With a k o n u r as th h s on amendments to the law of Ukraine "About encouraging the social self-realization and development of young people in Ukraine" (Supreme Council of Ukraine (BD), 2000, N 27, 211) (concerning partial suspending the law, see Law N 380-IV (38-15) on 26.12.2002, VVR, 2003, N 10-11, 86), the Verkhovna Rada of Ukraine n o s t a n o in l I is : make a change to the law of Ukraine "about encouraging the social self-realization and development of young people in Ukraine" (2998-12) (Supreme Council of Ukraine, 1993, N 16, art. 167; 1994 N 23, St. 160; in 1995, N 16, art. 111; 1996, N 16, art. 71; 1999, N 26, art. 220, N 31, art. 247), by capturing it in the following wording: "the law of Ukraine about encouraging the social self-realization and development of young people in Ukraine this law determines the General principles for the creation of organizational, socio-economic, political and legal conditions for the social formation and development of the young citizens of Ukraine in the interests of the individual, society and the State, the main directions of realization of State youth policy in Ukraine on social formation and development of youth.
Article 1. Definitions of terms in this law the following terms are used in the following meaning: youth, young people-Ukrainian citizens aged from 14 to 28 years;
underage citizens under 18 years of age;
social formation of youth-the process of diversified the inclusion of youth in the life of society as a system, the perception of it as an element of the system;
the first workplace-workplace young citizens after the end of any educational establishment or termination of study, completion of professional training and retraining, as well as after the release of urgent military service or alternative (non-military) service;
Youth Labor centers-specialized government agencies, which are created in order to address issues of youth employment, ensuring its employment in learning, to promote youth initiatives in employment, retraining and advanced training for youth;
young family-a marriage in which the age of the husband and the wife does not exceed 30 years, or incomplete family in which the mother (father) under 30 years of age;
social services for youth-special institutions that provide social services and social assistance to youth;
youth public organization Association of citizens aged from 14 to 28 years, the purpose of which is the implementation and protection of their rights and freedoms and meet the political, economic, social, cultural and other interests.
Article 2. The principles of the social formation and development of Youth Social establishment and development of youth based on the following basic principles: respect for human values, human rights and peoples, historical, cultural and national characteristics of Ukraine, its nature;
participation of youth in the formation and implementation of policies and programs relating to society in General and youth in particular;
taking into account the needs of young people, associating them with the economic possibilities of the State;
availability for every young citizen social services and equality of legal guarantees;
the responsibility of the State for the creation of conditions for self-development and self-realization of youth;
unity of effort of the State, all strata of society, political and public organizations, enterprises, institutions, organizations and citizens in the case of social formation and the development of youth;
responsibility of every young citizen to society and the State for the observance of the Constitution of Ukraine (254 k/96-VR) legislation.
Article 3. Legislation encouraging the social self-realization and development of youth legislation on encouraging the social self-realization and development of young people is based on the Constitution and consists of this law and other normative legal acts.
If an international treaty agreement to be bound by any given the Verkhovna Rada of Ukraine, the other rules than those stipulated in this law, the rules of the international treaty.
Article 4. Competence of the Executive power and bodies of local self-government in the sphere of social formation and development of the youth coordinating role regarding carrying out the State policy in the sphere of social formation and development of youth carries out specially authorized central body of the Executive power, which provides implementation and is responsible for its implementation.
The Council of Ministers of the Autonomous Republic of Crimea, local authorities form the relevant bodies to implement the State youth policy.
The specifically authorized central body of the Executive power, together with other bodies of the Executive power develops, and the Cabinet of Ministers of Ukraine approved by social norms and regulations concerning the social formation and development of youth, the observance and implementation of which are required for the executive bodies, local authorities, associations of citizens and enterprises, institutions and organizations irrespective of form of ownership.
Article 5. Funding measures for the social formation and development of youth Funding measures for the social formation and development
Youth is carried out at the expense of State and local budgets and other sources not prohibited by the legislation.
Verkhovna Rada of Ukraine with the approval of the State budget of Ukraine provides it means social formation and development of youth. Of these funds is a specially authorized central body of the Executive power.
Local authorities in approving budgets include spending on implementation of activities on social formation and development of youth.
At the State and local budgets in accordance with the legislation of the assumed target funds for the implementation of youth and children's programs that promote social self-realization and development of youth.
Article 6. Social services for Youth For the practical implementation of the support of the social formation and development of the young State creates a system of social services for youth.
The system of social services for young people include social services for youth and the centers of social services for youth, empowered by the State to participate in the implementation of State youth policy and to provide social services and social assistance to young citizens.
The specifically authorized central body of the Executive power creates the Ukrainian State Center of social services for youth, which belongs to the sphere of its management.
Republic (Autonomous Republic of Crimea), regional, Kyiv and Sevastopol city, district centers are established in accordance with the decision of the Council of Ministers of the Autonomous Republic of Crimea, regional, Kyiv and Sebastopol city, rayon State administrations and belong to the sphere of their management.
City, district in urban centers may be established by decision of the local authorities.
The default position of the social services for youth, approved by the Cabinet of Ministers of Ukraine.
Article 7. Work of the youth State ensures pracezdatnìj youth equal to other citizens of the right to work. Features of the labour of minors are set by law.
The State ensures pracezdatnìj youth, providing the first workplace for a period of not less than two years after the completion or termination of studies in secondary, vocational and higher education institutions, professional training and retraining, as well as after the release of urgent military or alternative (non-military) service. Two-year term of the first workplace is calculated taking into account the work of the young citizen to appeal to military or alternative (allocating pitiful sums).
Young people who have applied to the State employment service in finding work, receive free information and professional advice with the aim of selecting the type of activity, profession, place of work, as well as, if necessary, undergo vocational training and retraining.
The State encourages the establishment of youth centres, as well as youth organizations (agencies, stock exchanges, and other) to ensure the employment of youth, youth training programs and improve her professional skills. Typical provisions on the labour youth centers approved by the Cabinet of Ministers of Ukraine. The activities of youth labor centers may be financed at the expense of the State Fund of employment provided for these purposes.
Quota of jobs for youth employment is determined by the local bodies of executive power, bodies of local self-government within the limits set by the law of Ukraine "on employment" (803-12).
In case of refusal in the hiring of young citizens within the established quota from enterprises, institutions and organizations will be charged a fine of p'âtdesâtikratnomu amount of untaxed minimum incomes for each such failure. These funds are in a State Fund to promote employment of the population and are used exclusively to finance the costs of the creation of additional jobs for youth, her professional training and retraining.
State employment office, together with the authorities, the social services for youth provides students, students and students completing full-time education assistance in job placement in off-hour time.
The State provides conditions for secondary employment of youth.
The bodies of the Executive power and bodies of local self-government in accordance with the legislation may set additional benefits on income tax on citizens for students and students working in the part of the student and the student's employment of agricultural work or to other types of works at the enterprises of the State or municipal ownership.
Youth Centers work, acting in accordance with the Model Regulations, as well as the public youth organizations (agencies, stock exchanges, and others) in the presence in them of the appropriate authorization issued by the State service for employment, promote the employment of young people, including students, students in off-hour time provide services related to the proforìêntacìêû and preparing to work for a new profession.
State Employment Office provides a local bodies of executive power, bodies of local government, youth labor centers,
social services for youth, information about the availability of jobs (vacancies).
The State guarantees the provision of work for a period of not less than three years young professionals-graduates of State vocational and higher educational institutions, the need for which has been determined by the Government order.
Article 8. Support for entrepreneurial initiatives and activities of the youth, the State supports and promotes the development of entrepreneurial initiatives and activities of the youth.
The State promotes the creation of a youth business centers, business incubators for implementation of the program of training young people in entrepreneurship, providing information and advisory services. To this end, developed and implemented a system of measures to support youth entrepreneurship, including long-term preferential loans, the provision of industrial premises, insurance, commercial risk, etc.
Local governments can set up with funds coming to the local budget, reduced fees for registration of enterprises, created by young citizens and youth NGOs.
Article 9. Promoting the quality of life of the young State, taking into account the value of the subsistence minimum and based on the real possibilities of the budget, increases the size of assistance to families for the minor children, scholarships and other types of material security of youth, which receives vocational, higher education in their respective schools.
To promote the priority areas of development of the society and to encourage young people to work in their respective fields of State establishes incentive scholarships.
Material support, including scholarships for school and student's youth, which is in full State, is set at the level of the subsistence minimum.
Procedure for payment of allowances to the Fellowship for successes in study, as well as increased scholarships for specific categories of youth is established by the Cabinet of Ministers of Ukraine.
For pupils and students of full-time secondary, vocational and higher educational institutions of the State are guaranteed for a year benefits to travel through the territory of Ukraine by rail, water, road, urban (except taxi) transport. Matching funds are provided in the State budget of Ukraine, a separate line. The procedure for the granting of these benefits is determined by the Cabinet of Ministers of Ukraine. Local authorities under the legislation may establish the procedure for granting privileges to the transportation of pupils and students in local passenger transport and include appropriate expenditures from local budgets.
Article 10. Living conditions of the youth State provides young citizens equal to other citizens of the right to housing, promotes youth housing promotion, creation of youth residential complexes, etc.
With the disqualification of land parcels for individual housing construction local authorities approved the quota, which provided young families for the construction of housing.
Executive authorities, local self-government bodies, together with enterprises, institutions and organizations develop and implement programs of creation of favorable housing and domestic conditions for young people living in hostels.
Young families and young people can receive at the expense of budget funds preferential long-term government loans for the construction and purchase of residential houses and apartments, for the entrance of equity contributions in the introduction to youth residential complexes, residential construction cooperatives, as well as at the obzavedennâ home.
Youth moves into trudonedostatnì rural settlements for permanent residence, as well as local youth busy in agriculture, industry, service industries, agriculture, social sphere, these settlements, provided housing and farm buildings at the expense of the State budget of Ukraine.
Young families who do not have children, pay a loan with interest rate of three percent per annum of the amount owed on the loan.
Young family with one child are exempted from the payment of interest for using credit; young families who have two children, due to budget, moreover, is paid off in 25 percent of the amount of loan obligations, and young families who have three or more children, 50 percent of the amount of the obligations under the loan.
Young people who constantly lives in rural settlements and works in agricultural production, processing and service sectors of the agroindustrial complex, operating in rural areas, the social sphere and the bodies of local self-government in the country, is also the benefits provided by law of Ukraine "on the priority of social development and agriculture in the national economy" (400-12).
The procedure for granting preferential long-term credits for young families and their preferential repayment of the Cabinet of Ministers of Ukraine.
At the birth of children in families that received the loan, this family may be granted aid for repayment
funds that remain at the disposal of enterprises where young spouses (mother or father).
Article 11. Education, cultural development, young Ukraine guarantees the young citizens equal to other citizens of the right to education, cultural development, leisure and recreation.
The order of realization of the rights of young people in education, the State guarantees its acquisition, defining the rights and responsibilities of participants in the educational process are regulated by the law on education.
Young people can receive at the expense of the State or local budgets preferred long-term loans for education in higher educational institutions for various forms of education, regardless of ownership, operating on the territory of Ukraine. These funds are provided in the relevant budgets of the individual string. The procedure for granting these credits determines the Cabinet of Ministers of Ukraine.
Executive authorities, local self-government bodies may set together with interested ministries, scientific societies and creative unions, youth funds special scholarships to the most gifted students of higher educational institutions and include the allocation of funds for their training in the leading domestic scientific institutions and abroad.
Executive authorities, local self-government bodies, together with enterprises, organizations, scientific institutions, higher educational institutions and associations of citizens may establish educational institutions that contribute to the deepening of knowledge, appreciation of creative interests, develop skills, and meaningful leisure and recreation for youth, as well as institutions that provide search, support and development of talented youth in various spheres of life.
Pupils, students, minors have the right to free and preferential use of the objects of culture. The procedure for the granting of these benefits is determined by local authorities.
The State promotes the development of youth tourism, youth international exchanges. The bodies of the Executive power and bodies of local self-government may set for youth and children tour groups privileges to use transport, hotel, cultural and other services. The procedure for the provision of these benefits and sources of funding are established by the Cabinet of Ministers of Ukraine, local bodies of executive power, bodies of local self-government.
Article 12. Health, physical development of young people, the State provides young citizens equal to other citizens of the right to health care, physical culture and sports.
The Council of Ministers of the Autonomous Republic of Crimea, local authorities in the field of health care, health care institutions, together with enterprises, institutions and organizations to ensure the holding of the annual medical examination of all young people and minors.
Health authorities provide the development of the network of establishments of health drug dependency, which give young people the necessary free assistance, develop and implement programmes and measures for prevention among young people in socially dangerous diseases, as well as the promotion and establishment of a healthy lifestyle.
Enterprises, institutions and organizations may at the request of the young citizens or their representatives fully or partially pay for providing health care in most cases, paid medical establishments in the country or abroad.
Authorities develop and recommend, and secondary, vocational and higher educational institutions include in their programmes the course of physical culture, as well as organize sections for individual sports.
The State introduces the system of incentives and rewards for companies that are part of their profits to the development of physical culture and sports, the construction of physical education and sports, organization of leisure, the holding of recreational activities.
Pupils, students, minors have the right to free and preferential use of the objects of physical education and sports. The procedure for granting these benefits, compensation for the difference of the value of the services and tickets is determined by local authorities.
Article 13. Guarantees of legal protection of youth, any direct or indirect restriction of rights and freedoms, the young depending on age, in addition to legislation, is illegal and entail liability established by the laws of Ukraine.
Implementation of the young citizens of the rights and freedoms in the social formation and development should not harm the interests of society and the rights of other citizens.
Illegal decision of the Government or public authorities, acts or omissions of officials may be in the prescribed manner challenged young citizens or their representatives in court.
Protection of the rights of minors of the citizens is carried out by the State according to law.
Article 14. The legal status of youth public organizations the State ensures the right of young people to create youth organizations. Youth public organizations are non-profit organizations, their legal status is determined by the legislation of Ukraine.
Youth public organizations have the right to make the
the bodies of executive power, bodies of local self-government proposals on social formation and development of youth.
Article 15. Guarantees of the activities of youth organizations executive authorities, local self-government bodies have the right to financing programmes and projects for youth organizations that promote social self-realization and development of youth and her socially useful initiatives, provide grants and subsidies, youth organizations, to provide the free use of youth public organizations and foundations, houses, buildings, land and other property necessary to the exercise of their statutory activities.
Article 16. Final provisions 1. This law comes into force from the day of its publication.
2. Ukrainian Laws and other normative-legal acts adopted before the enactment of this Act, in part, that does not contradict this law.
3. the Cabinet of Ministers of Ukraine: bring their regulations into conformity with this Act;
develop regulations stemming from this law;
ensure the review and cancellation of ministries and other central bodies of executive power of regulations, contradicting this law. "
