Pursuant to the law on road traffic, November 13, 2008;

Pursuant to the law of product quality, the goods on November 21, 2007;

Pursuant to Decree No. 132/2008/ND-CP on December 31, 2008 detailing the Government's implementation of some articles of the law on product quality, goods;

Pursuant to Decree No. 51/2008/ND-CP dated April 22, 2008 Government's functions, tasks, powers and organizational structure of the Ministry of transportation;

Pursuant to Decree No. 12/2006/ND-CP dated 23 January 2006 from the Government detailing the trade Enforcement Act of purchase and sale of goods and international sales agent activities, processing and transiting goods with foreign countries;

The Minister of transportation regulations as follows: chapter I GENERAL PROVISIONS article 1. Scope 1. This circular provisions on quality control of technical safety and environmental protection the imported vehicles.

2. This circular does not apply to: a) motorcycle, motorcycle;

b) motor vehicles imported to use on defense purposes, security of the Ministry of defence, the Ministry of public security;

c) vehicles imported to perform the special purposes and not to join the traffic.

Article 2. The object that applies to this circular apply to organizations and individuals in the country and abroad (hereinafter referred to as the organization or individual) imports of motor vehicles and the organizations and agencies related to the management, inspection and testing of motor vehicles.

Article 3. Explanation of terms In this circular the terms below are interpreted as follows: 1. The motor vehicle is the type of motor vehicles operating on roads (except motorcycles, motorcycles) are defined in the ISO standard ISO and 6211 7271, including box chassis.

2. Motor vehicles of the same type as the motor vehicles of the same owner, same marks, same design, same specifications, the same country of origin.

Article 4. Imported vehicles must comply with the current rules on the types and standards, technical regulation respectively.

Article 5. Vietnam register (hereinafter the Agency) to organize and conduct quality control of technical safety and environmental protection (hereafter called check) vehicles imported within the country.

Chapter II PROVISIONS on QUALITY CONTROL of TECHNICAL SAFETY and ENVIRONMENTAL PROTECTION of article 6. Registration records check 1. Registration records check includes the following documents: a) A test registration key indicates the number of frames, engine number and year of manufacture of the vehicle according to the template outlined in annex I attached to this circular;

b) copies of import documents of the Organization, the individual imports include: commercial invoices or equivalent documents; Import goods declaration;

c) copies the document introduces the features and specifications of individual importing organizations which have expressed the following basic content: the parameters of the basic dimensions; The parameters of the volume: the volume itself, the volume of freight, the entire mass, the mass distribution is itself on the axle (only applicable to vehicles the whole mass from 15 tons and over); The basic specifications of the engine; The number of passengers, including the driver; Tire size; Introduction to the main system as: transmission system, brake system, steering system, suspension system, signal lights, special structures on the vehicle (if any);

Particularly for vehicles not yet through the use of external material then introduce features and specifications mentioned above, organizations, personal imports to supplement the following documents:-A key test Votes issued by the manufacturer for each vehicle that shows the number of the frame, engine number (if available) or the certificate of quality (C/Q) manufacturer's level for motor vehicles world imports.

-The documentation concerning the emissions of motor vehicles not yet through the use, import includes a copy certified by the Organization, the individual import of one of the following documents: + emission test report by the Agency, the competent foreign organization level for the type of motor vehicles or motor vehicle engines (for heavy cars) in which the test results of the test specified in the corresponding standards;

+ Certificate of authority foreign agency confirming the type of motor vehicles or motor vehicle engines (for heavy cars) has satisfied the requirements of the waste gas as current rules or higher for each type of vehicle and the test provisions in the respective standards.

+ Certificate (or certificate) of the manufacturer for the type of motor vehicles or motor vehicle engines (for heavy cars) which has confirmed the type of vehicles or motor vehicle engines satisfy the emissions requirements as the current regulations or higher for vehicles not yet through the use of imported objects is : Motor vehicles were the competent authorities of countries applying the European emissions standards certification type of vehicles or heavy automobile produced in countries not applied European emission standards but satisfy the requirements of the country and the requirements equivalent to or higher than the current.

The use of the certificate (or certificate) of the manufacturer for the type of motor vehicles or motor vehicle engines (for heavy cars) replaced the emission test report or certificate of authority foreign agencies as stated above only applies during 2 years from the date of this circular are enforceable.

-Requests for documents related to the exhaust of motor vehicles do not apply to the following objects: + motor vehicles not in traffic, operating mainly in the area of mining, ports, airports, warehouses, factories, resorts and entertainment;

+ Motor vehicles imported under the provisions of its own Prime;

+ Motor vehicles imported as non-refundable aid goods or gifts for the organizations.

d) for cars carrying people under 16 used seat, in addition to the documents mentioned in points a, b and c of paragraph 1 of article 6 of this circular, the Organization, the individual importing additional copies must be certified by the Organization, the individual import of one of the following papers :-the registration certificate or one of the types of papers are of equivalent value;

-Certificate of circulation;

Paper shredders-the certificate of registration or certificate of cancellation Certificate issued by the competent authority of the country where the registered cars in circulation levels for vehicles.

Particularly for the case of the media has changed owners several times before the import of Vietnam and on the registration certificate or the alternative papers do not have enough facilities to determine the time of registering to use the car, then the Organization, individuals can import additional legal evidence before the agency or professional organization media management industry in the car exporter.

2. Free brochure features and technical specifications and documents related to emissions referred to in point c of paragraph 1 of article 6 of this circular for the import of motor vehicles of the same type with the type of vehicle was inspected and certified the quality of technical safety and environmental protection of motor vehicle importers (hereafter referred to as the certificate of quality the amount). Article 7. Check for motor vehicles not used vehicles not yet through the use (including the box chassis) was examined according to the following rules: 1. Check to confirm the type of category a) this test method applies to vehicles not yet through use, produced before the time of the import of no more than 3 years There's full profile, as defined in article 6 of this circular and satisfy one of the following conditions:-the motor vehicle has been checked by the agreement or mutual recognition agreements on standards and conformance which Vietnam joined signed;

-Vehicles are imported by authorized dealers for sale and the manufacturer's warranty, have the same type of vehicles has been the Agency check the quality certification.

b) content check: check the fit of the type shown in the type of car registration documents checked versus type has been tested;

Check the status of your frame, engine number of each imported vehicle has the same type with the type of the type shown in the registration records check.

2. Check the test sample a) this test method applies to vehicles not using not subject referred to in paragraph 1, article 7 of this circular and in one of the following cases:-motor vehicles have emission-related documents but no material introduces features and specifications or documents introduction and features specifications do not match the actual vehicle;

-Vehicle type categories not yet competent foreign authority certification of type type.

b) content test: test 1 random samples taken from each truck type vehicles have registered record check under the categories specified in the current technical regulation of the Ministry of transportation of the quality technical safety and environment protection for motor vehicles;

Check the status of your frame, engine number of each imported vehicle has the same type of vehicle model.

3. check the probability a) this method applies to each type of vehicle used, yet have full records according to the rules, not subject referred to in the clause 1, 2 article 7 of this circular and in one of the following cases:


-Motor vehicle agencies to check the certificate of the type but subject to that agency have demonstrated differences between specifications technical documents with motor vehicles imported or technical documents are not reliable enough to base inspection.

-Type-type vehicles not yet test agency quality certification;

-Vehicles of the same type with different agencies checking quality certification but are imported by organizations or individuals not authorized resellers on sales and manufacturer's warranty.

b) content check: test 1 random samples taken from each truck type vehicles have registered record check under the category of general inspection, check engine, check the brake system, check out the suspension, check the steering system, check the electrical equipment, signal lights under the provisions referred to in article 8;

Check the status of your frame, engine number of each imported vehicle has the same type of vehicle model.

4. check each car a) this method applies to the vehicles in the subjects referred to in paragraphs 1, 2 and 3 of article 7 of this circular.

b) content check: check under the category of general inspection, check engine, check the brake system, check out the suspension, check the steering system, check the electrical equipment, signal lights under the provisions referred to in article 8.

5. Check the emissions testing (except for volatile test) a) this method applies to vehicles in the following subjects:-motor vehicles without emission-related documents as specified in point c paragraph 1 article 6 of this circular;

-Motor vehicles have emission-related documents but the document does not express the full range of the test applicable to the vehicle type as defined in the national technical regulation of QCVN 5:2009-BGTVT "national technical regulation of automobile emissions produced, assembled and new import";

-Vehicles are not consistent with the structure of documents related to the exhaust.

b) content check: test 1 random samples taken of each type of vehicles in accordance with national technical regulation of QCVN 5:2009-BGTVT "national technical regulation of automobile emissions produced, assembled and new importers" and tested at the testing center the exhaust of motor transport on road-Vietnam register or at one of the emissions testing facility test bodies were admitted.

Article 8. Check for motor vehicles đãqua use used motor vehicles (including vehicles no freighter barrels) imported, have full profile as defined in article 6 of this circular, are checking each car according to the following rules: 1. General test a) frame and/or VIN number the engine number, not be opaque, closed and properly with the registration records check of the vehicle;

b) the motor vehicle is in the normal operating status, ensuring full use, functionality, appearance and texture match brochure features and technical specifications were registered at the Agency check (unless a truck without cargo tanks);

c) motor vehicles must have a size, mass and the distribution of the mass on the axle line with provisions in the current technical regulation of the Ministry of transportation of the quality technical safety and environment protection for motor vehicles.

2. check the hull, cockpit, crates a) is not cracked, broken, rusty items, tear, puncture;

b) up and down the Door closed, gently open, not open by itself when the car runs;

c) windscreen and window glass is glass, the right type of vehicles which, in accordance with the rules of safe for the person sitting in the car; no breakage, cracking or discoloration;

d) mirror is full, true type, installation for sure;

DD) Chair the driver and passenger seats have the correct layout with technical documentation, docking and definitely has a size consistent with the provisions of the current technical regulation of the Ministry of transportation of the quality technical safety and environment protection for motor vehicles;

3. Check the chassis are not cracked, broken, warping at to identify by eye. Not a rust affect the ability of the texture.

4. check the engine a) true type or type of equivalent capacity. b) no leakage phenomenon into drops of fuel, lubricating oil and cooling water;

d) engine is stable activity in the rotation mode does not load; No strange knock;

DD) pressure lubrication, cooling water temperature when the engine works stable must be in the limits;

e) limits the allowed emission of the engine must satisfy the following rules:-for the media forced fire engines, 4 States: CO content must not exceed 3.0% by volume; HC concentrations do not exceed 600 ppm by volume;

-For the media forced fire engines, 2 States: CO content must not exceed 3.0% by volume; HC concentrations do not exceed 7800 ppm by volume;

-For the media forced fire engines, special (is the engine type as the Wankel engine and some other engine types have special structures other than the texture of the engines has píttông, round leather gloves (xéc cement) now commonly used): CO content must not exceed 3.0% by volume; HC concentrations do not exceed 3300 ppm by volume;

-For combustion engines by means of compression: smoke levels do not exceed 60% of the HSU;

g) noise emitted by the vehicle when parked does not exceed the maximum permitted noise level defined in the current technical regulation of the Ministry of transportation of the quality technical safety and environment protection for motor vehicles;

h) working volume of the engine are recorded according to the value shown in the brochure features and technical specifications or lock the motor safety deposit box mounted on the engine or the manufacturer's information. 6. check brake system a) are full of parts, the details according to the technical documentation of the type of vehicles;

b) gas pipelines, not cracked, worn, not defeated, no leaks;

c) pressure gauges, pressure indicator: true type, docking of working sure, stable, no damage;

d) foot Brake:-for brake systems, oil, after no more than 2 times the brakes the brakes must be applied.

7. check the steering system a) are full of the clusters, the details according to the technical documentation of the types of vehicle and normal functioning, stable;

b) Horn, lights, signal lights, gotten rain ensures the technical safety standards under current rules for motor vehicles are in circulation.

10. Check the specialized structure for specialized vehicles, the specialized structure is complete, make sure the functions match the technical documents of that type of car.

Article 9. Processing of results 1. After checking the vehicle and get the full profile under the provisions relating to motor vehicles imported, the Agency will grant the quality certificate for each particular case as follows: a) the vehicles satisfy the requirements referred to in article 7 paragraph 1, the Agency examined the level of quality inspection exemption notice (hereinafter referred to as notice of exemption check) in the form referred to in annex III attached to this circular;

b) motor vehicles satisfy the requirements stated in paragraphs 2, 3, 4 Article 7 and article 8 of this circular, the Agency examined the quality certification according to the template outlined in annex IV attached to this circular;

c) motor vehicles through check, unsatisfactory testing, the Agency issued notice does not reach the quality of technical safety and environmental protection motor vehicle import form outlined in Appendix V attached to this circular and send the relevant agencies to take measures to handle.

2. Certificate of quality or long message checking for motor vehicles imported to be used to address the audit procedure first technical safety, and media registration is used to solve the import procedure when required by the competent authority.

The motor vehicle has been issued a certificate or notification of quality inspection exemption but was damaged during unloading, transport, preservation cause does not guarantee the quality of the media, the quality certificate or notice long check has granted to vehicles which will not be valid.

3. The processing of some special case during the test is done as follows: a) case of second-hand motor vehicles do not have the document introduces features and specifications or the content of the technical documentation is incomplete, the basic specifications of the vehicle is determined on the basis of test , the actual test;

The case of private vehicles have shift from overseas on a number of specifications or texture than the base car, import personal organization shall produce the documents of the vehicle management agency for foreign cars has changed. The entire mass of the motor vehicle imports in this case cannot be greater than the value stated in the document of the foreign media management for vehicle has changed;

b) for cargo vehicles distributed mass on the axle is greater than prescribed, the mass transportation of imported cars is determined according to the results of calculating the axial load allowed under regulations of the Department of transportation;

c) where vehicles had used the size and/or weight greater than corresponding regulation or specialized media types have the steering on the right works in narrow range allowed importing as outlined in section 5, part II, Appendix No. 01 attached to Decree No. 12/2006/ND-CP on January 23, 2006, the Government is checking to import but in that quality certificate: this car works only in a narrow range, while in traffic must be allowed by the road administration authority;

d) where the imported vehicles were damaged during shipping from the port queue about Vietnam, the Organization, individuals are allowed to import a number of clusters as follows: hull, cockpit, cargo containers have scratches or paint the box to the local culture but poker not be termites , perforation; Windshield, glass windows were cracked; Lighting system, signal: cracked, shattered; The control relays are missing; Mirror cracked, shattered; Wiper rain damage or unusual activities; Battery does not work;

DD) motor vehicle case not yet through the use of size greater than current rules be disassembled to facilitate transportation on Vietnam, the Agency examined the import quality control only when the car was fully assembled;

e) where vehicles subject to recall (recall) to repair, fix the error according to the current rules on automobile products recall of faulty technique, is the manufacturer of the vehicle (or vehicle management agency abroad official announcement at the time of the import car inspection agency quality certification only after the Organization personal imports, have written commitment accompanied by the text of the manufacturer or of the manufacturer's authorized confirmed imported cars have done repairs to fix errors and ensure safe;

g) case on the car has no frame and/or of the engine or on the vehicle has many of the frames and/or engine number not be opaque, closed, the Agency will examine the specific record of the condition of the frame and/or engine number on the certificate of the quality of the vehicle;

The case of motor vehicles have frame and/or engine number was opaque this page shall be inspected but in the certificate indicates the quality of the opaque frame number and/or the engine number of the vehicle;

When there is doubt about the status of the frame and/or the number of motor vehicle inspection agency will referendum in specialized examiners to specific processing;

h) In the production of motor vehicles is determined by the base as follows:-according to the vehicle's identification number (VIN);

-According to the vehicle's chassis number;

-According to the manufacturer's documentation, such as catalogs, technical manual, the software or the manufacturer's information;

-Information on the manufacturer's labels are attached or close on the car;

-By year of production was recorded in the copy of the certificate of registration of the vehicle or vehicle registration cancellation Certificate are circulating in foreign countries;

For other special cases, the Agency established the Council of Examiners in which the participation of technical experts to decide.

Article 10. Procedure of quality certification technical safety and environmental protection for motor vehicles imported 1. Order a) Organization, personal imports up 11 of Ministry registration records check as stipulated in article 6 of this circular and submit it directly to the test;

b) after receiving the registration records check, inspection agencies will review, collate test registration records with current regulations relating to motor vehicles and treated as follows: If the registration records check incomplete according to the regulations, the Agency will guide the Organization personal import, complement, perfection;

If registration documents fully tested as prescribed in paragraph 1 of article 6 of this circular, the Agency will confirm on check registration certificate at the same time consistent with the organisation and individuals importing on time and location check;

c) inspection agency conducting the inspection of motor vehicles imported in the place agreed with the Organization, the individual level of notification and import free of quality control or quality certificate or notice does not reach the prescribed quality at points a, b, c paragraph 1 article 9 of this circular.

2. how to make the Organization, individuals filing import registration check directly at the Agency check and quality certification after having filed charges and fees according to the current rules relating to the inspection and certification of the quality of motor vehicle imports.

3. The time limit for settling a) for the inspection of records the registration check and confirmed on the test certificate: within 7 working days;

b) for the inspection and certification of quality: within 10 working days (for vehicles carrying people under 16 seats, not yet used) or 5 days (for other motorized vehicles) since the end of the motor vehicle test and get enough records as prescribed.

Chapter III EFFECTIVE IMPLEMENTATION of article 11. Effect 1. This circular has the effect after 45 days from the date of signing and annul the decision No. 35/2005/QĐ-BGTVT dated 21 July 2005 of the Minister of transport issued the regulations on quality control of technical safety and environmental protection motor vehicle imports.

2. quality certificates and inspection exemption notice has been issued before the effective date of this circular is still worth using.

Chapter IV IMPLEMENTATION article 12. The responsibility of the organization or individual to import 1. Responsible for the truthfulness and accuracy of the dossier of documents provided to the test.

2. Ensure the status quo of motor vehicle inspection agency to perform the inspection;

3. Make decision on disposal of the Ministry of transportation when violating regulations on the State test for the quality of motor vehicle imports.

Article 13. The Agency's responsibility to test the 1. Implementation of this regulation at the same time have the responsibility to guide the Organization, individuals importing in ensuring quality requirements of technical safety and environment protection for imported motor vehicles.

2. Uniform issuing, management quality certificate.

3. Build a business guide to quality control of technical safety and environmental protection the imported vehicles.

4. Collect the revenues related to the inspection, the certificate of quality according to current rules.

5. test records of motor vehicles imported within 2 years.

6. General results check the quality of imported motor vehicles to the Department of transportation report.

Article 14. Organizing Chief, Chief Inspector, Director of the Service, the Director of the Vietnam register, heads of agencies, organizations and individuals concerned is responsible for the implementation of this circular.
