DECISION functions, tasks, powers and structure of the Treasury under the Finance Ministry _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ based on Government Organization Law of 25 December 2001;
Pursuant to the law on State budget of 16 December 2002;
Pursuant to Decree No. 36/2012/ND-CP dated 18 April 2012 of the Government functions, tasks, powers and organizational structure of ministries, ministerial agencies;
Pursuant to Decree No. 215/2013/ND-CP on December 23, 2013 of government functions, tasks, powers and organizational structure of the Ministry of finance;
According to the recommendation of the Minister of finance, the Prime Minister issued decision functions, tasks, powers and structure of the Treasury under the Finance Ministry.
Article 1. The position and function 1. The State Treasury is the Agency directly under the Ministry of finance, staff functions, help finance Minister of State management of the State budget funds, State financial funds; manage state funds; of State accounting; make the mobilization of funds for the State budget and for investment in development through government bonds issued under the provisions of the law.
2. The State Treasury has legal personality, the seals have a coat, opened an account at the State Bank and the commercial bank under the provisions of the law, based in the city of Hanoi.
Article 2. Duties and powers of State Treasury perform the tasks, the following rights: 1. Article 5. The effect and enforcement responsibilities 1. This decision had effect since August 25, 2015. Annuls decision No 108/2009/QD-TTg dated 26 August 2009 by Prime functions, tasks, powers and structure of the Treasury under the Finance Ministry.
2. The number of Deputy Director General of State Treasury is done according to the current rules of the Prime until Prime Minister have decided otherwise.
3. The Minister of finance, the Ministers, heads of ministerial agencies, heads of government agencies, the Chairman of people's Committee of the central cities, and the Director General of the State Treasury is responsible for the implementation of this decision.
