MEASUREMENT UNIT SYSTEM

MANDATORY USE IS AVAILABLE THROUGHOUT THE NATIONAL TERRITORY AND
CREATES THE DIRECTION OF LEGAL METROLOGY

LAW PROJECT


CHAPTER I

Measurement Units

ArtAculoA 1Aº. -A mandatory use throughout the territory of the Eastern Republic of Uruguay, as of the date of validity of this law, the System of Units of Measures that is established in continuation, and which comprises: the essential units, the supplementary units, the derived units, their methods and submuses, prefixes and sAmbolus of the International System of Units (SI) recommended by the General Conference of Pesos and Measures up to their The fourth meeting, as well as those complementary units System which, for reasons of use, is considered appropriate to remain in force:

A) Basic Units:

1. The physical units, their sAmbolus, and the magnitudes they represent are:

2. The definition of these units is as follows:

B) Supplementary units:

3. The supplementary units, their sAmbolus, and definitions are as follows:

A The prefix sAmbolus must be placed directly in front of the unit's sAmbolo without the intermediary space, the set form the sAmbolo of the mältiplo or submältiplo. 6. Complementary units are foreign to the International System of Units and correspond to the magnitudes, denominations, and definitions given below:

6.1. In the case of documents on legal acts or acts carried out on the national territory, which are executed in or out of the territory or which refer to the goods for export, they may be carried out in conjunction with the units mentioned above, express their equivalences on other systems.

In case of not being able to access the necessary conversion coefficients, the Directorate of MetrologAa Legal will evacuate the relevant queries.

CHAPTER II

Measure Unit System (s) in charge

ArtAculoA 3Aº. -A Executive Branch, through the Ministry of Industry and Energy, is responsible for:

1) Set and direct the national metrology policy and execute the necessary administrative action to comply with these purposes;

2) Deciding the participation in international congresses and meetings related to the specific subject matter of this law, designating the representatives who in each case correspond;

3) Celebrate the necessary national or international agreements or conventions in metro-gyna;

4) Perform all committed tasks to ensure compliance with this law;

5) Collect when deemed necessary by the University of the Republic's advice on the subject.

ArtAculoA 4Aº. -A Uruguay Technical Laboratory (LATU) also gives the attributions that correspond to the article 164 of the leyA 13,640, dated 26 December 1967, and artAculoA 231 of the read 14,416, dated 28 August 1975, is responsible for:

1) Propose the Ministry of Industry and Energy to the national patterns, as well as the updating of the units, submuses, prefixes and sAmbolos of the System of Measure Units of the Eastern Republic of Uruguay;

2) Custoing, preserving, and calibrating the national patterns of the units of measure and their witnesses;

3) Practice the primitive and periical calibration of the derived patterns and the measurement instruments belonging to public or private people;

4) Performing and promoting scientific and technological research in the field of metrology;

5) Advising the Ministry of Industry and Energy, the Directorate of Legal Metrologa, the public bodies, the industry and trade, on scientific and technological aspects of metrology;

6) Spreading in the teaching centers and public bodies, the information relative to the Measurement Unit System;

7) Propose to the Ministry of Industry and Energy recommendations and technical regulations to be used;

8) Maintaining links with the International Bureau of Pesos and Measures and other related organizations.

ArtAculoA 5Aº. -A Crase in the Ministry of Industry and Energy, the Directorate of the Legal Metrologa to which all the human and material resources of the current Department of Weights and Measures are transferred, the National Directorate of Subsistences, under the Ministry of Economic and Financial Affairs.

ArtAculoA 6Aº. -A officials belonging to the service mentioned, which are transferred from the Program according to the previous article, must opt within the thirty days of this law, enter remain in the dependency to which they belong or move to integrate the budget plan of the IncisoA 8 (Ministry of Industry and Energy).

In this last case, you will retain all the functional rights included in the promotion and benefits of economic cter.

The Executive Power will perform the corresponding escalation adjustments, in the Accounts of Accounts following the transfer of the Program.

ArtAculoA 7Aº. -A Compete to the Legal MetrologAal:

1) Perform on any regulated mediation instrument, the approval of the asA model as its verifications, and the their use when appropriate, in accordance with the provisions of Article 12 of this Law;

2) Propose to the Ministry of Industry and Energy the technical regulations for which the instruments of Prior assessment of the Technical Laboratory of Uruguay;

3) Verify the instruments mentioned in the numeral 1) of this article, which will be done according to derived patterns approved by the Technical Laboratory of Uruguay, to which effect the performance of the tests can be entrusted to the said Laboratory;

4) Organize the registration of manufacturers, importers, and repairers of regulated measurement instruments and dispose of the admission, suspension or exclusive of the same registration, according to the regulations;

5) Fiscaling compliance with this law, sanctioning offenders.

To The Executive Branch, by way of resolution, you can commit the audit to the bodies of the Municipal Administrations, National Directorate of Subsistences or other state or para-state bodies to be created for this purpose;

6) Bring an updated record of all regulated mediation instruments;

7) Projecting the mediation instrument node referred to in the article 11;

8) Perform the conversion of units of measure referred to in the 2 Aº article of this law;

9) Maintaining links with the International MetrologAa Legal Organization and other like-minded organizations;

10) Advising the Ministry of Industry and Energy in the field of MetrologAa Legal.

CHAPTER III

Media patterns

ArtAculoA 8Aº. -A Executive Power will set a national pattern for each unit of measure that admits it, which will have to be excluded from every other and will be guarded as its witnesses by the Laboratory. Uruguay's technology, in the form that the regulation establishes.

ArtAculoA 9Aº. -A Legal Metrologic Directorate will be provided with Patrons derived from the national patterns and will perform periodic calibrations of the same in the Technical Laboratory of Uruguay, in the form to set the regulation.

CHAPTER IV

Measurement instruments

ArtAculoA 10. -A all element, medium, or apparatus is considered to be an instrument for counting or determining values of any magnitude.

ArtAculoA 11. -A SAFlo can be regulated the instruments of medicine used in the marketing of goods and services, in the preservation of public health and the safety of people and things. The technical regulations of the same will be established by the Ministry of Industry and Energy on a proposal from the Directorate of MetrologAa Legal with the advice of the Technical Laboratory of Uruguay.

ArtAculoA 12. -A All of the regulated mediation instruments will require the prior approval of your model. Any regulated instrument, manufactured according to the approved model, should be subjected to verification before being free of the public use, and its periodic verification and use surveillance should be made mandatory, provided that the purposes indicated in Article 11.

The instruments intended exclusively for scientific and educational use or related to national security are exempted from this rule.

ArtAculoA 13. -A Manufacturers, importers, and repairers of regulated mediation instruments are required to register as such in the records that will be brought to the effect by the Directorate of MetrologAa Legal, in the conditions, forms, and deadlines set by the regulation.

ArtAculoA 14. -A whole physical or legal person who, in the course of his activities, has to make use of regulated instruments of measurement, used for the purposes indicated in the article 11, should be provided with instruments whose models have been approved and also have the verification referred to in Article 12 of this Law.

The Directorate of the Legal Metrologa will project, for approval by the Ministry of Industry and Energy, the only instrument that as a mandatory minimum should be used by the persons mentioned in the exercise of their activities.

ArtAculo 15. -A measurement instruments used in commercial transactions should be located in place and form such that they do not affect the accuracy of the measures and allow for inspection and verifying the operations to be performed with them.

ArtAculoA 16. -A Forks or users of regulated mediation instruments used for the purposes indicated in the article 11, are obliged to allow their inspection, within the usual time of the exercise of their activities, to the officials responsible for monitoring compliance with this law. These, if any, may require the help of the public force.

CHAPTER V

Violations, Sanctions, and Procedures

ArtAculoA 17. -A violations of the provisions of this law will be sanctioned, according to their severity, with the following penalties:

1) Observing or admonishing n;

2) Multas, whose amounts will be fixed annually by the Executive Branch within the limits set by the artAculoA 24 from read 10.940, September 19, 1947 and amending laws;

3) Suspense of the records set by numerals 4) and 6) of the 7Ast item of this law;

4) Comiso of the instruments in violation in the following cases:

a) when the instrument would have been intentionally altered;

b) when the instrument in violation is not liable to be placed in legal conditions;

c) when the instrument is not placed under legal conditions within the deadlines agreed to the effect;

d) when no sign-ups have been performed corresponding.

ArtAculo 18. -A Sanctions listed in the previous article may be applied alternatively, or cumulative, and the criteria set forth in the following article should be taken into consideration.

ArtAculoA 19. -A For the determination of the sanction should be taken into account the importance and severity of the violation or violation attributable to the offender, in relation to the obligations that this law and the regulations impose on the safeguard of the protected intering.

You should also be taken into consideration:

a) the offender's repeat quality;

b) the amount of the ilAcito benefit that the agent has obtained or been able to obtain from the act or the repressed acts;

c) the material means available to us or the offender has disposed to produce the offence or to circumvent the sanction;

d) the economic-social consequences of your behavior.

ArtAculoA 20. -A When multiple people are responsible for the violation of this law, the penalty that corresponds will be applied equally to each and every one of them.

ArtAculoA 21. -A Officer who checks an infringement, will work out the minutes in which the entire data, identity and address of the alleged offender will be present, the circumstantial description of the infraction and the the name and address of the witness if any.

In the act, the characteristics of the instrument of mediation in violation will be settled and any other reference that will be useful to the substance of the procedure.

After reading, the act shall be signed by the acting official and the alleged infringer or, in the event that he or she refused to sign, by two witnesses hA biles or a police officer.

The acting official will leave the alleged offender to be a signed copy of the carved act.

If the character of the offence requires it, the preventive abduction of the media may be carried out, with the relevant constancy in the act.

ArtAculoA 22. -A the alleged infringer will have within five days a period of five days, counted from the day following the date of the act, in order to make their discharge to the Directorate of MetrologAa Legal, if the the offence has been found in the capital, and ten days if the offence has been found within the country of the country.

artAculoA 23. -Due to the deadlines referred to in the previous article, the Directorate of MetrologAa Legal will have the term of twenty days to issue a resolution.

ArtAculo 24. -A testimony of the firm administrative resolution, which imposes penalty of fine, will constitute executive title.

The Directorate of MetrologAa Legal, in representation of the State, shall promote the appropriate executive action before the Judge of Peace of the civil or commercial domicile of the infringer, after intimation of payment to the debtor, with time of three days.

Requested the execution, the Judge immediately delayed the seizure and seizure of assets of the infringer, subsequently following the proceedings of the executive judgment (artAculosA 873 et seq. of the Civil Procedure Code).

ArtAculo 25. -A Comiso of the instruments in violation, will be executed in administrative vAa, by the Legal MetrologAon.

ArtAculoA 26. -A definitive resolution imposing sanctions, will be published in two journals of the respective department.

ArtAculoA 27. -A In cases where this law provides or authorizes the use of instruments in violation and for any cause it is not possible to make it effective, the owner, owner or consignee, shall have to to replace the value of the same calculated at the current price in place at the time of the application of the replacement. This is without prejudice to the penalties that apply.

CHAPTER VI

Multiple Provisions

ArtAculoA 28. -A goods, articles or goods which may be marketed according to their weight or measure and in their own condition, such as boxes, glass containers, tinplate or other type, The net quantity contained in each package must be indicated, which should be a minimum of the total capacity according to the rules of the regulation.

The modalities of these indications should be approved by the Legal Metrologaal Direction.

ArtAculoA 29. -A tolerances for weights, counterweights, measures, apparatus and instruments of measurement, and for goods, articles or goods with their own conditioning, shall be established by Regulation.

CHAPTER VII

Transitional Provisions

ArtAculoA 30. -Within a period of one hundred and eighty days from the entry into force of this law, all manufacturers, importers and repairers of the instruments of measurement referred to in paragraph (4) of Article 7 of this Law.

ArtAculoA 31. -Within the time limit of an aA ± or from the entry into force of this law, the importers and manufacturers of regulated mediation instruments must submit to the official approval that they are refers to Article 12, a model of each instrument that amounts to or manufactures.

ArtAculoA 32. -A term of an aA ± or to withdraw from circulation, exhibition and marketing every instrument of regulated medication that does not conform to the provisions of this law and its Regulation.

The Executive Branch is empowered to extend the deadline agreed in this article by the end of a year.

Equally for the founded resolution, the Executive Branch may agree on a longer term in exceptional cases.

ArtAculoA 33. -A Executive Branch will proceed to the dissemination of this law, its Annex and its conversion tables, for the purpose of its knowledge in the educational centers of the country.

ArtAculoA 34. -A Right to all laws and provisions that oppose this law, that the Executive Branch will regulate within one hundred and twenty days.

ArtAculoA 35. -A This law will enter into force on the 1Ath of January 1983.
