The CIRCULAR regulates the training of technical and chemical safety training certification of chemical safety engineering _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ chemical Law base on November 21, 2007;
Pursuant to Decree No. 109/2008/ND-CP of June 7, 2008; Decree No. 26/2010/ND-CP on January 8, 2011 the Government modify some additional articles of Decree No. 109/2008/ND-CP of June 7, 2008 from the Government detailing and guiding the implementation of some articles of the law on chemicals;
Pursuant to Decree No. 38/2014/NĐ-CP on May 6 in 2014 of the Government on the management of chemicals in the control of the Convention on the prohibition of the development, production, Stockpiling, use and destruction of chemical weapons;
Pursuant to Decree No. 95/2012/ND-CP on November 12, 2012 of the Government functions, tasks, powers and organizational structure of the Ministry of industry and trade;
At the suggestion of the Director of safety engineering and industrial environment, the Minister of industry and Commerce issued a circular regulating the technical training of chemical safety and certified technical trainer chemical safety.
Chapter I GENERAL PROVISIONS article 1. Scope this circular regulates the training of technical and chemical safety training certification of chemical safety engineering for industrial chemical hazards; is the chemical precursor used in the chemical industry and in the Convention on the prohibition of the development, production, Stockpiling, use and destruction of chemical weapons in the scope of management. This circular does not adjust the training and coaching certification for gasoline , oil and gas; industrial explosives; dangerous chemicals transported by motorized transport by road, rail and inland waterways.
Article 2. The object that applies to this circular apply to organizations and individuals with chemical activities specified in article 1 of this circular and the organizations and individuals involved.
Chapter II PROVISIONS on TECHNICAL TRAINING CHEMICAL SAFETY article 3. 2. for direct workers in manufacturing, trading, transporting, storing, preserving, using chemicals (workers) a) The content specified in point b of Paragraph 1 of this article the DUS Points;

e) medical first aid, methods of emergency patient.
Article 4. Training institutions 1. For employees, the employer is responsible for: a) detailing the content of the training period, as defined in paragraph 2 of article 3 of this circular;
b) select coaches as defined in paragraph 3 of this article;
c) announced the plans of training and testing before seven (07) on to the Department of industry and trade of the province, the central cities in which the basis of local activities;

2. With regard to industrial and commercial Facility Management personnel training for managers on the basis of the geographical scope of management according to the content of the provisions in clause 1 of article 3 of this circular.
3. Coaches must have university level consistent with specialized training, with at least five (5) years work on chemical safety.

Chapter III RULES on TESTING and CERTIFICATION of TECHNICAL TRAINING of CHEMICAL SAFETY article 5. Recommended records of training, testing, certification 1. Article 6. Order and procedure for checking, certification 1. Active base chemical establishment proposed industrial and commercial training Facility (for managers), testing, certification.

3. Rules regarding certificate a) within a period of five (5) working days from the date of the check, the Department of industry and commerce made the certification according to the model in annex IV attached to this circular for the satisfactory inspection;

4. Before the certificate expires thirty (30) days, the facility is responsible for making industrial and commercial training Facility recommendations (if any), inspection certificate prescribed in this article.
Article 7. Re-issuance of certificates 1. Valid certificates are issued in the case of lost or damaged.
2. organizations and individuals making grant proposals back to the certificate sent to the certification agencies have to consider reissuing the certificate.
3. recommended records reissued certificate include: a) the paper certificate re-issuance proposal according to the form prescribed in annex II attached to this circular;
b) Two (2) photos (size 2 x 3 cm) of the recommended level certificate.
4. within three (3) working days from the date of receiving the application, the Department of industry and commerce made to certificate according to the model in annex IV attached to this circular. The case does not have to supply the written notice stating the reasons.

Chapter IV the TERMS OF IMPLEMENTATION of article 10. Implementation 1. The Bureau of safety and environmental engineering industry is responsible for:

Article 11. Transitional provision the object has been coaching certificates before the date this circular effect shall continue to be used until expiry of the validity of the certificate.
Article 12. Effect 1. This circular is valid from December 8, 2014.
