With a k o n u r as th h s Of Ukrainian Red Cross Society (Supreme Council of Ukraine (BD), 2003, N 5, art. 47) {amended in accordance with the laws of 3421 N-IV (3421-15) of 09.02.2006, VVR, 2006, N 22, 199 N 2803-VI (2803-17) from 17.12.2010, BD, 2011, N 25, 187 N 4496-VI (4496-17) from 13.03.2012, VVR , 2013, N 2, 4 N 406-VII (406-18) from 04.07.2013, VVR, 2014, N 20-21, 712 N 1206-VII (1206-18) from 15.04.2014, VVR, 2014, N 24, item 885} this law regulates relations related to the activities of the Red Cross Society, defines its legal status and legal principles.
Chapter I General provisions article 1. Ukrainian Red Cross Society (hereinafter-the company) is a voluntary non-governmental humanitarian organization.
The Society assists the State in providing medical and humanitarian assistance during armed conflicts and in peacetime, is involved in the provision of international assistance in case of disasters and emergency situations, provides medico-social assistance to the least socially protected layers of population.
Article 2. Legislation on the Ukrainian Red Cross Society and about the symbolism of the Red Cross, Red Crescent, Red Crystal is based on the Constitution of Ukraine (254 k/96-VR), the Geneva Conventions on the protection of victims of war of 12 September 1949 (995_151, 995_152, 995_153, 995_a153, 995_154) and additional Protocol (995_199, 995_200, 995_g74), consists of other international treaties of Ukraine , consent to be bound by the Verkhovna Rada of Ukraine, law of Ukraine "about the symbolism of the Red Cross, Red Crescent, Red Crystal in Ukraine (862-14), this law and other taken in accordance with these regulations.
{Article 2 as amended by law 2803 N-VI (2803-17) from 17.12.2010} Article 3. In this law the following terms and concepts are used in the following meaning: the červonohresnij movement-the international movement of Red Cross and Red Crescent societies, which parts of which is the International Committee of the Red Cross, the International Federation of Red Cross and Red Crescent societies and national Red Cross or Red Crescent societies;
National Society-National Red Cross or Red Crescent societies in foreign countries;
Ukrainian Red Cross Society-National Red Cross Society-an integral part of the international movement, all-voluntary non-governmental humanitarian organization;
charity, charitable activities-activities associated with the provision of assistance and support to those who need it, based on the common principles of humanity and mutual aid, which is carried out entirely disinterested (without the purpose of profit or other benefit);
emergency situations-armed conflict, natural disaster, accident, accidents, epidemics, mass poisoning, hunger, radioactive, bacteriological, chemical pollution, etc.
Article 4. Organization of activities, scope and methods of activity of organizations, the procedure of registration of membership in the community and the members of the organs of the Board are determined by the Charter of the company.
Article 5. Ukrainian Red Cross Society-the only in Ukraine National Red Cross Society that operates on the territory of Ukraine, creates a local organization that carries out its activities in accordance with the Charter and this law.
Article 6. The company performs its tasks on the basis of the fundamental principles of the International Red Cross and Red Crescent movement – humanity, impartiality, neutrality, independence, voluntary, uniqueness, universality.
Article 7. The supreme governing body of the society is the Congress, its organizations, the Conference and the General Assembly.
Congress of the society approves the Statutes of the Association, amends and additions, elects the President of the Association and members of the Board and the auditing Commission, listens to the reports of the President of the Association and the Board of the Association, carries out the ownership of the property and funds of the society, takes decision on the termination of (reorganization or liquidation).
Article 8. The company uses the emblem of the Red Cross in the manner prescribed by the law of Ukraine "about the symbolism of the Red Cross, Red Crescent, Red Crystal in Ukraine (862-14).

The company is in the process of their activity: collects various kinds of humanitarian aid from legal and physical persons in Ukraine, foreign persons, stateless persons, international organisations for recipients on the territory of Ukraine. Types of recipients and targeted assistance determines the Company independently according to its statutory objectives and goals in accordance with the legislation of Ukraine;
involved in the distribution of humanitarian aid received from the above-mentioned sources;
operates from Geneva Conventions on providing assistance to the wounded, the sick and others who suffered during the armed conflict;
cooperates with institutions of health epidemiological service of Ukraine, specialized units authorized central body of the Executive power of emergencies and Affairs of population protection from the consequences of

The Chernobyl disaster and the medical service of armed forces of Ukraine;
cooperates with State authorities on questions of accommodation, transportation, medical and other service entities of humanitarian aid;
cooperates with State authorities on social security system providing assistance to vulnerable groups;
receives, registers, maintains and provides information about victims of natural disasters or armed conflicts;
creates first aid squads during armed conflicts and natural disasters, searches for injured and killed as a result of disasters, natural disasters, armed conflicts, sets out the place of their burial, provides assistance in the State institutions;
organizes the work of the non-voluntary emergency service company, which is part of the system of the company, provides a vital activity camps for wounded and injured and to the public in a particular emergency situation required royalty-free sanitary and medical and social assistance; takes part in organization of free training (primarily youth) on provision of first medical (health) care;
contributes to the bodies of State power and bodies of local self-government in the transportation, admission and placement of the evacuated population and refugees, providing them with free medical and social assistance;
organizes the work of tracing the company, which is part of the Association, carries out the search of the persons who were missing, helps establish links between members of families separated as a result of armed conflicts or other emergency situations, promotes vozz'êdnannû families looking for graves of defenders of the Fatherland who died and are buried outside the Ukraine;
participates in the implementation of targeted and local (regional) development programs of donation blood and its components;
together with the bodies and establishments of health carries out work on engaging citizens in the ranks of donor blood and its components; {The thirteenth paragraph of amended according to the law N 3421-IV (3421-15) from 09.02.2006} provides royalty-free sanitary and medico-social assistance to the disabled lonely elderly, orphans, the disabled, the homeless, the infirm and other vulnerable people who need care and support within the donations and humanitarian aid, and at the expense of the existing Society charity, charitable funds;
promotes the implementation of targeted and local (regional) programmes aimed at the protection of health and the provision of assistance to vulnerable low-income people, collaborating to perform these tasks with other organizations and institutions. {The fifteenth paragraph of amended according to the law N 3421-IV (3421-15) from 09.02.2006} Section II ACTIVITIES of the COMPANY Chapter 1 the BASIC DIRECTIONS of ACTIVITY of the ASSOCIATION Article 10. The company and its local organizations since their State registration acquire the status of legal person in accordance with the legislation of Ukraine.
The company has separate property, independent balance, accounts in banks (including currency) can have stamps, symbols, stamps, letterheads.

The company takes part in international charitable, charity, in other international humanitarian actions, which are carried out in accordance with the international agreements of Ukraine, consent to be bound by the Verkhovna Rada of Ukraine, this law and other normative legal acts.
Article 12. To achieve the goals envisaged by the Charter, and the tasks according to the principles of the international movement and the Law Society has the right: to represent and protect the legitimate rights and interests of their own, and their members in the bodies of State power and bodies of local self-government bodies of the judiciary;
use symbols (logo) of the Red Cross in the manner prescribed by law;
disseminate information about international červonohresnij movement, international humanitarian law and on their activities, to promote the ideas and tasks of the Association;
receive from the bodies of State power and bodies of local self-government, the support needed to implement the goals and objectives stipulated by the Charter and this law;
participate in organizing and conducting events of humanitarian and charity;
to decide matters related to the receipt and the company of humanitarian and charity aid;
base media, issue paper and printing products, create movies, organize exhibitions, etc.;
create organizations, foundations, as well as to establish the enterprise with the purpose of the financial performance of the statutory tasks of the Association in accordance with the law and international obligations of Ukraine;
create the hospital pharmacy, animal shelters, canteens for the poor;
to work on tracing the graves of POWs and citizens who were missing as a result of emergencies.
Chapter 2-the SOCIETY and the State. STATE SUPPORT OF SOCIETY

Article 13. Ukraine in accordance with the international obligations assumed by providing compliance with the legitimate rights and interests of the society, its agencies, local organizations and members of the Association.
The intervention of organs of State power, bodies of local self-government, their Office and officials in the activities of the company are not permitted, except in cases envisaged by the Constitution of Ukraine (254 k/96-VR) and the laws of Ukraine.
Article 14. Ukraine as a member of the Geneva Conventions of 1949 on the protection of victims of war (995_151, 995_152, 995_153, 995_154) and the additional protocols thereto of 1977 (995_199, 995_200) supports humanitarian and charitable focus of the activities of the Association and of the international movement.
Payment of the fee for the membership of the Association at the International Federation of Red Cross and Red Crescent movement is carried out at the expense of the State budget of Ukraine, which annually provides in the law on State budget of Ukraine.
Bodies of State power and bodies of local self-government within their competence and contribute to Society, its bodies and local organizations in carrying out the tasks set them, support their humanitarian and charitable activities.
Article 15. Citizens of Ukraine, and also enterprises, institutions and organizations are located in Ukraine, regardless of ownership and activities provide a Company, its bodies and local organizations, as well as people who perform the task of the Association under this Act, the necessary assistance.
Article 16. The company, its local organization established (based) them businesses are exempt from payment of taxes and other payments in accordance with the law.
Article 17. With the amount of money or of value of property, voluntarily listed (incoming) juridical and physical persons of the Company and its local organizations, paid taxes, fees (compulsory payments) in accordance with the law.
Article 18. Products and material values received, including from abroad, the Society, its bodies and local organizations as humanitarian or charitable assistance, i.e. without the target profit, distributed and used by the company, its bodies and local organizations of exclusively free of charge to perform the statutory tasks of the company. Such goods and tangible assets are exempt by law from taxation, including fees, and fees for performing customs formalities out the location of customs authorities or outside working time established for the enforcement of income and fees.

State and municipal media in case of emergency situations to cover the activities of the company, its bodies and local organizations, related to the assistance and support to those who need it.
Article 20. Tracing service receives the services provided by the enterprises of postal, Telegraph, telephone and other communications (for rozšukuvannâ the graves of POWs and citizens who were missing as a result of the occurrence of emergency situations; reunification, the return home of refugees;
the establishment of the fact of Nazi persecution during the war), with the subsequent reimbursement of the expenses on them at the expense of the State budget of Ukraine, in the manner and within the limits established by the Cabinet of Ministers of Ukraine.
Chapter 3 the PROPERTY of the company. ECONOMIC ACTIVITIES of the ASSOCIATION article 21. The company as a legal entity has the right to take part in civil legal relations, may on its own behalf acquire and exercise property and non-property rights, the plaintiff and defendant in court according to the law.
The company is responsible for its obligations within the appropriate him the funds and other property.
Created by the company bodies and organisations responsible for its obligations within the funds and other property transferred to them by the society.
Article 22. The company may own funds separate and other property necessary to the exercise of its statutory activities.
The company acquires ownership of the funds and other property transferred to it by its founders, members of the Association, bodies of State power, bodies of local self-government, obtained from entrance and membership fees, donated or transferred to physical and legal entities, NGOs, religious organizations, as well as property acquired for own funds or on other grounds not prohibited by law.
Article 23. For the purpose of carrying out its statutory tasks of the Society, its bodies and local organizations can carry out necessary economic activities by establishing self-supporting institutions and organizations with the status of legal entities, as well as the establishment of enterprises in the manner prescribed by law.
The profits obtained by enterprises, institutions and organizations, which are in the ownership of the company, its bodies and local organizations, are used exclusively for the execution of the tasks of the Association, taking into consideration the administrative costs associated with the activities of the Association, its bodies and local organizations.

Article 24. The company, its bodies and local organizations, as well as created (based) it enterprises, institutions and organizations are required to conduct operational and accounting and statistical reporting in accordance with the law, to register in the prescribed manner in the revenues and fees. These legal entities shall record funds for economic activity (both in national and in foreign currency) on separate bank accounts.
{Article 24 amended by law N 406-VII (406-18) from 04.07.2013} article 25. The right of ownership on behalf of the company carry out its higher statutory authorities in the manner prescribed by this law and by the Charter of the company.
Article 26. The company has the right to receive the inheritance or as a gift of movable and immovable property, and funds (assets) from legal and physical persons in Ukraine, foreign States and international organizations.
Article 27. All movable and immovable property, as well as the assets that belong to the Association on the right of ownership in accordance with the Charter and legislation, are used exclusively by the society or its behalf its agencies and local organizations.
Property and funds of the society, its organizations and created (based) them, enterprises, institutions and organizations without consent may not be withdrawn or distributed, except in the cases and in the manner established by law.
Article 28. Funds and other property of the company, its bodies and local organizations, created (based) society, enterprises, institutions and organizations in case of their liquidation is not redistributable between society members. Such property and funds used by the company according to the decision of its statutory bodies exclusively for the execution of the Statute of the company goals, and in cases stipulated by law, are revenue of the State.
Chapter III LIABILITY for VIOLATION of the REQUIREMENTS of THIS LAW Article 29. For violation of the requirements of this law the persons responsible in accordance with the law.
Article 30. Utilities and officials and citizens guilty of violating the rights and freedoms of citizens-members of the Association shall be established by the law of administrative or criminal penalties.
Article 31. The company, its bodies and local organizations and their members (workers and volunteers) in the case of a breach of the Constitution of Ukraine (254 k/96-VR), this and other laws are responsible according to the legislation and the Charter.
In accordance with this law and in the manner prescribed by the Statute of the Association, Congress, Government, Presidium of the Board of Directors of the Association may prematurely terminate the powers of their bodies and local organizations, organizations and based them in enterprises as well as assigned or chosen people (staff and volunteers) in the case of violations of the legislation.
Chapter IV TRANSITIONAL and FINAL PROVISIONS Chapter 1 TRANSITIONAL PROVISIONS Article 32. All employees of the company who work contracted in the society, to extend legislation on labor, social security and social insurance.
Article 33. Legal regulation of the vacations of employees of the company is carried out in accordance with the law. VNS medical workers of the company are entitled to annual additional leave for work in harmful and difficult conditions of work and the special nature of the work. The order granting such leave, their duration and the conditions of payment are established by the Cabinet of Ministers of Ukraine.
Article 34. The company independently solves the issues determining the conditions and wages of the employees of the bodies and local organizations that work for labor agreements (agreements, contracts), and encouraging volunteers in accordance with the legislation on labour.
With heads of departments and other responsible employees of the company concluded labor contracts in the form of a contract in accordance with the Labor Code of Ukraine and the Charter.
Article 35. The company, its bodies and organisations providing support to the bodies of State power and bodies of local self-government in the distribution among the population of the texts of the Geneva Conventions of 1949 on the protection of victims of war (995_151, 995_152, 995_153, 995_154) and the additional protocols thereto of 1977 (995_199, 995_200), in the dissemination of knowledge about international humanitarian law.
Article 36. The society may be by them in accordance with law, the articles of Association and features provided by article 28 of this law.
Article 37. State control over the activities of the Association, including the order of it property and allocated by the State budget, is carried out by executive bodies according to their competence.
Chapter 2 FINAL PROVISIONS 1. This law comes into force from the day of its publication.
2. Before bringing the legislation into conformity with this Act regulations applied in the part that does not contradict this law.
3. The Cabinet of Ministers of Ukraine in the six-month period: submit to the Parliament proposals on bringing the laws into conformity with this Act;

to bring their regulations into conformity with this Act;
ensure the review and cancellation of ministries and other central bodies of executive power of their normative legal acts that are contrary to this Act;
ensure the adoption of the regulations stipulated by this law.
