With a k o n u r as th n and on amendments to certain laws of Ukraine regarding provision of disabled cars (Supreme Council of Ukraine (BD), 2010, N 8, 62), the Verkhovna Rada of Ukraine about with t and o in l I have: I. Make changes to the following laws: 1. In article 38 of the law "on social protection of disabled persons in Ukraine" (875-12) (Supreme Council of USSR , 1991, N 21, art. 252; Supreme Council of Ukraine, 2004, N 37, art. 453): 1) first part of lay in the following wording: "article 38. Disabled people and children with disabilities are provided free of charge or on preferential terms of social services and health care, technical and other means of rehabilitation (the means to travel, instep surdotehnìčnì tools, mobile phones for written communication, etc.), medical devices (individual devices, prosthetic eyes, teeth, jaws, glasses, hearing and golosoutvorûval′nì devices, implants, urinary and kaloprijmačì, etc.) based on the individual program of rehabilitation, the presence of the corresponding medical report ";
2) after part one to complement the new part of the following content: "after the death of a disabled child, a child with a disability car, issued free of charge or on preferential terms, including those recognized as humanitarian assistance, at the request of members of his family may be passed in their property in a manner described by the Cabinet of Ministers of Ukraine. Technical and other means of rehabilitation may be left in the property of the family members of the deceased of a disabled child, a child with a disability in a manner determined by the Cabinet of Ministers of Ukraine ".
In this regard, part of the second-fifth count in accordance with sections of third-sixth;
3) of the sixth put in this Edition: "the terms and conditions of provision of disabled people and disabled children medical, technical and other means of rehabilitation, products of medical purpose, sanatorium-resort trips, cars, as well as lists of technical and other means of rehabilitation and medical products determines the Cabinet of Ministers of Ukraine".
2. the third paragraph of part five article 6 of the law of Ukraine "on the rehabilitation of victims of political repression in Ukraine" (962-12) (Supreme Council of USSR, 1991, N 22, 262; Supreme Council of Ukraine, 1992, 32 N, 456) lay in the following wording: "If there are medical indications for maintenance of the vehicle and the absence of contraindications to control-ensuring your car free of charge, if you have medical indications and contra-indications to ensure the car control is to provide the vehicle with the right transmission driving family member discounts conditions are determined by the Cabinet of Ministers of Ukraine ".
3. Paragraph 13 of article 20 of the law of Ukraine "on the status and social protection of citizens who suffered as a result of the Chernobyl disaster" (796-12) (Supreme Council of Ukraine, 1992, N 13, 178; 1996, 35 N, 162) to lay out in the following wording: "13) extraordinary free software group I disabled the car regardless of the presence of a medical condition or disability group II if there are medical indications for maintenance of the car , the absence of these contra-indications to driving; Special preferential provision of car Group II disabled if there are medical indications and contra-indications to the control with the right to transfer the driving member of the family.
Group II disabled persons in the absence of appropriate medical indications are eligible for free or on a preferential basis ensuring the car, as well as the Group III disabled if there are medical indications – to ensure the vehicle and the absence of contraindications to control-on preferential terms in the order total. Terms and conditions of providing the car is determined by the Cabinet of Ministers of Ukraine ".
4. Paragraph 22 of article 13 of the law of Ukraine "about the statuse of war veterans, garantees of their social protection" (3551-12) (Supreme Council of Ukraine, 1993, N 45, item 425; 2005, N 9, 185) to lay out in the following wording: "22) an extraordinary provision of car free of charge if there are medical indications for maintenance of the car, the payment of compensation for petrol (fuel), repair and maintenance of vehicles or transport service in order that is determined by the Cabinet of Ministers of Ukraine ".
5. Part of the sixth article 34 of law of Ukraine "on mandatory State social insurance against accidents in production and professional disease, which resulted in the loss of working capacity (1105-14) (Supreme Council of Ukraine, 1999, N 46-47, St. 403) lay in the following wording: "6. If there are medical indications for the car and the presence or absence of contraindications to manage Fund of social insurance against accidents provides victim vehicle free of charge or on preferential terms, organizes and pays for the training of driving the car, and also pays for petrol (fuel), repair and maintenance of vehicles or transport service in the manner and on the terms that are determined by the Cabinet of Ministers of Ukraine.
According to the conclusion of MSEK Fund of social insurance against accidents may reimburse other costs. "
6. law of Ukraine "about humanitarian assistance" (1192-14) (Supreme Council of Ukraine, 1999, N 51, art. 451;
2003 N 27, art. 209 N, 37, art. 300; 2005 N 34, art. 442;
2007, N 27, art. 360) supplemented by article 11-1 of the following contents: "article 11-1. Ensure the disabled car, recognized humanitarian aid Providing disabled children with disabilities, recognized humanitarian aid, under the conditions stipulated by the law and in the manner determined by the Cabinet of Ministers of Ukraine.
After the death of a disabled child, a child with a disability car, recognized as humanitarian aid, which the invalid was secured through the bodies of the labour and social protection of the population and enjoyed less than 10 years, can be transferred in one of the family members according to the decision of the Commission for humanitarian aid under the Cabinet of Ministers of Ukraine on condition of payment of the taxes and fees at the rates applicable on the day when the customs clearance of the vehicle. If disabled, a child-invalid enjoyed a car more than 10 years, at the request of members of his family car can be transferred in property for free.
In the event of failure to pay a family member with a disability, child disability taxes and charges (statutory payments) car returns (excludes) the bodies of the labour and social protection of the population in the order and on conditions determined by the Cabinet of Ministers of Ukraine ".
7. Paragraph 22 of article 6-2 of the law of Ukraine "about victims of Nazi persecution" (1584-14) (Supreme Council of Ukraine, 2000, N 24, cent. 182; 2005, N 5, St. 120) put in the following wording: "22) extraordinary gratuitous provision of a car with a manual control if there are medical indications or at the request of a disabled child on preferential terms-with the usual car-in the order specified by the Cabinet of Ministers of Ukraine".
8. the first Paragraph of paragraph 2 of section II "final provisions" of the law of Ukraine "on amendments to some legislative acts of Ukraine regarding the regulation of the market for cars in Ukraine" (1820-14) (Supreme Council of Ukraine, 2001, N 4, item 16; 2002, N 9, art. 68) add the words "(except for the cases stipulated by the law of Ukraine" on social protection of disabled persons in Ukraine ") (875-12)".
II. Final provisions 1. This law comes into force from the day of its publication.
2. the Cabinet of Ministers of Ukraine within ninety days from the date of publication of this law to bring their regulations into conformity with this Act.
