EDIT, ADD ARTICLE 170 OF CORPORATE LAW

The 1992 Vietnamese Constitution base of the Socialist Republic of Vietnam was amended, adding some to the number of resolutions. 51 /2001/QH10;

Congress enacted the amended Law, the addition of Article 170 of the Digital Business Law 60 /2005/QH11 modified, supplemated by Article 3 of the Law No. 38 /2009/QH12.

Paragraph 2 Article 170 of the Enterprise Law is amended, the addition is as follows:

" 2. The business with foreign investment was established before 1 July 2006, except for the specified case at paragraph 3, which has the right to do one of the following two ways:

a) Sign up for the organization of management, activities under the provisions of this Law and the relevant legislation.

The business with foreign investment was established in advance. July 1, 2006, The expiration of the statute of limitations expires at the Investment License after the day. July 1, 2006, not performing a business dissolution procedure and has the offer to resume operations that must be reregistered before 1 February 2014. under the conditions prescribed by the Government . In this case, the registration is valid since the expiration date of the activity on the Investment License. ()

b) Not re-registered; in this case, the business organizes management, operating under the Investment License, the Business Charter. For non-regulation content at the Investment License, the Business Charter, the business is implemented by the provisions of this Law and the relevant legislation.

The business is adjusted, the industry supplement, the profession in the event that does not change the operating deadline in the investment license; the regulation, the addition of the industry, the profession is done according to the regulation of the law at the time of adjustment, supplements.

In case of changing activities or adjustments, industry additions, jobs change the operating deadline in the Investment License, and the business must register as specified at this point.

The government regulates this. "

The law came into effect on 1 August 2013.
