LAW OF UKRAINE

Concerning amendments to some laws of Ukraine regarding the improvement of the substance of the military personnel

(Information of the Verkhovna Rada (VR), 2015, No. 35, pp. 339)

Verkhovna Rada of Ukraine ruling :

I. Amend the laws of Ukraine to be amended:

1. Paragraph 1 Article 9 - 1 Law of Ukraine "On social and legal protection of servicemen and members of their families" (Parliament of the Verkhovna Rada of Ukraine, 1992, No. 15, art. 190; 2006, No. 51, pp. (519) To read:

" 1. The food provision of servicemen is carried out by the rules and the terms established by the Cabinet of Ministers of Ukraine.

The protection of military personnel is carried out according to the rules and terms defined by the Ministry of Defense of Ukraine, the Ministry of Infrastructure of Ukraine-for the State Special Transport Service, other central authorities. The Head of the Security Service of Ukraine, Chief of the Office of the State Guard of Ukraine, Head of the Foreign Intelligence Service of Ukraine, Chairman of the State Service of the Special Communications and protection of information of Ukraine, and order of cash compensation for "The unreceived river of property is determined by the Cabinet of Ministers of Ukraine."

2. Part Other Article 20 of the Law of Ukraine "On the Service of Security of Ukraine" (Verkhovna Rada of Ukraine, 1992, No. 27, pp. 382) teach in such an editorial:

" servicemen of the Security Service of Ukraine are entitled to wear military uniforms with signs of distinction, samples of which are approved according to Law of Ukraine "Military Service and Military Service". Members of the Security Service of Ukraine are issued with a license that is approved by the Head of the Security Service of Ukraine ".

3. Eleventh Part Article 16 of the Law of Ukraine "On State Protection of State Authorities of Ukraine and officials" (Verkhovna Rada of Ukraine, 1998, No. 35, art. 236) in such an editorial:

" servicemen of the State Protection Authority of Ukraine are entitled to wear military uniforms with signs of distinction, samples of which are approved according to Law of Ukraine "Military Service and Military Service". Members of the Office of the State Guard of Ukraine are issued by a service ID, a sample of which is approved by the President of Ukraine. "

4. Part 8 Article 23 of the Law of the Verkhovna Rada of Ukraine "On the State Border Service of Ukraine" (Information Council of the Verkhovna Rada of Ukraine, 2003, No. 27, pp. 208; 2007, No. 33, pp. 442; 2010, No. 6, pp. (46) To read:

" servicemen of the State Border Guard Service of Ukraine are entitled to wear military uniforms with signs of distinction, samples of which are approved according to Law of Ukraine "Military Service and Military Service".

5. In Article 5 Law of Ukraine "On the State Special Transport Service" (Verkhovna Rada of Ukraine, 2004, No. 19, pp. 269; 2013, No. 14, pp. 89):

(1) the second sentence of the part of the seventh to exclude;

(2) Part of the eighth complement of the sentence of this content: " servicemen of the State Special Service Service shall be entitled to wear military uniforms with signs of distinction, samples of which are approved according to Law of Ukraine "Military Service and Military Service".

6. Article 7 Law of Ukraine "On Military Duty and Military Service" (Verkhovna Rada of Ukraine, 2006, No. 38, pp. 324; 2010, No. 12, pp. 117) taught in such an editorial:

" Article 7. Military form of clothing and insignia of military personnel

1. Military uniforms and insignia are established for military personnel.

2. Military-based military service is provided by military form of clothing. Reservists are provided with military form of clothing according to established standards. For persons involved are set up for military personnel.

3. The military form of clothing is a set of uniform designs and regulations governing the appearance of items of clothing, shoes and separate equipment, set for military personnel of the Armed Forces of Ukraine and other military formations.

4. Signs of distinguishing of servicemen are signs (chase, outdoor and insignia, signs on the back; signs on the back; in particular the cocards, emblems, ornaments; and gapsing; cantes and lamps; with symbolism) on the uniform clothing, intended for Designation of military ranks, positions belonging to the state, military formation, of the Armed Forces of Ukraine, service of troops, services, military units (units).

5. Military forms of clothing and general requirements for distinguishing of servicemen are developed and approved by the Ministry of Defence of Ukraine.

6. Samples of special clothing, footwear and equipment of servicemen, means of individual protection and other material assets of servicemen are being developed by the Ministry of Infrastructure-for the State Special Transport Service, Relevant central executive bodies in their submission to military formations, Security Service of Ukraine, Office of State Protection of Ukraine, Foreign Intelligence Service of Ukraine, the State Special Communications Service and the protection of information of Ukraine and approved by the Ministry of Defence Ukraine.

7. Military clothing and identification regulations are developed and approved by the Ministry of Infrastructure of Ukraine-for the State Special Transport Service, the relevant central executive bodies in the field In its submission to military formations, Security Service of Ukraine, the Office of the State Guard of Ukraine, the Foreign Intelligence Service of Ukraine, the State Service of Special Communications and Information Protection of Ukraine.

8. A lack of military forms of clothing with signs of discriminating servicemen who do not have the rights to this is prohibited and enforcing responsibility under the law ".

7. In "National Guard of Ukraine". (Information of the Verkhovna Rada of Ukraine, 2014, No. 17, pp. 594):

(1) First sentence parts of third Article 20: " 3. Military personnel of the National Guard of Ukraine have the right to wear military uniforms with signs of distinction, samples of which are approved according to the Law of Ukraine "Military duty and military service";

2) part of this Article 21 read as follows:

" 7. The order of food and substance service of the National Guard of Ukraine, as well as monetary compensation costs for the unearned food and safety deposit, are determined according to Law of Ukraine "On the social and legal protection of servicemen and members of their families".

8. Part three Article 19 of the Law of Ukraine "On the State Service of the Special Communication and Protection of Information of Ukraine" (Council of the Verkhovna Rada of Ukraine, 2014, No. 25, pp. 890) to read:

" 3. Military personnel of the special communications and information protection of Ukraine are entitled to wear military uniforms with signs of distinction, whose examples are approved in accordance with Law of Ukraine "Military Service and Military Service".

II. Final and Transitional Provisions

1. This Act will take effect from the day, the following day by the day of its publication.

2. After this Act is taken into force:

A Polish military form of clothing, the insignia to it, approved for entry into force by this Act, is used until 1 January 2016; another military form of clothing of military personnel, insignia of military personnel, special clothes, shoes Civil servants, the means of individual protection and other items approved prior to the Act, are used within established norms, but not later than before 1 January 2018;

items of military uniforms wear as humanitarian or charitable assistance are used within the established norms of the provision, but not longer than a six-month line after the cessation of anti-terrorist operation; other items of substance, is obtained as a humanitarian or charitable assistance, used within the established rules of ensure.

3. The Cabinet of Ministers of Ukraine in a three-month period from the day of entry into force:

To bring their legal and legal acts into compliance with the Act;

To ensure the adoption of ministries, the other central authorities of the executive power of normative acts stemming from this Act;

Provide a view to the ministries and other central executive bodies of their normative acts contrary to this Act.
