Pursuant to Decree No. 23/2006/ND-CP dated 3 March 2006 from the Government about the implementation of the law on the protection and development of forests;

Pursuant to decision No. 186/2006/QD-TTg dated 14 August 2006 Prime Minister's Government issued the regulation of forest management;

The Ministry of agriculture and rural development, implementation guides, artisanal mining of wood and forest products out of wood as follows: chapter I GENERAL PROVISIONS article 1. Scope and objects 1. Scope: this circular object regulations, conditions, procedure sequences extraction, artisanal, wood forestry products besides wood in natural forests, planted forests and other plant species to the same name as the species of wood, forest products in addition to the above mentioned timber in nationwide.

2. Objects: a) is forest forestry companies, the forestry, forest management, forest, special-purpose and cooperative enterprises have registered forestry industry business (referred to as forest owners).

Section 2 exploitation, ARTISANAL WOOD and FOREST PRODUCTS OUT of WOOD for the FOREST OWNER is HELD article 7. The main natural forest timber exploitation 1. 4. Article 9. Exploitation by capital concentration by plantation forest owners investments or State aid 1. Extraction method: according to the provisions in clause 1 of article 8 of this circular.

2. Design: as item 2 article 8 of this circular.

3. registration of extraction: Forest Owners themselves approved mining design and send 1 the records of people's Social Committee to register. The records include: A sign of exploitation, decided to approve the design, presentation design, exploitation and the extraction zone map.

Within 3 working days from the date of receiving the application, if not yet valid-level people's committees shall inform the forest home Township to the prescribed supplements.

During 10 working days from when it receives a valid profile, if the social people's Committee has no comments, the forest was exploited by decision approved.

Article 10. Exploitation of bamboo in the forest production, forest protective natural forests.

1. Intensity of extraction: for maximum production forest is 70% of the trees, dust; for maximum protective forest is 30% of the trees, dust.

Within 10 working days from when it receives a valid profile, if the Department of agriculture and rural development no comments, the forest was exploited by decision approved.

Article 11. Exploit utilize on an area of ground clearance for the construction works, or use in other purposes.

1. eligibility: Must be authorized to allow the transfer of forests to construction or purpose of the forest to other purposes.

2. Unit is tapped: after being allowed to convert forest to construct buildings or switch to other purposes and the owner completes the prescribed compensation procedures, the provincial people's Committee delivered to the owner of the forest or mining function units.


3. design of extraction: Forest Owners or the unit was provincial people's Committee allow exploitation of DIY or hire consultants developed mining district boundaries take advantage, building a map of 1:5,000 or 1:10,000; data collection and written presentation design. Within 10 working days from receipt of a valid application, the Department of agriculture and rural development approved mining license, records and paid results for forest owners or mining units. The time limit for the registration of the server by exploiting the forest or mining unit, but must make sure the clearance period and recorded in the mining license.

Article 12. Exploit the advantage in the process of implementation of forestry measures, or mining and forestry activities born to serve scientific research and training 1. During 10 working days from when it receives a valid profile, if the competent authorities do not have comments then be exploited to leverage under the registered profile.

b) for plantations due to forest owners investments or State support: Forest Owners send 1 the records of people's Social Committee. Records of registration as specified in point a of paragraph 3 of this article.

Within 3 working days from the date of receiving the application, if not yet valid-level people's committees of communes must inform the owner of the forest to supplement according to the regulations.

In the time of 5 working days from receipt of valid records, if the social people's Committee has no comments, the forest was exploited to leverage under the registration records.

Article 13. Exploit the advantage of the trees stand dead dry, burned, broken trees and artisanal is wood, root, root, branches of cases not artisanal products by forest owners to decide, if there are artisanal products, then do the following: 1. for natural forests or plantations by budget the aid, which is not refundable: a) designed: Forest Home DIY or hire consultants to investigate, survey in the field, construction and mining area diagrams written presentation design.

b) take advantage of the mining license, artisanal: forest send 1 the records of the Department of agriculture and rural development. The profile includes: sheets of the recommendations, a theory of intelligent design, diagrams, take advantage of the mining area.

Within 3 working days from the date of receiving the application, if not yet valid Department of agriculture and rural development must inform the owner of the forest to supplement according to the regulations.

During 10 working days from when it receives a valid profile, Department of agriculture and rural development, approval, licensing, take advantage of exploiting currency and paid results for forest owners. The duration of the mining permit for a maximum of 12 months from the day of promulgation.

2. for plantations due to forest owners investments or State support: a) tabulates expected mining products: Forest Home DIY or hire consultants to investigate, verify in the field and the establishment of the Panel expected mining products.

b) registration: send the 1st indoor Forest Owners about social people's Committee to register. The records include: A sign of exploitation, the Panel expects mining products within 3 working days from the date of receiving the application, if not yet valid-level people's committees shall inform the forest home Township to the prescribed supplements.

 In the time of 5 working days from receipt of valid records, if the social people's Committee has no comments shall be exploited according to the register.

Article 14. Types of artisanal mining, forestry products besides wood and bamboo bamboo in natural forest, planted forest (except for the strictly protected forest's special purpose) 1. The types of forest products are in the category of management Cites and pine resin in natural forests, planted forests by capital budget, non-refundable aid on capital: a) the artisanal mining design: Forest Home DIY or hire consultants to investigate, reviews in the field to collect metrics, build site map mining area , artisanal and written presentation design.

Within 10 working days from when it receives a valid profile, Department of agriculture and rural development approved mining license, records and paid results for forest owners. The duration of the mining permit for a maximum of 12 months from the day of promulgation.

2. The types of forest products not specified in clause 1 of this article.

a) tabulates expected mining products: Forest Home DIY or hire consultants to investigate, verify in the field and the establishment of the Panel expected mining products.

Article 15. The logging of natural forests served the annual demand of 1. Conditions of exploitation: exploitation of forests have been approved according to the provisions in clause 2 6 of this circular.

Section 3 EXPLOITATION of ARTISANAL, WOOD and FOREST PRODUCTS OUT of WOOD for the FOREST OWNER FAMILIES article 16. Within 10 working days from receipt of valid records, district-level people's Committee approval, mining license and paid results for forest owners; at the same time sent the Department of agriculture and rural development, nuts foresters in the people's committees and the social level. The duration of the mining permit for a maximum of 12 months from the day of promulgation.

5. The Organization: as paragraph 4 Article 7 of this circular.
