011. This circular replaces decision No 51/2007/QD-BGDDT DATED August 31, 2007 by the Minister of education and training issued a Charter elementary school. The previous provisions contrary to the provisions of this circular are abolished.
Article 3. Office Manager, Director of elementary education, the heads of the relevant units of the Ministry of education and training, President of the people's committees of provinces and cities under central, Director of the Department of education and training is responsible for the implementation of this circular.

Scope and objects 1. The Charter regulates the organisation and functioning of primary schools include: Organization and management of the school; educational programs and educational activities; the teacher; students; the property of the school; the school, family and society.
2. The Charter applies to primary schools; primary grades in schools has many levels and specialized field; other institutions performing elementary education program; the Organization, individuals involved in the education activities in primary education.
Article 2. Location of elementary school in national education system in elementary school is the educational establishments of the system of national education, has legal personality, have accounts and private seals.
Article 3. Duties and powers of the elementary school 1. Organization of teaching, learning and educational activities targeted, quality educational programs elementary level by the Minister of education and training.

Article 4. Elementary school, elementary classes in schools has many levels and specialized schools, other institutions performing elementary education program 1. Primary schools are organized under two types: public and private schools.
a) public elementary school, established by the State, construction of infrastructure, ensuring funding for the mission often genera;

Chapter II ORGANIZATION and MANAGEMENT of the SCHOOL article 9. Conditions of primary and established conditions for allowing educational activities 1. 2. The school is allowed to operate with enough education to the following conditions: a) Has decided to establish or decide to allow the establishment of the school;

c) Have campus, land, physical facilities and equipment meet the requirements of educational activities;
d) Containing teaching materials, learning in accordance with suitable level;
e) has a team of teachers and management personnel of standard, sufficient in number, uniform structure to ensure implementation of the educational program and the Organization of educational activities;
g) have sufficient financial resources to ensure the maintenance and development of educational activities;
h) ruled the Organization and operation of the school.
3. Within the time limit prescribed for permission, if the school has enough of the conditions prescribed in paragraph 2 of this Article shall be the competent authority to allow education activities; expiry rules allow, if not eligible then decided to establish or decide to allow established recovered.

b) education and training receive the record, considering the conditions established by the provisions in clause 1 article 9 of the Charter. Within 20 working days of receipt of a valid application, if found qualified, education and training have comments in writing and send the profile proposed the creation of the school to the district-level people's committees;

Article 12. Merger, Division, separation of the primary school 1. The merger, Division, separation of the primary school must ensure the following requirements: a study of benefits) for students;

Article 13. Active suspension of primary education 1. Primary schools, campuses have active elementary education suspended the operation of primary education when it occurs in one of the following cases: a fraud) have to be allowed for educational activities;
b) does not guarantee one of the conditions specified in paragraph 2 of article 9 of this regulation and do not guarantee the normal operation condition of primary education;
c) Who allow educational activities vires;
d) does not implement educational activities within the prescribed time limit allowed since allowed educational activities;
e) violation of the provisions of the law on education sanctioned administrative offense in the level are suspended;
g) cases of violation of other provisions of the law.
2. 3. Article 14. Defunct elementary school 1. The elementary school was dissolved when occurs a in the following cases: a) serious breach of regulations on management of organizations, activities of elementary school; serious influence to quality of education;
b) out of time suspension that didn't fix the cause leading to the suspension;
c) objectives and content of the activities recorded in the decision established or allowing established elementary school no longer match the requirements of socio-economic development;
d) as suggested by individual organizations established elementary school.
2. The decision to dissolve must specify the reason dissolved, measures to ensure the rights of students, staff, teachers and management staff. The decision to dissolve the school must be publicized.
3. The order and procedure of dissolution elementary school, other institution: a) education and training assessed the level of violation prescribed in point a, point b, point c of paragraph 1 of this Article or review to recommend dissolution of the Organization, individuals established elementary school; the report suggested writing committees at district level decision to dissolve;

Article 16. Conditions and procedures, registration of establishment of other institutions performing elementary education program 1. The Organization, individuals register established in other institutions performing elementary education program is to allow the authorized establishment when ensuring the following conditions: a) support requires universal primary education locally;
b) Is an elementary school sponsored and helped the competent authorities on the management of the educational activity according to the provisions of article 27, article 28, article 29, article 30, article 31 of the Charter;
c) Have teachers under the standard provisions of article 36 of the Statute;
d) Has classrooms according to the provisions of article 46 of the Charter.
2. Order registration procedure established in other institutions performing elementary education program: a) individual organizations have registered with the social people's Committee, composed of: sheets of the proposed establishment of other institutions performing elementary education programs accompanied by a copy of the degree a valid certificate, tentative person's in charge of that institution, the writing of a primary school in the same area in the district;
b) people's Committee Chairman granted the town receiving records, review, writing to allow the establishment of other institutions performing elementary education program. The establishment permit or not permit establishment must be answered in writing, within a period not exceeding 20 working days from the date of receipt of a valid application.

Article 21. Deputy Principal 1. Article 23. School Council 1. Article 26.
