CIRCULAR rules on the criteria and procedures for the certification of economy farm _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ pursuant to Decree No. 01/2008/ND-CP dated 9 January 2008 of the Government functions, tasks, powers and organizational structure of the Ministry of agriculture and rural development; Decree No. 75/2009/ND-CP dated 10 Sep 2009 by Government to modify article 3 of Decree 1/2008/ND-CP dated 9 January 2008 by the Government;
Pursuant to Decree 41/2010/ND-CP dated 12 April 2010 the Government credit policies serve the agricultural, rural development;
The Ministry of agriculture and rural development guidelines and criteria, the certification procedure farm economy as follows: chapter I GENERAL PROVISIONS article 1. Scope this circular guidance on criteria determine the farm economy, the procedure level, level, level back and revoke certificates farm economy.
Article 2. Application object 1. Individuals, households have active agriculture, forestry, aquaculture reached the criteria determine the farm economy under the provisions of this circular;

Article 3. Farm classification 1. The farm is defined according to the production sector as follows: a) the farm crop;
b) breeding farms;
c) farm forestry;
d) aquaculture farms;

-2.1 hectares for the rest.
b) commodity output value reached 700 million/year.
2. breeding establishments must reach the value of output of goods from 1,000 million per year;
3. for forestry production facility must have a minimum area of 31 hectares and the output value of goods on average reaching 500 million/year or more.
Article 6. Change the criteria identifying farm economic criteria determine the farm economy is adapted to the socio-economic conditions of the country in each period, stability in the minimum time of 5 years.
Chapter III PROCEDURE for GRANTING, REVOKING the CERTIFICATE article 7 FARM ECONOMY. Article 10. The order, granted the certificate change farm economy.
1. Individuals, households or authorized representative filed 01 (a) record as defined in article 8 (for the case of the new grant proposals), article 9 (request for change) of this circular in people's Social Committee, where farm production.

The case does not confirm the petition, grant the certificate change farm economy, people's Social Committee must reply in writing stating the reason for the applicants within 3 working days from the date of receiving the application.
4. the people's committees at district level make the modified certificate level, level farm economy according to the form prescribed in annex I attached to this circular for individuals, households within 3 working days from the date of receiving resumes from people's Committee moved to township level If there's enough of the following conditions: a) full documents with the provisions of article 8, 9 of this circular;
b) satisfy the criteria determine the farm economy according to the provisions of article 5 of this circular.
The certificates issued after the farm economy was moved to the people's committees and township level charged to ranchers within 5 working days from the date of certification of the farm economy. No case level, not the modified certificate level farm economy, district-level people's committees must submit the text for social people's Committee, which articulates the reason to inform the applicants.
5. If after 14 working days from the date of submission of application which do not receive a certificate or farm economy is notice is not level, level economic certificate change the farm then the recommended level, the modified certificate level have the right to complain under the provisions of the law on complaints , accusations.
Article 11. Reissuing certificate case farm economy economic certificate lost farm, burning, tearing, ragged ranchers filed Paper certificate re-issuance proposal farm economy follow the form prescribed in annex IV attached to this circular and farm economic certificate has been issued in the case of laceration , crushed to the people's Committee at district level where has certification for individual farm economy, households.
District-level people's committees implement economic certificate reissuance farm within 5 working days from the date of receiving the application.
Article 12. Revocation of certificate of farm economy 1. Farm economics certificate is revoked in the following cases: a) the farm termination of production activity;
b) farm containing land use falls below specified levels, or in three years not standard regulations on product value goods agriculture, forestry and fisheries.
2. the people's Committee of social responsibility report-level people's Committee decision to revoke the certificates of the farm economy.
3. The decision to revoke the certificates sent farm economy for ranchers and people's Social Committee where the recovered farm farm economy certificate.
Chapter IV IMPLEMENTATION article 13. Implementation 1. The people's Committee, central cities are responsible for directing the Organization, implementation of this circular.

4. Article 14. Terms of implementation

1. farm economy certificate granted under the old criteria are no longer in force from the date of this circular are enforceable. The farm has the certification needs of farm economics to new grant proposals procedures as prescribed in this circular.
2. This circular takes effect after 45 days from the date of signing and replacing circular No. 69/2000/TTLT/BNN-GSO on 13/6/2000 of the Ministry of agriculture and rural development and the General Department of statistics on the instructions of the criteria determine the farm economy and circular No. 74/2003/TT-BKHCN on 4/7/2003 by the Ministry of agriculture and rural development modification additional items, III of circular No. 69/2000/TTLT/BNN-GSO.
