The CIRCULAR regulates the order and procedure for drafting, enacting legal documents of the State Bank of Vietnam _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ pursuant to the law the State Bank of Vietnam the number 46/2010/QH12 16 June 2010;
Pursuant to the law enacting the legal text no. 17/2008/QH12 June 3, 2008;
The French base command for the legal text no. 01/2012/UBTVQH13 March 2012;
Pursuant to Decree No. 96/2008/ND-CP on August 26, 2008 Government's functions, tasks, powers and structure of the State Bank of Vietnam;
Pursuant to Decree No. 24/2009/ND-CP on March 5th, 2009 by government regulations and details of the measures enforced the law promulgated legal documents (hereinafter referred to as the Decree No. 24/2009/ND-CP);
Pursuant to Decree No. 63/2010/ND-CP on 08 June 2010 of the Government on the control of administrative procedure and Decree No. 48/2013/ND-CP on May 14, 2013 the Government's amendments and supplements to some articles of the Decree relating to the control of administrative procedures (hereinafter referred to as the Decree 63/2010/ND-CP);
Pursuant to Decree No. 55/2010/ND-CP on January 4, 2011 by government functions, tasks, powers and organization of legal institutions;
At the suggestion of the Director of the legislation;
The Governor of the State Bank of Vietnam issued a circular regulating the sequences, procedures for drafting, enacting legal documents of the State Bank of Vietnam, chapter I GENERAL PROVISIONS article 1. Scope 1. This circular regulates the order and procedure for drafting, enacting, merging legal texts in the field of monetary, foreign exchange and banking operations by the Governor of the State Bank of Vietnam (hereinafter referred to as the Governor) issued or the issuing authority.

Article 2. The object that applies to this circular applies to the units in the State Bank involved in the process of drafting, enacting legal documents on currency, banking and foreign exchange activities.

Chapter III drafting, ENACTING, CONSOLIDATED LEGAL TEXT Item 1 DRAFTING laws and ordinances, RESOLUTIONS of the NATIONAL ASSEMBLY, the STANDING COMMITTEE of the NATIONAL ASSEMBLY, DECREES of the GOVERNMENT, the PRIME MINISTER'S DECISION article 13. The process of drafting laws and ordinances, resolutions of the National Assembly, the Standing Committee of the National Assembly, decrees of the Government, the decision of the Prime Minister 1. 3. within 10 working days from the day the Governor or Deputy Governor signed the consolidated text authentication, the Office is responsible for sending a text's main case for electronic data file attached to government offices to Post Gazette and posting on electronic information of the Government.
Article 24. Merge to circular, circular by the State Bank chaired drafting 1. Within 7 working days from the day the Governor sign the issued circulars, circular additional amendments, chaired the drafting unit is responsible for sending the Service legislation of electronic data files of the circular, circular additional amendments and is responsible for the accuracy of the text form of the electronic data file.
2. within 10 working days from the date of the electronic data file of the circular, circular additional amendments, the legislation is responsible for implementing the Union of text and the Governor or Deputy Governor signed the consolidated text authentication.
3. within 10 working days from the day the Governor or Deputy Governor signed the consolidated text authentication, the Office is responsible for sending the text to Post Gazette and made the best texts published on the website of the State Bank.
Chapter IV IMPLEMENTATION article 25. The expense of building the legal text 1. The expense of building the legal text is made according to the provisions of article 67 of Decree 24/2009/ND-CP, the instructions of the Ministry of finance and the State Bank on the management and use of State budget funds secured for the drafting, promulgation of the legal text.
2. The Heads of the units belonging to State Bank mission base drafting, enacting legal documents are delivered responsibly propose, in collaboration with the Financial Services-accounting, Administration Bureau to arrange funding and other necessary conditions to ensure the work of drafting , issued legal documents.
3. Unit chaired drafting legal texts establishing the detailed estimation of funding construction of legal texts submitted Legal Service appraisal about the fit of the estimation with the complexity, scope, object to the text.
Article 26. The responsibilities of the units belonging to State Bank 1. The units of the State Bank has responsibility: compliance with the regulation on the order and procedure for drafting, enacting legal writing in Law enacting the legal text, the text instructions and the provisions of this circular.
2. Legal Services is responsible for: a) track, the urge, guide the unit made the correct rules of order and procedure for drafting, enacting legal documents of the Bank;
b) promptly report the Governor about the difficulties and problems arising in the process of drafting, enacting legal documents of the State Bank and the proposed treatment.
Article 27. Effective enforcement of this circular effect since Jan. 24, 2014 and replaces circular No. 13/2009/TT-NHNN dated Jan. 23/7/2009 of the Governor of the State Bank regulatory sequence, procedure for drafting, enacting legal documents of the State Bank of Vietnam , Circular No. 38/2009/TT-NHNN dated Jan. 13, 2011 amendments and supplements to some articles of the circular No. 13/2009/TT-NHNN.
Article 28. Enforcement organization Chief, Director of Legal Affairs, heads of units of the State Bank, Director of the State Bank branch in the central cities, is responsible for organizing the implementation of this circular.
