The DECISION to enact rules good aquaculture practices in Vietnam (VietGAP) _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ the MINISTER of AGRICULTURE and RURAL DEVELOPMENT, food safety pursuant to the law No. 55/2010/QH12 was the National Assembly of the Socialist Republic of Vietnam tags XII, session 7 through 17 June 2010;
Pursuant to Decree No. 01/2008/ND-CP dated 9 January 2008 of the Government function test service, powers and organizational structure of the Ministry of agriculture and rural development;
Pursuant to Decree No. 75/2009/ND-CP on 10/09/2009 the Government amend article 3 of Decree 1/2008/ND-CP dated 3/1/2008 of the Government functions, tasks, powers and organizational structure of the Ministry of agriculture and rural development;
At the suggestion of the General Director of the Bureau of fisheries, decision: article 1. Attached to this decision legal good aquaculture practices in Vietnam (known as VietGAP) and The VietGAP criteria.
Article 2. This decision is effective from the date of signing.
Article 3. Chief of the Ministry, General Director of the Bureau of fisheries, the heads of the units of the Department, the Director of the Department of agriculture and rural development of the province and the central cities, organizations and individuals concerned is responsible for the implementation of this decision.

GENERAL PROVISIONS 1. Scope and object 1.1 application. Scope: this rules applies to good aquaculture practice, a systematic control of the threat in order to ensure food safety, minimize the impact on the ecological environment, good management of aquatic animal health, made the responsibility for social welfare and security for workers.
1.2. the applicable object: this rules applies to organizations, individuals and foreign participation in manufacturing, business, test and certification of good aquaculture practices on the territory of Vietnam.
2. Explanation of terms 2.1. Good aquaculture practices in Vietnam (known as VietGAP, translated into English as the Vietnamese Good Aquaculture Practices) is the legal practice of application in aquaculture in order to ensure the requirements of food safety and hygiene, reducing disease, reduce environmental pollution, ensure social responsibility and to trace the origins of products.
2.2. biological safety in aquaculture is the technical measures aimed at preventing, restricting the infection of the biological agent appear natural or human-generated in aquaculture activities likely to cause harm to humans, animals and ecosystems.
2.3. the adopted base was the site of aquaculture operations, by organizations or individuals.
2.4. Certificate of VietGAP activity is evaluated and confirmed the implementation process for aquatic production practices of the producer in accordance with breaking the good aquaculture practices (VietGAP).
2.5. the certificate of organization VietGAP is the organization with sufficient capacity and conditions prescribed by the Ministry of agriculture and rural development to implement check, certified good aquaculture practices in Vietnam.
LEGAL CONTENT 1. The General requirements of the standard standard standard control content in compliance with legal requirements 1.1 1.1.1 operations of breeding establishments must comply with the regulations of the State.
Must have valid papers according to the current rules of the State such as: land use right certificates or decisions or lease land; the report reviews the environmental impact or commitment to environmental protection or environmental protection project; proven record qualified breeding base producing safe food hygiene; proven record of breeding establishments meet the requirements of employers.
1.1.2 the adopted basis must have registered a valid production activities.
The production activities must register with the competent authority under the provisions of the State and has a valid profile.
1.1.3 the geographic location of the breeding facility must be clearly identified.

Data about geographic coordinates must be entered into the database of the VietGAP by the management authority immediately when done.
1.1.4 the adopted base must lay in the planning of aquaculture development.
Breeding facility is located in the region of aquaculture planning and referenced according to the coordinates VN2000 or have the text confirmed by the local Government of the area farmed it is legal or competent authority allows.
1.2 records 1.2.1 the adopted base notes to build the system of marking for each area produced and shown on the diagram/map.
Must have signage, the Sea mark for each pond and the diagram/map indicating each specific part like the pond area, channel level, channel drain, pond, barn and can reference marker system.

-The notes of orders received and export bills go if available.
1.2.3 the adopted basis must have records and documentation about ensure the hygiene conditions of food safety (FOOD HYGIENE).
Must have proven records of breeding establishments comply with FOOD HYGIENE conditions and documentation ensuring the adopted basis meet FOOD HYGIENE regulations of the State.
1.3 1.3.1 traceability in case the adopted base just registered VietGAP certificate for part of the product must have distinct systems prove the products are certified and not certified VietGAP VietGAP.
The adopted basis to declare the whole information of the farm are owned and manufactured products of the same type and level supplement extra VietGAP codes to distinguish products that are VietGAP and product certification certificate No VietGAP.
To have a system that can distinguish the spot to avoid confusion between products and non certificate VietGAP certificate. Can be made via intuitive or identified through the process of preliminary products, through the associated profile (e.g. number of ponds).
1.3.2 the move aquatic animals feed inside the base, from outside or from inside out are saved to the profile and retrieved.
Must have traceability on all livestock movement activities throughout the life cycle: move inside the base, from outside or from inside out. The information includes the name of the species, number, biomass, number of ao/area.
2. The quality and food safety aquaculture guidelines to ensure the quality and safety of food by way of compliance with the standards and regulations of the State and the provisions of the food and Agriculture Organization (FAO) of the United Nations and the World Health Organization (WHO).
Content standards-standards standard 2.1 compliance control of drugs, chemicals and Biologicals.
2.1.1 the adopted basis to perform inventory, updated all the drugs, chemicals, biological products in stock.

Drugs, chemicals, biological products must be stored in the repository, there are other conditions and according to the instructions indicated on the label.
The drugs, chemicals, biological products must be stored separately in order to eliminate the risk of cross-contamination, put in place solidly, good ventilation, no exposure to other chemicals.
2.1.4 the drugs, chemicals, biological products expired use must be removed properly.

2.2 2.2.1 foster facility hygiene must be a threat assessment on safety and hygiene.

2.2.2 foster facility must have a written safety guidelines.

-Restrict smoking, eating at work;
-Warning about all the possibilities of infection or a similar condition, including signs of infection (e.g., vomiting, jaundice, diarrhea) that if the affected employees will be prohibited from direct contact with aquatic products and food;
-Use suitable protective clothing.
2.3 2.3.1 waste sorts waste and potentially polluting sources must be identified at the facility.
Must have listing the types of waste (for example, paper, cardboard, plastics, oils, etc.) and the source of pollution (for example excess fertilizer, oil, fuel, emissions, noise, waste, chemicals, mud bath water/washing, food scraps, algae mortar off when dry mesh, etc.) generated in the process.
2.3.2 raising facility must have the system and the implementation of gathering, sorting, collection and disposal of garbage/waste regulated.

Must have the removal of wastewater and waste collection vehicles are available when check out.
2.4 2.4.1 harvest harvesting and harvesting and transport of aquaculture products must be done properly, to ensure FOOD HYGIENE.

2.4.2 between two rearing, breeding facility must perform disinfect and/or suspension.

3. Manage aquatic animal health aquaculture guidelines must ensure the health and living conditions for aquatic animal feed by creating optimum conditions in terms of health, reduce stress, limit the risks of disease and maintain good breeding environment in all of the stitching of the production cycle.

3.1.2 all measures to treat animal diseases aquatic pets must be applied and recorded in accordance with the current rules (if any) and fit the QLSKĐVTS plan.
Breeders must know the treatment of animal diseases aquatic farming was, is, will apply and demonstrate that this approach is consistent with the current rules (if any) and the QLSKĐVTS plan.
3.2 3.2.1 food hatchling and hatchling release the feed must be purchased from the same supply base have been authorities certified.
Must have documented proof varieties are purchased from the base have been certified. The supplier for the animal breeding establishments must be registered/certified.

Must have detailed records about all the substances added to food for aquatic animals as colourings, antioxidants, immune stimulant, probiotics ... If there use.
The food and the supplements used in the breeding base have to be purchased from licensed suppliers.
3.2.6 the types of food, including food mixed drugs, must be preserved and used in accordance with the manufacturer's instructions.
Breeders must be trained and instructed on how to preserve and use of food. Food must be stored and used in accordance with the procedures manual of the manufacturer (ask about the warehouse, storage conditions, the use and duration of use).
3.3 3.3.1 treatment does not use hormones and antibiotics to stimulate growth or prevention during the breeding process.
The hormones and antibiotics are not used to stimulate growth or prevention.
Only use antibiotics in farmed aquatic animals case are diagnostic expertise officer is already infectious disease.
Must have lists of antibiotics and dosages used in the breeding process.
3.3.2 breeding establishments must keep records of the purchase and the use of illegal veterinary drugs including the use of feed mixing pharmaceuticals.
The products used/preserved in the repository must be recorded according to the form prescribed. Purchase records include: date of purchase; Name of the product; The number of buying; The batch number; Expiry date; Provider name. Records of treatment include: batch number; Start date of treatment; The species name is treated; The number of aquatic biomass or treated; Dose and total volume of medication use; End date of treatment; The expiration date; Earliest days animals farmed seafood is harvested; Name (s) of person on drugs.
3.4 3.4.1 survival rate tracking
The number of varieties, the average volume, density and total biomass of aquatic animal feed must be monitored regularly.

If the category is in V or KVBT VI the Union's international nature (IUCN), should have the consent of the governing body KVBT.
To prove the location of breeding establishments and related facilities are not in the national or international KVBT (in items from Ia to IV of the IUCN), or areas are determined by international treaties (for example the RAMSAR or World Heritage). 4.2.7 sludge from the adopted basis must be collected and properly stored.
The mud left over from the Canal and from ponds to maintain the depth must be picked up and stored properly to avoid salty soil, groundwater and not cause ecological damage for areas with mangroves or other sensitive ecological areas.
The removal of special mud must be done according to regulations. When no specific regulations, special mud should be collected and eliminated in a separate area and have managed.
4.3 4.3.1 pest control does not apply pest control method is lethal for animals.

5. The socio-economic aspects of the principle of aquaculture must be done in a responsible way with society, respect the local community culture, accepted the State's regulations and the agreements of the International Labour Organization (ILO) labour rights , does not affect the livelihood of the people and the surrounding community. Aquaculture must actively contribute to the rural development, benefit, fairness and contribute to poverty reduction as intensify the local food security. So that the social-economic issues must be considered in all phases of the process of farming from the construction, development and implementation of aquaculture planning.
Content standards standards standards compliance controls 5.1 5.1.1 working conditions of all workers hired in the adopted basis must be 15 years of age.

5.1.2 for workers under 18 years of age, breeding establishments must apply the following working conditions: 1-have the right to go to school (if desired);
2-total number of working hours must not exceed 8 hours per day;
3-limitation in the level of light, simple labor;
4-not dangerous to life must have A daily job description, for each of the workers under age 18.
Limited to the level of light, simple labor jobs does not cause harm to the health and development of workers, does not affect learning or weaken the capacity of receiving knowledge.
Dangerous work life is due to the nature of the work or working conditions to do harm to the health, safety and morale of employees.
5.1.3 workers must be allowed to leave and receive adequate remuneration for work all day at last when the application breaks.
Must have labor contracts with the terms clearly. Workers are allowed to self manage their vacation time. Employers who do not hold back though as part of salary, bonus, property or documents of workers to force them to continue to work for themselves.
5.1.4 employees are allowed to establish or join the organizations to defend their rights (including the right to collective negotiation) without user intervention workers and not suffer the consequences after the implementation of this right.
Workers have the right to join organizations that protect their rights such as collective bargaining or Union in accordance with the labor law.
5.1.5 workers do not suffer any discrimination from employers or the other workers at the base.
Are there rules against discrimination in writing due to home base construction and farming issued (can burn in the rules). No discrimination of race, status, native origin, religion, disability, gender, age or any other condition that may be the root causes of discrimination.
5.1.6 pet owners to respect the dignity of all workers for hire.
Employees must always be treated in a respectful way (e.g. no infringement of the body). Workers not deducted the wages due to the discipline.
5.1.7 time working overtime to ensure the following conditions: 1-is voluntary;
2-do not exceed the maximum prescribed by the State;
3-it happens only in special cases (not often);
4-Be remunerated more highly regulated.
Workers confirm that work overtime is voluntary. Table of confirmed timekeeping maximum overtime per week and confirm overtime occur only in special cases, not routinely. The contract must specify the wages paid for overtime labor law suit.
5.1.8 the living conditions of workers to ensure hygiene.

5.2 health and labor safety 5.2.1 home base feed must have a written assessment of the threat to health, the safety of workers and settlement processes.
Must have A review about the threat to the health, the safety of workers and is updated every time there is a change (for example, new machinery, new buildings, new plant protection drugs, cultivating techniques change etc.).
The process of resolving issues related to the protection of the health and labor safety must conform to the conditions of the facility, including a solution to deal with the accident, the emergency backup plans, equipment and labor protection, the risks have been identified , accident insurance.
5.2.2 pet owners must create the living environment and work safety for workers.
Workers are protected against the harmful as drinking water, living conditions, hygiene, the environment is safe. Accommodation for workers must be constructed from materials of sufficient durability, safe and hygienic.
5.2.3 all workers must receive training, guidance on health and safety.
Pet owners must training on health and safety for workers when there are materials or equipment.
5.2.4 all accidents must be documented and must have the action handles for each accident.
Must have record all accidents, though mild, occur and resolve specific actions. There is evidence about the actions addressed (for example invoices payment of drugs etc.).
5.3 contracts and wages (wages) 5.3.1 employees often have to have labor contracts and clearly understand the terms stated in their employment contract.
All regular workers in breeding establishments are required to have labor contracts.
Case workers are members of the family of pet owners do not need to sign the labor contract.
5.3.2 maximum probationary period must correct according to the current rules of the State.

5.3.3 pet owners to pay no lower than the minimum wage in accordance with the current legislation.
The legal minimum wage regulations applied to breeding establishments are in full compliance.

5.3.4 Are there the table record clocking of working hours of labour in each breeding facility.

5.3.5 the salary or wages must be paid in cash or by the most convenient way for workers.

5.4 5.4.1 communication channels for livestock owners must ensure that all employees have the appropriate communication channel with the employer on issues related to labour rights and working conditions.

Pet owners must have statistics and keep track of the hard problems that workers are given (including the complaint), and the feedback has been made. Interview with staff reflecting the validity.
5.5 5.5.1 community problems in the breeding facility Owner to build and apply the conflict resolution for the surrounding community.
Pet owners must have compromise and solution of contradictions with respect to the adjacent farming households and the surrounding community. Is there an archive of issues on specific hour complaints and feedback routes (with the minutes and signed by the local community to confirm). When held in a meeting with the community, need to have the program and meeting minutes signed by Government representatives and at least one local trade union organization or a civil society organization that has credibility.
