Concerning the marginal amount of compensation for legal assistance in civil and administrative matters

This Act establishes the marginal amount of compensation for the costs of legal aid under consideration by the courts of civil and administrative affairs.
Article 1. The amount of compensation for the costs of legal assistance in civil cases in which such compensation is paid to the side in favour of which a judicial decision, another party, and in administrative affairs is a subject of authority, cannot exceed 40 percent of the subsistence minimum for able-bodied persons, set by 1 January calendar year, per hour of participation by the person who provided legal assistance, in a court trial, during the commit of individual procedural actions outside the court Meeting and meeting material in court, which is defined in the appropriate The court decision.

Article 2. In the case of a civil or administrative case exempt from payment of the costs of legal assistance, compensation for such costs is paid to the side, in favour of which a judicial decision and which is not subject to the authority, in the amount that is not above 2.5 per cent of the subsistence minimum for able-bodied persons, which is set by 1 January calendar year, per hour of participation by the person who provided legal assistance, in the trial, during the conduct of individual procedural actions outside the court and during the proceedings of the proceedings in court, which is defined in the The relevant court decision.

Compensation for legal assistance is paid through the state budget within the costs provided by the State Judicial Authority of Ukraine for the exercise of justice by local general and local administrative courts.
1. This Act is effective from 1 January 2012.
2. The Cabinet of Ministers of Ukraine for a two-month period from the day of entry into force of the Act to bring its legal and legal acts into compliance with the Act.
