Pursuant to the law on cultural heritage of 29 June 2001 and the law amending and supplementing a number of articles of the law on cultural heritage on June 18, 2009;
Pursuant to Decree No. 98/2010/ND-CP dated 21 September 2010 detailing the Government's implementation of some articles of the law on cultural heritage, and the law on amendments and supplements to some articles of the law on cultural heritage;
Pursuant to Decree No. 185/2007/ND-CP on December 25, 2007 of the Government functions, tasks, powers and organizational structure of the Ministry of culture, sports and tourism;
The Ministry of culture, sports and tourism of the regulations on the Organization and operation of the Museum as follows: article 1. Object, scope 1. This circular rules on organization and operation of the public museum, the Museum outside the establishment.
2. This circular apply to organizations and individuals in Vietnam to join the establishment, organization and operation of museums in Vietnam.
Article 2. Named the Museum 1. Named for the operation or content of the Museum's main collection;
2. Named for celebrities, according to the local name headquarters the Museum, under the name of owner or as the name of the owner of the Museum;
3. The name of the Museum was not identical with the name of the Museum was the competent bodies established or licensed activity;
4. The name of the Museum not to be paired with the word "Vietnam", "nation", except for the Museum by the Prime Minister decided to establish.
Article 3. The Museum's organization 1. Organization of the Museum due to established authority decided, in line with the powers, duties, functions and content of the Museum's activities, including: the Museum leadership, or organizational talents, the subdivisions.
2. The Director of the Museum has the responsibility to organize professional training for public officials, officers, workers to raise the level to meet operational requirements.
3. The Museum was involved as a member of international professional organization concerned in accordance with the law.
Article 4. The Museum's Science Council 1. The Scientific Council of the Museum by the Museum's Director decided to establish under the authority, as counsel for the Director of the Museum on the direction of short-term, long-term development and the scientific issues involved; evaluation of scientific value, economic value of documents, and objects relevant to the operation of the Museum.
2. The Scientific Council of the museum include: President, Vice President, Secretary and the Commissioner are scientists in and outside the country have reputation in the areas of science, business related to the content of the Museum's activities.
3. Funding of activities of the Scientific Council of museums of the funding activities of the Museum.
Article 5. Scientific research activities 1. Scientific research activities of the Museum are taken regularly through the deployment of scientific topics and levels, programmes, projects, other projects under the plan, the long term.
Scientific research activities must be mounted and enhance the quality of the Museum's operations to serve the public and contribute to the development of theory of museology.
2. The Museum is associated with the Organization, individuals in and outside the country to implement the programs, plans of scientific research related to the Museum's activities under the provisions of the law.
Article 6. Active material culture collections, documents, artifacts and intangible cultural heritage 1. The Museum collection, the material culture of documents, artifacts and intangible cultural heritage in home and abroad consistent with the scope, object, the content of the Museum's activities.
2. the Organization of museum collections, documents, material culture artifacts and intangible cultural heritage through the following methods: a) fill survey wildlife collectibles, chemical material documents, artifacts and intangible cultural heritage;
b) archaeological excavations;
c) receiving documents, artifacts caused by individual organizations to transfer, donate;
d) Buy, exchange documents, artifacts with individual organizations.
The material culture collections, documents, artifacts and cultural heritage objects are subject to the provisions of the current legislation and the international treaties to which Vietnam is a member.
3. documents, artifacts of the Museum was transferred, liquidation, in the following cases: a) is inconsistent with the scope, content and object of activity of the Museum;
b) damage is no longer likely to recover;
c) are determined harmful to humans and the environment;
d) are defined incorrectly on the history, culture, science;

Advisory opinion base of the Museum's Science Council and the relevant legal provisions, the Director of the Museum in addition to the decision the transfer, liquidate, destroying documents, artifacts; Public Museum Directors suggested the head of the Agency, held the direct owner of the Museum decided to transfer, liquidate, destroying documents, artifacts.
Article 7. Inventory activities 1. The Museum organized the inventory of documents, artifacts under inventory of artifacts the Museum was the Minister of culture and information attached to decision No 70/2006/QD-BVHTT DATED September 15, 2006.
2. inventory records documents, artifacts are created, managed, long-term stability; stored in writing and stored by information technology.
Article 8. Preservation activities 1. Works to preserve documents, artifacts including: a) arrange documents, artifacts and treasures for preservation organizations;
b) Established record of the status of documents, artifacts and preserving the environment;
c) organized the preventive preservation, conservation, disaster prevention, risk for documents, artifacts.
2. Maintenance must be done with all documents, artifacts when displayed, when kept in storage and when given in addition to the Museum.
3. The preservation of documents, artifacts must comply with the processes, principles, and techniques consistent with etiquette, customs, and beliefs related to documents, artifacts.
Article 9. Works on display documents, artifacts and introduced non-object cultural heritage 1. Works on display documents, artifacts and cultural heritage introduction of the museum include: a) long-term, short-term exhibits at the Museum;
b) exhibits, roving exhibitions in and outside the country;
c) Organization introduced the intangible cultural heritage.
2. Exhibits, artifacts and documents introduced the intangible cultural heritage of the Museum must ensure: a) fit the scope, object, the content of the Museum's activities;
b) focuses on showcasing the original artifacts, documents;
c) the introduction of the intangible cultural heritage is associated with the document content, artifacts, exhibits of the Museum, helping to protect and promote the value of intangible cultural heritage;
d) demonstration exhibits provide full, clear, accurate information about the documents, artifacts and match objects overview;
DD) A restored, copies of documents, artifacts must be accurate, and the science is clear notes;
e) convenient for sightseeing and preserve security, safe for documents, artifacts, visitors;
g) comply with the provisions of the law on the protection of political, social safety and order.
Article 10. Educational activities 1. The Museum's educational activities include: a) sightseeing Guide;
b) organize educational programs;
c) organize seminars, scientific debates, thematic talk;
d) publication related to the educational activities of the Museum.
2. the Museum's educational programs are consistent with active content and audience of the Museum.
3. the Museum's education program aims to create opportunities and encourage the study and enjoyment of the public.
Article 11. Media activities 1. The Museum's communications activities include: a) to introduce the content and operation of the Museum on the mass media;
b) organized the promotion, development and socialization activities of the Museum;
c) Organization took the public's opinions about the Museum's activities;
d) building networks of organizations and individuals concerned to develop the activities of the museums in and outside the country.
2. the Museum's communications activities are consistent with the scope, object, the content of the Museum's activities and comply with the provisions of the relevant laws.
Article 12. Service activities 1. The Museum's service activities include: a) the service organization to eat, drink, rest, recreation and other services;
b) product development organization, publication of the Museum;
c) the Organization of cultural events, education, sports and tourism;
d) provides information, materials;
DD) technical consulting, professional Museum;
e) expertise, artifacts, relics assessment, national treasures;
g) preservation, restoration, making copies of documents, artifacts;
h) cooperation in archaeological excavations;
I) fostering professional cooperation, professional Museum.
2. the Museum's service activities to be consistent with the functions and duties of the Museum and the provisions of relevant laws in order to meet the needs, sightseeing, culture and enjoyment of the public or the Organization's orders, personally.
Article 13. Terms of implementation 1. This circular effect since January 1st, 2011.
2. Abolish the following text: a) decision No. 135/1998/QD-BVHTT DATED June 2, 1998 by the Minister of culture and information issued the regulation on organization and operation of the Museum;
b) decision No. 09/2004/QD-BVHTT DATED June 24, 2004 the Minister of culture and information issued a regulation on organization and operation of the private museum.
