On Amendments to Some Legislative Acts of Ukraine for the Protection of the Animal World

(Information of the Verkhovna Rada (VR), 2015, No. 25, pp. 194)

Verkhovna Rada of Ukraine Orders:

I. Amend the following legislative acts of Ukraine:

1. In Codes of Ukraine on administrative offences (Information from the Supreme Council of the Ukrainian SSR, 1984, appendix to No. 51, st. 1122):

1) in Article 85 - 1 :

(a) The name of the office in this edition:

" Article 85 - 1 . Making, excusing, storing, or advertising prohibited tools of mining or plant world objects;

(b) In the first part of the first word "or excitation" would be replaced by the words "arousal or storage", and after the word "completion", the words "(compilation)";

(c) to complement part of the second such content:

" Advertising, as well as any other activity on the promotion or distribution of forbidden tools to extract (build) objects of animal or plant world.

Withdrawing a fine on the citizens of fifty to a hundred non-tax-imposed minimum income, and on the officials of the advertiser or the distributor of advertising-from one hundred to two hundred and fifty non-tax income minimums ";

(2) Text Article 88 - 1 Set out in this edition:

" Violations of the order of acquisition, excitation or distribution of animal or plant world objects-

We have a fine of thirty to one hundred non-taxable income minimum income citizens with the confiscation of animal or plant-world objects.

The same actions, committed against objects of animal or plant world, which were within the territories and objects of the natural-reserve fund listed in the Red Book of Ukraine, or which are protected according to the international treaties of Ukraine,

Withdrawing a fine from one hundred to two hundred fifteen untaxable income minimum income citizens with the confiscation of objects of animal or plant world.

Violating the rules of keeping wild animals in captivity or in semi-free conditions-

To impose a fine of three to fifty untaxable income minimum income citizens with the confiscation of objects of animal or plant world, or without such a ";

3) para. 9 Sections of the first article 255 will complement the paragraph by five such content:

" Public Health Inspector (Part Four of Article 85, Article 88) - 1 (91) ".

2. In Laws of Ukraine "On the Nature Reserve Fund of Ukraine" (Information of the Verkhovna Rada of Ukraine, 1992, No. 34, pp. 502; 2000, No. 4, pp. 26; 2010, No. 11, pp. 112; 2014, No. 23, pp. 873):

(1) In Article 3:

(a) Paragraph three of the first after the words "Zoological Parks", supplemented with the words "Nature monuments";

(b) The third part of the third part is supplemented by a sentence of such content: "Nature monuments may be located on the territory of other facilities of the Nature Reserve Fund";

(2) Part of the first article 15 after the word "components", with the words "maintenance of natural spontaneous processes and phenomena".

3. In "Local Government in Ukraine Law". (Information of the Verkhovna Rada of Ukraine, 1997, No. 24, p. 170 with the following changes):

1) para. 37 Part of the first article 26 supplements the words "decision making on the grounds of mass reproduction and growing the offspring of wild animals" of the season of silence "with the limitation of economic activity and the mining of animal objects";

2) sub-paragraph 3 "A" part of the first article 33 should be complemented by the words "preparation and adoption of proposals for proposals for the adoption of decision-making in the areas of mass reproduction and growing offspring of wild animals" of the season "silence" with the restriction of economic and mining of animal objects ";

3) para. 24 Part of the first article 43 supplements the words "decision making on the grounds of mass reproduction and growing the offspring of wild animals" of the season of silence "with the limitation of economic activity and the mining of animal objects";

4) para. 14 Part of the first article 44 supplements the words "preparation and submission of proposals for proposals for announcement in the areas of mass reproduction and growing offspring of wild animals" of the season of silence "with the limitation of economic activity and mining" objects of the animal world. "

4. In Part 4 Article 33 of the Law of Ukraine "On hunting and hunting" (Verkhovna Rada of Ukraine, 2000, No. 18, art. 132; 2010, No. 10, pp. (108) The words "and the sonodo" to exclude.

5. In "The Animal World". (Information of the Verkhovna Rada of Ukraine, 2002, No. 14, pp. 97; 2011, No. 45, st. 480):

(1) In Article 39:

(a) Part of the first addition to the sentence of such content: " In this, the subjects are jointly with the central body of the executive branch, which ensures the formation of public policy in the sphere of environmental protection, by the central authority; An executive branch that implements state policy in the sphere of forest and hunting, the body of local self-government is taking measures to identify the breeding sites of wild animals and to inform the population about the rules of behaviour must be observed in such places ";

(b) A portion of the fifth posting in this edition:

" In the period of mass breeding of wild animals, from April 1 to June 15, it is prohibited to conduct work and measures that are a source of increased noise and insolence (palm oil, conducting explosive works, fireworks, sanitary forest forest, use of motor vehicles). small craft, conduct of rally and other competitions on vehicles) ";

(2) Part of the first Article 52 - 1 After the word "(electrowood)", the words "electrode, furnace, self-inflicted, self-shoot" would be added.

6. In Article 20 Law of Ukraine "On Protection of Animals from Cruel Treatment" (Ukrainian Supreme Council of Ukraine, 2006, No. 27, pp. 230):

The third part of the third part, after the word "equipment", shall be supplemented with the words "gas, smoke, current";

part of the fourth complement of the paragraph of the eighth such content:

" that the evil (overruled by the ice, escape from the storm, fires, snowfall, pouring, snow avalanches, suffer from hunger, gets caught on an orglare, nast, to deep snow, to the abominable birds that are in the ovaries, on animals in others). (a) The animals that are in helpless condition (to be a young man (chunchunks), the young of the beasts) ";

Add part to the seventh of the following:

"Prohibition of breeding or in another way of damage, elimination of natural habitats of wild animals (nir, barlogs, nests, etc.)"

II. Final Position

1. This Act will take effect from the day, the following day by the day of its publication.

2. The Cabinet of Ministers of Ukraine for six months since the Act:

To bring their legal and legal acts into compliance with the Act;

To ensure that the ministries, other central executive bodies, have their legal and legal acts in compliance with the Act.
