Minister of Ministry of construction issued circulars providing professional real estate brokers; guide training, fostering knowledge of practice real estate broker, operating real estate trading; the establishment and organization of the activity of real estate trading floor.
Chapter I GENERAL PROVISIONS article 1. Scope this circular providing professional real estate broker (certificate); guide training, fostering knowledge of practice real estate broker and real estate trading; establishment and organization of the activity of real estate trading floor.
Article 2. Application object 1. The organizations and individuals who practice real estate broker and executive management real estate trading floor.

Chapter II PROVIDING PROFESSIONAL REAL ESTATE BROKERAGE 1. COMPLETING EXAMS ORGANIZATION KNOWLEDGE BROKERS REAL ESTATE article 3. Article 6. Exam content and exam 1. Test takers to be certified to the required examination of the following content, except in cases specified in clause 2 of this: a) Knowledge Base Section, including:-law concerning real estate business;
-The real estate market;
-Real estate investment;
-Prevention of money laundering in real estate business.
b) part expertise, including:-overview of real estate brokerage services;
-Process and skill of real estate brokerage;
-Solve the actual situation.
2. for countries which there estate broker certificate due to force levels and foreign cases of certificate level, please do the old certificate expires, then only have to test knowledge base section, not the section professional knowledge competition.
3. exam organization unit is responsible for the Organization compiled the examinations and answers, the Chairman of the competition Council approval.

5. The examinations must be administered according to the confidential document mode.
Article 7. The form, time and language test 1. Form of competition, time: a knowledge base Section): exam written exam, or a combination of the two forms on time, 120 minutes.

Article 11. Registered 1. The certificate needs to be registered on the national test.
2. Every year who need certification applicants registered under the provisions of paragraph 3 of article 3 of this circular.
3. Article 14. Preservation of records, document 1. 7. The certificate must obey the following rules: a) Not be repaired, erase the contents of the certificate;
b) is not for rent, lend or for organizations and individuals use the name and his certificate to perform the activities related to the practice of real estate brokerage;
c) Not be used for other purposes that the law does not prescribe.
8. After the end of each exam and certification, the Department is responsible for building The reports build on the situation and provide the list of personal certificates. 9. Periodically in advance on December 15 of every year the Department of building construction Ministry report about the situation of the local certificate.
Article 16. Level professional real estate brokerage 1. Who are certified but lost, torn, burnt, destroyed due to natural disaster or other unforeseen reason, the reissued certificate.

b) 2 photo 4x6cm size taken during 6 months as of the filing date;
c) old certificates (if any).
3. within 10 working days from the date of application specified in clause 2 of this construction, the Department has issued the certificate has the responsibility to verify records and reissued certificate (stating the level again on the certificate).
4. The certificate again, please submit the expense of 200,000 (two hundred thousand) for the Department of construction to prepare for the re-issuance of certificates.

Article 17. Rules for expired certificate 1. The certificate has expired cannot be allowed to continue practicing real estate broker.
2. The certificate is expired or nearly expired, if want to level again to contest certification testing as defined below: a) cases registered at the local certification exam is only part of the knowledge base under the provisions of this circular to be issued the certificate certificate number, according to the old number, certificate stating on page 1 is the second level, the third (according to the model in annex 4 of this circular);

Article 18. Recovery of real estate broker certificate 1. The certificate will be revoked certificate in the following cases: a) the certificate lost the capacity for civil acts;

d) Who are certified for others to borrow, hire a certificate to practice;

2. Chapter III of the GUIDE and the TRAINING and upgrading PROFESSIONAL KNOWLEDGE of REAL ESTATE BROKERS and REAL ESTATE TRADING category 1 RECOGNIZED TRAINING FACILITY, FOSTERING KNOWLEDGE of PRACTICE REAL ESTATE BROKER and PROPERTY TRADING article 19. The conditions for training, fostering knowledge of practice real estate broker, operating real estate trading (abbreviated training) training facility must have the following conditions: 1. Legal personality a) training establishments are competent licensing authority on training;
b) enterprises, economic organizations of business registration of training and upgrading professional knowledge;

Article 20. Sign up for training and accreditation of establishments eligible training knowledge to practice real estate broker, operating real estate trading (abbreviated as eligible training base) 1. 2. Registration documents include: a) the Ministry of construction proposal training organization;

d) teaching material, the title check and approval decisions of Heads of training establishments;
DD) Faculty list (according to the model in annex 8 of this circular);
e) Faculty's statements about qualifications, practical experience in the occupational activities (according to the model in annex 9 of this circular), accompanied by a copy of the teaching contract or contract labour;
g) training contract or written consent of the unit where the Organization's practice location practitioners;
h) training regulation includes the main content as follows:-admission regulations;
-Rules regarding student records;
-Regulations on school time;
-Regulation on the number, length of lessons for each topic;
-Rules of practice;
-Regulation on the final test, the scale and the article dot;
-Evaluation criteria sorting learning outcomes;
-Rules on the conditions to be granted a certificate of course completion.
3. The House Administration and the real estate market guide, check out the Organization of the examination and certification of practice of real estate brokerage under the provisions of this circular; consider the basis of eligible training on real estate broker and executive management real estate trading; in collaboration with the local construction Departments inspect the training fostered knowledge about brokers, managing real estate transactions; check the operation of the real estate transaction under the provisions of this circular.
